Radio and Television Supreme Council

The Radio and Television Supreme Council founded in 1994 is an administratively and financially autonomous and impartial public legal person for the regulation and supervision of radio, television and on demand media services which are under the jurisdiction of Republic of Turkey.

In the field of audio-visual media services, the main function of the Supreme Council is taking essential precautions for securing;

• Freedom of expression and information • Diversity of opinion • Media pluralism • Competition environment for avoiding media concentration • Protecting public interests

Radio and Television Supreme Council

In order to achieve its primary objectives, Supreme Council;

• monitors and supervises the broadcasts of media service providers,• makes and deploys the television channel and radio frequency

planning in the framework of frequency bands for the terrestrial radio and television broadcasts,

• determines the required administrative, financial and technical standards for a broadcast license; grants broadcast licenses to those of such companies which fulfill the required qualifications; supervises them and revokes the broadcast licenses when required,

• performs other functions and use its powers determined by the Broadcasting Law No:6112.

Radio and Television Supreme Council

Members;

• The Supreme Council is composed of 9 members who are elected by the General Session of the Turkish Parliament from among the nominees on the basis of the number of MPs of each political party.

• The term for the Supreme Council members is six years.• The Supreme Council members elect a President and a Deputy

President from among its members by holding a meeting. • The term of office of the President and Deputy President is two years.

The Supreme Council;

• meet with a quorum of at least five members and take decisions with affirmative votes of at least five members.

• decisions of the Supreme Council are subject to judicial review.

Radio and Television Supreme Council

Revenues of the Supreme Council are;

• Broadcast license fees from media service providers;• Annual usage fees for television channel, multiplex capacity and

radio frequency to be collected from public and private media service providers broadcasting through terrestrial network;

• A three percent share of monthly gross commercial communication revenues of media service providers excluding their sponsorship revenues;

• When needed, treasury aid to be obtained from the budget of the Presidency of the Turkish Parliament;

• Other Revenues.

National Legislation

• Broadcasting Law No 6112 on the Establishment of Radio and Television Enterprises and Their Audio Visual Media Services • was adopted by the Parliament on 15 February 2011 • entered into force after its publication in the Official Gazette No

27863 dated 3 March 2011.• Draft law was prepared by RTUK within extensive consultation with

stakeholders namely, broadcasting sector, public institutions, NGOs. • It principally aims the compliance to EU AVMS Directive and addresses

various sectoral issues including technological developments.

Main Novelties of The Law No:6112

• Lays down regulatory basis for transition to digital terrestrial broadcasting after frequency planning and its allocation.

• Lays down regulatory basis to new broadcasting technologies such as IPTV, DVB-H, HDTV etc.

• Definitions of the former law are renewed and/or extended according to AVMS Directive, such as: media service provider, on-demand media services, product placement, commercial communication etc.

• Media ownership rules are revised and liberalized.• Removes the dual regime by incorporating public service broadcaster

(TRT) to the same provisions and supervision as commercial broadcasters.

•”National Digital Terrestrial TV License Ranking Tenders” was annulled by RTUK further to court decisions in March 2014.•Regional (T2) and local (T3) Digital Terrestrial Television Broadcasting License Ranking Tenders were also annulled in August 2015.•Accordingly, Transition Implementation Calendar and technical requirements and standards of the system are being updated.

Developments in TurkeyElection Periods

•RTUK monitored broadcasts during Parliamentary Elections on 7 June 2015 and the election renewed on 1 November 2015.•RTUK monitors broadcasts during election periods according to the broadcasting principles determined by High Election Board. •High Election Board gives the final decision with respect to the sanction whether to be applied or not.

Developments in TurkeyMedia Literacy

•The media literacy education material is renewed and is used in the national education curriculum of this year. •«Media Literacy Research 2015» was realized aiming to find out media consumption habits of students and the benefits of media literacy courses in schools by having the views and suggestions of the students.

RTUK Communication Center

Developments in TurkeyRTUK Mobile

•In June 2014, RTUK Mobile Project has started in order to update and improve the RTUK Communication Center. •An application software called “RTUK Mobile” is designed and made available in relevant platforms such as Apple Store and Google Play Store. It can be downloaded by users to their smart phones for free and RTUK receives complaints, suggestions and views of the Public via this application.

Developments in TurkeyRTUK MobileSome of features, innovations and contributions brought by RTUK Mobile:•It is much faster way to obtain feedbacks from Public. RTUK receives instant feedbacks in that sense.•Online mini questionnaires via RTUK mobile are available. •Through a form, some demographic information of users such as age, gender, education level and profession can be obtained and the feedbacks can be classified accordingly. •The notifications or feedbacks are simultaneously conveyed to related monitoring experts at RTUK and also they are e-mailed to the relevant channels’ viewers’ representatives.•Evaluated feedbacks are submitted as periodical (Daily, weekly, monthly, quarterly, and yearly) statistical report to the Supreme Council.•These reports are shared with independent researchers and academicians.
