9. Earnest money of Rs. 1.25 Crore (Rupees One Crore Twenty Five lakhs) only in
the shape of online payment as prescribed in e-Tendering system in favour of Tripura
Urban Planning and Development Authority shall have to be submitted by the bidder.

10. Bidders should meet the following minimum eligibility criteria:-
a) The bidder shall have experience in completion of at least 2 (two) high rise
buildings during last 7(seven) years ending at 31st August, 2019, not below
G+14 high building costing to not less than Rs. 50.00 Crore (Rupees Fifty
Crore), out of which at least one shall be residential building.
b) Experience should be in the name of the bidding company and not in
subsidiary/ associate company/ group of companies/ Joint Venture/
Consortium. Otherwise this will not be counted.
c) The bidder should be in operation in India for a period at least 5 (five) years as
on publication of the bid.
d) The bidder shall have latest ISO certification.
e) The average annual Turnover of the bidder should be in Indian Rupees 100.00
Crore (Rupees One Hundred Fifty Crore) only for last 3 (Three) audited financial
years (2016-17, 2017-18, 2018-19).
f) The bidder should have Positive Net worth (PNW) in each of the last 3 (three)
financial years as on 31stMarch 2019.
g) The bidder shall have in-house architecture / design capacity for this with all
latest design software’s as well as manpower like,
i) Architects having experience in at least two completed similar nature of
work of construction of residential high rise buildings in last 10 (ten) years
and Conversant with all relevant BIS codes and National Building Code
provisions.
ii) Project Manager with Degree in Civil Engineering with min. 15 years
construction experience and Conversant with all relevant BIS codes and
National Building Code provisions.
iii) Civil Engineer-1 with Master Degree in Civil Engineering with
specialization in structural Engineering having design experience of 15
years to handle structural design of 13 storied building and Conversant
with Earthquake resilience issues, all relevant BIS codes and National
Building Code provisions.
iv) Civil Engineer-2, Degree in Civil Engineering having experience of 15
years to handle geotechnical, soil and foundation related issues and
Conversant with all BIS codes and National Building Code provisions.

v) Civil Engineer-3 with Degree in Civil Engineering having construction
experience of 15 years to handle work of multi-storied building and
Conversant with all BIS codes and National Building Code provisions.
vi) Civil Engineer-4 with Degree in Civil Engineering having construction
experience of 10 years to handle water supply, sanitary and plumbing
works and Conversant with all BIS codes and National Building Code
provisions.
vii) Mechanical Engineer-1 with Degree in Mechanical Engineering having
construction experience of 10 years to handle HVAC , water pumps ,
generator sets, Fire safety measures and other related issues and
Conversant with all BIS codes and National Building Code provisions.
viii) Mechanical Engineer-2 with Degree in Mechanical Engineering having
construction experience of 10 years to handle lift installation & operations
and other related issues and Conversant with all BIS codes and National
Building Code provisions.
ix) Electrical Engineer -1 with Degree in Electrical Engineering having
construction experience of 10 years to handle HVAC , water pumps ,
generator sets and other related issues and Conversant with all BIS codes
and National Building Code provisions.
x) Electrical Engineer-2 with Degree in Electrical Engineering having
construction experience of 10 years to handle internal/external
electrification works and fire safety measures in High rise buildings,
conceal wiring, lifts installation & operation and other related issues and
Conversant with all BIS codes and national Building Code provisions.
xi) Diploma Engineer with diploma in Engineering having construction
experience of 10 years in Civil, Electrical and Mechanical Engineering and
Conversant with all BIS codes and National Building Code provisions.
h) The bidder shall have experience in carrying out multi-disciplinary works such
as civil, mechanical, electrical, plumbing works, Lift installation, water supply,
disaster safety, fire safety measures, fire detection & alarms, CCTV etc and on a
single point responsibility basis.
i) The bidder shall have the ability to set up full-fledged Quality Testing Lab and
Batching Plant within or near by the working place, as per direction of the
Tripura Urban Planning & Development Authority (TUDA).

j) The bidding capacity of the Bidder should be equal to or more than Rs. 100.00
Crore (Rupees One Hundred Crore) only. The bidding capacity shall be worked
out by the formula:
Bidding Capacity= (A x N x 2) - B
Where
A= Maximum Value of construction works executed in any one year during
the last 5 (five) years taking in to account the completed as well as work in
progress.
The value of executed works shall be brought to current costing level by
enhancing the actual value of work at simple rate of 7% per annum; calculated
from the date of completion to the last date of submission of application for
tender.
N= Number of years prescribed for completion of work for which bids has
been invited.
B= Value of existing commitments and ongoing works to be completed during
the period of completion of work for which bids have been invited.
k) Those firms blacklisted by any Government or Govt. organization need not
apply.
l) The firm/ organization shall have to compulsorily submit litigation history with
technical bid.

11. The following documents should be scanned and uploaded during the
Technical bid submission in the e- tendering website www.tripuratenders.gov.in as
per standard process of e-tendering:
a. Registration of firm/ agencies/ Companies etc.
b. Certificate of registration for GST/ Valid GST clearance certificate etc.
c. Copy of professional tax clearance document.
d. Copy of valid license regarding engagement of workers in the contract works from
the Labour Department, Govt. of Tripura. (If not available can be submitted within
30 days after award of LOA).
e. Copy of PAN card.
f. Certificate from the Statutory Auditor / CA clearly specifying the annual turnover
for the specified years.
g. Audited and Certified Balance Sheet and Profit/Loss Account of last 3 (Three)
Financial Years (2016-17, 2017-18, 2018-19) should be enclosed.
h. Certificate from the statutory auditor/ CA clearly specifying the net worth.

1. DEFINITIONS
For the purpose of the agreement, the following words and expressions shall have the
meaning hereby assigned to them except where the context otherwise requires:
1. “TUDA” shall mean the Tripura Urban Planning & Development Authority.
2. “Application” shall mean the response submitted by interested parties.
3. “BID/ Tender” shall mean documents to be used by the prospective Bidder.
The word “Tender” is synonymous with “Bid”
4. “Project” shall mean Construction of Proposed Town ship (Ownership flats- 392 nos.)

5. “Site” shall mean the place where the works under the Project are to be carried out
and the details of which are provided in this document.
6. “Bid Security/ Earnest Money” shall mean the amount to be deposited by the
Bidder as per terms given.
7. “Bid Validity” shall mean the period for which the Bids shall remain valid.
8. “Bidder” shall mean the party participating in the bidding process.
9. “Contract Agreement” shall mean the agreement to be signed between the
Successful Bidder and the authorized representative nominated by TUDA.
10. “Contract Price” shall mean the financial bid of the Successful Bidder as
accepted by the TUDA.
11. “Client/Owner/TUDA” shall mean Tripura Urban Planning & Development
Authority, Agartala, Tripura.
12. “Employer/Principal Employer” shall mean Tripura Urban Planning &
Development Authority, Agartala, Tripura.

13. Engineer in Charge (EIC) means the authorized representative nominated by
TUDA.
14. “Evaluation Committee” shall mean the committee constituted by TUDA for
the evaluation of the bids.
15. “Successful bidder” shall mean the Bidder declared technically and financially
successful for the Project and with whom the Contract Agreement shall be
signed.
16. “Letter of Award” (LoA) shall mean the letter issued by the Client to the
Successful Bidder inviting him to sign the Contract Agreement.
17. “Date of commencement of work” shall mean the date of Start of execution as
per relevant clause.
18. “Performance Security” shall mean the amount to be paid by the Successful
Bidder as per relevant clause mentioned elsewhere.
19. “Similar Works” as defined in qualifying criteria.
20. “NI-e- R.F.P” means Notice Inviting –e- Request for proposal.
21. "Defects Liability Period/ Maintenance Period" means the period after
completion of the Project during which the TUDA or their authorized
representative / Engineer-in-charge will notify to the Bidder any defect noticed
in the work and the Bidder will be liable for rectification of such defects. Proof
of dispatch of letter notifying the defect/ intimating the representative of
Bidder at site on the last date of Defect liability period will make the Bidder
liable for rectifying all such defects.
22. “Built up area” of the building is the entire area occupied by the building
including the external walls for each floor (i.e. area of ground floor + area of all
individual floors).
23. “Built up area of the flat’’ is the entire area of the flat including external
walls, balconies but excluding the stair cases, lobby & lifts.
24. “Carpet area” of the flat is the entire area of the flat excluding external walls
and balconies.
25. The 'Contract' means the documents forming the tender and acceptance
thereof and the formal agreement executed between the competent authority

on behalf of the Tripura Urban Planning & Development Authority (TUDA) and
the Contractor, together with the documents referred to therein including these
conditions, the specifications, designs, drawings and instructions issued from
time to time by the Engineer- in - Charge and all these documents taken
together, shall be deemed to form one contract and shall be complementary to
one another.
26. ‘Approval’ means approved by TUDA in writing.
27. Applicable Law means the laws and any other instruments having the force of
law in India & Tripura.
28. “Client/Department/Competent Authority” means the TUDA, who propose
to get the works executed as mentioned in the Contract on behalf of Tripura
Urban Planning & Development Authority (TUDA) being the disclosed principal.
29. Tripura Urban Planning & Development Authority shall mean a Govt. Dept.
under the Govt. of Tripura, with its office at P.N. Complex, Gurkhabasti,
Agartala-799006, Tripura or its Administrative officers or its Engineer or other
employees authorized to deal with any matter with which these persons are
concerned and authorized on its behalf
30. “Department / Disclosed Principal” shall mean The Commissioner, TUDA for
the project.
31. Contract value or Contract Amount means the sum indicated in the Letter of
Award for the performance of the Services, in accordance with conditions of the
contract, which shall be firm & fixed during the entire period of contract,
including the extension, if any.
32. “EPC Contractor/ Contractor” means the successful bidder who has been
awarded the work/contract.
33. ‘‘Engineer-in-Charge’’ means the Engineer as may be duly appointed and
authorized in writing by TUDA, to act as “Engineer-in-charge” on its behalf for
the purpose of the contract, to perform the duty set forth in Condition of
Contracts and other contract documents.
34. In writing means communicated in written form with proof of receipt.
35. Language means all documents and correspondence in respect of this contract

shall be in English Language.
36. Month means English Calendar month, ‘Day’ means a Calendar day of 24 Hrs.
each.
37. "Site" means the place where the buildings and associated infrastructures are
to be constructed.
38. "Bid" or "Bids or Tender" shall mean the offer submitted by a Bidder in
accordance with this document for the above project.
39. The words Tenderer, Bidder, Applicant, Contractor, EPC Contractor shall have
the same meaning.
40. The words Project Management Client/Department, EPC Client/Department,
Client/Department, Client/ Department shall have the same meaning.
41. G+14 means that the building comprises with Ground Floor and additional 14
no. of Floors above it with parapet walls at Rooftop. Ground Floor of 3.00meter
height with provision for Shops, Office, Commercial outlet and Car-parking.
Each of the 14 floors above ground floor shall be of 3.00 meter height (Floor to
floor). The top most floors shall be provided with Parapet walls and Rooftop
gardening infrastructure.
42. BOQ means Bill of Quantities.
43. UDD means Urban Development Department, Government of Tripura,
Agartala.
44. “NBC” means National Building Code. 45. BIS means Bureau of Indian Standards 46. ‘IRP’ means Iron Removal Plant (Modified Iron Removal Plant) 47. “PNG” means Piped Natural Gas 48. “TNGCL” means Tripura Natural Gas Corporation Ltd. 49. “SS” means Stainless Steel 50. “sq.m” means Square Meter

2. SCOPE OF WORK
A. BACKGROUND:
There is shortage of Housing in and around Agartala City of Tripura and also in the major
District Head quarters. There is huge demand from different income groups of HIG, MIG, LIG for
Housing. Development of Housing so far has not been happened in a planned way. Therefore,
with this scope the Tripura Urban planning and Development Authority (TUDA) under the Urban
Development Department, Government of Tripura has taken up new initiative for developing
Township in the city of Agartala. Out of this new initiative this Township Project at Nandannagar
site is figured where in it is proposed to develop a Township of 392 Flats in a land of nearly 5.8
acre (approx).
B. LOCATION:

The scope of work shall include but not limited to the following-

G+14 means that the building comprises with Ground Floor and additional 14
no. of Floor above it with parapet walls at Rooftop. Ground Floor of 3.00 meter height
with provision for Shops, Office, Commercial outlet and Car-parking. Each of the 14
floors above ground floor shall be of 3.00 meter height (Floor to floor). The top most
floors shall be provided with Parapet walls and Rooftop gardening infrastructure.

** Payment will be made to the Bidder as per the measured and actually found built
up area of Building after/ during construction by the Engineer in Charge.
ii. Planning, Designing, Execution and Installation of ELV System : - Public
address system, Data/LAN cabling system, Telephone cable system, CCTV, Fire alarm,
Parking Management etc.
iii. Planning, Designing, Execution and Installation of E & M system/services: -
Lift, Internal electrification, Transformer, LT power distribution, Emergency lighting
system, DG set, UPS system, Earthing, Lightening arrester etc. complete as per the
direction of Engineer in charge.
iv. Planning, Designing, Execution and Installation of Creation of water source
with underground water tank, modified type Iron removal Plant and its pipeline
arrangement as per the full necessity/requirement of the Township Project as per the
direction of Engineer in charge. Provision for rain water harvesting and storage tank
shall be made.
v. Planning, Designing, Execution and Installation of Hydro-pneumatic pump,
stand by pump with necessary pipeline/fittings arrangement for ensuring 24 hr water
availability as per the direction of Engineer in charge.
Vi. Planning, Designing, Execution and Installation of pipeline network upto
individual flat for internal domestic PNG (Piped Natural Gas) connection as per
requirement of TNGCL (Tripura Natural Gas Company Ltd.) and as per the direction of
Engineer in charge.
vii. Planning, Designing, Execution and Installation of Plinth protection, drainage,
internal road, approaches etc. complete as per the direction of Engineer in charge.
Viii. Planning, Designing, Execution and Installation of External Electrification as
per the direction of Engineer in charge.
ix. Planning, Designing, Execution and Installation of Compound Wall, Security
Post, Entry gate, MS gate, wicket gate, Sign Boards, Guide Map, Location Board,

Direction Board, Houses/ Flats number marking etc. all completed as per the
direction of Engineer in charge
x. Planning, Designing, Execution and Installation of waste water, Solid Waste
disposal, Sewerage/Septage Disposal system, Dust bins as per the direction of
Engineer in charge.
xi. Planning, Designing, Execution and Installation of Pump House as per the
direction of Engineer in charge.
xii. Planning, Designing, Execution and Installation of Car parking place (Covered
and uncovered both types) as per drawing given from TUDA as per the direction of
Engineer in charge in the Ground Floor/ Uncovered areas.
xiii. Planning, Designing, Execution and Installation of Fire alarm, fire safety,
disaster safety arrangements as per the direction of Engineer in charge.
xiv. Planning, Designing, Execution and Installation of functional requirements in all
floors, necessary interlinking for better mobility & space for car parking as per
drawing and the direction of Engineer in charge.
xv. To prepare complete structural Design and drawings for foundation, Sub-
structure, Super Structure, Front elevation, Side elevation, 3D view/ elevation
preparation, services, functional requirements for ready to habitat condition and for
other structures to be provided / constructed within works area as per the provision
content in NBC and BIS codes as per the direction of Engineer in charge.
Considerations of Green building principles are to be incorporated.
xvi. The scope as described above is only indicative and not exhaustive. In additions to
the above the agency shall be responsible, binding and liable for executing all the
items required for completing the Township/Project upto ready to habitat condition. In
all respect to make the units/ Flats habitable and ready for occupation with all items
completed as per direction of Engineer in Charge.
xvii. All precautionary measures are to be taken by the Bidder/ agency to safeguard
and safety measures against any accidents for the employees, labour, public, staff and

others involved in the work by providing all necessary safety equipment, helmets etc.
at work site as per the Government’s rules and regulation.
xviii. Data provided under the scope and specifications are for general guidelines.
Changes if any, would not affect the agreed rates and no claim on this account shall
be entertained.
xix. Preparation of model (s) to suitable scale as per the direction of Engineer in
charge.
xx. Agency/ Bidder shall be responsible for watch & ward/guard for the safety of
building, fittings, fixtures, machineries’, accessories, tolls & kits provided by him
against Pilferage and breakage if any during the works till handing over the project. No
extra payment shall be made for this account.
xxi. No payment shall be made for any damaged caused by Rain/ Flood/ Calamities
etc. or any other similar reason.
xxii. All installation/ erections are subjected to necessary prior inspection and
clearance from TUDA/ Engineer in charge.
xxiii. For the site at Nandan Nagar there shall be provision for Shops, Commercial
Outlets, Gym, Office etc. in addition to car parking as per the approved drawing and
as per direction of Engineer in Charge.
xxiv. Planning, Designing, Execution and Installation of Lifts. There shall be 2 (Two)
Lifts in each of the Tower-
a. There shall be one lift of 8 person’s carrying capacity and another of 10
person’s carrying capacity in each of the Tower.
xxv. Rooftop gardening complete in all respect with all necessary infrastructure as
per direction of Engineer in Charge shall be provided as will be approved from TUDA.
xxvi. Parapet (1.00m height) in balconies and rooftop shall be provided along with
architectural view as will be approved from TUDA.

xxvii. Prestressed cement concrete tiles for entrance porch as per direction of
Engineer in Charge
xxviii. Front Elevation: Total front elevation area and remaining areas painted with

xxxiii. SPECIAL CONDITION:
The Employer, i.e. Tripura Urban Planning & Development Authority (TUDA),
reserves the right to change/modify/curtail/enhance the scope and functional
requirement of the work of the proposed Township (Ownership flats) Building at any
time or stage of progress of the tendering, awarding or implementation process,
without assigning any reason whatsoever for the same and which the bidders/
Bidder(s) / agency/agencies shall be bound to abide by without thus being entitled to
any kind of extra payment or facility whatsoever. In case of curtailment of scope of
work at awarding / negotiation/ post-award/ execution/ Implementation stages, the
payment to the implementing agency shall be proportionately reduced in line with the
reduced volume of work. This is purely remain at the discretion of TUDA.

3. SPECIFICATION OF WORK/ITEM(s)
Specifications:
a. Bidder shall strictly adhere to quality norms confirming to CPWD / State PWD
specifications /specifications to be got approved by Tripura Urban Planning &
Development Authority (TUDA).
b. RERA, NBC, BIS codes, Tripura building by Laws/ Tripura Building Rules, other
statutory provision(s) etc. should be strictly followed during plan, design and
execution.
c. All structural design shall confirm to latest BIS Codes particularly “criteria for
earthquake resistant structures – IS: 1893 – 2002/2016”.
d. All brick works shall be in 1st class bricks as per PWD specifications.
e. All external and partition wall shall be made with cement made blocks or similar
blocks approved quality and standards as per CPWD specification as will be
approved from TUDA.
f. The floors of lavatories and kitchen shall be made with approved quality
Ceramic tiles as per CPWD specification as will be approved from TUDA. Ceramic
wall tiles shall be provided upto 2.4 meter height in lavatories and kitchen as will
be approved from TUDA.
g. The floors of rooms, balconies other than kitchen and lavatories shall be made
with approved quality vitrified tiles of good quality as per CPWD specification as
will be approved from TUDA. The floors of verandahs, stair case, corridor, lobby
shall be provided with good quality marble flooring as per CPWD specification as
will be approved from TUDA. ‘SS’ made hand rails of approved quality with vertical
‘SS’ post suitably fixed on the stairs as will be approved by Engineer in Charge

shall be provided. Skirting in verandahs, corridor, lobby etc. shall be 250 mm
height (marble made) whereas in rooms it shall be 200 mm height (vitrified tiles
made), in kitchen 200 mm height (ceramic tiles made) as will be approved from
TUDA.
h. Sanitary fittings shall be of approved quality ISI standard/ marked (or higher
quality) as per the direction of Engineer in Charge. Sanitary fixtures and fittings,
sanitary installations, internal & external water supply arrangement with
provision of geyser line, internal sanitary systems, pumps house, pumps,
sewerage/Septage disposal system, rain water disposal/ harvesting etc. as will be
approved from TUDA. Bidder shall submit necessary Engineering drawings for the
above mentioned items and shall be got approved from TUDA before Installation/
Construction.
i. In plumbing works - pipes and other fittings/accessories shall be used of BIS
specification and ISI marked and all other fittings shall be of BIS specification and
ISI marked as will be approved from TUDA.
j. Main Door shutter shall be minimum 40 mm thick Teak wood (Preferably
SEGUN wood) made and with Architectural view. The Door frame of main door
shall be minimum 125x150 mm size made of Teak wood. Other doors in Flats are
of particle board (BIS specification and ISI marked, water proof, termite proof)
minimum 40 mm thick. Doors for Lavatories shall be Delux type good quality PVC
door/Fibre door (BIS specification and ISI marked) as will be approved from TUDA.
Other Door frames shall be of Teak wood or MS made as will be approved from
TUDA.
k. All windows shall be fully covered with glazed type & provided with MS Grills
made of square bars as per CPWD specification as will be approved from TUDA.
Balconies shall be provided with 1.00 meter height parapet and partly/ fully
covered with MS grill as per CPWD specification as will be approved from TUDA.
‘SS’ made best quality hand rails of approved design shall be provided over the

parapet. Fibre made transparent type rectangular shaped decorative sheet of
approved quality shall also be provided in the parapet in Balcony.
l. All windows shall be made with good quality Aluminum sliding frames (2/3/4
part as the case may be - Aluminum frame powder coated cherry colour) fitted
with Glass of requisite thickness and best quality as per CPWD specification as
will be approved from TUDA.
m. Wall painting inside the flats shall be completed up to base coat (wall
Putty made- BIS specification and ISI marked) as per CPWD specification and final
finish will be left for completion by the customers who booked their flat. Item(s) of
painting and finishing other than the above (to be done by the customers) shall be
done and completed by the Bidder. Outside portion, portions belongs to common
area, corridors, Stair cases, parking area, parapet etc. and all other remaining
part(s) shall be completed and finished by the Bidder with painting (BIS
specification and ISI marked) finished as per CPWD specification as will be
approved from TUDA.
n. There shall be provision for 2 (Two) lifts in each tower of the building with
arrangement of UPS as per NBC provision and CPWD specifications.
i. Location-Nandan Nagar Site
There shall be one lift of 8 person’s carrying capacity and another of 10 person’s
carrying capacity in each of the Tower.
Lift shall be OTIS/ ThyssenKrupp/ Mitsubishi or equivalent made with UPS for
emergency as will be approved from TUDA.
o. Generator set (DG Set) (Silent or Sound Proof type, energy efficient) competent to
cover the entire complex shall be set up and installed
(Kirloskar/Mahindra/Greaves or equivalent) made as will be approved from TUDA.
p. Specification of internal and external electrification, water supply arrangement,
sanitary and sewage disposal, work related with installation of lifts etc and other
ancillary items of works shall be as per CPWD specification and the same shall need

to be got approved from the Engineer in charge. The water supply, PNG pipeline
network of gas connection and internal electrification shall be made conceal.
Internal electrical work shall be carried out in recessed MS conduit wiring system
and FRLS PVC insulated copper conducted wire will be used for points, circuit,
main and sub-main wiring in accordance with CPWD specification. Meter Board and
Main distribution board as per DISCOM specification/ requirement shall be
provided by the agency. Each flat shall be provided with 3 Phase connection facility.
A Separate meter room for each tower shall be provided. Electrical
equipments/fittings shall be of BIS Standard & ISI marked. Electrical cables shall
be of BIS Standard & ISI marked. Internal electrification work in each flat shall be
made as competent to 3 Phase line connection (HIG and MIG Tower) and Single
Phase connection in LIG Tower. Necessary provision shall be made for Earthing,
Lightning arrester, aviation lights and safety against lightening/ thunderstorm (as
per IS 2309-1989) as per CPWD specification as will be approved from TUDA. AC
point in bed rooms and Geyser point in bathrooms shall be provided.
q. TV outlet point wiring of each Flat shall be terminated in suitable size of GI box
along with splitter at every floor with proper inter connections as per direction of
Engineer in charge
r. Telephone outlet point wiring of each Flat shall be terminated in suitable size of GI
junction box in DUs direct from ground floor to each DUs as per direction of
Engineer in charge.
s. The storage capacity of ground water reservoir, water lifting pump/motor, water
source creation, sewage/septage disposal system, Rain water harvesting etc. shall
accordingly be designed as per the number of inhabitants in the township
following standard norms and practices as per CPWD specification and BIS norms
as will be approved from TUDA. Necessary technical approval shall need to be
taken by the bidder from the Engineer in charge.
t. Plinth height shall be 0.45-0.60m from ground level for the ground floor as will be
approved from TUDA.

u. Parapet (1.00m height) in balconies and rooftop shall be provided along with
architectural view as will be approved from TUDA.
v. Rooftop gardening complete in all respect with all infrastructure shall be provided
as will be approved from TUDA.
w. There shall not be any deviation in terms of carpet area of HIG, MIG, LIG flats as
prescribed. This shall be strictly followed. Necessary changes if any in respect of
Layout of Covered & Uncovered parking area, interlinking of Towers, access to car
parking area, service road, pathways etc. are required that shall be done by the
Bidder without any extra cost/ charges as per the direction of Engineer in Charge.
x. Synthetic enamel paint in all doors (except Main door), Grills, Gates, Electric post,
Meter box and related wood / iron / steel work and Oil bound distemper in WC
and toilets shall be done complete and finished by the Bidder as CPWD
specification and as per the direction of the Engineer in Charge. Main door shall be
finished with best quality varnishing by the Bidder.
y. Granite Cladding upto 2.1 m ht on the lift walls.
z. Prestressed cement concrete tiles for entrance porch
aa. Front Elevation: Total front elevation area and remaining areas painted with
Exterior grade Acrylic emulsion paint.
bb. Rear & Side Elevation: Walls Finishes with Exterior grade acrylic emulsion
paint.
cc. Parking area & internal roads, approaches with sufficient base course/foundation
shall be provided with Paver Blocks/Paver tiles of approved quality for mobility as
will be approved from TUDA.

dd. Sample of building materials , all equipments, fittings, accessories or other
articles required for execution of work shall be got approved from TUDA/ Engineer
in charge before installation/ use.
ee. Materials shall be subjected to quality test if requires and as will be directed from
TUDA/ Engineer in charge. Charges for all necessary quality testing of materials
shall be borne by the Bidder.
ff. The Agency shall procure the required materials , all equipments, fittings,
accessories or other articles required for execution in advance within due time so
that sufficient time is available for testing if necessary as directed from TUDA/
Engineer in charge.
gg. All the charges related to testing of materials, vetting of Drawings & Designs as
prescribed shall be borne by the Agency/ Bidder.
hh. Cement for civil works shall be PPC/OPC conforming to IS: 1489 (Part-
1)/IS: 269/IS: 8112/IS: 12269. Steel reinforcement shall conform to IS:
1786-2008. Grade of design mix concrete shall not be less than M30. Only
stone aggregates of approved quality shall be used, no brick aggregate shall
be used.
ii. Suitable rain protection covers made of minimum 16 SWG ms sheet galvanized

4. ESSENTIAL INFORMATION FOR BIDDERS
i) INITIATION OF THIS R.F.P
Tripura Urban planning and Development Authority (TUDA) has taken up
Township scheme at the Nandan nagar Site land near Don Bosco School, Agartala
measuring nearly 5.8 acre (approx) for 392 flats in total.

Flats No. of Tower-1) No of flat in each HIG Tower – 56 , No of flat in MIG Tower – 112,
No of flat in LIG Tower – 112)} at the land of TUDA (Nandan Nagar Site), Agartala,
Tripura
It is a new initiative of Government of Tripura taken under implementation
through Tripura Urban planning and Development Authority (TUDA). Under this town
ship scheme provisions like Fire Safety, Disaster Safety, Earthquake resilience,
Generator backup, Car parking, CCTV and security services, Shops and Commercial
Outlets, Rooftop Garden etc. will be there.
ii) MODE OF OPERATION:-
a. Online RFP is called for both technical and the financial bids from all the eligible
bidders at a time. Through technical bid, eligible bidders will be selected and the financial
bids of the eligible technical bidders will be used, for making comparative status and thus
finalizing the lowest Bidder. Financial bids of ineligible bidders will not be considered for
any purpose in the process. Lowest bidder, such selected, will have to formulate Drawing
& design of structural details, BOQs for civil as well as all Building services such as,
internal electrification, internal water supply arrangement and other amenities as
prescribed under scope and specification of work, water facility in each flats so that 24 hr
water is available, external electrification works, fire fighting, fire alarm system, Lift,
emergency exits, Disaster safety, creation of water source with treatment of water, internal
road, waste water and Solid Waste disposal, plinth protection, surface drain etc. These
items of commitments to be rendered by the lowest bidder. They will have to formulate the
entire design & drawings as per specification given and to be approved from TUDA.
Successful bidder will start construction venture at the ground, simultaneously, as per

approved design and drawings. Financial offer, as such, will be inclusive of all activities’ to
be taken by the bidders, as per provisions and specification given. Bidders are insisted to
read carefully the terms and conditions and specifications before formulating offer

iii) ELIGIBILITY CRIERIA:-
a) The bidder shall have experience in completion of at least 2 (two) high rise
buildings during last 7(seven) years ending at 31st August, 2019, not below G+14
high building costing to not less than Rs. 50.00 Crore (Rupees Fifty Crore), out of
which at least one shall be residential building.
b) Experience should be in the name of the bidding company and not in subsidiary/
associate company/ group of companies. Otherwise this will not be taken into
consideration.
c) The bidder should be in operation in India for a period at least 5 (five) years as on
publication of the bid.
d) The bidder shall have latest ISO certification.
e) The average annual Turnover of the bidder should be in Indian Rupees 100.00
Crore (Rupees One Hundred Crore) only for last 3 (Three) audited financial years
(2016-17, 2017-18, 2018-19).
f) The bidder should have Positive Net worth (PNW) in each of the last 3 (three)
financial years as on 31st March, 2019.
g) The bidder shall have in-house architecture / design capacity for this with all latest
design software’s as well as manpower like,
xii) Architects having experience in at least two completed similar nature of work of
construction of residential high rise buildings in last 10 (ten) years and
Conversant with all relevant BIS codes and National Building Code provisions.

xiii) Project Manager with Degree in Civil Engineering with min. 15 years
construction experience and Conversant with all relevant BIS codes and National
Building Code provisions.
xiv) Civil Engineer-1 with Master Degree in Civil Engineering with specialization in
structural Engineering having design experience of 15 years to handle structural
design of 13 storied building and Conversant with Earthquake resilience issues,
all relevant BIS codes and National Building Code provisions.
xv) Civil Engineer-2, Degree in Civil Engineering having experience of 15 years to
handle geotechnical, soil and foundation related issues and Conversant with all
BIS codes and National Building Code provisions.
xvi) Civil Engineer-3 with Degree in Civil Engineering having construction experience
of 15 years to handle work of multi-storied building and Conversant with all BIS
codes and National Building Code provisions.
xvii) Civil Engineer-4 with Degree in Civil Engineering having construction experience
of 10 years to handle water supply, sanitary and plumbing works and
Conversant with all BIS codes and National Building Code provisions.
xviii) Mechanical Engineer-1 with Degree in Mechanical Engineering having
construction experience of 10 years to handle HVAC , water pumps , generator
sets, Fire safety measures and other related issues and Conversant with all BIS
codes and National Building Code provisions.
xix) Mechanical Engineer-2 with Degree in Mechanical Engineering having
construction experience of 10 years to handle lift installation & operations and
other related issues and Conversant with all BIS codes and National Building
Code provisions.
xx) Electrical Engineer -1 with Degree in Electrical Engineering having construction
experience of 10 years to handle HVAC , water pumps , generator sets and other
related issues and Conversant with all BIS codes and National Building Code
provisions.
xxi) Electrical Engineer-2 with Degree in Electrical Engineering having construction
experience of 10 years to handle internal/external electrification works and fire
safety measures in High rise buildings, conceal wiring, lifts installation &
operation and other related issues and Conversant with all BIS codes and
national Building Code provisions.

xxii) Diploma Engineer with diploma in Engineering having construction experience of
10 years in Civil, Electrical and Mechanical Engineering and Conversant with all
BIS codes and National Building Code provisions.
h) The bidder shall have experience in carrying out multi-disciplinary works such as civil,
mechanical, electrical, plumbing works, Lift installation, water supply, disaster safety,
fire safety measures, fire detection & alarms, CCTV etc and on a single point
responsibility basis.
i) The bidder shall have the ability to set up full-fledged Quality Testing Lab and Batching
Plant within or near by the working place, as per direction of the Tripura Urban
Planning & Development Authority (TUDA).
j) The bidding capacity of the Bidder should be equal to or more than Rs. 100.00 Crore
(Rupees One Hundred Crore). The bidding capacity shall be worked out by the formula:
Bidding Capacity= (A x N x 2) - B
Where,
A= Maximum Value of construction works executed in any one year during
the last 5 (five) years taking in to account the completed as well as work in
progress.
The value of executed works shall be brought to current costing level by
enhancing the actual value of work at simple rate of 7% per annum; calculated
from the date of completion to the last date of submission of application for
tender.
N= Number of years prescribed for completion of work for which bids has
been invited.
B= Value of existing commitments and ongoing works to be completed during
the period of completion of work for which bids have been invited.
k) Those firms blacklisted by any Government or Govt. organization need not apply.
l) The firm/ organization shall have to compulsorily submit litigation history with
technical bid.

b. Certificate of registration for GST/ Valid GST clearance certificate etc.
c. Copy of professional tax clearance document.
d. Copy of valid license regarding engagement of workers in the contract works from
the Labour Department, Govt. of Tripura. (If not available can be submitted within
30 days after award of LOA).
e. Copy of PAN card.
f. Certificate from the Statutory Auditor / CA clearly specifying the annual turnover
for the specified years.
g. Audited and Certified Balance Sheet and Profit/Loss Account of last 3 (Three)
Financial Years (2016-17, 2017-18, 2018-19) should be enclosed.
h. Certificate from the statutory auditor/ CA clearly specifying the net worth.
i. Copy of Work Orders along with the copy of completion certificate from the
competent authority/ Client. Certificate from competent authority/Client in this
regard is a must one; if it is not submitted then it will not be considered. If
experience lying with work awarded from Private Company/ Organization, in such
cases certificate of GST paid for the same shall be submitted by the bidder in
addition.

6) SECURITY DEPOSIT & PERFORMANCE GUARENTEE:-
a) PERFORMANCE GUARANTEE:-
Performance guarantee shall be @ 5.00% (Five point zero percent) of the
lump sum contract amount, to be submitted by the lowest/ successful bidder with in
28 (twenty eight) days of receiving LOA. After submission of the performance
guarantee as mentioned above earnest money will be released in full. If the bidder fails
to do so, his earnest money in full will be forfeited in full.
b) SECURITY DEPOSIT:-
Security deposit @ 5.00% (five point zero percent) of the contract value to be
deducted from bills for the defect liability period of 36 (thirty six) months from the
date of completion of the project. On receipt of fresh bank guarantee @ 5.00% (five
point zero percent) of the Contract value security money which was deducted from
bills will be released.

7. INSTRUCTIONS TO BIDDERS
INTRODUCTION:
The Tripura urban planning and Development is intending for development of
Township for construction of a (G+14) storied apartment building at the land of
TUDA (Near Don Bosco School) at Nandan Nagar, Agartala.
i. TECHNICAL BID:
The Technical package, clearly labeled as “TECHNICAL BID”, has to be
submitted, shall consist of information for responsiveness and other information
about Bidder, as required shall be the Technical Bid. The Technical Bid should
be uploaded in the e- tendering website www.tripuratenders.gov.in. This is to be
submitted online as well as in hard form to the given address.
ii. FINANCIAL BID
a. The financial bid should be uploaded in the e- tendering website
www.tripuratenders.gov.in . These prices should include all costs except GST. No
price variation clause or no separate benefit/ compensation under such clause
or no escalation in prices in any form shall be allowed.
b. EXTENSION OF BID VALIDITY
Prior to the expiry of the original Bid Validity Period, TUDA may, at its discretion,
request Bidders to extend the Bid Validity Period for a specified additional
period. This is fully under the discretion of the Authority of TUDA.

iii. SEALING AND MARKING OF BIDS
a. The Bid shall be submitted in accordance with the procedure detailed herein.
Specified documents shall be enclosed in envelope of appropriate size each of
which shall be sealed.
b. After online submission, the hard copy of the Technical Bid will be submitted in
marked “Technical Bid”. Documents shall be in a suitable packet/ envelope addressed to

time of opening of the Bid. The envelope should also bear the name and full address
of the Bidder. Bidders are responsible for any loss or damage or non- delivery of the
same or any kind of mistakes in this regards.
a. The qualified lowest Bidder will be considered for awarding the work/ project
after acceptance of their Bid by the competent authority of TUDA. The decision of
the TUDA shall be final and binding on all bidders.
iv. The bids sent telegraphically or through other means of transmission (Tele-fax,
E-mail etc.), which cannot be delivered in a sealed envelope, shall be treated as
defective, invalid and shall stand rejected

8. BID OPENING AND EVALUATION
A. BID OPENING
i. The Bids will be opened in the presence of Bidders or their authorized
representatives who may choose to attend on the date & time as mentioned in
Notice Inviting RFP. If such nominated date for opening of Bid is subsequently
declared as a public holiday, the next official working day shall be deemed as the
date of opening of the Bid.
ii. Bids for which an acceptable notice of withdrawal has been submitted shall not
be opened.
iii. Bids which have not complied with one or more of the foregoing instructions may
not be considered.
iv. First online technical bid will only be opened which will be checked for
completeness and evaluation. If the documents do not meet the requirements of
the BID, a note will be recorded.
v. On opening of the online technical bid, it will be checked if they contain
document as specified.
vi. After technical evaluation of all bids, the financial bid of all responsive Bidders
will be considered for opening on the date & time specified. If such nominated
date for opening of Bid is subsequently declared as a public holiday, the next
official working day shall be deemed as the date of opening of the Bid.

B. DETERMINATION OF RESPONSIVENESS
i. Prior to opening of Financial Bids, TUDA will determine whether each Technical Bid is
responsive to the requirements of NI-e-RFP
a. Contains all the information as requested in NI-e-RFP.
b. Contains information in same/similar formats as those specified in NI-e-RFP
c. The validity period of the offer is as per NI-e-RFP
d. If a Technical Bid is not substantially responsive to the requirements of DNI-e-RFP, it
will be rejected by TUDA the decision of the TUDA in this regard shall be final and
binding. The financial Bids of non-responsive Bidders shall not be considered and
opened.

9. EVALUATION OF BIDS
i. TUDA would subsequently examine and evaluate the Technical Bids of responsive
Bidders. After examination of technical bids, those who are qualified in technical
bids, their financial bid will be considered for evaluation.
ii. TUDA reserves the right to reject any Bid if:
a. The Bidder does not respond within the stipulated time of requests for
supplemental information/ clarifications required for the evaluation of the Bid.
b. It is found that the information provided is not true or incorrect or facts/ material
for the evaluation have been suppressed.
c. Due to any valid reason at the discretion of TUDA
iii.Evaluation of technical Bids submitted by Bidders shall be undertaken based on
details submitted therein only. Bidder shall not be allowed to submit on their own,
additional information or material subsequent to the date of submission and such
material/ information, if submitted, will be disregarded. It is therefore essential
that all details are submitted by the Bidder comprehensively, accurately and
specifically in their technical Bid, avoiding vague interpretations. However,
Evaluation Committee, if it so desires, reserves the right to seek any clarification
from the Bidders on the information provided in the technical package. The request
for clarifications and the response shall be in writing. No change / addition in the
information or substance of the Bid shall be sought, offered or permitted.
iv. To assist in the examination, evaluation and comparison of the financial Bid,
Evaluation Committee may ask Bidders individually for clarifications/
justification/ analysis etc. The request for clarification and the response shall be in
writing. No change in the price or substance of the Bid shall be sought, offered or
permitted except as required to confirm correction of arithmetical errors, if any
observed by the Evaluation Committee during the evaluation of Bids.

10. PROCESS TO BE CONFIDENTIAL
i. Except the public opening of the Bids, information relating to the examination,
clarification, evaluation and comparison of Bids and recommendations concerning the
award of Contract shall not be disclosed to Bidders or other persons not officially
concerned with such process.
ii. Any effort by a Bidder to influence TUDA Evaluation Committee in the process of
examination, clarification, evaluation and comparison of Bids and in decisions
concerning award of Contract, shall result in the rejection of the Bid. Client’s right to
accept any Bid and to reject any or all Bids TUDA
iii. Notwithstanding anything above, TUDA reserves the right to accept or reject any
Bid at any time prior to award of Contract without thereby incurring any liability to the
affected Bidder or Bidders.
iv. TUDA reserves the right to cancel the selection process, at any stage prior to the award
of the Contract, in larger public interest, on account of the following:
In case no Bid/ a single Bid is received.
Occurrence of any event due to which it is not possible to proceed with the selection
process
An evidence of a possible collaboration/mischief on part of Bidders, impacting the
competition and transparency of the selection process,
Any other reason, which in the opinion of the Client necessitates the cancellation of
the selection process.
v. On occurrence of any such event, TUDA shall notify all the Bidders within 7 days of
such decision. TUDA shall also promptly return the Bid Security submitted by the
Bidders within 15 days of issue of such notice. TUDA is not obligated to provide any

reason or clarification to any Bidder on this account. TUDA’s liability under this clause
is restricted to returning the Bid Security and no other reimbursements of costs/
expenses of any type shall be made by the Client on this account.
11. NOTIFICATION OF AWARD
a) TUDA will issue the Letter of Award to the Successful Bidder, notifying him of
being declared successful and the intent to sign the Contract Agreement with him. No
correspondence will be entertained by TUDA from the unsuccessful Bidders.
b) The Letter of Award shall form part of the Contract.
c) Upon submission of Performance Security by the Successful Bidder, TUDA will
promptly notify the other Bidders and discharge / return their earnest money.
12. SUB-CONTRACTING
i. The Bidder shall not be allowed to sub-contract the whole of the works.
ii. No partnership, Joint Venture, Consortium or Sub contract is allowed. However for any
specialized technical job in regard to Architectural Plan, drawing and Design, earthquake
resilient issues, Geo-Technical and Structural requirements etc. or for any kind of
specialized job - support from other agency may be hired or joint ventured.
iii. The Bidder shall be responsible for observance, by all sub-Bidders, of all the provisions of
the Contract Agreement. The Bidder shall be responsible for the acts or defaults of any
sub-Bidder, his representatives or employees, as fully as if they were the acts or defaults
of the Successful Bidder, his representatives or employees. The Bidder shall be solely
responsible for the performance of the sub agency/ sub-bidder/sub-contract if any for
making payments to them.

13. CLARIFICATION ON BID DOCUMENTS
a Prospective Bidder requiring any clarification within the prescribed date may
communicate through e-mail: [email protected]. The Bid inviting authority will
accordingly respond to such clarification through e-mail.
b. However, Bidder may contact the Bid inviting Officer at the address indicated in
the E-NIT, for clarification on the bid document.
14. AMENDMENT TO BID DOCUMENT
Before the last date for submission of Bid, the Bid inviting Officer may modify any
of the Contents of the Bid Notice, Bid documents by issuing amendment / corrigendum.
Any amendment / addendum/ corrigendum issued by the bid inviting Officer shall
be part of the bid document and it shall be published in the e-procurement portal at
https://tripuratenders.gov.in.

15. DETAILED PROCESS FOR SUB MISSION OF E- BIDS
SL. Steps to be followed.
1
On publication of the e-RFP, bidder should download the tender documents
from the website as mentioned in the PNIe-RFP and minutely go through the
instructions/terms conditions/critical dates/eligibility criterions of DNIT.
2 The Bidder shall purchase Class-2 / Class 3 Digital Signature Certificate
from any certifying / authorized agency.
3 The Bidder shall enroll himself / herself in the e-procurement website
‘https://tripuratenders.gov.in’ and create User ID and Password.
4 The Bidder shall Login into the website https://tripuratenders.gov.in’’
using the created ID and Password.

After login, the Bidder shall find ‘My Document / space’ folder option in the page.
The bidder shall upload his entire non sensitive documents as mentioned in the
checklist for uploading. Scanning resolution should be 200 x 100dpi.

1 The Bidder shall Download and fill up Check list, financial offer, bidder’s
sheet and

computer for uploading Technical Bid and Financial Bid at the time of e
Bidding.
Financial offer in the Prescribed format should be printed, ink signed &
stamped, and thereafter scanned and saved in the Bidder’s computer for
uploading at the time of e-bidding.
The Bidder shall Download DNI-e-RFP documents and save in the Bidder’s
computer for uploading at the time of e-biding as a proof of acceptance of all
terms conditions in the DNIT.
Thus, the Bidder shall be ready and start e-biding following the steps as per
the e-RFP application and upload all the above documents with his/ her
digital signature.

16. COMMERCIAL TERMS & CONDITIONS

Authority and it is non-refundable.
4. Performance
guarantee
Performance guarantee shall be @ 5.00%
(Five point zero percent) of the lump sum contract
amount, to be submitted by the lowest/ successful
bidder with in 28(twenty eight) days of receiving LOA.
After submission of the performance guarantee as
mentioned above earnest money will be released in full.
If the bidder fails to do so, his earnest money in full will
be forfeited.
5. Security Deposit /
Retention Money
Security deposit @5.00% (Five point zero percent) of the
contract value to be deducted from bills for the defect
liability period of 36(thirty six) months from the date of

completion of the project. On receipt of fresh bank
guarantee @5.00% of the Contract value security money
which was deducted from bills will be released.
6. Payment Terms I. Bill shall be prepared and submitted by the Bidder,
shall be interlinked with the agreed detailed PERT net
work of the Bidder setting forth his starting and
completion dates for the various key phases of works.
II. Joint measurements shall be taken continuously
need not be connected with Billing stage. System of 4
copies of measurements, one each for Bidder,
Employer and Engineer-in-Charge or his nominee
and signed by both Bidder and Employer shall be
followed.
III. Bill amount shall be paid after necessary verification.
IV. The Bidder should resubmit the Bill, with corrections
within 30 days of its return.
7. Mode of Payment
Breakup
As per Schedule of payment.
8. Secured Advance
against Materials
No Secured Advance for the works is allowed.
9. Escalation Compensation for Price variation will not be allowed
to the Bidder under any circumstances.
10. Insurance I. The Bidder shall provide in the joint names of the
employer and the Bidder Insurance cover from the
Start date to the end of the defect liability period, in

the amounts and deductibles stated in the Contract
data for the following events, which are due to the
Bidders risks.
a) Loss of or damage to the works, Plant and
materials.
b) Loss of or damage to equipment.
c) Loss of or damage of property (except the
works, plant materials and equipment) in
connection with the Contract and Personal
(worker /staff/ labourer/ employee/ helper etc)
Injury or Death.
II. Policies and Certificates shall be delivered by the
Bidder to the engineer-in-charge for his approval
before the start date. All such Insurances shall
provide for compensation to be payable in the types
and proportions of currencies required to rectify the
loss or damage incurred.
III. Alterations to the terms of the Insurance shall not be
made without the approval of the Engineer-in-charge
or his nominee.
IV. Both parties shall comply with all conditions of the
Insurance policies.
11. Tax & Duties Rate shall be quoted in the Financial Bid as per
format as prescribed excluding GST. However, all
other taxes, levies, cess, royalties whether local,
municipal, provincial or central pertaining to the
contract if any payable during the entire periods of
contract, shall be to the Bidder/Bidders account and
shall be deemed to have been included in the

contracted rate for the work to be executed by the
Bidder. The Employer shall not be liable for any taxes
or levies etc. whatsoever in connection with this
contract. The Employer will perform such duties in
regard to the deduction of such taxes at source as
per applicable law.
Income Tax & GST at source, shall be deducted by
the employer at source from the bills of the Bidder(s)
at the rates as notified by the Government, from time
to time.
Compulsory deduction for all works – 1(one) % Cess
on the gross payable amount of running / final bill as
per ‘Building and other construction workers welfare
Cess Act, 1996.
The Employer reserves the right to deduct/withhold
any amount towards taxes, levies, etc. and to deal
with such amount in terms of the provisions of the
statute or in terms of the direction of any statutory
authority and the Employer shall only provide with
certificate towards such deduction and shall not be
responsible for any reasons whatsoever.
12. Defect Liability
period/ maintenance
of work
Rectification of any genuine defects attributes to
Bidder and notified within the defects liability period
of 36 (thirty six) months from the date of
completion and maintenance for the aforesaid period
is at Bidder’s own risk and cost.

13. Liquidated Damage In case of delay in completion of the contract,
liquidated damages shall be levied @ 1% of the
contract price per week of delay, subject to a
maximum of 10 % of contract price.
14. Statutory
requirements
Residential development is permissible on the Site.
However, the bidder is required to adhere to the
construction norms as per the prevailing Building
Bye-laws of Tripura. The bidder shall at its sole cost
obtain the applicable clearances and sanctions from
competent statutory authorities for building plans,
utilities, firefighting, electric connection/ sub-station,
environment, pollution etc. etc. It is to be clearly
understood that all such clearances are to be
obtained by the Successful Bidder and the TUDA may
only provide assistance, wherever possible, on best
effort basis without any binding obligation. The
bidder should obtained clearance from Airport
Authority, MES, Defense if any etc at his own cost.
The bidder shall plan and install fire-detection, fire-
alarm and firefighting system, disaster safety and
obtain necessary approval from competent authority
on design and installation of the same.
All architectural and structural arrangements should
conform to the BIS Codes, National Building Code of
India, 2016, RERA & Tripura building by-laws /
Tripura building rule and other rules and

regulations, as applicable with all amendments from
time to time. No extra cost will be entertained from
the employer.
15. Work at night,

Bidder shall be mobilizing to the site, adequate plant
and machinery and provide necessary supervision for
fulfillment of the contract and timely completion of
the job as per the requirement and construction
schedule. Bidder shall be permitted to plan their
activities and for deployment of staff, labour, plant,
etc. at their own discretion, to ensure satisfactory
execution of the work and also be permitted to
remove extra materials/plant etc. from the site of
works, if required under intimation to the employer.
No extra cost will be entertained from the employer.
18. Delay & Extension of
time/ compensation
for suspension
I. The Engineer-in-charge or his nominee shall extend
the intended completion date if a compensation event
occurs or a variation is issued which makes it
impossible for completion to be achieved by the
intended completion date. Engineer-in-charge will
take necessary permission from TUDA in this regard.
II. The Engineer-in-charge or his nominee shall decide
whether and by how much to extend the intended
completion date within 21 days of the Bidder asking
the Engineer-in-charge or his nominee for a decision
upon the effect of a compensation event or variation
and submitting full supporting information. If the
Bidder has failed to give early warming of a delay or
has failed to cooperate in dealing with a delay, the
delay by this failure shall not be considered in

assessing the new intended completion date.
Engineer-in-charge will take necessary permission
from TUDA in this regard.
III. The following mutually agreed compensation events
unless they are caused by the Bidder would be
applicable:
a. The employer does not give access to a part of the site
by the site possession date stated in the contract
date.
b. The employer modifies the schedule of other Bidders
in a way which affects the work of the Bidder under
the contract.
c. The Engineer-in-charge or his nominee orders a delay
or does not issue drawings, specifications or
instructions required for execution of works on time.
d. The Engineer-in-charge or his nominee instructs the
Bidder to uncover or to carry out additional tests
upon work which is then found to have no defects.
e. The Engineer-in-charge or his nominee unreasonably
does not approve for a subcontract to be let.
f. Ground conditions are substantially more adverse
than could reasonably have been assumed before
issuance of letter of acceptance from the information
issued to bidders (including the site investigation
reports), from information available publicly and from
a visual inspection of the site.
g. The Engineer-in-charge or his nominee gives an
instruction for dealing with an unforeseen condition,
caused by the employer, or additional work required

for safety or other reasons.
h. Other Bidders, public authorities, utilities or the
employer does not work within the dates and other
constraints stated in the contract that cause delay or
extra cost to the Bidder.
i. The payment is delayed.
j. The effect on the Bidder of any of the employer’s
risks.
k. The Engineer-in-charge or his nominee unreasonably
delays issuing a certificate of completion.
l. Other compensation events listed in the contract data
or mentioned in the contract.
m. Whenever any compensation event occurs, the Bidder
will notify the employer, within 21 days and provide a
forecast cost of the compensation event.
n. If a compensation event would cause additional cost
or would prevent the work being completed before the
intended completion date, the contract price shall be
increased and/or the intended completion date shall
be extended. The Engineer-in-charge or his nominee
shall decide whether and by how much the contract
price shall be increased and whether and by how
much the intended completion date shall be
extended.
IV. As soon as information demonstrating the effect of
each compensation event upon the Bidder’s forecast
cost has been provided by the Bidder, it is to be
assessed by The Engineer-in-charge or his nominee
and the contract price shall be adjusted accordingly.

If the Bidder’s forecast is deemed unreasonable, the
Engineer-in-charge or his nominee shall adjust the
contract price based on the Engineer-in-charge or his
nominee’s own forecast. The Engineer-in-charge or
his nominee will assume that the Bidder will react
competently and promptly to the event.
19. Arbitration In the event of any question or dispute arising out of
the conditions of this contract or the interpretation
thereof the same shall be referred to the award of two
arbitrators, one to be appointed by the employer and
the other by Bidder. The arbitrator shall appoint an
umpire. The decision of the arbitrators or in the event
of their not reaching an agreement, the decision of
the umpire shall be final and conclusive. The
arbitration proceedings shall be governed by the
provisions of law of the Indian arbitration and
Conciliation Act, 1996 or any Re-enactments or
statutory modifications thereof for the time being in
force. The venue of arbitration shall be at Agartala.

20. Termination of
contract
The employer or the Bidder may terminate the
contract if the other party causes a fundamental
breach of the contract.
Fundamental breaches of contract include, but shall
not be limited to the following:
a. The Bidder stops works for 15 days when no
stoppage of work is shown on the current
programmed and the stoppage has not been
authorized by the Engineer-in-charge or his nominee.
b. The Engineer-in-charge or his nominee
instructs the Bidder for delaying the progress of the
works and the instruction is not withdrawn within
15 days.
c. The employer or the Bidder becomes bankrupt
or goes into liquidation other than for a
reconstruction restructure or amalgamation.
d. The Bidder does not maintain a security which
is required.

e. The Engineer-in-charge or his nominee gives
notice that failure to correct a particular defect is a
fundamental breach of contract and the Bidder fails
to correct it within a reasonable period of time
determined by The Engineer-in-charge or his
nominee.
f) The Bidder has delayed the completion of
works by the number of days for which the
maximum amount of liquidated damages can be paid
as defined in the contract data.
g) If the Bidder, in the judgment of the employer
has engaged in corrupt or fraudulent practices in
competing for or in the executing the contract.
h) When either party to the contract gives notice
of a breach of contract to the Engineer-in-charge or
his nominee for a cause other than those listed
above, the Engineer-in-charge or his nominee shall
decide whether the breach is fundamental or not.
i) Notwithstanding the above, the employer may
terminate the contract for convenience subject to

payment of compensation to the Bidder including
loss of profit on uncompleted works. Loss of profit
shall be calculated on the same basis as adopted for
calculation of extra/additional items.
j) If the contract is terminated the Bidder shall
stop work immediately, make the site safe and secure
and leave the site as soon as reasonably possible.
k) If the contract is terminated because of a
fundamental breach of contract by the Bidder, The
Engineer-in-charge or his nominee shall issue a
certificate for the value of the work done less advance
payments received upto the date of the issue of the
certificate, less other recoveries due in terms of the
contract, less taxes due to be deducted at source as
per applicable law and less the percentage to apply to
the work not completed as indicated in the contract
data. Additional liquidated damages shall not apply.
If the total amount due to the employer exceeds any
payment due to the Bidder, the difference shall be a
debt payable to the employer.
l) If the contract is terminated at the employer
convenience or because of a fundamental breach of

contract by the employer, the Engineer-in-charge or
his nominee shall issue a certificate for the value of
the work done, the reasonable cost of removal of
equipment repatriation of the Bidder’s personnel
employed solely on the works, and the Bidder’s costs
of protecting and securing the works and loss of
profit on uncompleted works less advance payments
received up to the date of the certificate, less other
recoveries due in terms of the contract and less taxes
due to be deducted at source as per applicable law.
21. Quality control I. There shall be third party quality monitor- one or
more, to be engaged by the Tripura Urban Planning
& Development authority, for quality assurance. They
/ he will act as authorize nominee of the TUDA for
such all purposes. Bidder shall be binding with it.
II. The Engineer-in-charge or his nominee shall check
the Bidder’s work and notify the Bidder of any defect
later found. Such checking shall not affect the
Bidder’s responsibilities. The Engineer-in-charge or
his nominee may instruct the Bidder to search for a
defect and to uncover and test any work that the
Engineer-in-charge or his nominee considers may
have a defect.
III. If the Engineer-in-charge or his nominee instructs
the Bidder to carry out a test not specified in the
specification to check whether any work has a defect
and the test shows that it does the Bidder shall pay
for the test and any samples. If there is no defect the
test shall be a compensation event.

IV. The Engineer-in-charge or his nominee shall give
notice to the Bidder of any defects before the end of
the defects liability period, which begins at
completion. The defects liability period shall be
extended for as long as defects remain to be
corrected.
V. Every time notice of a defect as given to the Bidder
shall have to attend to rectify the notified defect
within the length of time specified by the Engineer-in-
charge or his nominee’s notice.
VI. If the Bidder has not corrected a defect within the
time specified by the Engineer-in-charge or his
nominee’s notice the Engineer-in-charge or his
nominee we will assessed the cost of having the
defect corrected, and the Bidder will pay this amount.
22. Cost control Lump sum turnkey basis.
Payments will be based on payment schedule.
23. Time control
a. The total completion time shall be 24 months
w.e.f the date of commencement of work.
b. Bidder should submit bar chart within 15 days
from the issuing of LOA.
c. Within the time stated in the contract data the
Bidder shall submit to the Engineer-in-charge
or his nominee for approval a programme

showing the general methods, arrangements,
order and timing for all the activities in the
work along with monthly cash flow forecast.
II. An update of the programmed shall be a programme
showing the actual progress achieved on each activity
and the effect of the progress achieved on timing of
the remaining work including any changes to the
subsequence of the activities.
III. The Bidder shall submit to the Engineer-in-charge or
his nominee, for approval and updated programme at
intervals no longer than the period stated in the
contract data. If the Bidder does not submit an
updated programme within this period, the Engineer-
in-charge or his nominee may withhold amount
stated in the contract data from the next payment
certificate and continue to withhold this amount until
the next payment after the date on which the over
view programme has been submitted.
IV. The Engineer-in-charge or his nominee approval of
the programme shall not alter the Bidder’s
obligations.

V. The Bidder may revised the programme and submit it
to the Engineer-in-charge or his nominee again at
any time. A revised programme is to show the effect
of variations and compensation events.
VI. Bidder should submit Monthly and quarterly
progress report to TUDA.
24. Specifications As mentioned under Scope of Work
25. Vetting of Structural
analysis, design and
drawing
Structural analysis and design details shall be got
vetted by the department/ TUDA/ NIT Agartala or any
referral Engineering institute/3rd party appointed
from TUDA as will be decided by TUDA. prior to
commencement of work. Necessary charges will be
paid by the bidder. Necessary cost for getting the
vetting shall be paid by the bidder.
26. Dismantling of
structures , if any, in
the specified area of
proposed
construction(s)
Specification for these works should be followed as
per “Technical specifications for Civil, Structural &
Architectural Works”. However, an amount equal to
the approved RESERVE VALUE of the dismantled
structure will be recovered from the Bidder in the
form of Demand Draft, which will be submitted to the

27. Alternation of the
scope of the work
The employer may reserves the right to
change/modify/curtail/enhance the spatial and
functional requirement of the proposed residential
building at any time or stage of progress of the
tendering, awarding or implementation process,
without assigning any reason whatsoever for the same
and which the bidders/ Bidder(s) / agency/agencies
shall be bound to abide by without thus being entitled
to any kind of extra payment or facility whatsoever. In
case of curtailment of work in Built-up-Area at
awarding / post-award/ execution stages, the
payment to the Bidder shall be proportionately
reduced in line with the reduced volume of work. No
kind of compensation or any other charges shall be
allowed in this regard.
28. Materials Best quality materials should be used and the said
should be approved by Tripura Urban Planning &
Development authority with consultation with buyers.
The bidder shall take prior approval from TUDA
regarding the quality of material to be used in the
construction.
29. Site visit The Bidder is advised to visit the site of work, at his
own cost and examine it & its surroundings by
himself & collect all informations that he considers
necessary for proper assessment of the prospective

assignment and for quoting his rates judiciously.
30 External
Electrification
The successful bidder will make necessary
arrangement for the required external electrification
system with the construction of electrical sub –
station, installation of transformer, ST/LT line etc
considering total electrical install capacity of 3 times
of the forecast requirement ( for future expansion) and
shall obtain necessary connection from Tripura State
Electricity Corporation (TSECL). The bidder shall also
make arrangement of street lighting in the complex in
the befitting manner.

18. Technical Specification for approach road, Water
supply arrangement etc
1. Internal Road:- PWD blacktop road is already available upto the work site. If
further approaches at the site are required for moving plants/materials/
machineries etc. that may be made by the bidder with their own cost. Internal road
within the project complex shall be made with pavers block/tiles as prescribed and
as will be approved from TUDA.
Internal road will need to be made starting from entrance gate to the entry of the
Township building along with necessary access for movement of vehicles and
habitants for car parking as will be approved from TUDA.
2. Creation of water source:-
i) Deep tube well (300 mm x 200 mm) is required to be installed in required depth
with minimum 120 ft-150ft strainer. There may be requirement of multiple unit
based on the available output of deep tube well in terms of discharge availability.
ii) Submersible pump should be installed of 5000 gallon/ hr capacity or 3000
gallon/ hr capacity in the site or as per design and need as will be approved from
TUDA, as it will be of reputed make with all necessary electrical accessories
including kiosk box of required size for fitting & fixing of electrical accessories
inside the kiosk box and permanent provision for lowering & lifting arrangement of
pump as per direction of Engineer-in-charge. Necessary iron removal plant (IRP-
modified type) shall be attached with the above tube well as per direction of
Engineer in charge.
iii) Latest technology for treatment of underground water should be used.
iv) RCC Underground reservoir of 2.50 lakh ltr. Capacity or as per the design
requirement as the case may be.

v) Hydro-pneumatic pump of approved make or any other suitable devices as per
standard design and practice.
vi) Pipe line for delivery of water to underground water tank should be DI pipe of
requisite diameter as per design and for lifting of water from underground tank to
supply point should be UPVC of best quality and standard as will be approved from
TUDA.

with this document only for reference of the bidders. The successful bidder(s) shall
compulsorily propose their own comprehensive and exhaustive detailed outdoor/indoor
and allied Design Package complete with civil, electrical, mechanical works,
miscellaneous items like public utilities, Earthquake, Disaster & Fire safety measures,
services etc. and all other necessary allied inputs required for preparing their best offer

20. ADDITIONAL INFORMATION TO BIDDERS
The following additional terms & conditions are also acceptable to the Employer. The
bidders are requested not to quote any additional conditions in their tender.
1. TIME
1.1 The time and the date of completion of the works is stipulated to be 24 (twenty four)
months and shall be the essence of the contract. The Bidder shall so organize his
resource, workout programme and perform his work as to complete it not later than the
date agreed to.
1.2 The successful Bidder shall submit a detailed PERT network within the stipulated
time frame as above consisting of adequate number of activities covering various key
phases of the works such as design procurement manufacturing, and field erection
activities within ten (10) days after the date of acceptance of tender. This network shall
also indicate the interface facilities to be provided by the owner and the dates by which
such facilities are needed. Bidder shall discuss the network so submitted with the
Employer and the agreed network which may be in the form as submitted or in revised
form in line with the outcome of discussions and shall form part of the contract to be
signed within fifteen (15) days from the date issue of letter of acceptance of notice
of award of contract. During the performance of contract, if proper progress is not
maintained, in the opinion of the Engineer-in-Charge suitable changes shall be made in
the Bidder's operations to ensure proper progress.
1.3 The above PERT network shall be reviewed and periodic review reports shall be
submitted by the Bidder as directed by the Engineer-in-Charge.
2.0 CONTRACT PRICE/RATE
The prices quoted by the Bidder in his bid, as may be agreed before signing of the
contract, for the entire scope of the work covered under the specifications and documents
shall be treated as the contract price.

3.0 Commencement of Work, Progress of work and Completion:
The date of commencement of work will be reckoned from the 15th day of issue of Letter
of Acceptance or signing of the Agreement or handing over of complete site, whichever is
later. Following scheduled shall be followed
i. Submission of Design and Drawing of Structural parts of sub-structure and super-
structure within 21 days from the LoA issuing date.
ii. Detailed Drawing of service amenities within 30 days from the LoA issuing date.
iii. Mobilization and placement of Man and Machineries within 25 days from the LoA
issuing date.
iv. Physical starting of work in Foundation within 30 days from the LoA issuing date.
v. Completion of Building works including all amenities and services within 24 months
w.e.f. date of issuing LoA.
4.0 PROGRESS REPORTS AND PHOTOGRAPHS
During the various stages of the works in the pursuance of the contract, the Bidder shall
at his own cost submit periodic progress reports as may be reasonably required by the
Engineer-in-Charge with such materials as charts net-works, photographs, test
certificates, etc. such progress report shall be in the form and size as may be required by
the Engineer-in-Charge and shall be submitted in at least three (3) copies.
5.0 Signature and Stamp
Every page of Bid document (Front and reverse of all pages) shall be duly signed by the
Bidder with Stamp and seal. If any blank pages are there in the Tender document that
shall be marked as “BLANKED PAGE” and signed by the bidder.
