Background

On 13 July 2009, in Kwun Tong Bypass- Used civilian vehicles to form road block to

stop > 14 illegal road racers

- 8 people injured- *No police officer told drivers of civilian

vehicles what was going on

On 14 July, police chief apologized “Error of judgment in the operation” “Would review their procedures” In Sept., I.P.C.C. & LegCo. looked into

the matter respectively.

Our Observation and Opinion I

Anti-illegal Road Racing Policy of HKPF

Guiding Principles: “the safety of both innocent members of the public and police officers are the most importance”

A decision that violates the Policy !!!

Problem A

Chapter 41 paragraph 6 of Force Procedures Manual (“FPM”) of HKPF:

In short, only marked police vehicles can form roadblock.

A practice that violates the Manual / Guidelines !!!

Problem ADid they read the Policy & Manual / Guidelines? Why they don’t follow?

Our Observation and Opinion II

Section 63 of Police Force Ordinance (Cap 232):

“Police had the right to request any person to assist police officer for prevention of crime, but the person who can refuse the request if it is hazardous to their lives.”

Cap 232 S.54:

Police officer was empowered to stop, detain and search and persons on car.

Problem BIs the power of police too big? Is it providing room

for police to abuse its power?

Our Observation and Opinion III

Raise public awareness on the seriousness of the illegal car racing problem.

The follow up action carried out by If HKPF, IPCC and LegCo might re-heat the above public awareness.

If police does no respond to the awareness positively and immediately, may cause PR crisis.

Remedies by Police

To clearly specify the Policy Guiding Principle that in all relevant orders and instructions or direction;

To issue a Commissioner’s Order on illegal road racing to ensure standardization and best practice of the relative policy; and

To review roadblocks issues by forming a working group.

To guarantee that they will continue to take stringent enforcement action to the illegal road racers.

Providing more simulation practical trainings of fighting street racing to frontline traffic police

Educating public and warning street racers

Conducting surveillance of the street racing

Conclusion

We don’t deal with problem which involves professional judgment or legislative issue .

This incident review aims to find out and to cope with are (i) the policy enforcement problem (i.e problem A and C); and (ii) the limitation of the remedies.

We hope this review would (i) stimulate more different thought angles; and (ii) contribute to the relative review action which will be

carried out in future.
