E1. Price Firmness and Price Risk Project Name: ___________________________________________ Evaluated By: ___________________________________________ Weight: ___________________________________________ This factor address the extent to which the price offered is firm, contains cost containment provisions for cost of service transmission projects, or proposes purely cost-of-service pricing. It also addresses price risk. Price firmness and price risk will be evaluated from the perspective of total bid costs. A bid may be for generation only under a PPA, it may be for both generation under a PPA and for transmission, and it may be for transmission only under the Delivery Commitment Model. It is expected that generation costs under a PPA will be fixed. Bids to recover the transmission costs may vary from fixed charges to cost-of-service proposals with cost containment provisions, to purely cost-of-service proposals. In addition, the degree of price risk (costs varying from the estimates) may vary significantly among transmission bids, the risk may vary in terms of its symmetry or asymmetry (or degree thereof), and the extent to which the cost risk is effectively managed by proposed cost containment provisions may vary significantly among bids. Finally, bidder plans and capability to manage costs may differ among proposals. The purpose of this non-price evaluation criteria is to capture the degree of risk that costs to customers may vary from costs evaluated in the quantitative evaluation. Because there are many interacting factors an Independent Transmission Cost Consultant (ITCC) will be hired and relied upon for assistance in determining scores in this area. The ITCC will determine the expected capital cost of the transmission component of a bid (which may be the bidder’s estimate, which the ITCC determines is reasonable for use in the quantitative evaluation, or the ITCC’s own estimate, as applicable). The ITCC will also determine a reasonable range of what actual costs might be compared to expected costs, with the high side of the range that may be based, at least in part, on the cost containment provisions in a transmission component of a bid and the effectiveness of such cost containment provisions. In addition, the ITCC will assign a percentage risk factor to each transmission bid or transmission component to a bid to take into consideration the degree of risk associated with the bid in terms of the actual costs being higher than expected costs (taking into consideration the risk of costs being higher and the magnitude of such higher costs). The Evaluation Team will assign points based upon the results of the ITCC’s work as described.

F1. Exceptions to Contract/PPA/Tariff: Risk Allocation Other than Risks Associated with Costs Exceeding Estimates Project Name: ___________________________________________ Evaluated By: ___________________________________________ Weight: ___________________________________________ For generation proposals, this factor addresses the extent to which bidders accept provisions of the PPA. Bidders who propose material changes to the PPA that would significantly and adversely change the risk allocation in the PPA to the detriment of the buyers and their customers will not be highly evaluated. For transmission projects, this factor addresses the extent to which the transmission tariff and service agreement (and/or other contract documents) protects EDCs and their customers from risks such as delays, lower than expected capacity, lower than expected energy deliveries, change in law, force majeure and other matters addressed in the Pro Forma PPA or otherwise relevant to transmission proposals.
