60% of the amount worked for deployment quality shall be periodic and shall be released from month to month. Balance 40% payment shall be payable at every 10% percentage progress of individual projects in proportion to Estimate cost and shall be paid without any interest

Payment related to progress normally hampers the cash flow of the consultant due to no fault of theirs. As the Employers engineer, we will do our best to make sure the contractors deliver the projects are per schedule. It is requested to relax this clause by increasing the percentage payment for deployment to 90% and balance 10% may be linked with the contractors work progress

He might have completed his work/assignment/tenure but still his payment will not be made due to this issue.

2. Out of total 7 projects, 4 are yet to be awarded and 3 are under construction. As per present RFP terms, payment of O&M services will be made 100% (Refer clause 6.2 (vi) page no. 26, while construction stage payment will be made (60% on monthly basis and 40% with progress). As per the staggered project schedule given in RFP, few projects will be under O&M and others will be under construction, then how payment of O&M stage will be made for these projects for 100% deployment until and unless there are clear guidelines of individual staff requirement/input requirement for individual project, so that there is no issue in payment.

In view of all these practical difficulties, it is suggested that payment should be made as per deployment rather than linked with progress. It will also affect cash flow of consultant severely and un- necessary financial loading. Further, consultant has to quote man month basis rates as the financial proposal is man month based, hence by partially linking it with progress, it is only deferred payment affecting cash flow and extra cost loading only while no financial advantage to DICDL. Hence we request the payment to the consultant shall be based on site deployment and on monthly basis, without linking with progress. 100 18 5.4 Services, Facilities and Property of the Client

The office space will be provided to Employer’s Engineer of approximately 230 square meters in ABCD building, Dholera. The nominal rent including electricity and water will be charged by DICDL as per company policy. The rent will be informed to Employer’s Engineer at a later date. Employer’s Engineer shall pay rent to DICDL on monthly basis in advance and the same will be reimbursed to Employer’s Engineer in their bills.

Since it is mentioned that nominal rent includes Electricity and water. Further it is mentioned that office rent will be reimbursed by client. Hence we understand that office rent including electricity and water will be reimbursed by client. Pl confirm. You are also requested to inform the rent. However, we suggest that the entire process of paying rent to Employer by Consultant and subsequently reimbursement process leads to unnecessary and more tedious work, TDS/GST inclusion process is more complicated in nature. According to ITC Page 5 of RFP, the different work packages under New Construction works and ongoing construction works have different completion date and subsequently each package will have different DLP start date and DLP end date and some projects DLP date will overlap also. Therefore to segregate payment based on monthly basis and financial percentage linked progress considering simultaneously for all running packages having different stage of ongoing, completion, DLP time, consultant cannot be penalized. Therefore, we request the payment to consultant be considered on monthly basis considering the fact that the financial proposal is also submitted based on man month basis.

Sometime person is travelling for office work, meeting to Gandhinagar or inspection of equipment/material and returning late night or departing early morning. 109 Clause 3.13 It is mentioned that in case of delay by contractors in achieving mile stones, Employer’s Engineer will be paid only 60% of rates during extended contract period.

Now as per this clause this will be additional penalty on Consultant where there is no fault of Consultant.

In order to avoid such penalty, Employer’s Engineer will have a tendency to return invoices on flimsy reasons or there will be chances of any error due to limited staff and only one Sr. QS Engineer for 7 packages which is highly insufficient to work at a time simultaneously. 111 Clause 3.16, Delay in approval of drawings/designs

It is proposed to levy a penalty of Rs. 5000 per event of delay in processing of drawings after certain time period.

125 Payment terms as mentioned in RFP state that payment will be made in 2 parts i.e. 60% payment will be monthly and balance 40% payments shall be payable at every 10 % percentage progress of individual projects. We request you to kindly change the payment terms as under - 90% monthly payment shall be released once we submit the monthly RA Bill and balance 10% can be released as per project progress.
