RESOLUTION NO. ZR-2012-015 RESOLUTION APPROVING ZONING APPLICATION ZV-2012-00981 CONTROL NO. 2006-00550 TYPE II VARIANCE (STANO ALONE) APPLICATION OF Boynton Beach Associates XXIII LLLP BY Urban Design Kilday Studios, AGENT (TRAILS AT CANYON AGR PUD) WHEREAS, the Palm Beach County Zoning Commission, pursuant to Article 2 (Development Review Procedures) of the Palm Beach County Unified Land Development Code (Ordinance 2003-067, as amended) is authorized and empowered to consider, approve, approve with conditions or deny a Type II Variance; and WHEREAS, the notice and hearing requirements, as provided for in Article 2 of the Palm Beach County Unified Land Development Code, have been satisfied; and WHEREAS, Zoning Application ZV-2012-00981 was presented to the Zoning Commission at a public hearing conducted on June 7, 2012; and WHEREAS, the Zoning Commission considered the evidence and testimony presented by the applicant and other interested parties, and the recommendations of the various county review agencies; and WHEREAS, this approval is subject to Article 2.E of the Palm Beach County Unified Land Development Code and other provisions requiring that development commence in a timely manner; and WHEREAS, the Zoning Commission hereby finds that the Zoning application meets all the standards contained in Article 2.B.3.E; and WHEREAS, Article 2.A.1.K.3 (Board Action) of the Palm Beach County Unified Land Development Code requires that the action of the Zoning Commission be adopted by resolution . NOW, THEREFORE, BE IT RESOLVED BY THE ZONING COMMISSION OF PALM BEACH COUNTY, FLORIDA, that Zoning Application ZV-2012-00981, the application of Boynton Beach Associates XXIII LLLP, by Urban Design Kilday Studios, agent, for a Type II Variance to allow an increase in building coverage for single story single-family units within Pods D and E of the Trails at Canyon Agricultural Reserve- Planned Unit Development (AGR-PUD), on a parcel of land legally described in EXHIBIT A, attached hereto and made a part hereof, and generally located as shown on a vicinity sketch as indicated in EXHIBIT B, attached hereto and made a part hereof, was approved on June 7, 2012, subject to the conditions of approval described in EXHIBIT C, attached hereto and made a part hereof, and variance request as described in EXHIBIT D, attached hereto and made a part hereof. TYPE II VARIANCE (STANO ALONE) APPLICATION OF Boynton Beach Associates XXIII LLLP

WHEREAS, the Palm Beach County Zoning Commission, pursuant to Article 2 (Development Review Procedures) of the Palm Beach County Unified Land Development Code (Ordinance 2003-067, as amended) is authorized and empowered to consider, approve, approve with conditions or deny a Type II Variance; and

CONDITIONS OF APPROVAL

VARIANCE 1. This Variance was approved based on the layout of the approved Final Master Plan dated April 18, 2012. (ONGOING: BLDG - Bldg) 2. The Develpment Order for this variance shall be tied to the Time Limitations of the Development Order for EAC-2010-2807. (ONGOING: MONITORING - Zoning) 3. Single family residential units that exceed the maximum building coverage permitted pursuant to this variance approval shall be limited to one-story and shall be located in Pods D and E only. (ONGOING / BLDG PERMIT: ZONING Zoning) 4. Within thirty (30) days of this approval the Final Master Plan and Final Subdivision Plans for Plat 5 and 6 will be updated to reflect the Variance approval granted herein. (DATE: ZONING – Zoning 5. This variance is not applicable to any building permit application increasing building coverage in Pods A, B, C and F. (ONGOING: BLDG - Zoning) 6. Prior to issuance of a Building Permit, for each lot utilizing the increased building coverage, a Landscape Plan must be submitted for review and approval showing the required trees. Each lot requires one tree per each 800 square feet of gross lot area. (BLDG PERMIT: BLDG – Landscape) 7. In granting this approval, the Zoning Commission relied upon the oral and written representations of the property owner/applicant both on the record and as part of the application process. Referral to code enforcement; and/or e. Imposition of entitlement density or intensity. Staff may be directed by the Executive Director of PZ&B or the Code Enforcement Special Master to schedule a Status Report before the body which approved the Official Zoning Map Amendment, Conditional Use, Requested Use, Development Order Amendment, and/or other zoning approval, in accordance with the provisions of Section 2.E of the ULDC, in response to any flagrant violation and/or continued violation of any condition of approval.
