In exercise the power under sub-section (9) of section 40 of the Bye-
Laws of Residents Welfare Association, AWHO Township, Gurjinder Vihar,
Greater Noida (hereafter called RWA Gurjinder Vihar), the General Body of
RWA Gurjinder Vihar makes the following Rules for its Community Club called
Gurjinder Vihar Army Institute.

RULE OF
GURJINDER VIHAR ARMY INSTITUTE
1. Preview. The buildings of Community Hall cum library No 2 and Community
Hall No 1 were designed and constructed as part of AWHO project of Greater
Noida with an aim of creating a recreational and social hub of the Township.
The AWHO Township having acquired the revered name of “Gurjinder Vihar”,
the club was named as “Gurjinder Vihar Army Institute (GVAI)”. The Institute
was made functional in August 2013 with a scope of developing the same to
fully grown club with streamlined rules and procedures for its efficient
management and maintenance.
2. Name of Institute. The name of institute shall be the Residents Welfare
Association, Gurjinder Vihar Army Institute. The name, in short, may be
called Gurjinder Vihar Army Institute (GVAI).
3. Definitions. In these Rules, unless the context otherwise requires:
(a) ‘GVGN’ term stands for “GURJINDER VIHAR, GREATER NOIDA” and
covers the entire AWHO Township consisting of 2822 dwelling units
(b) ‘Institute’ shall mean “GURJINDER VIHAR ARMY INSTITUTE” (GVAI) and
all complexes as may be set up by the Institute.
(c) ‘Rules’ wherever it appears means the rules and regulations of the
GVAI duly ratified by the General Body of the RWA, Gurjinder Vihar and
published.
(d) 'Management Committee’ means the Management Committee of
GVAI consisting of Four members including President of RWA Gurjinder
Vihar as ex-officio Chairman, Secretary (Elected member), member
Activities (Elected member), Member Finance and Property (appointed
member from Board of Management of RWA, Gurjinder Vihar). The
elected members Management Committee shall be the owners of
apartments in the AWHO Township, Gurjinder Vihar and resident
(Active) members of GVAI.
(e) 'Owners' or 'Apartment owners' means the person owning an
apartment in the AWHO Township, Gurjinder Vihar.
(f) ‘Member’ means member of GVAI.
(g) ‘Dependent Children’ shall mean son below 21 years of age and
unemployed divorcee/ unmarried/widowed daughter irrespective of
their age when living with parents.
(h) ‘Non-Dependent children’ the son/married daughter above 21 years of
age when living with parents.
(i) ‘Guest’ shall mean any person, not being a member, validly introduced
by a member for temporary use of any of the facilities of the Institute,
subject to such terms, conditions or restrictions as laid down from time
to time.
(j) ‘Family’ shall mean spouse, children and parents as declared by the
member.
(k) Unbecoming Conduct” includes, in addition to the dictionary meaning
and as established by the decisions of the Court of Law, the following:
(i) Misuse of Institute property, facilities and privileges.
(ii) Causing loss to the Institute with a view to gain for self, relatives
or friends.
(iii) Maliciously tarnishing the image of a fellow member or the
members of the Management Committee of RWA, Management
Committee of GVAI etc. within the Institute premises.
(iv) False accusations against the staff and/or members of the
Management Committee of RWA, Management Committee of
GVAI etc.
(v) Any act or omission, unbecoming of a member.
(vi) Moral turpitude.
4. Objective of GVAI. The objects for which the GVAI is founded are;
(a) To provide and afford to its members facilities, amenities, privileges,
comforts and conveniences as are normally provided in a Community
Club.
(b) To associate the activities of the GVAI with other institutions, clubs,
associations, societies within Greater Noida.
(c) To organise and arrange activities, functions, meets and seminars in
furtherance of the interest of GVAI members.
(d) Provide platform for expression and exhibition of skills.
(e) To do all such other lawful things, as are incidental or conducive to the
attainment of the above objects.
Concept
5. The GVAI is a sub set of RWA Gurjinder Vihar and hence, shall function under
the umbrella of Board of Management RWA Gurjinder Vihar. The buildings of
Community Hall cum library No 2 and Community Hall No 1 shall be used for
activities of GVAI members. However, the revenue generated through both
these buildings, being common facilities of RWA Gurjinder Vihar, shall be
credited to the accounts of RWA Gurjinder Vihar. The Board of Management
RWA Gurjinder Vihar shall provide central support viz. development,
maintenance and repair of its infrastructure. It shall function on “no profit no
loss” basis.
6. The Gurjinder Vihar Army Institute (GVAI) is an institute for all DU owners of
GVGN. Although all DU owners will be de-jure ‘Permanent Member’ of GVAI,
the status of “Active Resident Membership” will be granted to only those
who pay refundable Security Deposit and monthly facilities-maintenance
charges to avail all facilities of GVAI. The remaining ‘Permanent Member’ will
have the status of “Dormant Resident Members” and can participate in
special GVAI events notified from time-to-time by paying entry fee.
Membership of GVAI.
7. The individuals who are admitted in accordance with these rules and
regulations shall be the members of GVAI. The number of members at any
time may not exceed 3220. However, the ceiling on the number of members
may be revised by the General Body of the GVAI Association, from time to
time.
8. Eligibility for Membership.
(a) All those who own Apartment in AWHO Township, Gurjinder Vihar or
others as given in these Rules under various categories of
memberships. The eligibility for the membership of the GVAI, other
than apartment owners, shall be on recommendation of the screening
committee detailed by the Ex-Officio Chairman GVAI.
(b) Minimum age for eligibility for membership of the GVAI, will be 21
years.
(c) The permanent Membership of the GVAI is restricted to the Apartment
Owners only.
(d) This membership is non-transferable. However, in the case of demise of
the member of RWA Gurjinder Vihar, it may be transferred to the legal
heir if he/she applies in writing.
9. Categories of Membership.
(a) Permanent Member. All those who own Apartment in the AWHO
Township, Gurjinder Vihar are permanent members of GVAI provided
they fulfil all other conditions laid down in Rule 8 above. A permanent
member shall lose his/ her right of membership if he loses the
ownership of his property whether by sale, transfer or otherwise. The
permanent members of GVAI shall be of two types as given below:
(i) Resident Members (Active). All those apartment owners who
wish to avail GVAI facilities shall pay refundable security of Rs.
5000/- to become Resident member (Active) of GVAI. In
addition, they shall also pay a monthly facilities-maintenance
charges of Rs. 200/- (or as decided by the RWA General Body
from time to time).
(ii) Resident Members (Dormant). The apartment owners who do
not wish to become Resident members (Active) of GVAI for any
reasons; they will neither pay any refundable security nor any
monthly facilities-maintenance charges for becoming Resident
Members (Dormant). However, they can use GVAI facilities, if so
desired by paying facilities-maintenance charges as laid down
from time to time.
(b) Associate Members (AM). Defence personnel from Army/Air
Force/Navy who do not own Apartment in AWHO Township Gurjinder
Vihar but are permanent residents of Greater Noida may be admitted,
on request, as an Associate Member on payment of non-refundable
entry fees of Rs.10000/- (Rupees Ten Thousand Only) and refundable
security deposit of Rs.10000/- (Rupees Ten Thousand Only) or as fixed
by the General Body of RWA Gurjinder Vihar. In addition, they shall also
pay monthly maintenance charges of Rs. 500/- or as laid down by the
General Body of RWA Gurjinder Vihar from time to time. The number
of such members shall not exceed 100 with a stipulation that any
person from outside the Greater Noida Township shall not be made a
member of GVAI. They shall be made associate members provided:
(i) They submit a Photostat copy of their permanent residential
proof which should be of Greater Noida.
(ii) They fulfil all other conditions laid down in Rule 8 above.
(c) Outstation Member. All Resident Members (Active) can opt for
outstation membership in case they are likely to be out of NCR region
for a continuous period of 90 days or more. Member seeking outstation
membership will deposit their membership cards including that of
spouse and Dependents with the Secretary GVAI or an officer
nominated for administration and obtain a receipt to that effect. On re-
joining, the member will be given back his original cards. The
Outstation Member and his family while on a visit to Gurjinder Vihar/
NCR for duration of less than 30 days may avail all GVAI facilities as
available to any other Resident Member (Active). The monthly
facilities-maintenance charges of Rs. 100/- for the Outstation
Membership.
(d) Casual Member (CM). Any blood relation of Resident members during
his stay in AWHO Township Gurjinder Vihar may, on being duly
proposed by the Resident member, be admitted by the Management
Committee as a casual member. A casual member shall not be required
to pay any refundable security but shall pay in advance a facilities-
maintenance charges at the rate which may be fixed by the General
Body of RWA Gurjinder Vihar from time to time. The proposer shall be
responsible for all sums due to the GVAI from the Casual member. They
shall be issued entry passes.
(i) Green-Card-Holder Member (GCHM). After attaining the age of 21
years the Non-dependent children only of the permanent member
may apply to become a Green-Card-Holder member of the GVAI.
They shall be permitted to use the GVAI on payment of the current
monthly facilities-maintenance charges applicable for Resident
members. GCHM shall pay refundable security of Rs. 5000/- in case
it has not earlier been paid by the permanent member.
(ii) The Dependent Children. The dependent children shall be issued
dependent cards by Secretary GVAI and shall be permitted to use
GVAI amenities free of charge while accompany the eligible
member. However, they shall not have access to the bar, card
rooms and such other places as may be mentioned in the GVAI Bye-
Laws.
(e) Guest Members. The Resident Member (Active) Associate Members
and Green-Card-Holder members may bring their guests to GVAI by
paying the laid down charges.
10. Application for Membership.
(a) The application for enrolment as a Resident member (Active) and
Green-Card-Holding member shall be made on a form issued by GVAI
without any payment. However, the individual shall deposit a
refundable amount of Rs.5000/- with their applications. The
applications for Green-Card-Holder Membership shall be sponsored by
the members of their non-dependent children. They shall also pay
Rs.5000/- as refundable security if not paid earlier by the member of
the non-dependent children. The Management Committee of GVAI
shall not refuse any DU owner's admission as a Resident member
(Active) of GVAI.
(b) The applications of Resident Member (Active) and Green-Card-Holder
shall be signed by GVAI Secretary and counter signed be the Chairman.
There shall no interview for them.
(c) The application for enrolment as an Associate member of GVAI shall be
made on a form issued by GVAI by paying Rs 100/- (one hundred only)
non-refundable. It shall be accompanied by a cheque for Rs.10000/-
which shall be adjusted against entry fee on grant of membership
otherwise it shall be refunded.
(d) The Management Committee of GVAI shall have absolute discretion to
refuse any person's admission as an Associate member of GVAI without
assigning any reason.
(e) All proposals for Associate membership received by the Secretary shall
be serially entered in a register and those candidates considered
eligible for membership, their particulars will be displayed on GVAI
Notice Board for at least 7 days before the date of interview
(f) The Management Committee GVAI will interview the candidates
apparently eligible for admission as Associate members before granting
membership of GVAI. The applications of the selected candidates shall
be signed by the Secretary and countersigned by the Chairman of GVAI.
11. Register of Membership. A register of members shall be maintained by
Secretary GVAI in which the names, type of membership, addresses, contact
number and other particular of every member of GVAI shall be entered.
12. Termination of Membership. A member shall cease to be a member of GVAI:-
(a) On his/her demise.
(b) On written request submitted by a member indicating his/her intention
to withdraw from the GVAI membership.
(c) On sale of his/her Dwelling Unit by a member of RWA Gurjinder Vihar.
13. Disqualification. No Resident Member shall be eligble to contest election
for GVAI Management Committee, if he/she is in arrears, of any sum due from
him in respect of RWA Gurjinder Vihar or GVAI provided such dues are more
than 30 days older on the day of elections.
Management of GVAI.
14. The affairs of GVAI shall be managed and administered by the Management
Committee in accordance with the aims and objects of GVAI and the
directions of RWA Gurjinder Vihar. The GVAI Management Committee shall be
elected by secret ballot from amongst eligible Resident members (Active) of
GVAI.
15. The Management Committee of GVAI. The Management Committee shall
consist of the following members in accordance with these rules.
Chairman - 1 (Ex officio President RWA)
Secretary - 1 (one) Elected
GVAI Activities Member - 1 (one) Elected
Member Finance & property - 1* (one)
*Nominated member of RWA Management Board
Election and Term of Management Committee. The Election of GVAI
Management Committee shall be held along with elections for the Board of
Management of RWA to elect Secretary and Member Activities. Provided that no
member shall be eligible for election if he has been found guilty of misusing the
post during any of his previous terms of Board of Management of RWA Gurjinder
Vihar and Management Committee of GVAI.
16. The term of GVAI Management Committee shall be of one year from the date
of assuming the office. However, the Management Committee members shall
hold office until their successors have been elected and hold their first
meeting. No elected member of the Management Committee shall hold the
office for more than two consecutive terms and no elected member of the
Management Committee shall have more than four terms in aggregate.
17. The applicant aspiring to be a member of the Management Committee should
have been a Resident Member (Active) of the Club for at least two years with
an unblemished record.
18. The member from the Board of Management RWA, AWHO, Gurjinder Vihar
nominated by the President RWA should preferably be a Resident Member
(Active) who shall be part of GVAI Management Committee and shall have full
rights of a member of the Management Committee GVAI and shall have the
right to vote during decision making of GVAI Management Committee.
19. Chairman. He shall preside over Meetings of the GVAI Management
Committee. He shall have all the general powers and duties which are usually
vested in the office of the Chairman, including the power to appoint
committees from amongst the Resident members (Active) of GVAI if required.
20. Secretary. He will be the executive authority for administrative functioning
and activities of the GVAI. He shall maintain the minute’s book of the
Management Committee meetings. He shall perform all duties incidental to
the office of the Secretary. He shall keep Rs.50,000/- as petty cash for day to
day expenditure on small items required for maintenance of GVAI.
21. Member Finance & Property. He shall be responsible to keep accurate
account of the refundable security amount, facilities maintenance charges and
other receipts collected from the members of GVAI and all disbursements
made. He shall maintain separate record of receipts from members and non-
members of RWA Gurjinder Vihar as maintenance contribution received from
them are exempted from income tax. Also, no GST shall be charged on
facilities maintenance charges received from the members of RWA Gurjinder
Vihar since there is an exemption for them up to 7500/- (inclusive
maintenance charges paid to RWA). He shall deposit all amounts collect from
members and the revenue generated through GVAI property (being common
facilities of RWA) with account branch of RWA Gurjinder Vihar. He shall also
be responsible to keep accurate account of expendable and non-expendable
property of GVAI including fittings and fixtures. The property ledgers shall be
centrally maintained by the RWA office and items shall be issued on loan to
GVAI for which loan ledgers should be maintained by GVAI and initialled by
the property member. He shall ensure day to day maintenance of the GVAI
complex and property. All administrative support shall be provided by RWA
Board of Management.
22. GVAI Activities Member. He shall be member of food beverages and shall
assist the Secretary in arranging weekly and special functions of GVAI. He shall
carryout any other duty as assigned to him by the Secretary/Management
Committee.
23. Vacancies. The vacancies in the GVAI Management Committee caused by any
reason, except removal of the member, shall be filled by nominating a
member from Resident Members (Active) of GVAI by the Management
Committee GVAI until a successor is elected at the next Annual General
meeting of the RWA Gurjinder Vihar.
24. Removal of office bearers. At any regular or special meeting duly called, any
one or more elected members of GVAI Management Committee may be
removed by a majority of RWA General Body and a successor may then and
there be elected to fill the vacancy thus created. The member whose removal
have been proposed shall be given an opportunity to be heard at the meeting.
25. Duties of the Management Committee. In addition to the duties imposed by
these rules or by resolution of the RWA Gujinder Vihar, the Management
Committee shall be responsible for the following:-
(a) To recover every loss or damage done to the property of GVAI either by
member of his/her guest from the member concerned and the decision
of the Management Committee will be final in this matter.
(b) Maintenance and repair of the property given in the charge of GVAI.
(c) Collections from the members of GVAI, including the facilities
maintenance charges, security, entry fee etc., and deposit the same
with accounts branch RWA Gurjinder Vihar.
(d) To ensure that cash book is written up promptly and is signed daily by
the Member Finance of the Management Committee.
(e) To inspect the accounts kept by Secretary/Member Finance and
examine the registers and account books and to take steps for the
recovery of all sums due to GVAI.
26. Financial Powers of Management Committee. The financial powers which
the Management Committee can exercise for sanction for non-budgeted
expenditure are as under:-
Secretary - Up to Rs. 10000/-
Chairman - Up to Rs. 50,000/-
BOM, RWA Gurjinder Vihar - Up to Rs. 250000/-
RWA General Body - Up to any amount
27. Meetings of the Management Committee. The Management Committee
shall meet at least once in a month on a date time and place as the Chairman
may determine.
28. Notice for the Meeting. As far as practicable, a notice of at least two days
shall be given for every meeting of the Management Committee stating the
business to be transacted at the meeting. The meeting may be held at a
shorter notice if the circumstances so warrant.
29. Questions to be decided by majority of votes. All questions placed before
the Management Committee for decision shall be determined by majority of
votes. In case of equality of votes, the Chairman of the meeting shall have a
casting vote.
Financial Management of GVAI
30. Facilities-maintenance charges when Payable. The security deposit shall be
paid before membership is granted. Advance facilities-maintenance charges
shall be paid by all members for 12 months in the beginning of the financial
year ie on 01 April every year.
31. Review of Charges/Rates. Should the financial position of GVAI so warrants,
the General Body of RWA Gurjinder Vihar through a resolution passed by the
majority of Association members present at its General Body may;
(a) Increase the rates of non-refundable entry fee, refundable security and
the monthly facilities-maintenance charges.
(b) Levy any charges of monthly or otherwise on games/sports, cards
room, Gym, entertainment or any service or activity of GVAI.
32. Account of GVAI. All accounts of GVAI shall be maintained centrally by
Account Branch of RWA Gurjider Vihar. All the assets of GVAI are part of
common facilities which belong to RWA Gurjinder Vihar Township, hence the
revenue generated through these assets shall be used for the maintenance of
RWA common areas and facilities. This, in turn will reduce the monthly
maintenance charges of all the members of RWA. Therefore, the members of
GVAI who use these facilities/assets shall pay additional monthly charges for
the maintenance of these facilities/assets. Maintenance of assets and facilities
GVAI shall be the responsibility of Board of Management of Gurjinder Vihar
Township including payment of salaries to employees responsible for looking
after assets and facilities of GVAI. All the amounts collected by GVAI on
various accounts such as refundable security deposit, monthly facilities-
maintenance, property damage recovery, rentals, swimming pool, Gym and
any other charges shall be deposited with accounts branch of RWA Gurjinder
Vihar.
33. Auditors. The Board of Management RWA Gurjinder Vihar shall
nominate two members of RWA to carryout quarterly as well as annual audit
of GVAI. No person who holds an office in the Management Committee of the
GVAI or is indebted to the GVAI shall be nominated as an auditor. The audited
statements of accounts and report of the audit committee to be given to BOM
RWA Gurjinder Vihar and the Management Committee GVAI. At the end of
each financial year Management Committee GVAI shall present a
comprehensive report on the working of GVAI highlighting salient activities
under various heads to the Board of Management RWA. A copy of the Annual
Audit Report and the statement of accounts duly audited along with
consolidated state of yearly receipts and expenditure will also be sent to the
Board of Management of the RWA Gurjinder Vihar.
Property Management of GVAI
34. Property of GVAI. All property held in the charge of GVAI shall accurately be
accounted for. Proper handling/taking over of GVAI property shall be carried
out when new incumbent takes charge. Annual stock taking of the property
shall be undertaken and all losses thoroughly investigated and responsibility
fixed. A note for the same will be put up to the Board of Management RWA
which in turn shall put up to General Body of RWA Gurjinder Vihar for
information.
35. Minor and Major Works. All works exceeding the financial powers of the
Chairman GVAI shall be will be projected the BOM RWA Gurjinder Vihar for
sanction. Works beyond Rs. 2,50,000/- (Rupees Two Lac Fifty Thousand Only)
may be recommended by GVAI Management Committee for inclusion in the
Annual Budget of RWA Gurjinder Vihar.
36. Power to make Bye Laws. The Management Committee of GVAI may make
GVAI Bye-Laws consistent with these Rules for the administration of the
affairs of GVAI and for carrying into effect the provisions of these Rules. The
GVAI Bye Laws and amendments, if any, to Bye Laws made by Management
Committee shall be put up to General Body of RWA of approval. The
Management Committee may adopt such means as they deem sufficient to
bring to the notice of the members of GVAI all such Bye Laws, amendments
and repeals thereof. So long the Bye Laws remain in force shall be binding on
all the members of GVAI. In particular and without prejudice to the generality
of this para, the Bye Laws may provide for all or any of the following matters:-
(a) Giving any additional responsibilities to member of Management
Committee.
(b) Issue of Membership cards various categories of members.
(c) SOP for conduct of GVAI functions.
(d) The times of opening or closing of any property of GVAI or any part
thereof.
(e) The terms as to payment or otherwise of admission of members to
participate to the benefit of any of the privileges of GVAI whether by
donation or facilities-maintenance charges or otherwise in addition to
the monthly facilities-maintenance charges by these articles as
provided.
(f) The admission of visitors to the property and benefits of GVAI.
(g) The rules to be observed by the members or visitors playing any games
and or discipline in or on GVAI property.
(h) The prohibition of any particular games/discipline on GVAI property
entirely or at any particular time.
(i) The conduct of members of GVAI in relation to one another and GVAI
staff.
(j) The setting aside of any part of GVAI property for particular purpose.
(k) Method to recover loss/damage to GVAI property.
(l) The imposition of fines for the breach of any Bye Law or any articles of
Rules of the GVAI.
37. Amendments. These Rule may be amended by the General Body RWA
Gurjinder Vihar and no amendment shall take effect unless approved by at
least two third of the members present in the meeting.
