REAL estate agents will be required to actas “policemen” under new rules clampingdown on foreigners buying residentialproperty, the industry has warned.

Real Estate Institute of Australiapresident David Airey has requested ameeting with Assistant Treasurer NickSherry to clarify the role of Australia’s100,000 real estate agents under the newrules, which prevent non-residents buyingestablished Australian homes.

The restrictions, announced by SenatorSherry two weeks ago, reinstate foreigninvestment rules dumped in 2008.

They include requiring temporaryresidents – such as students – to sell theirhouses or apartments when leaving thecountry.

The change means that foreigninvestors may only purchase new housingstock and temporary residents may onlypurchase existing housing for use whilethey reside in Australia. In addition, all

temporary residents seeking to purchase

an existing propertyin Australia will

now be broughtwithin the Foreign

Investment ReviewBoard notification,

screening andapproval process.

Temporaryresidents will be

required to notify, be screened or beapproved by the FIRB.

The changes ensure that temporaryresidents are subject to the samecompulsory notification, screening andapproval requirements as foreign non-residents.

Temporary residents who are approvedwill have to compulsorily sell theestablished property they have boughtwhen they depart Australia; and berequired, where undeveloped land hasbeen purchased, to commence cons-truction on that land within 24-months or

have the land compulsorily sold. The government will establish new

penalties under civil law that also apply toreal estate agents.

Mr Airey said real estate agents whobroke the law should be prosecuted.However, he said it was not appropriatefor agents to “police” foreign investmentguidelines. “Are we supposed to askpeople for their passport or residencyvisa?” he asked.

The Government plans to produce aguide for the real estate agents but detailswere not yet available, Mr Airey said.

While there were no figures available,Mr Airey said the REIA estimated thatabout 5 per cent of residential purchaseswere made by foreign buyers.

There have been several reports ofoffshore buyers – mainly Asian investors –outbidding locals at auctions, fuellingalready hot housing markets.

The median price of Perth housing hasclimbed 15 per cent in the past year. ■
