The BAC Chairperson certified that the quorum of the BAC was present to 92 transact business. He acknowledged the presence of the BAC members, Office 93 of the Assistant Secretary for Procurement and Administration, BAC 94 Secretariat, End-User Representatives, observers and made a roll call of the 95 bidders in the attendance registry. 96 97

III. HIGHLIGHTS OF DISCUSSION 98 99

The BAC Chairperson welcomed everyone to the pre-bid conference. 100 101 Mr. Lauro Roberto, Jr. gave a brief description of the project and asked the 102 prospective bidders to introduce themselves and the company they represent. 103 The BAC Chairperson turned over the discussion to Mr. James Ronald 104 Ybiernas who discussed, clarified and explained the eligibility requirements, 105 technical and financial components of the contract to be bid as well as the 106 salient parts of the Bidding Documents. Moreover, the BAC Chairperson 107 announced that the floor was open to queries, information, proposals or other 108 concerns coming from the prospective bidders or suppliers on the assumption 109 that the prospective bidders have downloaded bidding documents from the 110 PhilGEPS, requested from the BAC Secretariat for copies of the same, or 111 bought copies of the same. The floor was open to all and the BAC Secretariat 112 moderated the discussion. 113

Yes, it is acceptable as long as the completed contract is sufficient.

It is still accepted since the filing of said document happens to be today and there may have extensions made because of the current situation.

GCC Clause 2.2

Mr. Jescie Palabay (JC Palabay Enterprises, Inc.) – Is the 15% advance payment a mobilization or should we complete the 25% first before we could claim the 15%?

The 15% may be used for mobilization subject to a submission of an irrevocable letter of credit or special bank guarantee equivalent to the amount of 15%. The 15% advance payment is separate and distinct from the requirement of the 25%. Suppliers may claim the 15% even without delivery yet. However, for the initial progress payment, suppliers can only claim when they have reached the initial 25% of the contract price. These progress

payments have a recoupment from the 15% advance payment paid to the supplier.

GCC Clause 4

Ms. Lhen Villanueva (Bloombooks, Inc.) – Until what percentage of the pre-delivery should the inspection be done?

There is no threshold as to the percentage, as soon as the supplier is ready with the items for inspection, acceptance and delivery, suppliers can already request for the said inspection.

Mr. Jun Gamboa (Ecosystems Enterprises) – Are we only allowed one progress payment?

No. As long as the initial progress payment of 25% is attained, the subsequent payments will not have any more threshold based on the actual progress of the contract.

Ms. Katherine Silva (FEP Printing Corporation) - Can we submit a Performance Securing Declaration instead of a Performance Bond?

Yes, the Performance Securing Declaration is one of the allowable submissions.

Schedule of Requirements


Mr. Jescie Palabay (JC Palabay Enterprises, Inc.) – Because of some regions under various levels of community quarantine, can the delivery points be limited or can you aid during delivery of the materials for easy access of said areas?

The expectation is for suppliers to deliver to the drop-off points as specified in the Schedule of Requirements. To give ease to the suppliers, passes will be provided by DepEd during delivery and they may communicate with DepEd when issues/concerns arise.

Mr. Jun Gamboa (Ecosystems Enterprises) - Is the 60-calendar day delivery period pertaining to the date of arrival to the destination or the day of shipment from the origin?

The 60 calendar days shall start at the receipt of the authority to mass print and is inclusive of the production and delivery of the items as stated in the Bidding Documents.

Ms. Lilibeth Manabat (Book Media Press, Inc.) – How much would be the adjustment for the price of bidding documents?

Bidders are only required to pay the minimum amount stated in the Bidding Documents. Should they opt to purchase additional slice/line items, bidder should pay the corresponding amount.

Ms. Lilibeth Manabat (Book Media Press, Inc.) – We just want to be clarified if this project is subject to the 12% VAT since procurement for textbooks were not?

The project is subject to all taxes required by the Bureau of Internal Revenue. DepEd is not in the position to decide on this matter so it’s up to the bidder’s company’s Accounting/Legal department on what to apply during the undertaking of the project.

Ms. Marie Antonette Yap (Eduresources Publishing, Inc.) / Mr. Jescie Palabay (JC Palabay Enterprises, Inc.) – We heard that the machine of Forest Products Research and Development Institute (FPRDI) that process the paper test results is still currently unavailable. What will be the alternative document for the paper test result? Are we allowed to submit a certification from the supplier?

As stated in the Bidding Documents, only the certification from the paper manufacturer will be accepted in lieu of the paper test results if it will not still be available. But during the inspection, under the reservation clause, the paper test results may be done for purposes of further evaluation.

It is the discretion of the bidders to adjust their modules depending on the requirements stated in the Bidding Documents.

It is up to the bidders on how they would come up with their interpretation of the Price Schedule.
