Martinez Chjiirman, Committee on Peace and Order and Public Safety WHEREAS, speeding is road injury problem, as it influences vulnerable road users; WHEREAS, Section 35 the most important contributor to road fatalities and is at the core of the both crash risk and crash severity, and as it significantly affects md 38 of Republic Act No. 4136 or the Land Transportation and Traffic Code prescribes the maximum al owable speed for specific road classes and motor vehicle and mandates local government units (LGUs) to Sectic ns WHEREAS, under known as the Local Government streets and bridges within their ealth, safety, convenience, maintain nhabitants; 447 (a) (5)(vi) and 458 (a)(5)(vi) of Republic Act No. 7160 otherwise Code, cities and municipalities have the power to regulate traffic in all territorial boundaries, and to enact measures that will enhance public peace and order, and promote the general welfare of their tl-e WHEREAS, in view of all streets and bridges within th 7160, the honorable members o Transportation Office and the De jartment roads and to determine the appropriate inhabitants and road users; NOW THEREFORE, BE regular session duly assembled, tljiat: SECTION 1. S E C T I O N 10. Respo is ibi l i t ies o f the Lead Agency . T h e Lead Agency shal l , in addi t ion to ~ other funct ions under other ore inances, orders, or pol icy issuances, have the fol lowing funct ions:

their dr iver 's l icense. In cases where the connect ion wi th the LTO IT not yet been establ ished, the Lead Agency shall submit a quarter ly report

LTO conta in ing the re levant informat ion.

he/she can prove that the motor vehic le was dr iven by another person. d) The registe red owne r shal l have seven (7) days f rom the da te o f receipt o f the notice

within wh ich to sett le the f ine indicated in the notice, o r to fi le a protest in accordance with Sect ion 13 of this ord inance. Failure to fi le a protest with in the per iod shal l be d eemed a wa iver of the r ight to protest, and shall result in the automat ic esolut ion o f the violat ion against the registered owner .

e) In case o f a protest based on the identity of the driver, the registered owner shal l have the duty to provide under oath the name of the dr iver of the motor vehic le, his known address, and other detai ls as may be required by the Traff ic Management Commit tee . Except in cases where the protest is based on stolen vehic les, no protest based on the identity of the dr iver shall be a l lowed unless the a l leged driver at the t ime o f v i oa t i on is identi f ied.

f) Upon a fin Jing that the registered owner is not the dr iver of the motor vehic le at the t ime of th(! v io lat ion, the Traff ic Management Commi t tee shall send a notice to the driver, as dent i f ied by the registered owner , subject to the requ i rements of Sect ion 12.2 ( b ) a r d 1 2 . 2 ( d ) .

S E C T I O N 12. i Apprehens ion for speeding under Sect ion 6 (b) a n d (c).

a) Where a c river found to have v io lated Sect ion 6 (b) and (c) of this Ord inance, the offense sh all be cons idered "reck less dr iv ing". The law enforcement off icer shal l f lag down the driver and inform h im of the v io lat ion and the c i rcumstances surrounding the violatic n.

b) Upon apprehens ion , the law en fo rcement off icer shall inform the of fending dr iver of the violatktn, d emand the presentat ion o f the driver 's l icense of the of fending dr iver and motor vehic le cert if icate of registrat ion and official receipt or registrat ion.
