RESOLUTION NO. 2011 - 024

RESOLUTION OVERRIDING THE VETO MESSAGE OF THE CHIEF EXECUTIVE, HON. FRANCISCO P. TENENAN, SR., MUNICIPAL MAYOR, THIS MUNICIPALITY, ON THE APPROVED APPROPRIATION ORDINANCE NO. 2011-001 WHEREAS, after a thorough review of the proposed Executive Budget for Calendar Year 2011, the Sangguniang Bayan, this municipality, has finally approved the Annual Appropriation Ordinance in the amount of FIFTY FIVE MILLION SEVEN HUNDRED NINETY EIGHT THOUSAND PESOS (PhP 55,798,000.00) and authorizing the implementation of various expenditures for the operation of the Municipal Government; WHEREAS, the approved Appropriation Ordinance was transmitted to the Office of the Municipal Mayor on the 2nd day February 2011 for appropriate action, however, the Appropriation Ordinance was returned on the 14th day of February 2011 which is beyond and in violation of the ten (10) days reglementary period provided under Article 108 of Republic Act 7160, known as the Local Government Code of 1991, otherwise the ordinance shall be deemed approved; WHEREAS, most of the items that were vetoed by the Chief Executive are expenditures covering various programs of the municipal government and were increased by the Local Sanggunian which was considered as ultra vires act by the Local Chief Executive because those were considered an increase in the appropriation of the Executive Budget, well in fact there was no increase in the total appropriation of the Executive Budget but only on specific items; WHEREAS, during a series of committee hearing, it reveals that these expenditures were either underestimated or bloated by the Local Finance Committee (LFC) hence, the Sangguniang Bayan reduced some of the unjustified programs/projects/activities and added to the top priority programs of the municipal government; WHEREAS, the Go-Lamut Educational Assistance was vetoed being categorized as new item well in fact, there is an ordinance justifying the inclusion of the program under the 20% development fund. Given the fact, there is no need that the program be included in the Annual investment Plan of the Municipality because it falls under the statutory obligation of the Local Government as provided under Article 415 of the Implementing Rules and Regulations of RA 7160; WHEREAS, in the veto message it was indicated that the Sangguniang Bayan through the Chairman, Committee on Appropriation and standing representative of the Sangguniang Bayan in the Municipal Development Council failed to bring the issues and concerns to proper Body and proper forum for consideration and approval, hence their actions in increasing the proposed amount in the Executive Budget. In this regard, the Chairman on Appropriation being a representative of the Sanggunian to the Municipal Development Council is merely to ASSIST in the formulation of Annual Investment Plan (AIP) and is not involved in the appropriation of funds under the Executive Budget but it is the Local Finance Committee which holds that power. The act

of the Sanggunian in adjusting and increasing some of the appropriations on specific items but not increasing the TOTAL proposed budget is within the powers granted to the Sangguniang Bayan and is not in any way consider as ultra vires as provided under Article 415 of the Implementing Rules and Regulations of RA 7160 and as enunciated in the case of Sarmiento, et al. versus the Treasurer of the Philippines dated September 4, 2001; WHEREFORE, on motion, duly seconded and upon unanimous vote of the members present, be it: RESOLVED, to override the Veto Message of the Chief Executive, Hon. Francisco P. Tenenan, Sr., Municipal Mayor, this Municipality on the approved Appropriation Ordinance No. 2011 – 001; RESOLVED FINALLY, to forward this Resolution to the Sangguniang Panlalawigan for their information and basis of appropriate action; APPROVED AND ENACTED this 21st day of February 2011 by the Sangguniang Bayan of Lamut, Ifugao.

RESOLUTION EARNESTLY REQUESTING THE HONORABLE TEODORO B. BAGUILAT, JR., CONGRESSMAN OF THE LONE DISTRICT OF IFUGAO, TO ALLOCATE FUNDS FOR PROJECTS HEREUNDER ENUMERATED, ALL IN THE MUNICIPALITY OF LAMUT, PROVINCE OF IFUGAO

WHEREAS, the Municipal Mayor of this Municipality verbally requested this Body to adopt a resolution requesting for fund assistance to the Honorable Congressman Teodoro B. Baguilat, Jr., for the following projects:

WHEREAS, notwithstanding the fact that the Municipality of Lamut recognizes the priority construction of these farm-to-market roads which is a very basic and important need of the people of Lamut, the meager funds of this Local Government Unit, being a 4th class Municipality, hinders the immediate funding of the above-stated priority projects;

WHEREAS, considering the felt-deep concern of the Honorable Congressman Teodoro B. Baguilat to the people and development of Lamut, the Body finds merit and justification on the request to seek his financial assistance;

NOW THEREFORE, on motion of Hon. Adryan B. Chaguile, duly seconded severally by the members and upon unanimous vote, be it:

RESOLVED, to earnestly request the Honorable Teodoro Baguilat, Jr., Congressman of the Lone District of Ifugao for the funding of the above-stated projects, all in the Municipality of Lamut, Province of Ifugao;

RESOLUTION GRANTING FRANCHISE TO VARIOUS MOTORIZED TRICYCLE OPERATORS IN THE MUNICIPALITY OF LAMUT, PROVINCE IFUGAO “WHEREAS, Section 447, Article III of the Local Government Code of 1991 empowers the Sangguniang Bayan to grant franchises for the operation thereof within the territorial jurisdiction of the municipality; WHEREAS, based on actual inspection/verification, the tricycle units of the tricycle operators hereunder enumerated have complied with the requirements for franchising as stipulated in the Franchising Requirements Guideline Memorandum Circular No. 01, Series of 2008 dated September 10, 2008 and other local laws:

RESOLUTION AUTHORIZING THE HONORABLE FRANCISCO P. TENENAN, SR., MUNICIPAL MAYOR, THIS MUNICIPALITY, TO ENTER INTO A MEMORANDUM OF AGREEMENT (MOA) WITH THE PHILIPPINE COMMISSION ON WOMEN (FORMERLY THE NATIONAL COMMISSION ON THE ROLE OF FILIPINO WOMEN), MANILA, PHILIPPINES RELATIVE TO THE GREAT WOMEN PROJECT IN THE MUNICIPALITY OF LAMUT

WHEREAS, the Municipality of Lamut is cognizant of the opportunity to have been included as one of the pilot municipalities for the implementation of the Great Women Project in Ifugao Province for a period of three (3) years from December 13, 2011 when a tripartite Memorandum of Agreement was signed by the Philippine Commission on Women, the Provincial Government of Ifugao and the pilot municipalities;

WHEREAS, after an in depth deliberation and scrutiny on the provisions of the Memorandum of Agreement, this Body finds it in order especially when this Body has been clarified by the department concerned that the obligation of this municipality required particularly under 3.2.6, 3.2.7 and 3.2.8 of the MOA actually had been complied by this LGU by providing funds for such projects/activities under the 2011 Annual Budget of this LGU; WHEREAS, this Body recognizes the need to sustain the implementation of the project for the best interest of the constituents;

WHEREFORE, on motion of Honorable Adryan B. Chaguile, duly seconded and upon unanimous vote, be it: RESOLVED, to authorize the Honorable Francisco P. Tenenan, Sr., Municipal Mayor, this Municipality, to Enter into a Memorandum of Agreement (MOA) with the Philippine Commission on Women, Manila, Philippines relative to the Great Women Project in the Municipality of Lamut;
