AN ORDINANCE ESTABLISHING PROCEDURAL GUIDELINES & REQUISITES PRIOR TO ACCREDITATION OF NON­GOVERNMENT ORGANIZATIONS, PEOPLES ORGANIZATIONS & OTHERS WITHIN THE CITY OF SANTA ROSA, LAGUNA.

EXPLANATORY NOTE

WHEREAS, Republic Act (R.A) 7160, otherwise known as the Local Government Code, CHAPTER IV on Relations with People's and Non-Government Organizations, in particular Section 34. Provides the "Role of People's and Non-Governmental Organizations. - Local Government Units shall promote the establishment and operation of people's and non-governmental organizations to become active partners in the pursuit of local autonomy;"

WHEREAS, Section 35. Of the R.A. Linkages with people's and Non-governmental Organizations. - states that " Local Government Units may enter into joint ventures and such other cooperative arrangements with People's and Non-Governmental Organizations to engage in the delivery of certain basic services, capability-building and livelihood projects, and to develop local enterprises designed to improve productivity and income, diversity agriculture, spur rural industrialization, promote ecological balance, and enhance the economic and social well-being of the people;"

WHEREAS, in accord with Section 36. On Assistance to People's and Non-Governmental Organizations. - which provides that "A Local government unit may, through its local chief executive and with the concurrence of the Sanggunian concerned, provide assistance, financial or otherwise, to such people's and non-governmental organizations for economic, socially-oriented, environmental, or cultural projects to be implemented within its territorial jurisdiction;"

Section 1. Short Title:

This Ordinance shall be known as an "ORDINANCE on PROCEDURAL GUIDELINES & REQUISITES PRIOR TO ACCREDITATION OF NON-GOVERNMENT ORGANIZATIONS, PEOPLE'S ORGANIZATIONS"

Section 2. Declaration of Policy

This ordinance shall delve on the Non-Government organizations/People Organizations which are now recognized as third key sector actors on the landscape on the development and human actions that are envisioned to cater with human rights, environmental protection, disaster relief, and development assistance needs of the people.

Section 3. Definition of Terms- For the purpose of this ordinance the following terms are defined as follows:

a) Advocacy - particular support of an organization/stakeholder

b) Beneficiary - the community or any of its sector which is the recipient of the results of the development efforts of Government Office and the NGO/PO

c) Bogus - fake or spurious organization

d) Civil society the aggregate of non-governmental organizations and institutions that manifest interest and will of citizens;

e) Funds - government funds entrusted to the NGO/PO to cover the implementation of the project for a given period of time;

f) Government Organization - refers to national government agencies, local government units, government-owned or controlled corporation and their subsidiaries providing funds to NGO/PO;

g) Legitimate - lawfully/recognized organization

h) Non-Governmental Organizations (NGOs) - a non-profit, voluntary organization committed to the task of socio- economic development and established primarily for

services such as assisting citizens or people's organizations in various ways by educating, training or giving funds to them, including foundations created for the same purpose; It is legally constituted corporations created by natural or legal people that operate independently from any form of government

i) People's Organizations (POs).- PO s are independent communities and/or class based association, generally composed of disadvantaged individuals established to protect and advance the interest of specific causes or sectors, e.g. labor, farmer, fisherman, women, children, civic organization. POs work to advance their members' material or social well-being, Pos are grassroots organizations, and their members typically work on a voluntary basis

g) Requites - mandatory requirements to comply with

Section 4 Project Objectives -To establish procedural guidelines & requisites prior to accreditation of Non-Government Organizations,

People's Organizations & others within the City of Santa Rosa, with primary advocacies to include but are not limited to, environmental, social,

advocacy and human rights work.

This LGU shall value the role of independent People's organizations to assist the people to pursue and protect, their legitimate and collective interest and aspirations for as long as it is within the democratic framework which can be achieved through peaceful and lawful means.

Section 5. Requirements/Policies: Requirements for accreditation

5.1. Submission of required documents pursuant to Rule XIII, Art. 64 (b) of the RRI of RA 7160

5 .1.1 Registration with either the Securities & Exchange Commission, Cooperatives Development Authority, Department of Labor & Employment, Department of Social Welfare and Development, or Any recognized NGA that accredits people's Organizations, NGO's or the private sector. If not Formally registered, the said organizations may be recognized by the Sanggunian for the purposes of only meeting the minimum requirements for membership of such organization in local special bodies.

5.1.2 Organizational purpose and other objectives include community organization and development, institution-building, local enterprise development, livelihood development, capability-building and Similar developmental objectives and considerations.

5.1.3 Community - based with project development and implementation track record of at least one (1) year.

5.1.4 Reliability as evidenced by the preparation of annual reports and conduct of annual meetings duly certified by the board secretary of the organization.

5.2 Others

5.2.1 There shall be no Bogus PO's/NGO's Policy -All organizations that meet the requirements shall be properly accredited by the Sangguniang Panlungsod.

5.2.3 Accomplishment Report of PO's and NGO's must be submitted to the Sangguniang Panlungsod And subsequently be endorsed to the Committee on Rules & Privileges and Laws & Government once every six (6) months. Failure to comply shall mean Termination of accreditation by the Sanggunian.

Section 6. Programs & Activities: 6.1 the following activities will be undertaken:

6.1.1 Cooperative Arrangements 6. 1.2 Basic Services 6.1.3 Capability Building 6.1.4 Livelihood Projects 6.1.5 Local Enterprises

6.1.6 Human Rights/Children's Rights Advocacy

6.2 Requisites in availing government funds:

6.2.1 All programs, projects, activities and the likes must have sustainability in its purpose.

6.2.2 All programs, projects, activities must be in accordance with section 35 & 36 of the Republic Act 7160, otherwise known

6.2.3 Projects, programs and activities must be in line with the mission & vision programs of the said Local Government Unit, failure to comply shall mean disapproval of the accreditation by the Sanggunian concerned or disapproval to access on any local government resources

6.2.4 PO's/NGO's accessing the local government resources must also pass thru the SP resolution prior to approval of the Local Chief Executive.

6.2.5 The Local Finance Executive shall submit report to the Sanggunian Panlungsod on the status of the Financial Grants/assistance/donations to PO's/NGOs and the like.

6.2.6 Proper validation shall be made on the List of the accredited organizations thru the SP Secretariat once every six (6) months, pursuant to Chapter 9, Section 32 of the 1987 Administrative Code of The Philippines, failure to do such shall mean non­compliance with the Code of Ethics promulgated by the Civil Service Commission pursuant to Section 35 of The Administrative Code of the Philippines.

6.2. 7 Financial Grants/assistance/donations to PO's/NGOs must be subject to COA auditing rules and principles., specifically COA Circular No. 2007-001, dated October 25, 2007

6.2.8 All programs, projects, activities of the Local Chief Executive relative to the PO's/NGOs shall be incorporated with Annual Executive Budget and must consistent with that of the Annual Investment Plans/Programs of the Local Government Unit to maximize its service delivery of basic programs, projects, activities and the like of PO's NGOs and for purposes of the Sanggunian concerned in aid of legislation.

6.2.9 Liquidation Support relative to the Financial Assistance extended to the organization by the Local Chief Executive (LCE) in accordance with the Sangguniang Panlungsod must be reported accordingly to the SP Secretariat to be ca lendared on the following regular session and be referred to the committee on Rules & Privileges Committee on Laws and Government & Committee on Finance for proper review And action subject to the existing COA rules and regulation.

Section 7. Implementing Agency: Stakeholders & Functions

Sangguniang Panlungsod - shall enact Legislative measure to the establishment and improvements of local policy.

Local Chief Executive - upon approval of this ordinance shall establish set of rules and Regulations in collaboration with the City Departments including the GAD FOCAL POINT SYSTEM SECTORAL REPRESENTATIVE

Budget Office - shall prepare budgetary Requirements to accredited Pos/NGOs that comply with the procedural guideline & requisites of this ordinance.

Section 8. Repealing Clause.

Accounting - shall account all based on the Accepted & existing accounting rules & regulations.

Treasury - shall safe keep

NGO - perform a variety of service and Humanitarian functions, bring citizen concerns to Governments, advocate and monitor policies and encourage political participation through provision of information.

Peoples Organization - (PO) are generally composed of disadvantaged individuals and work well-being. Civil Society Organization - (CSO)

Any Provincial Ordinances, Executive Orders, Resolution, Rules & Regulations or part thereof which are inconsistent with provisions of this ordinance, are hereby repealed, modified or amended accordingly.

Section 9. Effectivity

This Ordinance shall take effect upon its enactment by the City Council and ratification of the Sangguniang Panlalawigan,

RESOLVED: As it is hereby RESOLVED to approve, ''An Ordinance Establishing Procedural Guidelines & Requisites prior to Accreditation of Non-Government Organizations/ People's Organizations & others within the City of Santa Rosa"
