Re: Questionnaire on EU Legislation on Exports of Non-Hazardous Waste to Non-OECD Countries like Namibia

Your letter concerning the above subject matter has reference. We examined the

various wastes contained in the above mentioned EU questionnaire and have the

following comments:

(a) The hazardous wastes in their mixtures of limited dose levels under the Basel

Convention cannot be accommodated for importation into Namibia as these will lead

not only to violation of the Basel Convention to which we are signatory, but also to

viofation of Article 95 of the Constitution of the Republic of Namibia.

(b) All other wastes with their traces in impurities of chemically or metallurgical^

engineered formulations are difficult or even impossible to monitor in the absence of

any tracing mechanisms nor regulatory thresholds in Namibia.

(c) Generally, many of the wastes on the EU Questionnaire subsist in the form of

organic or inorganic materials fused with other elements of which Namibia lakes the

engineering competence to dissect and make a decision in favour of importation.

(dj Although some wastes are classified as non-hazardous wastes within the borders of

the ELI, this does not necessarily mean that such wastes are classified or would be

classified as such in Namibia.

(f) Above all, it would be ethically incorrect for Namibia to subscribe to any importation

of any form of non-hazardous wastes from the EU without conducting a detailed public

consultation on the matter.

(g) Considering the above comments, it is hereby concluded that Namibia has

not yet consulted widely on the subject of importing non-hazardous waste from the EU countries. From this perspective, all exports of both hazardous and n on-

hazardous wastes from any OECD counties into Namibia remain prohibited.
