I hereby file First Appeal before the First Appellate Authority under RTI Act, 2005 with following by producing copies of relevant sections from RTI Act, 2005 as my supporting points: 1. Section 2(f) of RTI Act, 2005: information means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force. 2. Section 2(i)(d) of RTI Act, 2005: record includes - any other material produced by a computer or any other device. 3. Section 2(j) of RTI Act, 2005: right to information means the right to information accessible under this Act which is held by or under the control of any public authority and includes the right to - (i) inspection of work, documents, records (ii) taking notes, extracts or certified copies of documents or records (iii) taking certified samples of material (iv) obtaining information in the form of diskettes, floppies, tapes, video cassettes or in any other electronic mode or through printouts where such information is stored in a computer or in any other device While filling up application of SSC SELECTION POST EXAMINATION PHASE-VI, 2018, every applicant needs to choose one of the options among UR, OBC, SC and ST. Hence, it is possible for SSC to retrive the information sought by me at this point of time. Therefore, I request the First Appellate Authority to furnish the information sought at the earliest. I further request the First Appellate Authority concerned not to physically send the letter. Instead, scanned copy of the same may be uploaded in RTI Portal or may be sent to my email address furnished above i.e. [email protected].

Please refer to your appeal No. SSCER/A/2018/60025 dated 10.12.2018 submitted online, against the reply furnished by the CPIO on 10.12.2018 against your RTI on line application dated 10.12.2018. 2. I have gone through the reply furnished by the CPIO on 10.12.2018 in response to your RTI application dated 10.12.2018. You have sought information regarding total number of applicants and category wise number of applications in respect of Category No. ER 10518 for the Post of Data Processing Assistant, advertised vide Advertisement No. Phase – VI/2018/Selection Post. The CPIO furnished information in respect of the total number of applicants but the category wise number of applications have not been provided as the same is yet to be finalised. As per guidelines of the RTI Act, the Public Information Officer is not supposed to create information that is not a part of the record of the Public Authority. The Act also provides that Public Information Officer is required to supply the material in the form as held by the Public Authority. The material in the form as sought by you is not available with the CPIO as on the date of RTI application. Therefore the reply of CPIO dated 10.12.2018 stands upheld. 3. Accordingly, your appeal dated 10.12.2018 stands disposed of.

The final result of SI in CPOs Examination, 2008 was declared by the Commission on 03.02.2010. Hence the PET/PST result of the above examination is not available in this office.

2. As regards your request for providing copy of the marks list containing the marks secured by you in Paper-I of SI in CPOs Examination, 2008, it is stated that as per the above mentioned record retention schedule, the Original mark lists / marks data of all examinations are to be retained by EDP/C-I section of SSC (HQ) for three years from the date of announcement of the final results.
