Terms and Conditions 1. The amount of the rental payment for the initial four-month period is payable at the beginning of the rental period. The Renter may continue the rental beyond the initial four-month period by making monthly rental payments. Rental equity toward purchase of a new instrument only accrues until the maxi-mum amounts. The amount of Payments made after maximums are reached are solely rental payments and may not be applied to any purchase. Payment includes Sales Tax. Renter agrees to pay a late charge of Five Dollars ($5.00) per month when payment is in default for ten (10) days or more. A returned check fee of $35.00 for all returned checks.

2. If at any time during the rental payment period the Renter wishes to convert the rental into the purchase of a new instrument, 100% of all payments made, less tax and O.P.P., up to 36 months will be applied as a discount off the manufacturer’s suggested retail price of the new of the new instrument. The new instrument that is purchased must be a like instrument of equal or greater value as compared to the instrument rented. The rental discount may not be used for any other purpose.

2b. In the case of percussion instruments there is no accumulation of monies that may be applied. Please contact Brighton Music Center for new pricing.

3. The Renter acknowledges that upon taking possession of the instrument that it is in good working order. Maintenance re- pairs are covered under this agreement.

4. Brighton Music Center shall at all times retain sole and exclusive title to the instrument. Renter shall not in any manner represent that they are the owner of the instrument or that they have the option to purchase the rented instrument, nor shall they do anything to impair or destroy Brighton Music Center’s vested rights in and to the instrument, it being understood by the parties that the Renter holds possession of the instrument only as rental subject solely to the terms and conditions of this agreement.

5. The Renter shall be responsible for any damage occurring to the instrument while in his possession as a result of misuse or negligence on his part. Renter shall also be responsible for the replacement value of the instrument in the event that is lost or stolen, unless the Renter has chosen the Optional Protec-tion Plan.

6. The Renter shall not assign or sublet the Rental Agreement, the instrument which is the subject of the Rental Agreement, or any of his rights under the Rental Agreement.

7. If the Renter shall default in the payment of any rent when due or default in the performance of any other provision of the Agreement, they shall immedi-ately surrender possession of the instrument to Brighton Music Center. Upon failure of Renter to surrender possession of the instrument following default, Brighton Music Center or its agents may without notice or liability or legal process enter into any premises of or under control of renter where the instru-ment may be and repossess the equipment. For the purpose of enabling Brighton Music Center to obtain possession of the instrument, Renter hereby au-thorizes the Prothonotary or any Attorney of any court of record to appear for and confess judgment in replevin or for writ of possession against Renter in favor of Brighton Music Center or its assigns in any action of replevin or for writ of possession, for which this Rental Agreement or verified copy shall be suffi-cient warrant. Renter hereby expressly waives all further rights to possession of the instrument and all claims for injuries suffered through or loss caused by such repossession. In case of any default by Renter hereunder, all sums due and to become due hereunder, shall become immediately due and payable with-out further notice to Brighton Music Center. Brighton Music Center, upon any default, having retaken possession of the instrument, may retain the instru-ment and all prior payment of rent made hereunder, and Renter shall remain liable to Brighton Music Center for the unpaid total rent for the balance of the term of this agreement, together with any and all expenses including a reasonable attorney’s fee for retaking. Nothing herein contained shall prohibit Bright-on Music Center from pursuing any other remedy available to Brighton Music Center at law or in equity.

8. No agreement of sale or agreement to sell the instrument is intended hereby, nor has any option been given to Renter to purchase the equipment at any time.

9. All rights of Brighton Music Center hereunder shall insure to the benefit of Brighton Music Center’s successors and assigns, and all obligations of Renter shall be binding upon Renter’s heirs, administrators, executors, successors or assigns.

10. This Agreement constitutes this entire contract between the parties and may not be modified unless done so in writing signed by both parties.

11. If the Renter decides to return the rental instrument and end their contract the Renter must contact Brighton Music Center no later than 2 weeks prior to the last day of the school year and obtain a return authorization number. Rental instruments may only be returned to a school where Brighton Music Center makes weekly stops. The instrument may also be returned in person or by a trackable delivery service.

OPTIONAL INSTRUMENT PROTECTION PLAN By signing up for the optional protection plan, your rental instrument is covered against theft and any damage not caused by willful destruction provided your ac-count is in good standing. Cost of the plan is $3.00 per month for Group I instruments and $5.00 per month for Group II & III instruments. If you choose to not take advantage of this plan, you will be charged for any non–maintenance repair. Any claim of theft must be accompanied by a police report This protection plan must be added at the time of rental. This plan may not be canceled and can not be added to an already existing rental.

Coverage does not include: Replacement of expendable accessories such as reeds, cleaning equipment, drumsticks, or strings. Replacement of lost or damaged mouthpieces or lost bows Removing of minor dents that do not effect playing. Damage done by unskilled persons attempting repair. Any malicious or willful destruction.

All repair parts and replacement must be handled by BRIGHTON MUSIC CENTER. No reimbursement made for service procured from other sources
