1. Purpose This regulation is aimed at transposing SRAC policy related to SRAC, IQNet and FSSC 22000 marks and logos management by establishing the rules regarding the ownership and the right to use own certification marks, as well as the way of using and displaying IQNet certification mark. The certification marks and the certificates issued by SRAC prove the compliance of the management system of the certified organization with the reference standard(s), for the management system and scope for which it was certified. These marks shall not be used on product or product packaging, visible for the consumer, or in another way that may mislead the interpretation of product compliance. Note: In compliance with SR EN ISO/IEC 17021-1:2015, the packaging of a product is considered as that which can be removed without the product disintegrating or being damaged. Type labels or identification plates are considered as part of the product.

2. General Requirements

SRAC certification mark is registered at OSIM by its owner and it is the property of SRAC and it is granted for use to SRAC certified organizations under the terms provided for in this Regulation.

3. Models and application 3.1. SRAC Logo

SRAC Logo – presented in Annex 1 – is SRAC graphical identification sign in its official

documentation and correspondence. SRAC logo is registered at OSIM and consists of the

name SRAC.

It is forbidden the use of SRAC logo by the certified organizations.

3.2. SRAC certification marks

SRAC certification marks are designed in such a manner thus the accompanying text identifies each management system for which SRAC has granted certification, as well as the number of the certificate issued.

3.2.1. SRAC certification mark for quality – is the graphical identification sign for a certified quality management system, as presented in Annex 2.

SRAC certification mark for quality always includes the marking Certificate No. …….. ISO 9001, which identifies the number of the certificate granted by SRAC to the organization, as well as the reference standard ISO 9001 for the certified organization.

SRAC certification mark for quality has the dimensions 6 x 6 cm, on which the figurative element is in white and black and the background is made up of a field in tones of blue, RGB: 237, 237, 241 in the upper part and RGB: 82, 91,153 in the lower part.

3.2.2. SRAC certification mark for environment – is the graphical identification sign for a certified environmental management system – as presented in Annex 3.

SRAC certification mark for environment always includes the marking Certificate No. …….. ISO 14001, which identifies the number of the certificate granted by SRAC to the organization as well as the reference standard ISO 14001 for the certified organization SRAC certification mark for environment has the dimensions 6 x 6 cm, on which the figurative element is in white and black and the background is made up of a field in tones of green, RGB: 238, 245, 239 241 in the upper part and RGB: 20, 128, 109 in the lower part .

3.2.3. SRAC certification mark for occupational health and safety – is the graphical identification sign for a certified occupational health and safety management system, as presented in Annex 4.

SRAC certification mark for occupational health and safety always includes the marking Certificate No. …….. OHSAS 18001, which identifies the number of the certificate granted by SRAC to the organization as well as the reference standard OHSAS 18001 for the certified organization.

SRAC certification mark for occupational health and safety has the dimensions 6 x 6 cm, on which the figurative element is in white and black and the background is made up of a field in tones of pink RGB: 246, 236, 244 in the upper part and RGB: 165, 70, 134 in the lower part.

3.2.4. SRAC certification mark for information security – the graphical identification sign for a certified information security management system – as presented in Annex 5.

SRAC certification mark for information security management system always includes the marking Certificate No. … ISO/IEC 27001, which identifies the applicable reference standard for the certified organization and the number of the certificate granted by SRAC to the organization.

SRAC certification mark for the information security management system has the dimensions 6 x 6 cm, on which the figurative element is in white and black and the background is made up of a field in tones of Purple RGB: 233, 230, 239 in the upper part and RGB: 137, 103, 150 in the lower part . 3.2.5. SRAC certification mark for IT service management system – the graphical identification sign for a certified IT service management – as presented in Annex 6. SRAC certification mark for IT service management system always includes the marking Certificate No. … ISO/IEC 20000-1, which identifies the applicable reference standard for the certified organization and the number of the certificate granted by SRAC to the organization. SRAC certification mark for the IT service management system has the dimensions 6 x 6 cm, on which the figurative element is in white and black and the background is made up of a field in tones of purple RGB: 233, 230, 239 in the upper part and RGB: 137, 103, 150 in the lower part. 3.2.6. SRAC certification mark for quality for medical devices management system – the graphical identification sign for a quality for medical devices management system – as presented in Annex 7. SRAC certification mark for quality for medical devices management system always includes the marking Certificate No............ ISO 13485, which identifies the applicable reference standard for the certified organization and the number of the certificate granted by SRAC to the organization. SRAC certification mark for quality for medical devices management system has the dimensions 6 x 6 cm, on which the figurative element is in white and black and the background is made up of a field in tones of blue RGB: 237, 239, 241 in the upper part and RGB: 78,129,180 in the lower part. 3.2.7. SRAC certification mark for energy management system – the graphical identification sign for energy management system, having as referential ISO 50001 – is presented in Annex 8. SRAC certification mark for the energy management system always includes the marking Certificate No............ ISO 50001, which identifies the applicable reference standard for the

certified organization and the number of the certificate granted by SRAC to the organization.

SRAC certification mark for the energy management system with the referential ISO 50001 has the dimensions 6 x 6 cm, on which the figurative element is in white and black and the background is made up of a field in tones of olive RGB: 244, 245, 237 in the upper part and RGB: 142, 160, 146 in the lower part. 3.2.8. SRAC certification mark for the food safety management system – is the graphical identification sign for the certified food safety management system – as presented in Annex 9. SRAC certification mark for the food safety management system in compliance with ISO 22000 always includes the marking ISO 22000, Certificate No. ………., that identifies the reference standard SR EN ISO 22000 and the number of the certificate granted by SRAC to the organization.

SRAC certification mark for the food safety management system has the dimensions 6 x 6 cm, on which the figurative element is in white and black and the background is made up of a field in tones of yellow galben RGB: 241, 239, 219 in the upper part and RGB: 198, 155, 43 in the lower part.

3.2.9. SRAC certification mark for the audit of the quality management system in compliance with R333/2011/EU of EC from 31.03.2011 – the graphical identification sign for the quality management system in compliance with R333/2011/UE – is presented in annex 10. SRAC certification mark for the quality management system in compliance with R333/2011/UE always includes the marking Certificate No. ........... Reg. (EU) 333, that identifies the reference standard R333 and the number of the certificate granted by SRAC to the organization. SRAC certification mark for quality management system in compliance with R333/2011/EU has the dimensions 6 x 6 cm, on which the figurative element is in white and black and the background is made up of a field in tones of light green RGB: 243, 244, 216 in the upper part and RGB: 136, 147, 75 in the lower part. 3.2.10. SRAC certification mark for the audit of the quality management system in compliance with R1179/2012/EU of Commission from 10.12.2012 – the graphical identification sign for the quality management system in compliance with R1179/2012/EU – is presented in annex 11. SRAC certification mark for the quality management system in compliance with R1179/2012/EU always includes the marking Certificate No. ........... Reg. (EU) 1179, that

identifies the reference standard 1179 and the number of the certificate granted by SRAC to the organization. SRAC certification mark for quality management system in compliance with R1179/2012/UE has the dimensions 6 x 6 cm, on which the figurative element is in white and black and the background is made up of a field in tones of light green RGB: 243, 244, 216 in the upper part and RGB: 136, 147, 75 in the lower part. 3.3. IQNet logo and mark

3.3.1. IQNet mark (Logo) - is the graphical identification sign of IQNet, in the official documentation and correspondence of IQNet and its partners and consists of the name IQNet THE INTERNATIONAL CERTIFICATION NETWORK with figurative element as presented in Annex 12.

It is strictly forbidden the application of IQNet logo by the certified organizations.

3.3.2. IQNet certification mark – is the graphical identification sign for a management system certified by SRAC and it is presented in Annex 13. The IQNet certification mark is granted together with SRAC certification mark and it is only used together with it. 3.3.3. IQNet certification mark for social responsibility – the graphical identification sign for social responsibility, having as referential standard SA 8000 – is presented in Annex 14. IQNet certification mark for social responsibility is the property of IQNet, it is issued by IQNet and identifies the number of the certificate granted by IQNet to the organization and the reference standard SA 8000. SRAC certification mark for social responsibility / SA 8000 is made of three elements:

- A circular element with blue background and having written on it IQNet and SA 8000. - A circular element with white background with text and figurative element. - A rectangular element with blue background and having written in red SA 8000.

3.4. FSSC 22000 logo and mark

3.4.1. SRAC certification mark for the food safety system, in compliance with FSSC 22000 scheme – is the graphical identification sign for a management system certified by SRAC in compliance with FSSC 22000 scheme and it is presented in Annex 15. SRAC certification mark for the food safety management system, in compliance with FSSC 22000 scheme, has the background made up of a field in tones of green RGB: 236, 238, 210 in the upper part and RGB: 100, 161, and 90 in the lower part.

3.4.2. SRAC certification mark for the food safety management system, in compliance with FSSC 22000 scheme, always includes the marking Certificate No. ........... . ........... FSSC 22000, that identifies the number of the certificate granted by SRAC to the organization and the referential - FSSC 22000 scheme. 3.4.3. FSSC 22000 logo is issued with SRAC certification mark and it is used only in conjunction with this mark. 4. PROCEDURE

4.1 Issue of the certification mark 4.1.1 Only the organizations certified by SRAC are entitled to use SRAC certification mark,

following the assessment of the management system for which they applied for certification.

4.1.2 SRAC certificate and IQNet certificate and/or FSSC 22000 certificate – are issued by SRAC separately for each management system – together with SRAC certification mark, either on a CD/DVD. This can be enlarged or reduced respecting its proportions, to dimensions such as to ensure the legibility of the text (certificate number and reference standard). Besides the tones of colors presented above in this text, black is also allowed.

4.1.3. The authorization to use SRAC certification mark is valid as long as the organization continues to fulfil the terms of this regulation and the obligations it has undertaken upon the issue of the certificate of certification and during its validity according to the certification contract. 4.2 Ownership and control

4.2.1 This regulation is an integrating part of the certification contract

4.2.2 Upon request, SRAC provides to the interested parties any information or answers to questions related to the certification mark 4.2.3 After certification is granted, SRAC shall register the organization as a holder of

SRAC certificate and SRAC certification mark.

4.2.4 SRAC certified clients have the following rights and obligations : Rights:

to use SRAC and IQNet and/or FSSC 22000 certification marks to promote the

organization’s image only for those activities and locations included in the scope of certification.

Şters: and shall publish the List of SRAC certified organizations in the magazines “Quality Assurance” and “Quality – Access to Success”, edited by SRAC, as well as on SRAC Website. The list shall be continuously maintained and updated, being available to those interested.

to use SRAC/IQNet certification mark for the certified management systems in correspondence, letterheads, advertisements, on its buildings and advertising materials.

To state, on the product’s packaging or in any accompanying information that it has a certified management system. Accompanying information is considered as separately available or easily detachable. The statement shall in no way imply that the product, process or service is certified by this means. The statement shall include reference to:

- Identification of the certified client (e.g. brand or name); - The type of management system (e.g. quality, environment) and the

applicable standard; - The certification body issuing the certificate.

Obligations: to conform to this regulation for using SRAC certification mark and IQNet and/or

FSSC 22000 certification marks when making reference to it certification status in communication media, such as the Internet, brochures or advertising, or other documents;

to make no or permit any misleading statements regarding its certification; to make no use or permit the use of the certificate or any part thereof in a

misleading manner; upon suspension, withdrawal or expiry of its certification, to discontinue use of

all advertising materials that contain reference to certification; to amend all advertising materials when the scope of certification has been

reduced; not to allow reference to its management system certification to be used in

such a way as to imply that SRAC certifies a product (including service) or a process;

not to imply that the certification applies to activities that are outside the scope of certification;

to make no use of its certification in such a manner that would bring SRAC and/or the certification system into disrepute and loss of public trust.

to make no use of the mark when the validity of the certificate is exceeded; to make no use of the mark on products and their primary packaging in a

manner that would mislead to the interpretation of product compliance; to make no use of the mark on test, calibration or inspection reports or on those

scopes for which the organization is not certified.

4.2.5 The use of SRAC/IQNet and/or FSSC 22000 certification mark is strictly limited to the certified organization and it cannot be demised to a third party or successor.

4.2.6 The use of SRAC/IQNet and/or FSSC 22000 certification mark is allowed only during the validity term of the certificate issued by SRAC.

4.2.7 SRAC, IQNet and/or FSSC 22000 certification marks cannot be transferred to a third party or submitted to any enforcement measures. 4.3 Monitoring the use of the certification marks

4.3.1 During the programmed or un-programmed audits and of other surveillance activities conducted by SRAC to the certified organizations, SRAC shall verify the observance, by the certified organization, of the manner of using the certificates and marks.

4.3.2 In order to solve the situations of abusive use of the certification mark by the certified organization, SRAC imposes the accomplishment of an action plan (corrections/ corrective actions), which might inclusively include the suspension or withdrawal of the right to use the mark of legal actions, as appropriate.

4.3.3 SRAC shall keep the record of all complaints related to the use of the certification mark.

4.3.4 If the provisions of this Regulation are breached, SRAC has the right to withdraw, at any time, the right to use the certification mark for those certified organizations that are not fulfilling the obligations they have undertaken.

4.3.5 This decision shall be applied instantly, and within 6 months, all the necessary measures should be taken to remove the certification mark from all documents, windows, etc.

4.3.6 If an organization continues to use the certification mark, although this right has been withdrawn, and the above-mentioned period has ended, SRAC has the right to claim material damages by any procedural means.

4.4 The use of IQNet certification mark

4.4.1 Only the organizations certified by IQNet partners, among which is also SRAC, are entitled to use IQNet certification mark.

4.4.2 IQNet certificate and IQNet certification mark are granted together with SRAC certificate and shall be used only with SRAC certificate and certification mark and under the same terms (see par. 4.2). IQNet certification mark can be enlarged or reduced, but other changes are not allowed. The colors are specified in Annexes of the present procedure.

4.5. Conditions of use of FSSC 22000 logo and of SRAC certification mark FSSC 22000 4.5.1. SC SRAC CERT SRL uses FSSC 22000 logo only in conjunction with SRAC logo, on the issued certificates, stationary and documents associated with the certification activities.

4.5.2. An organization certified for FSSC 22000 can use FSSC 22000 logo only in conjunction with the certification mark of SC SRAC CERT S.R.L. on facilities, documents and web-sites, subject of the below mentioned conditions and of the provisions of the present Regulation of use of the certification marks.

4.5.3. The FSSC 22000 logo must be trebuie sa fie reprodus în culorile specificate şi la o mărime, care să facă toate elementele acestui logo să poata fi distinse cu claritate.

4.5.4. When wether SC SRAC CERT SRL, or a certified organization uses the FSSC 22000 logo, its size must not be different from the size of the mark of the certification body.

4.5.5. FSSC 22000 logo cannot be used by SC SRAC CERT SRL on any document, web-site or other public materials, except for the situation when documents are totally or partially related to the certification activities in compliance with FSSC 22000 scheme. This allows SC SRAC CERT SRL to include the accreditation mark on the pre-printed papers, with letterhead.

4.5.6. Neither FSSC 22000 logo, nor the mark of the certification body cannot be used by the certified organization on products, on products’ labels or packaging or in any other manner that might suggest that SC SRAC CERT SRL certified or approved any product, process or service for the certified location.

4.5.7. If the FSSC 22000 board (The Board of Stakeholders FSSC 22000) shall adopt other decisions regarding the use of FSSC 22000 logo, these shall be considered part of the agreement signed with the Foundation (The Foundation for Food Safety Certification) and shall be implemented.

4.5.8. Any non certification found during the accreditation audits related to the use of logo shall determine actions that correct the unnapropriate use of the logo on the issued documents, and corrective actions for the future use of the logo.

4.5.9. SC SRAC CERT SRL shall audit the use of FSSC 22000 logo by the certified organizations at every surveillance or recertification audit . Any non certification associated with the use of the logo shall determine actions that will correct any unappropriate use of the logo on the issued documents and corrective actions for the future use of the logo. 4.5.10.
