DESCRIPTION
Neste trabalho foi analisado o problema das ocupações humanas informais em Áreas de Preservação Permanente (APP), e foram levantados os aspectos que contribuem para a formação dessa ilegalidade, e os instrumentos jurídicos e ambientais necessários para proceder à regularização. A metodologia baseia-se no estudo dos instrumentos jurídicos que estão previstos no Estatuto da Cidade, na Constituição Federal de 1988 e na análise das normas ambientais que discorrem sobre o assunto da Regularização Fundiária em Áreas de Preservação Permanente, em especial a Resolução CONAMA nº 369 que dispõe sobre as formas de intervenção ou de supressão da vegetação em obras de interesse social em APP e o Projeto de Lei nº 3.057/2000 que revisa a Lei de Parcelamento do Solo o qual possui um capítulo dedicado à Regularização Fundiária Sustentável.This work has examined the problem of informal human occupations in Permanent Preservation Areas (PPA). The aspects that contribute to the formation of the illegality, and legal and environmental instruments necessary to the regularization were raised. The methodology is based on the study of the various instruments provided by the City Statute and the Federal Constitution of 1988 relating to Land Regularization and examining the legal and environmental standards that discourse upon it, such as CONAMA (National Council of the Environment) Resolution No. 369, which provides on the forms of intervention or removal of vegetation in works of social interest in PPA and Draft Law No. 3057/2000 which revises the Land Division Law and that has a chapter dedicated to Sustainable Land Regularization.Márcio Estevam da SilvaTRANSCRIPT
