Aloha Pau Hana families,

Will this craziness ever end and will we ever be back to a more normal way of life? Well, I guess if I had the answer to that I would be a millionaire! I would like to start off by thanking all of you who have continued to have faith in me and our program. It has not been easy since March 2020 and I appreciate your loyal-ty and never giving up attitude!

So…here we go on our next adventure and the Fall/Winter 2021-2022 season. Al-though we are not back in Denison ….we have alternative pool space…the oppor-tunity to train and have MEETS!!!!

The registration packet may seem long but it should have all the info needed to answer your questions. There are also forms that we need to pass onto you that you need to sign and be familiar with in order to be on Pau Hana. We will follow all guidelines asked of us for each facility and I will make sure everyone is updat-ed before the season starts.

You have the opportunity to offset your swim fees by participating in our TEAM FUNDRAISERS. Your first opportunity is to sell hole sponsorships (signs) at our 3rd Annual Pau Hana Swim Team Golf Scramble. The event is at the Denison Golf Club on Sept. 25th. The hole sponsorships are $100 per sign and you get $75 cred-ited back!! So the more you sell the more you can apply and offset your account. The second fundraiser will occur in October and will be a holiday plant fundrais-er.

I am looking forward to our upcoming season and making more memories with each of you. Here is to incredibly FAST swimming, smiling faces, and going above and beyond what you may expect possible. Dream big…try harder than ever…listen and ap-ply all that your coaches tell you…and believe !! We are OHANA and that means you will always matter and have a family behind you.

Pau Hana Mission StatementThe mission of Pau Hana Swim Team is to provide a high-quality age-group competitive swim program in a safe and supportive swimming environment, free from abuse, with positive, chal-lenging coaching and technique instruction that helps each athlete reach their unique potential and benefits them physically, emotionally, and mentally.

Registration InformationRegistration is completed online on our team website, www.pauhanaswimteam.com, by clicking “Online Registration” to begin the process and following the onscreen prompts after that. Re-turning swimmers, please be sure to update all of your information including email, address, ect. The forms below/paperwork will be included with the online registration. You must agree/initial online during the registration process. No paperwork needs to be turned into your coaches. Copies are included in the packet for your review.

Team Vendor & ApparelThe Pau Hana Swim Team is a SPEEDO sponsored program. They are the official supplier of our swim equipment, suits, and warm-ups. Their support allows our members to receive dis-counts on Speedo products. In return for their support we are expected to support SPEEDO and their products. So you are asked to wear all SPEEDO suits and attire when they are re-quired TEAM Apparel.

All swimmers will be required to wear our team uniform to all competitions. No exceptions. team uniform will consist of:

Our team vendor is Aquatic Outfitters of Ohio. Team suits, sweats, bags, parka’s, etc. can be purchased through them and a team fitting is scheduled for September 21 (more details coming soon). Aquatic Outfitters can be found by clicking on their logo on the left hand side of our website (this takes you to our team page) or at aquaticoutfittersofohio.com or 330-498-9179. More information will be coming soon on our team fitting.

We will also have a team apparel sale that same evening where you may purchase various t-shirts, sweats and other apparel (other than Speedo apparel that can be purchased from our team vendor). More information on the apparel sale will be coming soon as well but please be prepared to pay separately for Aquatic Outfitters and team apparel (and please, only cash or checks payable to Pau Hana Swim Team for team apparel. AO will accept credit cards).

Team Fees and Expenses

Team Fees are outlined by practice group on pages 6 & 7 below. Your payment options to pay team fees - you may pay by credit card in full or monthly installments (or you may pay be check ahead of the first of the month when credit cards are automatically charged). Our team will also be participating in fundraisers over the course of the season to help offset the costs associated with the covid restrictions and guidelines we are incurring. These fundraisers can be used to offset your swim fees/travel fees so it is up to you how much you want to participate (Example: if you sell a hole sponsorship for our golf outing Sept 25 @ $100 you will be credited $75 to your account. Sign info due Sept 10th to Bill Arnholt ([email protected]) So the more you sell the more you are credited!! Our other fundraiser will be the Holiday Fundraiser.

Registration fee: A non-refundable $25 registration fee per family is required with registration

Travel fee: $150 for Kamehameha, Alani, Akala, $125 Polu & Poni and $100 Koa & Koa 2 which will be used to cover coaches travel expenses for meets.

USA Registration Fee: $79

Fund Raising Fee: $150 Each family is responsible for raising $150. This can be accomplished by selling 2 hole sponsorships/donating to the golf outing. We will also have other fundraisers that you can offset this fee (which means you will be billed this fee initially but will be credited once you reach the $150 amount). Otherwise if you choose not to participate in any of our team fundraisers you may opt out and pay $150.

Monthly Dues: Your account will be charged on the 1st of each month and will be considered past due on the 15th of each month. Delinquent accounts will be automatically charged a $15 service charge and the credit card on file will be charged.

Credit Card ProcessingYour registration and meet fees can be automatically charged to your credit card (or bank ac-count via ACH) each month - no more worries about having money in your escrow account and constant monitoring of your balance. This can be set up during the registration process or af-terward in your account - please note that a credit card transaction fee will be added to your monthly total to offset the fees charged by Mastercard/Visa/Discover. If you prefer to pay by check, please pay your monthly payment prior to the 1st of the following month (a check can be given to your coach at practice). Practice GroupsThe Pau Hana Swim Team offers progressive training and practice groups from the novice swimmer to the elite swimmer. It is the goal of the Pau Hana Swim Team to offer age specific training for all of our athletes geared towards challenging each individual and developing each individual to the best of THEIR ability. Swimmers are assigned to practice groups by the coach-ing staff. They are continually evaluated and moved up as deemed ready. Any new swimmers must be evaluated prior to registration (please contact the Head Coach, Teresa Fightmaster, to schedule).

Kamehameha 1 & 2 (The One Set Apart) $1,740 or 6 monthly payments of $290This group is made up of swimmers 13 and older who have increased their level of commitment to and focus on swimming and want to get the most out of their training every practice. Training emphasis is on fine tuning stroke mechanics, increased physical conditioning, and improved racing strategies. Goals for this group are to compete and score at USA JO’s and Zones, the High School District & State meets, as well as the USA Sectionals and Junior National meets. They are expected to compete at the highest level meet they qualify for during the season with the team.

You must also be committed to your workouts and training to the best of your ability each prac-tice. You are also highly encouraged to submit a goals/expectation sheet to Teresa the first week of the season.

Hui Alani (Team Orange) $1,590 or 6 monthly payments of $265.00This group is for high school swimmers, 14 and over, who are interested in increasing their conditioning level as well as working on proper stroke mechanics. Workouts will consist of train-ing all 4 strokes, drill work as well as instruction on race strategy. The goal for this group is to build a great stroke and conditioning base to be better prepared for high school swim season. They should also be willing to compete at the USA Senior meet championships at season’s end.

Hui Akala (Team Pink) $1,590 or 6 monthly payments of $265.00This group is for the more experienced and committed 11-14 year old swimmers who are seri-ous about their goals and training. Training emphasis is on advanced stroke technique work, increased physical conditioning, and improving racing strategies. The goal for this group is to qualify for Junior Olympics. They should be willing to compete at the highest level meet that they qualify for during the season with the team.

Hui Polu (Team Blue) $1,380 or 6 monthly payments of $230.00This group is for the 9-14 year old swimmers who are increasing their commitment to the sport of swimming. Training emphasis is on proper stroke mechanics, increasing their conditioning level, and intensity of workouts. The goal for this group is to progress to qualifying for and partic-ipating at the Junior Olympics.

Hui Poni (Poh’nee) (Team Purple) $1,260 or 6 monthly payments of $210.00This group is made up of 8 - 12  year old swimmers. Training focuses on learning proper stroke mechanics for all four competitive strokes, working on starts and turns, and increased condition-ing. The goals for this group are to have fun, learn while being challenged to compete at their own unique ability levels and competing at the USA Regional meet.

Koa Kids (Warrior) $400 or 3 monthly payments of $133.33Designed for young athletes who enjoy swimming and want to compete and develop over the winter. Focuses on technique and stroke development in a fun and rewarding environment. This year the group will be split into two groups, but will have a combined practice on Sundays. Both groups will have the opportunity to compete in 2-4 meets during the season.

Season starts: October 18, 2021 for Koa 2 November 1, 2021 for Koa 1

Important Covid Information For our 2021-2022 swimming season we will be following the guidelines available through the CDC, current state/local government and USA swimming that we followed over the summer.

You will be expected to follow this specific information as it worked well over the summer and we will update accordingly. These protocols are in place to make sure we do everything to the best of our ability to stay safe and healthy. I am relying on everyone doing their part and com-municating to coaches if there are any health issues. When in doubt stay home.

Ohio Department of Health Concussion Information Sheet For Youth Sports Organizations

Dear Parent/Guardian and Athletes, This information sheet is provided to assist you and your child in recognizing the signs and symptoms of a concussion. Every athlete is different and responds to a brain injury differently, so seek medical attention if you suspect your child has a concus-sion. Once a concussion occurs, it is very important your athlete return to normal activities slowly, so he/she does not do more damage to his/her brain.

What is a Concussion?

A concussion is an injury to the brain that may be caused by a blow, bump, or jolt to the head. Concussions may also happen after a fall or hit that jars the brain. A blow elsewhere on the body can cause a concussion even if an athlete does not hit his/her head directly. Concussions can range from mild to severe, and athletes can get a concussion even if they are wearing a helmet. Signs and Symptoms of a Concussion

Athletes do not have to be “knocked out” to have a concussion. In fact, less than 1 out of 10 concussions result in loss of consciousness. Concussion symptoms can develop right away or up to 48 hours after the injury. Ignoring any signs or symptoms of a concussion puts your child’s health at risk! Signs Observed by Parents of Guardians i� Appears dazed or stunned. i� Is confused about assignment or position. i� Forgets plays. i� Is unsure of game, score or opponent. i� Moves clumsily. i� Answers questions slowly. i� Loses consciousness (even briefly). i� Shows behavior or personality changes (irritability,

sadness, nervousness, feeling more emotional). i� Can’t recall events before or after hit or fall. Symptoms Reported by Athlete i� Any headache or “pressure” in head. (How badly it hurts

does not matter.) i� Nausea or vomiting. i� Balance problems or dizziness. i� Double or blurry vision. i� Sensitivity to light and/or noise i� Feeling sluggish, hazy, foggy or groggy. i� Concentration or memory problems. i� Confusion. i� Does not “feel right.” i� Trouble falling asleep. i� Sleeping more or less than usual. Be Honest

Encourage your athlete to be honest with you, his/her coach and your health care provider about his/her symptoms. Many young athletes get caught up in the moment and/or feel pressured to return to sports before they are ready. It is better to miss one game than the entire season… or risk permanent damage!

Seek Medical Attention Right Away

Seeking medical attention is an important first step if you suspect or are told your child has a concussion. A qualified health care professional will be able to determine how serious the concussion is and when it is safe for your child to return to sports and other daily activities.

i� No athlete should return to activity on the same day he/she gets a concussion.

i� Athletes should NEVER return to practices/games if they still have ANY symptoms.

i� Parents and coaches should never pressure any athlete to return to play.

The Dangers of Returning Too Soon

Returning to play too early may cause Second Impact Syndrome (SIS) or Post-Concussion Syndrome (PCS). SIS occurs when a second blow to the head happens before an athlete has completely recovered from a concussion. This second impact causes the brain to swell, possibly resulting in brain damage, paralysis, and even death. PCS can occur after a second impact. PCS can result in permanent, long-term concussion symptoms. The risk of SIS and PCS is the reason why no athlete should be allowed to participate in any physical activity before they are cleared by a qualified health care professional.

Recovery

A concussion can affect school, work, and sports. Along with coaches and teachers, the school nurse, athletic trainer, employer, and other school administrators should be aware of the athlete’s injury and their roles in helping the child recover.

During the recovery time after a concussion, physical and mental rest are required. A concussion upsets the way the brain normally works and causes it to work longer and harder to complete even simple tasks. Activities that require concentration and focus may make symptoms worse and cause the brain to heal slower. Studies show that children’s brains take several weeks to heal following a concussion.

Returning to Daily Activities

1. Be sure your child gets plenty of rest and enough sleep at night – no late nights. Keep the same bedtime weekdays and weekends.

2. Encourage daytime naps or rest breaks when your child feels tired or worn-out.

3. Limit your child’s activities that require a lot of thinking or concentration (including social activities, homework, video games, texting, computer, driving, job-­‐related activities, movies, parties). These activities can slow the brain’s recovery.

4. Limit your child’s physical activity, especially those activities where another injury or blow to the head may occur.

5. Have your qualified health care professional check your child’s symptoms at different times to help guide recovery.

Returning to School

1. Your athlete may need to initially return to school on a limited basis, for example for only half-days, at first. This should be done under the supervision of a qualified health care professional.

2. Inform teacher(s), school counselor or administrator(s) about the injury and symptoms. School personnel should be instructed to watch for:

a. Increased problems paying attention. b. Increased problems remembering or learning new information. c. Longer time needed to complete tasks or assignments. d. Greater irritability and decreased ability to cope with stress. e. Symptoms worsen (headache, tiredness) when doing schoolwork.

3. Be sure your child takes multiple breaks during study time and watch for worsening of symptoms.

4. If your child is still having concussion symptoms, he/she may need extra help with school-­‐related activities. As the symptoms decrease during recovery, the extra help or supports can be removed gradually.

Returning to Play

1. Returning to play is specific for each person, depending on the sport. Starting 4/26/13, Ohio law requires written permission from a health care provider before an athlete can return to play. Follow instructions and guidance provided by a health care professional. It is important that you, your child and your child’s coach follow these instructions carefully.

2. Your child should NEVER return to play if he/she still has ANY symptoms. (Be sure that your child does not have any symptoms at rest and while doing any physical activity and/or activities that require a lot of thinking or concentration).

3. Be sure that the athletic trainer, coach and physical education teacher are aware of your child’s injury and symptoms.

4. Your athlete should complete a step-by-step exercise-based progression, under the direction of a qualified healthcare professional.

5. A sample activity progression is listed below. Generally, each step should take no less than 24 hours so that your child’s full recovery would take about one week once they have no symptoms at rest and with moderate exercise.*

Sample Activity Progression*

Step 1: Low levels of non-contact physical activity, provided NO SYMPTOMS return during or after activity. (Examples: walking, light jogging, and easy stationary biking for 20-­‐30 minutes). Step 2: Moderate, non-contact physical activity, provided NO SYMPTOMS return during or after activity. (Examples: moderate jogging, brief sprint running, moderate stationary biking, light calisthenics, and sport-­‐specific drills without contact or collisions for 30-­‐45 minutes). Step 3: Heavy, non-­‐contact physical activity, provided NO SYMPTOMS return during or after activity. (Examples: extensive sprint running, high intensity stationary biking, resistance exercise with machines and free weights, more intense non-­‐contact sports specific drills, agility training and jumping drills for 45-­‐60 minutes). Step 4: Full contact in controlled practice or scrimmage. Step 5: Full contact in game play. *If any symptoms occur, the athlete should drop back to the previous step and try to progress again after a 24 hour rest period.

Pau Hana Swim Team Code of Conduct for Athletes and Parents

This Code of Conduct MUST be read and signed by swimmers and a parent/guardian BEFORE any swimmer will be allowed to take part in training and competition. By signing below, an acknowledgement of the contents of this Code of Conduct is made and that the swimmer

agrees to abide by the same.

ATHLETE CODE OF CONDUCT

The purpose of a code of conduct for athletes is to establish a consistent expectation for athletes’ behavior.

I, the undersigned athlete, participating in training and competitions with the Pau Hana Swim Team, understand and agree to comply with the below-listed guidelines as set forth by the Pau Hana Swim Team. Any additional guidelines as needed may be established by the Head Coach.

General Behavior 1. The transportation, possession or use of alcohol, tobacco products, or illegal drugs by any Pau Hana

team member is prohibited. 2. Pau Hana swimmers will display proper respect and good sportsmanship toward coaches, officials,

administrators, competitors, teammates, and the public to include both their person and their property during all practices, meets and team activities. Facilities (including locker rooms) and other property will also be respected.

3. Illegal or inappropriate behavior that will reflect negatively on the Pau Hana Swim Team or be detrimental to performance objectives and will not be tolerated.

4. Bullying will not be tolerated within the Pau Hana Swim Team. 5. Pau Hana swimmers will set good examples of behavior and work ethic for younger teammates. 6. Pau Hana swimmers will refrain from foul language, violence, behavior deemed dishonest, offensive, or

illegal. 7. Pau Hana swimmers will obey all of USA Swimming’s rules and codes of conduct.

Travel Behavior 1. No athlete will travel when any illness is evident to the parents or coaching staff. 2. Unless otherwise excused or instructed by a coach, participants in a team trip will attend all team

functions (on time), to include meetings, practices, and any other team sanctioned event. 3. There will be no male athletes in female athletes’ rooms and no female athletes in male athletes’

rooms. 4. Athletes will not ride in a coach’s vehicle without another adult present who is the same gender as the

athlete unless prior parental permission is obtained. 5. Any additional guidelines will come from the staff as needed.

Implementation Failure to comply with these guidelines will subject the swimmer to discipline, up to and including suspension and/or dismissal from the Pau Hana Swim Team. If any failure to comply with these guidelines occurs during a travel trip, the swimmer may be sent home at the swimmer’s expense.

PARENT CODE OF CONDUCT

The purpose of a code of conduct for parents is to establish consistent expectations for behavior by parents.

As a parent/guardian of an athlete participating in training with the Pau Hana Swim Team, I understand the important growth and developmental support that my child’s participation fosters. I also understand that it is essential to provide the coaching staff with respect and the authority to coach the team. And I understand and agree to comply with the below-listed guidelines as set forth by the Pau Hana Swim Team. Any additional guidelines as needed may be established by the Head Coach.

General Behavior

1. Pau Hana parents will set the right example for our children by demonstrating sportsmanship and showing respect and common courtesy always to the team members, coaches, competitors, officials, parents, and all facilities.

2. Pau Hana parents will get involved by volunteering, observing practices, cheering at meets, and talking with their children and their coach about their progress.

3. Pau Hana parents will refrain from coaching their children from the stands during practices or meets. 4. Pau Hana parents understand that criticizing, name-calling, use of abusive language or gestures

directed toward coaches, officials, volunteers, and/or any participating swimmer will not be tolerated. 5. Pau Hana parents will respect the integrity of the officials. 6. Pau Hana parents will direct their concerns first to their swimmer’s primary coach; then, if not satisfied,

to the Head Coach.

Implementation Failure to comply with these guidelines may result in disciplinary action from the Pau Hana Swim Team.

What is Lindsay’s Law? Lindsay’s Law is about Sudden Cardiac Arrest (SCA) in youth athletes. It covers all athletes 19 years or younger who practice for or compete in athletic activities. Activities may be organized by a school or youth sports organization.

Which youth athletic activities are included in Lindsay’s law? • Athletics at all schools in Ohio (public and non-public)

• Any athletic contest or competition sponsored by or associated with a school

• All interscholastic athletics, including all practices, interschool practices and scrimmages

• All youth sports organizations

• All cheerleading and club sports, including noncompetitive cheerleading

What is SCA? SCA is when the heart stops beating suddenly and unexpectedly. This cuts off blood flow to the brain and other vital organs. People with SCA will die if not treated immediately. SCA can be caused by 1) a structural issue with the heart, OR 2) a heart electrical problem which controls the heartbeat, OR 3) a situation such as a person who is hit in the chest or a gets a heart infection.

What is a warning sign for SCA? If a family member died suddenly before age 50, or a family member has cardiomyopathy, long QT syndrome, Marfan syndrome or other rhythm problems of the heart.

What symptoms are a warning sign of SCA? A young athlete may have these things with exercise:

• Chest pain/discomfort

• Unexplained fainting/near fainting or dizziness

• Unexplained tiredness, shortness of breath or difficulty breathing

• Unusually fast or racing heart beats

What happens if an athlete experiences syncope or fainting before, during or after a practice, scrimmage, or competitive play? The coach MUST remove the youth athlete from activity immediately. The youth athlete MUST be seen and cleared by a health care provider before returning to activity. This written clearance must be shared with a school or sports official.

What happens if an athlete experiences any other warning signs of SCA? The youth athlete should be seen by a health care professional.

Who can evaluate and clear youth athletes? A physician (MD or DO), a certified nurse practitioner, a clinical nurse specialist, certified nurse midwife. For school athletes, a physician’s assistant or licensed athletic trainer may also clear a student. That person may refer the youth to another health care provider for further evaluation.

What is needed for the youth athlete to return to the activity? There must be clearance from the health care provider in writing. This must be given to the coach and school or sports official before return to activity.

All youth athletes and their parents/guardians must view the Ohio Department of Health (ODH) video about Sudden Cardiac Arrest, review the ODH SCA handout and then sign and return this form.

WAIVER AND RELEASE As a condition to participating in any and all events and activities associated with the Pau Hana Swim Team (“Pau Hana”), including, without limitation, swim practices, swim competitions, sponsored events and transportation to or from any such activities (collectively, “Activities”), the undersigned, acknowledges that the Activities are subject to inherent risks, including, without limitation, the risk of personal injury (or even death) resulting from physical activity, drowning or the contraction of communicable diseases (e.g., COVID-19), and agrees to voluntarily assume any and all such risks. The undersigned believes himself or herself to be fit and capable of participating in the Activities. To the maximum extent permitted by applicable law, the undersigned, on behalf of him or herself and his or her heirs, administrators and estate, hereby voluntarily, irrevocably and forever: (1) releases Pau Hana, its affiliates and its and their current and former coaches, employees, agents, representatives, contractors and anyone else acting on their behalf (collectively, "Released Parties") from any and all liability whatsoever (including, without limitation, for personal injury or death) with respect to the Activities, including, without limitation, any such liability based on whole or in part on the negligence of any Released Party; (2) waives his or her right to sue or make any claim whatsoever against any Released Party for any damages or losses arising out of or in connection with the Activities; (3) agrees never to sue or make any claim against any Released Party for damages or losses suffered in connection with the Activities; and (4) agrees to indemnify and hold each Released Party harmless from any and all claims, demands, suits, damages, expenses, costs, liabilities, judgments, settlements and losses of any and every kind suffered or incurred by any Released Party and arising, directly or indirectly, out of or in connection with the breach of any agreement of the undersigned in clause (1), (2) or (3) of this paragraph. THIS POLICY APPLIES TO: In-Program Contact: Any contact (including communications, interactions or activities) between an Adult Participant and any Minor Athlete(s) related to participation in sport. Examples include, but are not limited to: competition, practices, camps/clinics, training/instructional sessions, pre/post event meals or outings, team travel, video review, team- or sport-related team building activities, celebrations, award ceremonies, banquets, team- or sport-related fundraising or community services, sport education, competition site visits, conventions and/or summits. Adult Participants: Any adult 18 years of age or older who is a:

x USA Swimming member, either athlete or non-athlete; x Participating non-member (e.g., meet marshals, meet computer operators, timers, etc.); x Authorized, approved or appointed by USA Swimming, Zones, Local Swimming Committees

(“LSCs”) or member clubs to have regular contact with (e.g., ongoing interactions during a 12-month period wherein the individual is in a role of active engagement) or authority over Minor Athletes; and/or

x Within the governance or disciplinary jurisdiction of USA Swimming, Zones, LSCs or member clubs.

GENERAL REQUIREMENT

USA Swimming Zones, LSCs and member clubs are required to implement this Minor Athlete Abuse Prevention Policy in full. The Minor Athlete Abuse Prevention Policy must be reviewed and agreed to in writing by all athletes, parents/legal guardians, coaches and other non-athlete members of member clubs on an annual basis with such written agreement to be retained by the club or LSC, as applicable.

DEFINITIONS Athlete: A USA Swimming athlete member. Authority: When one person’s position over another person is such that, based on the totality of the circumstances, they have the power or right to direct, control, give orders to, or make decisions for that person (e.g., when a power imbalance exists). Dual Relationship: When an Adult Participant has a relationship with a Minor Athlete that is outside of the sport program. Examples of Dual Relationships include, but are not limited to, family members, mental health professionals, teachers, medical professionals and family friends. Emergency Circumstances: A serious, unexpected and possibly dangerous situation that requires quick action and cannot be avoided. Emergency circumstances include, but are not limited to: a physical, mental or emotional medical emergency involving the Minor Athlete, relative of the Minor Athlete or relative of an Adult Participant; a Minor Athlete’s suicidal ideations/behavior; a report of abuse; a severe weather event; and last-minute practice changes. Electronic Communication: Includes, but not limited to, phone calls, emails, videoconferencing, video coaching, text-messaging and social media. Event or Facility Under Partial or Full Jurisdiction: Includes any USA Swimming sanctioned event (including all travel and lodging in connection with participation in the event) or any facility that USA Swimming, Zones, LSCs or member clubs owns, leases or rents for practice, training or competition. In-Program: Activities related to participation in sport. Examples include, but are not limited to: competition, practices, meetings, camps/clinics, training/instructional sessions, pre/post event meals or outings, team travel, video review, team- or sport-related team building activities, celebrations, award

ceremonies, banquets, team- or sport-related fundraising or community services, sport education, competition site visits, conventions, conferences, summits and/or workshops. In-Program Contact: Any contact (including communications, interactions or activities) between an Adult Participant and any Minor Athlete(s) related to participation in sport. Examples include, but are not limited to contact occurring at or related to: competition, practices, meetings, camps/clinics, training/instructional sessions, pre/post event meals or outings, team travel, video review, team- or sport-related team building activities, celebrations, award ceremonies, banquets, team- or sport-related fundraising or community services, sport education, competition site visits, conventions, conferences, summits and/or workshops. In-Program Massage: Any Massage involving an Adult Participant and any Minor Athlete(s) related to participation in sport. Examples include, but are not limited to Massage occurring at or related to: competition, practices, meetings, camps/clinics, training/instructional sessions, pre/post event meals or outings, team travel, video review, team- or sport-related team building activities, celebrations, award ceremonies, banquets, team- or sport-related fundraising or community services, sport education, competition site visits, conventions, conferences, summits and/or workshops. In-Program Travel: Any transportation or travel involving an Adult Participant and any Minor Athlete(s) related to participation in sport authorized or funded by the Organization. Examples include, but are not limited to transportation or travel to or related to: competition, practices, meetings, camps/clinics, training/instructional sessions, pre/post event meals or outings, team travel, video review, team- or sport-related team building activities, celebrations, award ceremonies, banquets, team- or sport-related fundraising or community services, sport education, competition site visits, conventions, conferences, summits and/or workshops. Massage: Any massage, rubdown, athletic training modality including physical modalities (e.g., stretching, physical manipulation, injury rehabilitation, etc.) and electronic or instrument assisted modalities (e.g., stim treatment, dry needling, cupping, etc.). Minor Athlete: An athlete under 18 years of age who is a USA Swimming member or was a USA Swimming member within the previous 12 months. Organization: Pau Hana Swim Team

EXCEPTIONS [Note: Exceptions apply only where specified]

Close-In-Age Exception: In-Program Contact between an Adult Participant and a Minor Athlete is permitted if:

a. The Adult Participant has no authority over the Minor Athlete; and b. The Adult Participant is not more than four years older than the Minor Athlete.

Dual Relationship Exception: An Adult Participant has a dual role or relationship with a Minor Athlete. This exception requires written consent of the Minor Athlete’s parent/legal guardian at least annually.

ONE-ON-ONE INTERACTIONS I. Observable and Interruptible

All one-on-one In-Program Contact interactions between a Minor Athlete and an Adult Participant must occur at an observable and interruptible distance from another adult, except: a. In emergency circumstances; b. When a Dual Relationship exists; and/or c. When the Close-In-Age Exception applies.

MEETINGS AND INDIVIDUAL TRAINING SESSIONS I. Meetings

a. Meetings between a Minor Athlete and an Adult Participant may only occur if another adult is present and where interactions can be easily observed and at an interruptible distance from another adult.

b. If a one-on-one meeting takes place, the door to the room must remain unlocked and open. If available, it must occur in a room that has windows, with the windows, blinds, and/or curtains remaining open during the meeting.

c. Meetings must not be conducted in an Adult Participant or Athlete’s hotel room or other overnight lodging location during In-Program Travel.

II. Meetings with Licensed Mental Health Care Professionals and/or Health Care Providers

If a licensed mental health care professional and/or health care provider meets one-on-one with a Minor Athlete at an Event or Facility Under Partial or Full Jurisdiction of the Organization in conjunction with participation, the meeting must be observable and interruptible by another adult, except if: a. The door remains unlocked; b. Another adult is present at the facility; c. The other adult is advised that a closed-door meeting is occurring although the Minor

Athlete’s identity does not need to be disclosed; d. The Organization is notified that the licensed mental health care professional and or health

care provider will be meeting with a Minor Athlete; and e. The licensed mental health care professional and/or health care provider obtains consent

consistent with applicable laws and ethical standards, which can be withdrawn at any time. III. Individual Training Sessions

a. In-Program one-on-one individual training sessions outside of the regular course of training and practice between Adult Participants and Minor Athletes must be observable and interruptible by another adult, except:

i. When a Dual Relationship exists; and/or ii. When the Close-In-Age Exception applies.

b. The Adult Participant providing the individual training session must receive advance, written consent from the Minor Athlete’s parent/legal guardian at least annually, with a copy provided to the Pau Hana Swim Team, which can be withdrawn at any time.

c. Parents/legal guardians must be allowed to observe the individual training session.

ELECTRONIC COMMUNICATIONS I. Content

All Electronic Communication from Adult Participants to Minor Athletes must be professional in nature.

II. Open and Transparent

a. If an Adult Participant communicates one-on-one with a Minor Athlete via Electronic Communications, the Minor Athlete’s parent/legal guardian must be copied or included. If a Minor Athlete communicates to the Adult Participant privately first, said Adult Participant must copy or include the Minor Athlete’s parent/legal guardian on any Electronic Communication response to the Minor Athlete. Adult Participants must only use Electronic Communication platforms that allow for Open and Transparent communication.

b. The following exceptions apply to Section II(a): i. In emergency circumstances; ii. When a Dual Relationship exists; and/or iii. When the Close-In-Age Exception applies.

c. When an Adult Participant communicates electronically to the entire team or any number of Minor Athletes on the team, said Adult Participant must copy another Adult Participant.

III. Requests to Discontinue

Parents/legal guardians may request in writing that their Minor Athlete not be contacted through any form of electronic communication by the Organization or by an Adult Participant subject to this Policy. The Organization must abide by any such request that the Minor Athlete not be contacted via electronic communication, or included in any social media post, absent emergency circumstances.

IV. Hours

Electronic communications must only be sent between the hours of 5:00 a.m. and 9:00 p.m. local time for the location of the Minor Athlete, unless emergency circumstances exist, or during competition travel.

V. Prohibited Electronic Communication

a. Adult Participants are not permitted to maintain private social media connections with Minor Athletes and such Adult Participants are not permitted to accept new personal page requests on social media platforms from Minor Athletes, unless the Adult Participant has a fan page, or the contact is deemed as celebrity contact as opposed to regular contact. Existing social media connections with Minor Athletes must be discontinued. Minor Athletes may “friend”, “like” or “follow” the Organization’s official page.

b. Adult Participants must not send private, instant or direct messages to a Minor Athlete through social media platforms.

c. The following exceptions apply to Section V: i. When a Dual Relationship exists; and/or ii. When the Close-In-Age Exception applies.

IN-PROGRAM TRAVEL AND LODGING I. Transportation

a. During In-Program Travel, observable and interruptible environments must be maintained. b. An Adult Participant must not transport a Minor Athlete one-on-one during In-Program Travel

and must always transport at least two Minor Athletes or another Adult Participant, except: i. In emergency circumstances; ii. When a Dual Relationship exists; iii. When the Close-In-Age Exception applies; and/or iv. The Minor Athlete’s parent/legal guardian has provided, at least annually, written

consent for the Adult Participant to transport the Minor Athlete one-on-one, which can be withdrawn at any time.

c. Adult Participants, including team managers and chaperones, who travel with the Organization must be USA Swimming non-athlete members of USA Swimming.

d. Adult Participants who are parents/legal guardians of Minor Athletes must pick up their

Minor Athlete first and drop off their Minor Athlete last in any shared or carpool travel arrangement.

II. Lodging

a. An Adult Participant must not share hotel room, sleeping arrangement or overnight lodging location with an Athlete.

b. During In-Program Travel, all In-Program Contact in a hotel room, sleeping arrangement or overnight lodging location between an Adult Participant and a Minor Athlete must be observable and interruptible.

c. During In-Program Travel, when doing room checks, two-deep leadership (two Adult Participants should be present) and observable and interruptible environments must be maintained.

d. The following exceptions apply to II(a), (b) and (c): i. When a Dual Relationship exists, the Adult Participant is not a coach, and the Minor

Athlete’s parent/legal guardian has provided advance, written consent for the lodging arrangement; and/or

ii. When the Close-In-Age Exception applies and the Minor Athlete’s parent/legal guardian has provided advance, written consent for the lodging arrangement.

e. Minor Athletes should be paired to share a hotel room, sleeping arrangement or overnight lodging location with other Minor Athletes of the same competition category and of similar age.

III. Written Consent

A Minor Athlete’s parent/legal guardian must provide written consent, at least annually, for all In-Program Travel and lodging during In-Program Travel, which can be withdrawn at any time.

IV. Meetings a. Meetings during In-Program Travel must be conducted consistent with the One-on-One

Interactions section of this Policy (e.g., any such meeting must be observable and interruptible).

b. Meetings must not be conducted in an Adult Participant or athlete’s hotel room or other overnight lodging location during In-Program Travel.

LOCKER ROOMS AND CHANGING AREAS

I. Requirement to Use Locker Room or Changing Area The designated locker room or changing area must be used when an athlete or Adult Participant changes, in whole or in part, into or out of a swimsuit when wearing just one suit (e.g., deck changing is prohibited).

II. Observable and Interruptible All In-Program Contact between Adult Participants and Minor Athletes in a locker room, changing area or similar space must be observable and interruptible, except: a. In emergency circumstances; b. A Dual Relationship exists; and/or c. The Close-In-Age exception applies.

III. Private or Semi-Private Space for Minor Athletes

The Organization must provide a private or semi-private place for Minor Athletes that need to change clothes or undress at Events or Facilities Under Partial or Full Jurisdiction of the Organization.

IV. Use of Recording Devices

Use of any device’s (including a cell phone’s) recording capabilities, including voice recording, still cameras and video cameras in locker rooms, changing areas, or similar spaces by a Minor Athlete or an Adult Participant is prohibited.

V. Undress

Adult Participants must not change clothes or behave in a manner that intentionally or recklessly exposes his or her breasts, buttocks, groin or genitals to a Minor Athlete under any circumstance. An Adult Participant must not request a Minor Athlete to expose the Minor Athlete’s breasts, buttocks, groin or genitals to the Adult Participant under any circumstance. Nothing in this section shall be construed to apply to areas of the body exposed while wearing swimwear which conforms to the current concept of the appropriate for the individual’s competition category.

VI. Showers

a. Adult Participants must not shower with Minor Athletes unless: i. The Adult Participant meets the Close-in-Age Exception; and/or ii. The shower is part of a pre- or post-activity rinse while wearing swimwear.

b. Parents/legal guardians may request in writing that their Minor Athlete(s) not change or shower with Adult Participants during In-Program Contact. The Organization must abide by such a request.

VII. Monitoring

The Organization must regularly and randomly monitor the use of locker rooms and changing areas to ensure compliance with this Policy. Locker rooms and changing areas may be monitored by use of the following methods: a. Conducting a sweep of the locker room or changing area before athletes arrive; b. Posting staff directly outside the locker room or changing area during periods of use; c. Leaving the doors open when adequate privacy is still possible; and/or d. Making occasional sweeps of the locker rooms or changing areas with women checking on

female locker rooms and men checking on male locker rooms.

Every effort must be made to recognize when a Minor Athlete goes to the locker room or changing area during practice and competition, and, if the Minor Athlete does not return in a timely fashion, to check on the Minor Athlete’s whereabouts.

VIII. Parents/legal guardians in Locker Rooms or Changing Areas

If a parent/legal guardian enters a locker room or changing area, it must only be a parent/legal guardian of the same competition category and the parent/legal guardian should notify a coach or administrator in advance.

MASSAGES, RUBDOWNS AND ATHLETIC TRAINING MODALITIES I. General Requirement

Any In-Program Massage performed on an athlete must be conducted in an observable and interruptible location and must be performed by a licensed massage therapist or other certified professional. However, even if a coach is a licensed massage therapist, the coach must not perform a rubdown or massage of an athlete under any circumstance.

II. Additional Minor Athlete Requirements

a. Written consent by a parent/legal guardian must be obtained in advance at least annually by the licensed massage therapist or other certified professional which can be withdrawn at any time.

b. Parent/legal guardians must be allowed to observe the Massage, except for competition or training venues that limit credentialing.

c. Any Massage of a Minor Athlete must be done with at least one other Adult Participant physically present and must never be done with only the Minor Athlete and the person performing the Massage in the room.

d. Any Massage of a Minor Athlete must be performed with the Minor Athlete fully or partially clothed, ensuring that the breasts, buttocks, groin or genitals are always covered. Nothing in this section shall be construed to apply to areas of the body exposed while wearing swimwear which conforms to the current concept of the appropriate for the individual’s competition category.

e. Any Massage of a Minor Athlete must only occur after a proper diagnosis from a treating physician and be done in the course of care according to the physician’s treatment plan.

PURPOSE There has been much talk about whether it is safe to have images taken of children participating in sports. While the great majority of images are appropriate and are taken in good faith, it is a fact that images can be misused, and children can be put at risk if common‐ sense procedures are not observed.

TEAM POLICIES

1. The publishing of a photograph of swimmer under 18 either on a notice board or in a published article or video recording (including video streaming) of swimming competitions (“publication”) should only be done with parents’ consent per the attached form.

2. A parent or guardian has a right of refuse to have children photographed. The exercise of

this right of refusal cannot be used as grounds for refusing entry into a swimming competition. Therefore, any photo that may go to press or on a notice board, be it through a member of the club or official photographer, should receive parental consent before publishing/displaying the photo, preferably in writing. The attached form allows parents to indicate refusal of consent.

3. All photographs must observe generally accepted standards of decency in particular:

x Action shots should be a celebration of the sporting activity and not a sexualized

image in a sporting context. x Action shots should not be taken or retained where the photograph reveals a

torn or displaced swimsuit. x Photographs should not be taken from behind swimming blocks at the start of a

race or exhibit a child climbing out of the swimming pool. x Photographs should not be taken in locker‐rooms or bathrooms.

Pau Hana Swim Team Code of Conduct for Athletes and Parents

This Code of Conduct MUST be read and signed by swimmers and a parent/guardian BEFORE any swimmer will be allowed to take part in training and competition. By signing below, an acknowledgement of the contents of this Code of Conduct is made and that the swimmer

agrees to abide by the same.

ATHLETE CODE OF CONDUCT

The purpose of a code of conduct for athletes is to establish a consistent expectation for athletes’ behavior.

I, the undersigned athlete, participating in training and competitions with the Pau Hana Swim Team, understand and agree to comply with the below-listed guidelines as set forth by the Pau Hana Swim Team. Any additional guidelines as needed may be established by the Head Coach.

General Behavior 1. The transportation, possession or use of alcohol, tobacco products, or illegal drugs by any Pau Hana

team member is prohibited. 2. Pau Hana swimmers will display proper respect and good sportsmanship toward coaches, officials,

administrators, competitors, teammates, and the public to include both their person and their property during all practices, meets and team activities. Facilities (including locker rooms) and other property will also be respected.

3. Illegal or inappropriate behavior that will reflect negatively on the Pau Hana Swim Team or be detrimental to performance objectives and will not be tolerated.

4. Bullying will not be tolerated within the Pau Hana Swim Team. 5. Pau Hana swimmers will set good examples of behavior and work ethic for younger teammates. 6. Pau Hana swimmers will refrain from foul language, violence, behavior deemed dishonest, offensive, or

illegal. 7. Pau Hana swimmers will obey all of USA Swimming’s rules and codes of conduct.

Travel Behavior 1. No athlete will travel when any illness is evident to the parents or coaching staff. 2. Unless otherwise excused or instructed by a coach, participants in a team trip will attend all team

functions (on time), to include meetings, practices, and any other team sanctioned event. 3. There will be no male athletes in female athletes’ rooms and no female athletes in male athletes’

rooms. 4. Athletes will not ride in a coach’s vehicle without another adult present who is the same gender as the

athlete unless prior parental permission is obtained. 5. Any additional guidelines will come from the staff as needed.

Implementation Failure to comply with these guidelines will subject the swimmer to discipline, up to and including suspension and/or dismissal from the Pau Hana Swim Team. If any failure to comply with these guidelines occurs during a travel trip, the swimmer may be sent home at the swimmer’s expense.

PARENT CODE OF CONDUCT

The purpose of a code of conduct for parents is to establish consistent expectations for behavior by parents.

As a parent/guardian of an athlete participating in training with the Pau Hana Swim Team, I understand the important growth and developmental support that my child’s participation fosters. I also understand that it is essential to provide the coaching staff with respect and the authority to coach the team. And I understand and agree to comply with the below-listed guidelines as set forth by the Pau Hana Swim Team. Any additional guidelines as needed may be established by the Head Coach.

1. Pau Hana parents will set the right example for our children by demonstrating sportsmanship and showing respect and common courtesy always to the team members, coaches, competitors, officials, parents, and all facilities.

2. Pau Hana parents will get involved by volunteering, observing practices, cheering at meets, and talking with their children and their coach about their progress.

3. Pau Hana parents will refrain from coaching their children from the stands during practices or meets. 4. Pau Hana parents understand that criticizing, name-calling, use of abusive language or gestures

directed toward coaches, officials, volunteers, and/or any participating swimmer will not be tolerated. 5. Pau Hana parents will respect the integrity of the officials. 6. Pau Hana parents will direct their concerns first to their swimmer’s primary coach; then, if not satisfied,

to the Head Coach.

Implementation Failure to comply with these guidelines may result in disciplinary action from the Pau Hana Swim Team.

Sudden Cardiac Arrest and Lindsay’s Law Parent/Athlete Signature Form

What is Lindsay’s Law? Lindsay’s Law is about Sudden Cardiac Arrest (SCA) in youth athletes. It covers all athletes 19 years or younger who practice for or compete in athletic activities. Activities may be organized by a school or youth sports organization.

Which youth athletic activities are included in Lindsay’s law? • Athletics at all schools in Ohio (public and non-public)

• Any athletic contest or competition sponsored by or associated with a school

• All interscholastic athletics, including all practices, interschool practices and scrimmages

• All youth sports organizations

• All cheerleading and club sports, including noncompetitive cheerleading

What is SCA? SCA is when the heart stops beating suddenly and unexpectedly. This cuts off blood flow to the brain and other vital organs. People with SCA will die if not treated immediately. SCA can be caused by 1) a structural issue with the heart, OR 2) a heart electrical problem which controls the heartbeat, OR 3) a situation such as a person who is hit in the chest or a gets a heart infection.

What is a warning sign for SCA? If a family member died suddenly before age 50, or a family member has cardiomyopathy, long QT syndrome, Marfan syndrome or other rhythm problems of the heart.

What symptoms are a warning sign of SCA? A young athlete may have these things with exercise:

• Chest pain/discomfort

• Unexplained fainting/near fainting or dizziness

• Unexplained tiredness, shortness of breath or difficulty breathing

• Unusually fast or racing heart beats

What happens if an athlete experiences syncope or fainting before, during or after a practice, scrimmage, or competitive play? The coach MUST remove the youth athlete from activity immediately. The youth athlete MUST be seen and cleared by a health care provider before returning to activity. This written clearance must be shared with a school or sports official.

What happens if an athlete experiences any other warning signs of SCA? The youth athlete should be seen by a health care professional.

Who can evaluate and clear youth athletes? A physician (MD or DO), a certified nurse practitioner, a clinical nurse specialist, certified nurse midwife. For school athletes, a physician’s assistant or licensed athletic trainer may also clear a student. That person may refer the youth to another health care provider for further evaluation.

What is needed for the youth athlete to return to the activity? There must be clearance from the health care provider in writing. This must be given to the coach and school or sports official before return to activity.

All youth athletes and their parents/guardians must view the Ohio Department of Health (ODH) video about Sudden Cardiac Arrest, review the ODH SCA handout and then sign and return this form.

WAIVER AND RELEASE As a condition to participating in any and all events and activities associated with the Pau Hana Swim Team (“Pau Hana”), including, without limitation, swim practices, swim competitions, sponsored events and transportation to or from any such activities (collectively, “Activities”), the undersigned, acknowledges that the Activities are subject to inherent risks, including, without limitation, the risk of personal injury (or even death) resulting from physical activity, drowning or the contraction of communicable diseases (e.g., COVID-19), and agrees to voluntarily assume any and all such risks. The undersigned believes himself or herself to be fit and capable of participating in the Activities. To the maximum extent permitted by applicable law, the undersigned, on behalf of him or herself and his or her heirs, administrators and estate, hereby voluntarily, irrevocably and forever: (1) releases Pau Hana, its affiliates and its and their current and former coaches, employees, agents, representatives, contractors and anyone else acting on their behalf (collectively, "Released Parties") from any and all liability whatsoever (including, without limitation, for personal injury or death) with respect to the Activities, including, without limitation, any such liability based on whole or in part on the negligence of any Released Party; (2) waives his or her right to sue or make any claim whatsoever against any Released Party for any damages or losses arising out of or in connection with the Activities; (3) agrees never to sue or make any claim against any Released Party for damages or losses suffered in connection with the Activities; and (4) agrees to indemnify and hold each Released Party harmless from any and all claims, demands, suits, damages, expenses, costs, liabilities, judgments, settlements and losses of any and every kind suffered or incurred by any Released Party and arising, directly or indirectly, out of or in connection with the breach of any agreement of the undersigned in clause (1), (2) or (3) of this paragraph. The undersigned acknowledges and agrees that he or she has been advised to seek the approval of his or her personal physician before participating in the Activities, and the undersigned has obtained such approval, has voluntarily decided to ignore his or her physician's advice or has neglected to seek such approval. The undersigned grants Pau Hana all rights to any photographic images and video or audio recordings made by or for Pau Hana during the undersigned’s participation in the Activities, including, without limitation, for the purpose of publishing on the Pau Hana website and social media platforms. If the participant is under the age of 18, this document must be signed on his or her behalf by his or her parent or legal guardian.

THIS POLICY APPLIES TO: In-Program Contact: Any contact (including communications, interactions or activities) between an Adult Participant and any Minor Athlete(s) related to participation in sport. Examples include, but are not limited to: competition, practices, camps/clinics, training/instructional sessions, pre/post event meals or outings, team travel, video review, team- or sport-related team building activities, celebrations, award ceremonies, banquets, team- or sport-related fundraising or community services, sport education, competition site visits, conventions and/or summits. Adult Participants: Any adult 18 years of age or older who is a:

x USA Swimming member, either athlete or non-athlete; x Participating non-member (e.g., meet marshals, meet computer operators, timers, etc.); x Authorized, approved or appointed by USA Swimming, Zones, Local Swimming Committees

(“LSCs”) or member clubs to have regular contact with (e.g., ongoing interactions during a 12-month period wherein the individual is in a role of active engagement) or authority over Minor Athletes; and/or

x Within the governance or disciplinary jurisdiction of USA Swimming, Zones, LSCs or member clubs.

GENERAL REQUIREMENT

USA Swimming Zones, LSCs and member clubs are required to implement this Minor Athlete Abuse Prevention Policy in full. The Minor Athlete Abuse Prevention Policy must be reviewed and agreed to in writing by all athletes, parents/legal guardians, coaches and other non-athlete members of member clubs on an annual basis with such written agreement to be retained by the club or LSC, as applicable.

DEFINITIONS Athlete: A USA Swimming athlete member. Authority: When one person’s position over another person is such that, based on the totality of the circumstances, they have the power or right to direct, control, give orders to, or make decisions for that person (e.g., when a power imbalance exists). Dual Relationship: When an Adult Participant has a relationship with a Minor Athlete that is outside of the sport program. Examples of Dual Relationships include, but are not limited to, family members, mental health professionals, teachers, medical professionals and family friends. Emergency Circumstances: A serious, unexpected and possibly dangerous situation that requires quick action and cannot be avoided. Emergency circumstances include, but are not limited to: a physical, mental or emotional medical emergency involving the Minor Athlete, relative of the Minor Athlete or relative of an Adult Participant; a Minor Athlete’s suicidal ideations/behavior; a report of abuse; a severe weather event; and last-minute practice changes. Electronic Communication: Includes, but not limited to, phone calls, emails, videoconferencing, video coaching, text-messaging and social media. Event or Facility Under Partial or Full Jurisdiction: Includes any USA Swimming sanctioned event (including all travel and lodging in connection with participation in the event) or any facility that USA Swimming, Zones, LSCs or member clubs owns, leases or rents for practice, training or competition. In-Program: Activities related to participation in sport. Examples include, but are not limited to: competition, practices, meetings, camps/clinics, training/instructional sessions, pre/post event meals or outings, team travel, video review, team- or sport-related team building activities, celebrations, award

ceremonies, banquets, team- or sport-related fundraising or community services, sport education, competition site visits, conventions, conferences, summits and/or workshops. In-Program Contact: Any contact (including communications, interactions or activities) between an Adult Participant and any Minor Athlete(s) related to participation in sport. Examples include, but are not limited to contact occurring at or related to: competition, practices, meetings, camps/clinics, training/instructional sessions, pre/post event meals or outings, team travel, video review, team- or sport-related team building activities, celebrations, award ceremonies, banquets, team- or sport-related fundraising or community services, sport education, competition site visits, conventions, conferences, summits and/or workshops. In-Program Massage: Any Massage involving an Adult Participant and any Minor Athlete(s) related to participation in sport. Examples include, but are not limited to Massage occurring at or related to: competition, practices, meetings, camps/clinics, training/instructional sessions, pre/post event meals or outings, team travel, video review, team- or sport-related team building activities, celebrations, award ceremonies, banquets, team- or sport-related fundraising or community services, sport education, competition site visits, conventions, conferences, summits and/or workshops. In-Program Travel: Any transportation or travel involving an Adult Participant and any Minor Athlete(s) related to participation in sport authorized or funded by the Organization. Examples include, but are not limited to transportation or travel to or related to: competition, practices, meetings, camps/clinics, training/instructional sessions, pre/post event meals or outings, team travel, video review, team- or sport-related team building activities, celebrations, award ceremonies, banquets, team- or sport-related fundraising or community services, sport education, competition site visits, conventions, conferences, summits and/or workshops. Massage: Any massage, rubdown, athletic training modality including physical modalities (e.g., stretching, physical manipulation, injury rehabilitation, etc.) and electronic or instrument assisted modalities (e.g., stim treatment, dry needling, cupping, etc.). Minor Athlete: An athlete under 18 years of age who is a USA Swimming member or was a USA Swimming member within the previous 12 months. Organization: Pau Hana Swim Team

EXCEPTIONS [Note: Exceptions apply only where specified]

Close-In-Age Exception: In-Program Contact between an Adult Participant and a Minor Athlete is permitted if:

a. The Adult Participant has no authority over the Minor Athlete; and b. The Adult Participant is not more than four years older than the Minor Athlete.

Dual Relationship Exception: An Adult Participant has a dual role or relationship with a Minor Athlete. This exception requires written consent of the Minor Athlete’s parent/legal guardian at least annually.

ONE-ON-ONE INTERACTIONS I. Observable and Interruptible

All one-on-one In-Program Contact interactions between a Minor Athlete and an Adult Participant must occur at an observable and interruptible distance from another adult, except: a. In emergency circumstances; b. When a Dual Relationship exists; and/or c. When the Close-In-Age Exception applies.

MEETINGS AND INDIVIDUAL TRAINING SESSIONS I. Meetings

a. Meetings between a Minor Athlete and an Adult Participant may only occur if another adult is present and where interactions can be easily observed and at an interruptible distance from another adult.

b. If a one-on-one meeting takes place, the door to the room must remain unlocked and open. If available, it must occur in a room that has windows, with the windows, blinds, and/or curtains remaining open during the meeting.

c. Meetings must not be conducted in an Adult Participant or Athlete’s hotel room or other overnight lodging location during In-Program Travel.

II. Meetings with Licensed Mental Health Care Professionals and/or Health Care Providers

If a licensed mental health care professional and/or health care provider meets one-on-one with a Minor Athlete at an Event or Facility Under Partial or Full Jurisdiction of the Organization in conjunction with participation, the meeting must be observable and interruptible by another adult, except if: a. The door remains unlocked; b. Another adult is present at the facility; c. The other adult is advised that a closed-door meeting is occurring although the Minor

Athlete’s identity does not need to be disclosed; d. The Organization is notified that the licensed mental health care professional and or health

care provider will be meeting with a Minor Athlete; and e. The licensed mental health care professional and/or health care provider obtains consent

consistent with applicable laws and ethical standards, which can be withdrawn at any time. III. Individual Training Sessions

a. In-Program one-on-one individual training sessions outside of the regular course of training and practice between Adult Participants and Minor Athletes must be observable and interruptible by another adult, except:

i. When a Dual Relationship exists; and/or ii. When the Close-In-Age Exception applies.

b. The Adult Participant providing the individual training session must receive advance, written consent from the Minor Athlete’s parent/legal guardian at least annually, with a copy provided to the Pau Hana Swim Team, which can be withdrawn at any time.

c. Parents/legal guardians must be allowed to observe the individual training session.

ELECTRONIC COMMUNICATIONS I. Content

All Electronic Communication from Adult Participants to Minor Athletes must be professional in nature.

II. Open and Transparent

a. If an Adult Participant communicates one-on-one with a Minor Athlete via Electronic Communications, the Minor Athlete’s parent/legal guardian must be copied or included. If a Minor Athlete communicates to the Adult Participant privately first, said Adult Participant must copy or include the Minor Athlete’s parent/legal guardian on any Electronic Communication response to the Minor Athlete. Adult Participants must only use Electronic Communication platforms that allow for Open and Transparent communication.

b. The following exceptions apply to Section II(a): i. In emergency circumstances; ii. When a Dual Relationship exists; and/or iii. When the Close-In-Age Exception applies.

c. When an Adult Participant communicates electronically to the entire team or any number of Minor Athletes on the team, said Adult Participant must copy another Adult Participant.

III. Requests to Discontinue

Parents/legal guardians may request in writing that their Minor Athlete not be contacted through any form of electronic communication by the Organization or by an Adult Participant subject to this Policy. The Organization must abide by any such request that the Minor Athlete not be contacted via electronic communication, or included in any social media post, absent emergency circumstances.

IV. Hours

Electronic communications must only be sent between the hours of 5:00 a.m. and 9:00 p.m. local time for the location of the Minor Athlete, unless emergency circumstances exist, or during competition travel.

V. Prohibited Electronic Communication

a. Adult Participants are not permitted to maintain private social media connections with Minor Athletes and such Adult Participants are not permitted to accept new personal page requests on social media platforms from Minor Athletes, unless the Adult Participant has a fan page, or the contact is deemed as celebrity contact as opposed to regular contact. Existing social media connections with Minor Athletes must be discontinued. Minor Athletes may “friend”, “like” or “follow” the Organization’s official page.

b. Adult Participants must not send private, instant or direct messages to a Minor Athlete through social media platforms.

c. The following exceptions apply to Section V: i. When a Dual Relationship exists; and/or ii. When the Close-In-Age Exception applies.

IN-PROGRAM TRAVEL AND LODGING I. Transportation

a. During In-Program Travel, observable and interruptible environments must be maintained. b. An Adult Participant must not transport a Minor Athlete one-on-one during In-Program Travel

and must always transport at least two Minor Athletes or another Adult Participant, except: i. In emergency circumstances; ii. When a Dual Relationship exists; iii. When the Close-In-Age Exception applies; and/or iv. The Minor Athlete’s parent/legal guardian has provided, at least annually, written

consent for the Adult Participant to transport the Minor Athlete one-on-one, which can be withdrawn at any time.

c. Adult Participants, including team managers and chaperones, who travel with the Organization must be USA Swimming non-athlete members of USA Swimming.

d. Adult Participants who are parents/legal guardians of Minor Athletes must pick up their

Minor Athlete first and drop off their Minor Athlete last in any shared or carpool travel arrangement.

II. Lodging

a. An Adult Participant must not share hotel room, sleeping arrangement or overnight lodging location with an Athlete.

b. During In-Program Travel, all In-Program Contact in a hotel room, sleeping arrangement or overnight lodging location between an Adult Participant and a Minor Athlete must be observable and interruptible.

c. During In-Program Travel, when doing room checks, two-deep leadership (two Adult Participants should be present) and observable and interruptible environments must be maintained.

d. The following exceptions apply to II(a), (b) and (c): i. When a Dual Relationship exists, the Adult Participant is not a coach, and the Minor

Athlete’s parent/legal guardian has provided advance, written consent for the lodging arrangement; and/or

ii. When the Close-In-Age Exception applies and the Minor Athlete’s parent/legal guardian has provided advance, written consent for the lodging arrangement.

e. Minor Athletes should be paired to share a hotel room, sleeping arrangement or overnight lodging location with other Minor Athletes of the same competition category and of similar age.

III. Written Consent

A Minor Athlete’s parent/legal guardian must provide written consent, at least annually, for all In-Program Travel and lodging during In-Program Travel, which can be withdrawn at any time.

IV. Meetings a. Meetings during In-Program Travel must be conducted consistent with the One-on-One

Interactions section of this Policy (e.g., any such meeting must be observable and interruptible).

b. Meetings must not be conducted in an Adult Participant or athlete’s hotel room or other overnight lodging location during In-Program Travel.

LOCKER ROOMS AND CHANGING AREAS

I. Requirement to Use Locker Room or Changing Area The designated locker room or changing area must be used when an athlete or Adult Participant changes, in whole or in part, into or out of a swimsuit when wearing just one suit (e.g., deck changing is prohibited).

II. Observable and Interruptible All In-Program Contact between Adult Participants and Minor Athletes in a locker room, changing area or similar space must be observable and interruptible, except: a. In emergency circumstances; b. A Dual Relationship exists; and/or c. The Close-In-Age exception applies.

III. Private or Semi-Private Space for Minor Athletes

The Organization must provide a private or semi-private place for Minor Athletes that need to change clothes or undress at Events or Facilities Under Partial or Full Jurisdiction of the Organization.

IV. Use of Recording Devices

Use of any device’s (including a cell phone’s) recording capabilities, including voice recording, still cameras and video cameras in locker rooms, changing areas, or similar spaces by a Minor Athlete or an Adult Participant is prohibited.

V. Undress

Adult Participants must not change clothes or behave in a manner that intentionally or recklessly exposes his or her breasts, buttocks, groin or genitals to a Minor Athlete under any circumstance. An Adult Participant must not request a Minor Athlete to expose the Minor Athlete’s breasts, buttocks, groin or genitals to the Adult Participant under any circumstance. Nothing in this section shall be construed to apply to areas of the body exposed while wearing swimwear which conforms to the current concept of the appropriate for the individual’s competition category.

VI. Showers

a. Adult Participants must not shower with Minor Athletes unless: i. The Adult Participant meets the Close-in-Age Exception; and/or ii. The shower is part of a pre- or post-activity rinse while wearing swimwear.

b. Parents/legal guardians may request in writing that their Minor Athlete(s) not change or shower with Adult Participants during In-Program Contact. The Organization must abide by such a request.

VII. Monitoring

The Organization must regularly and randomly monitor the use of locker rooms and changing areas to ensure compliance with this Policy. Locker rooms and changing areas may be monitored by use of the following methods: a. Conducting a sweep of the locker room or changing area before athletes arrive; b. Posting staff directly outside the locker room or changing area during periods of use; c. Leaving the doors open when adequate privacy is still possible; and/or d. Making occasional sweeps of the locker rooms or changing areas with women checking on

female locker rooms and men checking on male locker rooms.

Every effort must be made to recognize when a Minor Athlete goes to the locker room or changing area during practice and competition, and, if the Minor Athlete does not return in a timely fashion, to check on the Minor Athlete’s whereabouts.

VIII. Parents/legal guardians in Locker Rooms or Changing Areas

If a parent/legal guardian enters a locker room or changing area, it must only be a parent/legal guardian of the same competition category and the parent/legal guardian should notify a coach or administrator in advance.

MASSAGES, RUBDOWNS AND ATHLETIC TRAINING MODALITIES I. General Requirement

Any In-Program Massage performed on an athlete must be conducted in an observable and interruptible location and must be performed by a licensed massage therapist or other certified professional. However, even if a coach is a licensed massage therapist, the coach must not perform a rubdown or massage of an athlete under any circumstance.

II. Additional Minor Athlete Requirements

a. Written consent by a parent/legal guardian must be obtained in advance at least annually by the licensed massage therapist or other certified professional which can be withdrawn at any time.

b. Parent/legal guardians must be allowed to observe the Massage, except for competition or training venues that limit credentialing.

c. Any Massage of a Minor Athlete must be done with at least one other Adult Participant physically present and must never be done with only the Minor Athlete and the person performing the Massage in the room.

d. Any Massage of a Minor Athlete must be performed with the Minor Athlete fully or partially clothed, ensuring that the breasts, buttocks, groin or genitals are always covered. Nothing in this section shall be construed to apply to areas of the body exposed while wearing swimwear which conforms to the current concept of the appropriate for the individual’s competition category.

e. Any Massage of a Minor Athlete must only occur after a proper diagnosis from a treating physician and be done in the course of care according to the physician’s treatment plan.

PAU HANA SWIM TEAM PHOTOGRAPHY POLICY

PURPOSE There has been much talk about whether it is safe to have images taken of children participating in sports. While the great majority of images are appropriate and are taken in good faith, it is a fact that images can be misused, and children can be put at risk if common‐ sense procedures are not observed.

TEAM POLICIES

1. The publishing of a photograph of swimmer under 18 either on a notice board or in a published article or video recording (including video streaming) of swimming competitions (“publication”) should only be done with parents’ consent per the attached form.

2. A parent or guardian has a right of refuse to have children photographed. The exercise of

this right of refusal cannot be used as grounds for refusing entry into a swimming competition. Therefore, any photo that may go to press or on a notice board, be it through a member of the club or official photographer, should receive parental consent before publishing/displaying the photo, preferably in writing. The attached form allows parents to indicate refusal of consent.

3. All photographs must observe generally accepted standards of decency in particular:

x Action shots should be a celebration of the sporting activity and not a sexualized

image in a sporting context. x Action shots should not be taken or retained where the photograph reveals a

torn or displaced swimsuit. x Photographs should not be taken from behind swimming blocks at the start of a

race or exhibit a child climbing out of the swimming pool. x Photographs should not be taken in locker‐rooms or bathrooms.

PHST Photography Consent Form Pau Hana Swim Team may wish to take photographs (individual and in groups) of swimmers under the age of 18 that may include your child during their membership in the club.
