    BackgroundtothepublicdiscussionOn 27 July 2018, people in Chharanagar witnessed the Ahmedabad Police unleashing itsmostbrutalterrorthattheyhadexperiencedsofar.Itwasjustpastmidnight,whencloseto500policemen(manyinplainclothesandallwithoutnametags),wentonaviolentrampagein Chharanagar. They barged into the Chhara houses, physically assaulted women andchildren,pickedupyoungmen,beatthemwithsticksandparadedthemtothepolicevansastheycontinueddestroyingvehiclesparkedinthearea.ThisbrutalunleashingofStateterrorcontinuedtillcloseto5a.m.TheCommissionerofPolice,whenapproachedonthephoneat4a.m.,termedthisaspoliceactiontomaintainlawandorder.Chharanagar,beingaghettoofthede-notifiedChharatribe,hasbeenatthereceivingendofpolicetortureandpersecutionforgenerationsnow. Inthisrecent incident,morethan150people have suffered serious injuries and 29 persons have been charged with fabricatedcases.Efforts to registercasesagainst thepolicemenhavenotbeensuccessful so far.TheresponseofChharanagartothebrutalpolicerepressionhasbeenresolute.Theyhavesofarrespondedthroughart,songsandpublicprotestsastheylegallychallengethepoliceactions.The National Alliance Group of De-Notified and Nomadic tribes (NAG DNT) organised apublicdiscussionwithsomecommunitymembersfromChharanagaron8thAugust2018,asaplatformforthemtoshareforthefirsttime,outsideAhmedabad,theirlivedexperienceofthenightofterror.Theeventwasanefforttoreachouttowidercivilsocietytosolicittheirsuggestionsonrespondingtothepolicebrutality.Thespeakersattheeventincluded:§ Dakxin Chhara, a residentofChharanagarandanawardwinning filmmaker (including

    National Human Rights Commission and South Asia Documentary Film awards) andtheatre educator, associatedwith Budhan Theatre,who has directed 46 plays and 87fictionandnon-fictionfilms.ThemostrecentawardhewonwastheBestDirectorforhisfilmSameeratQueenslandInternationalFilmFestival;

    § Kalpana Chhara, awell-known theatreand filmartist inGujarat, foundingmemberofBudhan Theatre, a recipient of Nari Shakti Award by Kim Foundation, CII FoundationWoman Exemplar Award and Kaleshwari Award for her contribution in the field ofTheatre.

    § AtishChhara,anactorassociatedwithBudhanTheatreandaculturalactivistwhohasperformed inover30playsand700 shows, andwaspickedupby thepolicewhilehewasdocumentingthepoliceviolence,tortured,arrestedandreleasedonbail;and

    Proceedingsoftheevent

    OpeningstatementbyMr.BharatVitkarMr.VitkarbeganbystatingthatdetailsandinformationrelatedtotheatrocitythatoccurredinChharanagarshouldreacheveryone.Issuesandproblemsofthedenotifiedtribes(DNTs)andtheatrocitiesthattheyhavetoexperienceonadailybasisshouldreachpeopleacrosstheglobe.DNTshavenorepresentation–andthereforetheyarebeingoppressed.DespiteseveralDNTsbeingpart ofmanyorganisations, it is still verydifficult to shed lighton theissues the face. There is ahuge justicedeficit andDNTsare farbehindwhatever theyareentitledtoascitizens.Andevenwhenactivists try tohelptheDNTgroups, theyarebeingtargetedandattacked.Ithasbeen71yearssinceIndia’s independence,butstill,theDNTsareexploited.TheDNTare supposed to have “villages” but these are only on paper. DNTs cannot work in theirhometowns because of their stigmatised identity and would rather migrate to differentplaces-inotherpartsandcornersofthecountrytoearntheirlivelihood.Whenanyoutsidercomestoavillageto livethere, theyareunknown,andthereforetheybecometargets forfalse messages and narratives. Recently, five DNT members were victims of such falsemessages,inDulantavillageinMaharashtrawheretheywerebrutallybeaten.Andthisisnota case in isolation - this ishappeningallover India today.That iswhat thismeeting is fortoday,toknowfrompeoplefromthecommunity,thestoryofwhathappenstoDNTpeoplealloverthecountry.Thespeakersweretheninvitedtosharetheirexperiencesfromthenightof27thJuly2018.DetailssharedbyAtishChharaOn27July,atapproximately12:30am,Iwassleepingathomeandheardsomethingoutside.Isawabout30vansenterthearea.Thepolicewerethrowingstonesandabusingpeople.Myhouseholdmembersdidn’tletmegoout,butwhenIinsistedandwentoutIsawthatDakxinbhai’sfour-wheelerwasbeingpeltedanddamaged,andhewasalsobeinghit.Astheywere

    hittinghimtheydraggedhimtohismother-in-law’shouse,wheretheyalsostartinghittingher.SoIimmediatelystartedtakingavideoanduploadeditonFacebook.Inthemeanwhile,I found out thatmy uncle, another photographer, was beaten up quite aggressively. Thepolicewasnoteven letting108 [ambulanceservice]enterourareasaying theywanted to“finish”usall.Whenwewenttotendtohim,Igotanothercallfrommyyoungerbrother,sayingthatourcar had been attacked. A big gang of policemenwere entering and hitting the cars - so Iasked themwhy theyweredoing this; they completely ignoredmeandhitme. I told thepolice,“Iamakalakar(artist),Iamnotacriminal.Thenwhyareyoubeatingus?”Atleast20peoplekepthittingme,andthenpushedmeintothemobilepolicevan,inwhichtheyhitmeagain.I reached Sardar Nagar station –where I told them that Iwant to file an FIR against thepolice – but they putme into the lock up. Iwas very thirsty but theywere not giving uswater.IwasdesperatesoIdrankwaterfromthetoiletbowl.Muchlater,theygaveusonebottleofwaterfor29peopletoshare.I work as a community theatre artist in Chharanagar, so many people know me therebecause of this. I got calls from people inmy community askingme to come help them,whichiswhyIhadgoneoutinthefirstplace.Butthey,inturn,tookusin.Duringthenightandearlymorning,theissuehadgainedtractioninthemediaandthenextday, therewasabigdharna (protest)outside thepolice station. Thepolice said that theywouldletsomeofusgobutwesaid“if29peoplecannotbetakenoutofjail,thenonlyfourofuswillnotgoout”.Weweremadetogo foramedicalexamination.Duringthis ratherdehumanisingprocess,weweremadetositonthefloor,andwereaskedwhywehitthepolice,wheninfactitwasthepolicethathadbeatenus.Whenwewerethentakentothejudge’sbungalowataround12:30 at night; wheremany lawyers were also present, wewere treated as accused andperpetratorsofacrime.Weweremadetositonthefloorandourstatementwasrecorded.Fromhere,weweretakenbacktopolicecustody.Wewerefightingsleepbynow,aswehadnotsleptfortwodays.Atabout5:30am,wewerealltakentoaroomandforcedtostripoffallourclothes.Whenweaskedwhy(wearetheatreartists,weaskmanyquestions!) theysaidtheyhavetogetbodyscansdoneandwhenweaskedthemtotakeustothemachinefor privacy, they refused. This was the first time that my spirit broke and I cried – notbecause I was frustrated with what as happening but because my old uncle and I wereforced to be stark naked in front of thesemen and were helpless and could do nothingaboutit.For the remainderofmytime incustody,wehadtosleepnear the toilet; the foodwouldstink;11sectionswereimposedonus,andifyouhaveSection390(loot),thenhomemadefoodisnotallowedinthelockup.Ididnoteat,andonlyhadtodrinkteaforsixdays.DetailssharedbyKalpanaChharaWomeninChharanagarhavealwaysbeeninapositionofdisadvantage.Inregularraidsthathappened at Chharanagar, women were harassed because they are typically accused ofbrewingillicitliquor.Andonthatdayaswell,allthiswastriggeredbecauseofawomen.

    A police sub inspector (PSI) in plainclothes, came in his personal car to buy and consumeliquorfromChharanagar. Inhisdrunkenstate,hetoldthemanfromwherehewasbuyingliquor,“kyamaallekebaitheho”(referringtothewomannexttohimwhohappenedtobetheman’swifeandwhowasfeedingachild).Infuriatedbythis,someboysgottogetherandbeathimup forhaving said that.Assuming thishurt thePSI’s “ego”,he left and returnedshortlypastmidnightandtheyunleashedterrorinChharanagar.WhileAtishhasdescribedwhattheydidtomostpeople, Iwantedto focusonthewaytheytreatedthewomenandgirls.They hit a 70- year old paralysed women - no matter how ‘low’ in society you are, youwouldn’traiseyourhandonsuchanoldperson.Theydidnothesitatetopunchherorattackablindgirlandinjureherbadlyonherhead.Ihaveneverseensuch‘girahua’(demeaning)behaviour.Duringthisentireincident,twowomenwerealsotakenintocustody.Policesaythatthiswasa“normal”raidandthatthecommunitypeopleattackedthemwhichiswhytheycameback–butthis isnottrue.Thiswasnota“normal”raidatall. If itwas, therewouldhavebeenwomenconstableswiththem–buttherewerenone..The police had so much power that night, that they hit women in places where no onewouldbeabletoevensharewithyouwhichbodyparttheyhavebeenhurtin.BecauseweareChhara,becausewedon’thaveavoice,thisiswhythisishappeningtous.Tothis,Atishadded,thathisgrandmother,whois84yearsold,wasalsohitandthefanandutensils inherhousewerealsobroken.Thepoliceeventried tobreak thedoorwherehissisterswere,andwereabusinghisfamilythroughout.DetailssharedbyDakxinChharaThese two testimonies (Atish and Kalpana) have helped recreate the scene of what hadhappened.Iwouldwanttotellyouabouttherealcauseofthisis.Policeegowasshatteredbecauseour communitybeatup their colleague. Somepolicemembers knewmeand theconstables did not wanted to beat me, but since one of the PSIs standing close byquestionedthemaboutwhyIwasspared,Iwasbeaten.I believe that it isonlyafterbeing severelydrunk that you canbe thisbrutal toanyone–especiallychildren,womenandoldpeople.Thepolicebeata17-yearboyandalsoattackedhis sister (who was dressed in “boy’s clothes”). Their mother begged the police to stop,insistingthatoneofthemwasagirlandthepoliceonlylethergoafterfeelingherbreasts.Mymother-in-law,adiabeticpatientwhowasbadlybeaten,nowhasaninfectionthathasspreadtoherthroat.Shewillhavetoundergoanoperationforthis.Idon’tknowhowandwhathappenedduringtheEmergencybutIhaveseenriotsandthatday was no less than what had taken place in most riots. The root cause is the age oldCriminalTribesActthathasbeentaughttothepolice.Thoughtheactwasrepealeditwasreplacedby theHabitualOffender’sAct andnow for thepolice,we are seen as “habitualoffenders”nomatterwhatwedoordon’tdo.Wearenot theonlyones - therearemorethan200tribeswhoareseenthroughasimilar lensbecausethepoliceareconditionedtoseeourcommunityinacertainway.Thatday,of the29whowerearrested,26haveabsolutely clean records.The17-yearoldboy,whoIjustmentioned,losthisjobbecauseofthiscase.Hisfatherhasworkedalifetime

    toensurethathissonreachedapositionwherehewasemployedbyabank,butallthatisnowdownthedrain,inonenight.Wewerehelpedbylawyertobailoutourcolleagues.Butthiswasnotthefirsttimethatthishappened. Exactly a month prior to this, in June, a mob lynching had taken place. Fourfemale snake charmers had come from Pali to beg, because men from the community,usuallyintraditionalattire,areperceivedtobeintimidating.Oneofthewomenwasbeatenand even though the police station only 100 meters away and she kept calling for help,nothingwasdonetohelpher.Shediedduetobrainhaemorrhage.Lynchinghasbecomeatrend.TakethecaseofPehluKhan-nothinghasbeendone.IncaseofAlwar too, nothingwasdone. I don’t haveanyhope for this caseeither.WhatwehadwitnessedistheworstformofviolenceandIdon’tknowwhathastakenplaceintheinteriorpartsofChharanagar.Wearestigmatisedwiththeideathatourcommunitysellsalcoholandare criminals andwehave never stopped the police for taking action against peoplewhohavecommittedcrimesbut this incidentwas just thepolicegettingevenwithusbecauseoneoftheirpolicepersons’egowasshattered.Atish,whowasarrestedbeatenandjailed,isawell-reputedculturalartistandactivistwhohastravelledextensivelyacrosstheglobe,toperform.Iwanttoknow-don’tthesepeopledeservecompensation?I am tagged a criminal despite being a renowned artist,NHRC awardee anddocumentaryfilmdirector.Wearesayingwhatyouwant tohear.Yes,wearecriminals.Whydon’tyougive us rehabilitation? We want to live a dignified life. What alternatives do you have?Samadhanhainnahi,aaphumemarterahtehain”.AnandibenPatel[formerGujaratChiefMinister] had adopted Chharanagar and a Rs. 500 crore budget was allotted for our“resettlement”. Where has it gone? Nothing has happened. Only a few surveys wereconducted by women from SEWA initially and we have never seen them thereafter. Wedon’tknowwherethemoneyhasgone.WhatalternativewilltheGovernmentwillprovidefor our rehabilitation is a question that has never been answered but they are ready totortureandputpressureonuswithoutprovidingsolutions.TheGovernment–witheveryonewhoworksforthem–areallveryegotistical,donothaveanyhumilityandalluniformlydislikeus.Wehavebeen trying tomeet theChiefMinister,buthavenotbeenable tosecureanappointmentyet.Theattitudeof lookingdownuponpeoplestartsrightatthetopandisimitatedallthroughtheranks.Sowhatwetakeawayis“youdon’twanttohearusandneitherdowewanttoprovideasolutionforyourproblems”.This is cornering the marginalised and minority communities. This government shouldunderstand the power of our vote bank. They should be brought down andwe have thepowertodoit.Kalpanaaddedthateventoday,thereareatleast100guntotingpolicemenwalkingaroundChharanagar-“GujaratkaKashmiragardekhnaho,tohChharanagaraajao”.Dakxinsharedthat our childrenplay and go to school. Tomorrow if some accident happenswhowill beresponsible?Thepolicemenwhowereinvolvedintheincidentinthecommunityshouldbedismissed,notsuspended–butthepoliceofficersstillroamaroundunaffected.We organised a besna (a mourning held in memory of departed persons) with thesignificancebeingthemourningofthedeathof lawandorderthatnight.Forall the lathis(beatings) thatwereceived,wewentandhandedover roses toeachpolicemanwhobeat

    us.Whatmorefriendlygesturecanacommunityshow?Eventhechildrenofourcommunitytook out a march and went and asked the police if they could quote provisions in theconstitution that allows the ruthless beating of innocent people and to show themwhatpage its on.We also had events where people like JigneshMevani came across to showsolidarity–asdidotherartists,performersandlawyers.OurlocalMLAthough,didnotbothertoturnupwhenthishappenedandinfact,evensaidthatChharanagarisa“nuisance”.Withnopoliticalbacking,thewidercommunitycontinuetodiscriminate,treatusascriminalandleaveusnoplacetogo.Andithasremainedlikethisfor years. In 1998 I was at this same Constitution Club with George Fernandez andMahashweta Devi and the same questions were raised then as well. Governments havecomeandgonebutnothinghaschanged.Withthis,thediscussionwasopeneduptotheaudience.Discussionwithmembersoftheaudience

    RameshRahi:ThisisnotjusthappeninginChharanagar,itisalloverIndia.Therootcauseisthe inappropriate and incorrect police training itself. All over the country, the police istaught that anyone from these tribes are criminals. The target of the police is almostinvariablyyoungboysso that their future is ruined.Evenhere inDelhi, thoseofuswhosetraditionaloccupationisbrewingalcoholarestillseenfromthatperspective–ascriminals.Iftheywantedto,theycouldhaveeasilyendedourworkinvolvedwithbrewingalcohol,butitisthesourceoftheirbribes(hafta-vasooli).Anywherewegoitisasifthestigmaispastedonour foreheads.We have always raised questions – yes, you saywe sell alcohol, butwhatotheralternativesareyougivingus?Wehaveneverbeenable to finda solution,andourstigmafollowsuseverywhere.Ihaveagovernmentjob,butstill,IamalwaysseenfromtheangleofmyDNTidentity.ShankarLal:71yearsofIndependencelater,wearestillslaves.Weshouldthinkaboutthesolution. We are still forced to live lives that are worse than animals. People from ourcommunity have be given reservation in some places, but they are asked to producedocumentsfrom50yearsago-ifsomeoneisanomad,howcantheyhavearecord?

    Our children who go to school to study are mistreated because of our traditionaloccupationsand this shatters theirmoral completelyand they lose interest in studies.Forme, this is a political problem, and the solution is also political. Political power is the keywithwhichanythingcanbeopened.Everytimetheyhaveprotestedorspokenup,theyhavebeentargeted.TheDNTwillhavetouniteandstandupandriseinpoliticalpower.Ravindra Kumar: The thinkingof thegovernment is still the same–weare criminals.Wehaveonlybeenrunningdifferentorganisations,basedonourdifferent identities.Weneedtoworkcollectively.Whenpeopleliketheministerforsocialwelfareandjusticestatesthatsomeonefromasansicommunityisathief,thenwhathopedowehave?Wehavetocreateour own solution and the only solution is political power. We are already laying thefoundationsofapoliticalpartyandmovementandneedtoleveragetheselargenumbersofDNTpopulationthatwehaveacrossthecountry.PuranSinghBhatt:Weareperformersandentertainersandareusuallyatapedestalwhenwe are showing our skill (with the usually higher ups actually sitting below us in theaudience),butthatisonlyonepartofthepicture.Ontheotherside,weourselveshavenotbeenabletorecognisewhoweareandaremistreated.WeareknownasGhumantujaati/kalakar.But there isnocommunityproof.Whenchildrenare taken to schoolandcollege,eitherweneedsomeone’s recommendationorgo forprivateeducation”.OurpeoplewhohaveshiftedoutofRajasthantodothisworkwithpuppetmakingandpuppetrydonothaveidentity cards.Weourselvesarenotable to recognisewhatpath to takeandprobablydonotrecognisethepowerthatourvotecarries.Ifeveryoneofus,inallthealleysthatwelivein,istoldthatweneedtounderstandourselvesandthepowerweholdasvoters,thenthegovernmentthemselveswillcomeknockingatyourdoor.Butwegetstuckinourownlittleisolatedspaces.Wemayevenlivetogether,butneverrecognisethatevenourproblemsarethesame.BharatVitkar:TheDNTsareenlistedindifferentcategoriesinourcountries-someareSC,OBC,STwhereassomedonotbelongtoanylistandinsomecases,thesamecommunityisin the SC category in one state, ST in another and OBC in a third and it creates factionswithinus.TheConstitutiononlyprovidesforSC,STandOBCandtheDNTsdonotfindanyspace for redress within the constitution. So maybe we should all explore how to besubsumedintothesecategoriesthatalreadyexistratherthatcreatethenewDNTidentity.Dinesh Rajbhar: As a lawyer practicing in the Supreme Court, reiterated that there arespecific constitutional provisions, which we have to understand. The 1924 law that wasrepealed in 1952, was not a common law (the penalties, were specific, it was regardingentirecommunities)... it isacceptedinthereportthatsuchalawwasnotapplicableintheworld anywhere. The word “criminal” was used by the British to label people whoparticipatedinthe1857mutiny,butthecontexthaschangedtodayandthewordhastakeninanewmeaningsocitizensshouldnitbeusingormakingreferencetothetemcriminalswhenreferringtoDNTs.Dakxin Chhara: We are working towards brining together DNT groups in 12 states andmovementbuildingtakestimetocometogether.WiththeSimonCommission,whichcameto India,onlyBabaSahebattendedandwroteamemorandum that criminal tribes shouldnotbegivenvotingrightsandthissomehowsealedthefateoftheDNTs.Withpeoplewhocreated theconstitutionandhada closedmindaboutDNTs, the repercussionsare felt tilltoday.Historyhasdoneinjusticetousforwhichwestill facestigma.Hedidrecognisethis

    mistakeinhindsightandstatedthatwhiletheDNTswerethemostoppressedandthetribalfollowed,withtheoppressedcastes(SCs)betterthanthem,thathewoulddedicatehislifetothecauseoftheseoppressedcastes.We also understand the importance of documentation and have taken the initiative byrecording testimonies from the community to collect the documentation of this atrocityfacedbyourcommunity.Wealsohavealotofaudio-visualsandtode-stigmatiseourselves,peoplemarchedwithplacardssaying,“IamaChhara.Iamanengineer.Iamnotacriminal.Canyouhelpme?”Dakxinshared,thatinJanuarythisyear,therewasameetingof45denotifiedtribeleadersand activists from across the country who collectively agreed to push forward six keydemands formulated by community members from across the country. These werereiteratedandaredetailedbelow:1)Mechanismtostoppoliceviolenceand labellingof thecommunity -Policeshouldnotlookatusasthievesandstoptheuseofphysicalandverbalviolenceagainstus.Theyshouldstop wrongly accusing us. It has been observed that they particularly abuse and targetwomen from DNT communities. They should also not arrest innocent persons withoutproperinvestigation.Thereshouldbesomemechanismtostoptheseexcesses.2) Access to quality education -Weshouldget freeeducationwithgoodhostel facilities,particularly for girls. Teachers should be from the DNT community so that they do notdiscriminateagainstus.Thereisaneedtoencourageco-educationamongthecommunity.3) Livelihood opportunities - Government should provide employment opportunities fornomadictribesbyprovidingloansforsmallenterprises.Someofthosepracticingtraditionaloccupations,includingstreetperformers,arestrugglingduetochangesinlawsandneedtobe revived. Companies that are hampering traditional occupations and polluting the localenvironment should be discouraged as it further marginalises us. For landed DNTcommunitiesthereneedstobestrengtheningofirrigationaswellasotherinputfacilitiessothattheydowellinagriculture.4) Land rights and ending of land grabbing - Landlessness is high among denotifiedcommunities and in some places powerful people have grabbed land belonging to DNTs.Therearealso instanceswherebusinessesandgovernmenthave takenover their land fordevelopingproject sites.The landbelonging to theDNTshouldbe restored to themthereshouldbeactive consultationbeforeany such stepofdisplacementandallocationof landfor landless. Houses should have toilets and for nomadic communities, there should be aprovisionofmobiletoilets.5)Identitydocumentstoaccessrights-Rationcards,Aadharcards,otheridentitycardsanddocuments should be prepared so that nomadic tribes have an identity and the ability togain access to government programmeswhich provide food, health, education and otherbasicneedsaswellasothersocialprotectionmechanisms.6) Reservation and representation -Thereshouldbe reservation for thedenotified tribesandcastecertificatesshouldbepreparedforthemembersofnomadictribes.Nomadicanddenotifiedtribesshouldhaverepresentationinpublicoffices.

    Bywayof summingup thediscussion, somerecommendationswereput forwardbyUshaRamanathan.§ Case documentation is extremely important. We need to document the issues (like
