SERIES 11: TERRITORIAL COURT RECORDS - INTRODUCTION

Approximately a thousand miners were searching the tributaries of the Yukon River for gold in the mid-1880s. At this time, the Yukon was under the legal jurisdiction of the North West Territories, thoughbecause of its remoteness, the influence of an established court system was not felt. The prevailing formof law and order was the miners’ meeting, a form of justice used by the predominately American minersin the area.

Inspector Constantine of the N.W.M.P. was sent to the Yukon in 1894, and he wrote of these meetings:“The American miners meetings had the power of life and death over the members of the community. Itcould hang a man, give him a divorce, imprison, banish or lash him.” Any prospector could call ameeting simply by posting a notice. An elected chairman performed the function of judge, while theentire meeting acted as jury. Both sides could produce witnesses and state their case. Anybody whowished could ask a question or make a speech. The verdict was decided by a show of hands.

In June 1895, Inspector Constantine returned to the Yukon with a force of eighteen men and managed toabolish the miners’ meetings and establish his authority. In his report for that year he noted that civilcourts were urgently required to settle disputes. With the influx of population following the discovery ofthe fabulously rich Klondike gold deposits in August 1896, the federal government became moreinterested in establishing law and order in the area.

The Canadian government appointed T.H. McGuire as Judge of the Court of the Yukon ProvisionalDistrict in August, 1897. The Yukon Act of 1898 established Yukon as a separate territory, and changedthe judicial structure by replacing this court with a superior court of record styled after the TerritorialCourt, which could consist of one or more judges. It provided that judicial procedure and administrationwere to conform as closely as possible to the practices found in the North West Territories. TheCommissioner, Territorial Councillors, and commissioned officers of the North West Mounted Policewere to possess the powers of one or two justices of the peace. The Act also specified the residence,tenure, oath of office, and rights and privileges of the judges. The power, authority, and jurisdiction ofthe court were to be the same as those of the court of the North West Territories. A judge of the courtcould not hold any other office or emolument under the Government of Canada.

In 1899 an amendment to the Yukon Act constituted the Supreme Court of British Columbia as a Court ofAppeal for the territory. In May 1901, a further amendment provided for the appointment of a policemagistrate at Dawson and at Whitehorse. These positions had jurisdiction in cases of theft, claims ofdebt, breach of contract and other personal actions where the amount claimed did not exceed $500. TheTerritorial Court retained jurisdiction in respect of actions for gambling debts, liquor offences, recoveryof land, wills, libel, slander, and other more serious offences.

T.H. McQuire resigned as the Yukon’s first judge just three months after his appointment. He wasreplaced by C.A. Dugas on October 7, 1898. In March of 1899, the Yukon Bar Association petitioned thefederal government for two more judges because of the large number of cases awaiting trial. Two morejudges of the Territorial Court were in fact appointed, the Hon. James Craig and the Hon. C.D. Macaulay.

Until 1912, the Territorial Court comprised three judges, and it was possible for appeals to be made fromthe decision of a police magistrate, to the Territorial Court en banc. This was defined in 1903 as being atleast two of the three Territorial Court judges.

In 1912, an amendment to the Yukon Act reduced the number of Territorial Court judges to one. JudgesDugas and Craig left the Yukon. Judge Macaulay remained in office until his retirement from the Benchin 1940.

The Territorial Court records date from 1897 to 1950, and include Cases, Court Notebooks, Estates,Judges’ Notebooks, Trial Judgements, Arguments, Appeal Books, and other miscellaneous records.They were originally received in a number of accessions. Cases were received in Accessions #77/6 and#83/23; Estates were received in Accession #79/114. Some unaccessioned and miscellaneous records arealso included in this Finding Aid. Certain Court Notebooks and Judges’ Records are cross-referencedfrom YRG 1 Series 8. In most cases, records were received in no apparent order. It was necessary torearrange cases, estates, and other documents to correspond with the order indicated by original file anddocket numbers. All records were retained. The Territorial Court Records comprise eight linear metresof archival storage space.

Some of the files are restricted. These contain personal information. Researchers will be granted accessto material specifically relating to themselves. Researchers wishing to conduct blind statistical studies ofinformation contained within these files may apply in writing to do so.

Territorial court cases were originally received in two accessions, #77/6 and #83/23, and were organizedin several systems. This original organization has been maintained in the listings which follow.

These volumes contain hand-written notes (some in shorthand) of court case proceedings. They appear tohave been kept by the court reporter, and were the rough notes from which the final typed caseproceedings were prepared. C. ESTATES 1897-1950

In the Yukon, no court of probate existed apart from the Territorial Court. It was in this court that willswere proved and Letters of Administration were issued.

This section contains individual estate files, which comprise the documentation required for theadministration of an estate. These include wills, releases and transmission applications to transfer realproperty, certificates of administration, affidavits of relationship, and deeds to effect the transfer of realproperty, mining claims, chattels, and other assets. Some estates comprised more than one file, whilesome files contained documents pertaining to two estates. Estates were numbered consecutively. After1947, it appears that a new numbering system was started. These records were received as Accession#79/114. A few estate files are also found in the Annual / Sequentially Numbered Cases. Several types of judges’ records are contained within the Territorial Court records. These include Judges’Notebooks, Trial Judgements, Arguments, and Appeal Books.

1. Judges’ Notebooks 1898-1911

These volumes contain hand-written notes made by judges during and after court proceedings.They were apparently used by the judges in arriving at decisions regarding verdicts in cases.Most of these notebooks appear to be those of Judge C.A. Dugas who was the senior judge in theterritory from 1898 to 1912. Some of these volumes are cross referenced from YRG 1 Series 8.
