Sonoma Wire WorksEnd-User License AgreementThisEnd-UserLicenseAgreement(“Agreement”)isalegalagreementbetweenyou(“Licensee”,“You”,or“Your”)(eitheranindi-vidualoranentity)andSonomaWireWorks(“SonomaWireWorks”)regardingtheuseofthesoftwareproductthataccompaniesthisAgreement,includinganyassociatedmediaanddocumentation(“LicensedSoftware”).TheLicensedSoftwarealsoincludesanysoftwareupdates,add-oncomponents,andwebservicesthatSonomaWireWorksmayprovideYouormakeavailabletoYouafterthedateYouobtainyourinitialcopyoftheLicensedSoftware,totheextentthatsuchitemsarenotaccompaniedbyaseparatelicenseagreementortermsofuse.ThisLicensedSoftwareisprotectedbycopyrightlawsandinternationalcopyrighttreaties,aswellasotherintellectualproperty lawsandtreaties.ThisLicensedSoftwareis licensed(notsold),anditsuseissubjecttothetermsofthisAgreement.
1. LICENSE 1.1 Definition of Licensed Software, Documentation and Associated Media.“LicensedSoftware”meanstheobjectcodever-sionofthesoftwareprogramthatisdownloadedwiththisAgreement,allpermittedreproductionsofthesamemadebyLicensee,andallupgrades,enhancementsor improvements tosuchsoftwareprogramsubsequentlyprovided toLicenseebySonomaWireWorksoritsauthorizedagents,distributors,orresellersonanydistributionmediaorviaanyformofelectronicdistribu-tion.“Documentation”meanstherelateddocumentationgenerallyprovidedbySonomaWireWorkswiththeLicensedSoftware,whichmaybeprovidedinhardcopyorelectronicallyorviawebservices.“AssociatedMedia”meansallphotographs,videoclips,soundsandmusicsamples, including InstantDrummer (aSonomaWireWorks trademark) files (together “AssociatedMedia”)whichareincludedwiththeLicensedSoftwareorsubsequentlydownloadedorinstalledbyYoufromSonomaWireWorksortheirlicenseddistributorsorresellers.
1.2 License Grant.SubjecttotheothertermsinthisAgreement,SonomaWireWorksherebygrantstoLicenseeaperpetualandnon-exclusivelicensetoinstallandusetheLicensedSoftwareontwocomputersforLicensee’spersonalorinternalbusinesspurposes.LicenseemustlicenseaseparatecopyoftheLicensedSoftwareforeachadditionalcomputeronwhichtheLicensedSoftwarewillbeinstalled.Licenseemaymakeuptotwo(2)copiesoftheLicensedSoftwaretobeusedforarchivalorback-uppurposesonly.LicenseemaycopytheDocumentationasreasonablynecessaryinconnectionwithLicensee’sauthorizedinternaluseoftheLicensedSoftware.
1.3 Additional License Grant for Associated Media.Youmayuse,copyandmodify theAssociatedMedia,alongwithYourmodifications,aspartofYourproduct(s)andservice(s).Youarenotlicensedtosell,licenseordistributetheAssociatedMediaonastand-alonebasisoraspartofanycollection,productorservicewheretheprimaryvalueoftheproductorserviceistheAs-sociatedMedia.YoumaynotuseordistributeanyoftheAssociatedMediathatincludesrepresentationsofidentifiableindividuals,logos,trademarksforcommercialpurposesortoimplyanyendorsementorassociationwithanyproduct,serviceorentity.YoumustincludeavalidcopyrightnoticeonyourproductsandservicesthatincludetheAssociatedMedia.Youmustindemnify,holdharmless,anddefendSonomaWireWorksagainstanyclaimsorlawsuits,includingattorney’sfees,thatarisefromorresultfromtheuseordistributionofAssociatedMediaasmodifiedbyYou.

1.4 License Restrictions.Excepttotheextentthefollowingprohibitionsmaybeprohibitedbylocallaw,Licenseemaynot:(a)modify,adapt,decompile,disassemble,orreverseengineertheLicensedSoftware;(b)exceptasprovidedforinparagraph�.3,createderivativeworks(asdefinedintheUnitedStatesCopyrightAct,�7USC§�0�)basedontheLicensedSoftware;(c)allowanythirdpartytouseorhaveaccesstotheLicensedSoftwareorDocumentation,exceptforanoutsourceserviceproviderwhoagreestobeboundbythisAgreement;(d)maketheLicensedSoftwareavailableovertheInternetorsimilarnetworkingtechnol-ogy;(e)use,evaluateorviewtheLicensedSoftwareorDocumentationforpurposeofdesigning,modifying,orotherwisecreat-inganysoftwareprogram,oranyportionthereof,whichperformsfunctionssimilartothefunctionsperformedbytheLicensedSoftware;or(f)sublicensetheLicensedSoftwareorDocumentationtoanythirdparty.
1.5 Ownership.Licenseeacknowledgesandagreesthat:(a)theunderlyingstructure,sequence,organizationandsourcecodeoftheLicensedSoftwarearevaluabletradesecretsofSonomaWireWorksand/oritslicensors;(b)theLicensedSoftwareandDocumentation,includinganycopyorpartialcopymadebyLicensee,arethepropertyofSonomaWireWorksoritslicensors,andnotLicensee;and(c)LicenseewillusetheLicensedSoftwareandDocumentationonlyunderthetermsandconditionsherein.Licenseemaynotremoveoralteranycopyright,trademarkandotherproprietaryrightsnoticesincludedbySonomaWireWorksontheoriginals,andwillincludeallsuchnoticesonanycopies.
1.6 Upgrades.IftheLicensedSoftwareislabeledasanupgrade,Licenseemustbeproperlylicensedtousethesoftwareidenti-fiedbySonomaWireWorksasbeingeligiblefortheupgradeinordertousetheupgradedLicensedSoftware.LicensedSoftwarelabeledasanupgradereplacesand/orsupplementsthesoftwarethatformedthebasisforLicensee’seligibilityfortheupgrade.LicenseemayusetheupgradeandtheresultingupgradedLicensedSoftwareonlyinaccordancewiththetermsofthisAgree-ment;exceptthatwhenanupgradeisdownloadedfromtheInternet,LicenseemayadditionallymakeonecopyoftheupgradeforeachlicensedcopyoftheunderlyingLicensedSoftware.IftheLicensedSoftwareisanupgradeofacomponentofapackageofsoftwareprogramsthatLicenseelicensedasasingleproduct,theLicensedSoftwaremaybeusedonlyaspartofthatsinglesoftwarepackageandmaynotbeseparatedforuseonmorethanonecomputer.
1.7 Assignment of License.ThisLicenseisgrantedtotheoriginallicenseeandisnottransferable.
2. Termination.UponanyviolationofanyoftheprovisionsofthisAgreement,Licensee’srightstousetheLicensedSoftwareshallautomaticallyterminateandLicenseeshallbeobligatedtodestroyallcopiesoftheLicensedSoftwareandrelatedDocumen-tation.LicenseemayterminatethisAgreementatanytimebydestroyingtheLicensedSoftwareandrelatedDocumentation.
3. Limited Warranty.SonomaWireWorkswarrants toLicensee that theLicensedSoftwarewillperform insubstantialconformancetoitsprogramspecificationsforninety(90)daysfromthedateofdownloading.SonomaWireWorks’soleobligationunderthisexpresswarrantyshallbe,atSonomaWireWorks’optionandexpense,tomodifytheLicensedSoftwaresothatitperformsinsubstantialconformancetotheapplicablepublishedspecifications,orreplacetheLicensedSoftwarewithasoftwareprogramthatperformsinsubstantialconformancetotheapplicablepublishedspecifications,orifneitheroftheforegoingoptionsiscommerciallyfeasible,refundthelicensefeepaidforthedefectiveLicensedSoftware.
Exclusions.SonomaWireWorksshallnotbeliableunderthiswarrantyifistestingandexaminationdisclosethattheallegeddefectormalfunctioninthesoftwaredoesnotexistorwascausedbylicensee’soranythirdperson’smisuse,neglect,improperinstallationortesting,unauthorizedattemptstomodifythesoftware,oranyothercausebeyondtherangeoftheintendeduse,orbyaccident,fire,lightning,powercutsoroutages,otherhazards,oractsofGod.
Warranties Exclusive.IftheLicensedsoftwarelicensedunderthisagreementdoesnotoperateaswarrantedbySonomaWireWorksabove,Licensee’ssoleremedyforbreachofthatwarrantyshallberepair,replacement,orrefundofthelicensefeepaid,atSonomaWireWorksoption.Tothefullextentallowedbylaw,theforegoingwarranties,terms,orconditions,expressorimplied,eitherinfactorbyoperationoflay,statutoryorotherwise,orarisingfromthecourseofdealingbetweenthepartiesorusageoftrade,includingwarranties,terms,orconditionsofmerchantability,fitnessforaparticularpurpose,satisfactoryquality,andnon-infringement,allofwhichareexpresslydisclaimed.Thesedisclaimersofwarrantyconstituteanessentialpartofthisagreement.

4. Limitation of Liability. Tothefullextentallowedbylaw,SonomaWireWorksshallnotbeliabletolicensee,whetherbasedincontract,tort(includingnegligence),oranyotherlegaltheory,forincidental,consequential,indirect,specialorpunitivedamagesofanykind,orforlossofrevenueorprofits,lossofbusiness,oranydamagesthatarenotdirect,arisingouroforinconnectionwiththisagreementortheperformanceorbreachhereof,evenifSonomaWireWorkshasbeenadvisedofthepossi-bilitythereof.Themaximumliability,ifany,ofSonomaWireWorksanditslicensorstolicenseeforthelicensedsoftwarelicensedhereunder.Thesedisclaimersofliabilitywillnotbeaffectedifanyremedyprovidedhereinfailsofitsessentialpurpose.
5. Export.Licenseeagreesnot toexport,eitherdirectlyor indirectly, theLicensedSoftwareorDocumentationwithoutfirstobtaininganyrequiredlicenseorotherapprovalfromtheU.S.DepartmentofCommerceoranyotheragencyordepartmentoftheUnitedStatesGovernment.IntheeventLicenseeexportsanyLicensedSoftwareorDocumentationfromtheUnitedStatesorre-exportsitfromaforeigndestination,Licenseeshallensurethattheexport/re-exportorimportoftheLicensedSoftwareandDocumentationisincompliancewithallapplicablelaws,regulations,ordersorotherrestrictionsoftheUnitedStatesandtheappropriateforeigngovernment.
6. US Government Rights.IfLicenseeisanagencyand/orinstrumentalityoftheUnitedStatesofAmerica,allLicensedSoftwareandtherelatedDocumentationisprovidedsubjecttotherestrictionsapplicabletootherendusersinaccordancewiththetermsofthisAgreementandasprovidedinDFARS227.7202-�(a)and227.7202-3(a)(�995),DFARS252.227-70�3(c)(�)(ii)(Oct.�988),FAR�2.2�2(a)(�995),FAR52.227-�9,orFAR52.227-�4(AltIII),asapplicable.
7. General7.1 Entire Agreement; Other Signed License.ThisAgreement represents thecompleteagreementconcerning thematterscoveredandmaybeamendedonlybyawritingexecutedbybothparties.However,ifLicenseehasineffectasignedlicenseagreementwithSonomaWireWorkswithrespecttotheLicensedSoftwarecoveredbythisAgreement,thennotwithstandinganyotherprovisioninthisAgreement,thetermsofthatsignedlicenseagreementshallcontrolLicensee’suseoftheLicensedSoftwareandrelatedDocumentation. IfanyprovisionofthisAgreementisheldtobeunenforceable,suchprovisionshallbemodifiedonlytotheextentnecessarytomakeitenforceable,andtheremainingprovisionsshallbeenforceable.
7.2 Governing Law and Venue. ThisagreementisgovernedbythelawsofthestateofCaliforniaassuchlawsareappliedtoagreementsentered intoand tobeperformedentirelywithinCaliforniabetweenCaliforniaresidents,andbe the lawsof theUnitedStates.TheUnitedNationsConventiononContractsfortheInternationalSaleofGoods(�980)isherebyexcludedinitsentiretyfromapplicationtothisAgreement.TheSuperiorCourtofSantaClaraCountyand/ortheUnitedStatesDistrictCourtfortheNorthernDistrictofCaliforniashallhaveexclusivejurisdictionandvenueoverallcontroversiesinconnectionherewith.

2.1.1 Turning knobsAll knobs inRiffWorks function thesameway.Left-clickingonaknobanddraggingthecursordirectlyupordownwillcausetheknobtorotateeitherright(cursorup)orleft(cursordown).
Right-clickingaknoborCTRL-clickingonaMacwillreturntheknobtoitsdefaultposition.Withknobslikegainandpan,thisdefaultpositionisinthecenter.WithsomeoftheInstantDrummerknobslikeINTENSITYandVARIATION,thisdefaultpositionisallthewaytotheleftoratzero.

Chapter 3 Recording 3.1 The Riff Recorder
TheRiffRecorderistheheartofRiffWorks.Thisiswherealltherecord-ing happens.When you select a Riff from the RIFFS list, its contentsandsettingsarealldisplayedhere.RememberthatRiffWorkshasaRiffbasedworkflowwheresongsarerecordedinchunksinsteadofalltheway through.Thosechunksofyoursong (Riffs) canhaveavarietyofBACKUPS,varyinglengths,andsoon.JustcheckupintheRIFFSListtoseewhichRiffhasthelittlebrowntriangle.ThisistheRiffyouareseeingintheRIFFRECORDER.
