A. Everitt Enteiprises, Inc., Carl H. Petersen and Carol J. Petersen submitted the real property described in the Protective Covenants and Homeowner's Association

. Agreement fut Soutbmoor Village East Second and Third Filings, now known as Nelson Farm Homeowner's Assn. Inc., recorded in the real property records of Larimer County, State of Colorado, at Book 1802, Page 3, as amended aod restated by that certain Amended and Restated Protective Covenants aod Homeowner's Association Agreement for Nelson Farm Homeowner's Ass!L Inc., recorded in the real property records of the Larimer County, State of Colorado, at Reception No. 2006-0001825, on January 9, 2006, (collectively referred to as the "Original Declaration").

B. The Association has determined that a technical, clerical, typographical and clarification amendment to the Amended and Restated Protective Covenants and Homeowner's Association Agreement for Nelson Farm Homeowner's Asan. Inc. is necessary to clarify the identity of the lots located outside of the Nelson Farm community that subject the owners ofthose lots to Social Membership status by adding legal descriptions to the addresses ofthe Social Members.

NOW THEREFORE,

(a) Repeal and Restatement. Exhibit A of the Amended and Restated Protective Covenants and Homeowner's Association Agreement for Nelson Farm Homeowner's Assn. Inc. is repealed in its entirety and replaced by the attached Exln'bit A.

ll. No Other Amendments. Except as amended by the terms of this Amendment and previous amendments, the Declaration shall remain in full force and effect.
