Members of the Public / Media There were 32 members of the public in attendance. Ms Laura Pond from the Stirling Times was in attendance. 1. Declaration of Opening

The Presiding Member, Ms Karen Hyde declared the meeting open at 9.30am on 22 February 2018 and acknowledged the past and present traditional owners and custodians of the land on which the meeting was being held.

The Presiding Member announced the meeting would be run in accordance with the DAP Standing Orders 2017 under the Planning and Development (Development Assessment Panels) Regulations 2011. The Presiding Member advised that in accordance with Section 5.16 of the DAP Standing Orders 2017; No Recording of Meeting, which states: 'A person must not use any electronic, visual or audio recording device or instrument to record the proceedings of the DAP meeting unless the Presiding Member has given permission to do so.', the meeting would not be recorded.

1. A Parking Management Plan shall be submitted to the City of Stirling for

approval prior to commencement of development. The Parking Management Plan shall demonstrate how: a. How vehicle access to the secured car parking area and universal access

to the residential visitor bays will be controlled; b. How a reciprocal car parking arrangement will operate outside of

standard business hours allowing the dedicated commercial car bays to be utilised as residential visitor bays, in compliance with Clause 6.3.3 of the Residential Design Codes (Parking), with a minimum nine (9) residential and three (3) residential visitor bays;

c. What methods will be used to monitor and enforce compliance with Local Planning Policy 6.7 – Parking & Access and the Residential Design Codes within standard business hours;

d. How the different types of parking, such as ACROD and visitors, within the facility will be managed and controlled;

e. How evidence will be collected and reported to demonstrate compliance; and

f. What safety and security measures will be implemented to protect those using the facility.

The Parking Management Plan is to be complied with for the duration of the occupation of the development, unless otherwise varied by the City of Stirling.

2. The Consulting Room tenancy is to be occupied by no more than one (1)

practitioner at any one time.

3. All awnings are to comply with the weather protection provisions of the City’s Local Planning Policy 5.7 – Karrinyup Regional Centre Guidelines. Awnings are to be constructed of opaque and non-reflective materials (no glass).

4. The parapet wall facing south on the Second Floor is to be modulated and

provided with additional indentations to provide visual interest as viewed from the public street, in accordance with the City’s Local Planning Policy 5.7 – Karrinyup Regional Centre Guidelines, to the satisfaction of the City.

5. A 1.8m high screen wall facing Smith Street is to be provided 2.0m behind the

predominant building line of the development on the eastern side boundary, in accordance with the safety and surveillance provisions of the City’s Local Planning Policy 5.7 – Karrinyup Regional Centre Guidelines.

6. The ground floor vehicle access roller shutter door is to be designed and

constructed to be visually permeable in accordance with the provisions of the City’s Local Planning Policy 5.7 – Karrinyup Regional Centre Guidelines, to the satisfaction of the City of Stirling.

7. Privacy screening in compliance with the requirements of Clause 6.4.1 of the

Residential Design Codes (Visual Privacy) deemed-to-comply provisions is to be provided to the First Floor Lower Walkway, as marked in green on the First Floor plan (A1.02 Rev G refers), to the satisfaction of the City. The amendments are to be shown on the plans submitted as part of the Building Permit application.

8. The submission of an Acoustic Report from a qualified acoustic (noise)

consultant is required to the satisfaction of the City, prior to the issue of a Building Permit. All noise attenuation measures, identified by the report and additionally required by the City of Stirling in accordance with the City’s Local Planning Policy 5.7 – Karrinyup Regional Centre Guidelines, are to be incorporated into the building design and implemented prior to occupancy of the development or as otherwise required by the City of Stirling and the requirements of the report are to be observed at all times.

9. Boundary wall/s shall not exceed the height/s shown on the approved plans.

Prior to occupation, the external finish of the boundary wall/s shall be finished externally to the same standard as the rest of the development, to the satisfaction of the City.

10. All clothes drying devices and clothes drying areas shall be located and

positioned so as not to be visible from the street or a public place.

11. Each multiple dwelling shall be provided with a mechanical dryer prior to the occupancy or use of the development where a concealed drying area is not provided exclusively for the dwelling.

12. The Waste Management Plan submitted with the application dated 23

November 2017 is to be complied with for the duration of the occupation of the development. The refuse areas shall comply with the City of Stirling Waste Management Local Law 2010.

13. Residential car parking bays ‘R1’, ‘R2’ and ‘R3’ as marked in red on the ground

floor plan are to be relocated 200mm towards the residential store structures to ensure an aisle width of 6.1m is achieved between the subject bays and the vehicle access roller door, in accordance with Australian Standards AS/NZS2890.1 section 2.4.2 (d), to the satisfaction of the City.

14. Commercial car parking bays ‘C2’, ‘C3’ and ‘C4’ and Residential car parking

bays ‘R7’, ‘R8’ and ‘R9’, as marked in blue on the ground floor plan, are to be switched in location to ensure access to Residential stores 1, 2 and 3 is not restricted.

15. Vehicular parking manoeuvring and circulation areas indicated on the approved

plans shall be sealed and drained, the parking spaces marked out and maintained in good repair.

16. All parking areas (including ACROD car parking bays) are to comply with

AS/NZS2890.1:2004, AS2890.2:2002 and AS/NZS2890.6:2009. Particular items to note include headroom (AS/NZS2890.1 section 5.3, and AS/NZS2890.6 section 2.4), and manoeuvring space (AS/NZS2890.1 section 2.4.2 (d)).

17. Crossover/s shall be designed and constructed in accordance with the City’s

Local Planning Policy 6.7 - Parking and Access. Crossovers are to be installed prior to occupancy or use of the development.

18. Prior to the occupation or use of the development, any redundant crossover(s)

shall be removed and the kerbing and road verge reinstated at the owners cost

in accordance with City’s Local Planning Policy 6.7 - Parking and Access.

19. The two (2) residential visitor parking bays shall be permanently marked,

maintained and legally accessible at all times for use exclusively by visitors to the property, be clearly visible or suitably sign posted from the street or communal driveway and be located, together with the reversing area, in front of any security gates or barrier for the development unless otherwise approved by the City.

20. Prior to occupancy or use of the development all off-street parking to be

available onsite during business hours for all residents, customers and staff.

21. No goods or materials being stored, either temporarily or permanently, in the parking or landscape areas or within access driveways. All goods and materials are to be stored within the buildings or storage yards, where provided.

22. No walls, letterboxes, fences or other structures above 0.75 metres in height to

be constructed within the 1.5 metres of where: a) vehicular access points adjoin the site, or b) driveway meets a public street, or c) two streets intersect, or d) driveway meets a right of way, unless further approval of Council is obtained.

23. A Site Management Plan to be submitted and approved by the City prior to the issue of a Building Permit. The Site Management Plan to address dust, noise, waste management, storage of materials, traffic and site safety/security. The Site Management Plan is to be complied with for the duration of the construction of the development.

24. Prior to occupancy or use of the development, all privacy screening shall be

visually impermeable and is to comply in all respects with the requirements of Clause 6.4.1 of the Residential Design Codes (Visual Privacy) deemed-to-comply provisions.

25. All land indicated as landscaped area on the approved landscaping plans shall

be developed on practical completion of the building and be reticulated thereafter, to the satisfaction of the City.

26. Prior to occupation of the development, two (2) advanced trees must be

planted on site in the areas indicated on the approved landscaping plans and be thereafter maintained. The trees must be provided with a minimum nine (9) square metres of soil space with a minimum dimension of two (2) metres at ground level free of intrusions (refer Advice Note 7).

27. Planting of (1) new street tree at the applicants cost will be scheduled to occur

in the next available planting season after the completion of the development. The applicant shall pay the cost of planting of the new street tree prior to commencement of development as determined by the City in the City’s Local Planning Policy 6.11 - Trees and Development (refer Advice Note 8).

28. Pedestrian entrances shall be finished at pavement level of the adjacent public

road to allow for Universal Access.

29. All signage is to comply with the City’s Local Planning Policy 6.1 – Advertising

Signs, unless the further approval from the City of Stirling is obtained.

30. All air conditioning units, plant and roof equipment and other external fixtures are to be screened from view of a public street.

31. Stormwater from all roofed and paved areas shall be collected and contained

on site. Stormwater must not affect or be allowed to flow onto or into any other property or road reserve.

32. The development is to be connected to the reticulated sewerage network.

33. All ground floor external walls are to be treated with an anti-graffiti coating to

reduce the likelihood of and improve ease of graffiti removal.

34. A minimum of five (5) bicycle parking bays shall be provided on site. The design and construction of the bicycle bays shall be in accordance with Australian Standards AS 2890.3:2015 Parking Facilities Part 3: Bicycle Parking.

35. The bicycle parking bays shall be made available for use by residents and

visitors, prior to the occupancy or use of the development.

36. External lighting is to be provided to all public spaces including under awnings, parking areas, service areas, footpaths and entry and exit points (refer Advice Note 6).

37. All works proposed within the Francis Avenue and Smith Street road reserves

require separate approval from the City.

Advice Notes 1. Construction noise is not permitted outside of the hours of 7.00am to 7.00pm

Monday to Saturday inclusive. Any construction works are to comply with the Environmental Protection (Noise) Regulations 1997. Noisy construction works to comply with times specified under the Noise Regulations unless a Noise Management Plan for the construction site has been issued.

2. The level of noise emanating from all fixed plant and equipment installed at the

premises not to exceed that prescribed in the Environmental Protection Act 1986 and Environmental Protection (Noise) Regulations 1997.

3. The proposed crossover configuration is subject to the approval of the City’s

Engineering Operations Business Unit. A ‘Crossover Installation Application’ is required to be submitted and approved prior to the commencement of the crossover installation.

4. All street trees adjoining the subject land as shown on the submitted plans are

to be retained and protected. It is the responsibility of the applicant to ensure that the site survey plan is correct as any inaccuracy of the plans will not be considered justification for removal of the trees in the event that their positions are incorrectly shown. The removal of street trees without the written approval of the City is an offence.

5. Development is to comply in all respects with the Health (Public Building)

Regulations 1992.

6. Any outside lighting should meet Australia Standard AS 4282-1997 for the control of obstructive effects of outdoor lighting and must not spill into any adjacent residential premises.

7. An Advanced Tree is defined in Local Planning Policy 6.11 as: means a tree

which requires planting in at least a 90 litre contained or greater size and which is at least two (2) metres in height and at least two (2) years of age.

8. As per Condition 27 the associated contribution costs for the planting of one (1)

street tree are as follows: i) Cost of new tree - $860.00 ii) Number of new trees required – One (1) iii) Total cost for the associated works - $860.00

Tree species will be chosen by the City to reflect the surrounding streetscape. Costs include 2 years of watering and the provision that the City will replace the tree should it be damaged or die during that period.

AMENDING MOTION Moved by: Mr Ray Haeren Seconded by: Mr John Syme To amend Condition 3 to read as follows:

All awnings are to comply with the weather protection provisions of the City’s Local Planning Policy 5.7 – Karrinyup Regional Centre Guidelines. With the exception of the 2m wide glass awning above the pedestrian entry to the dwellings on Francis Avenue, the remainder of the awnings are to be constructed of opaque and non-reflective materials.

REASON: Only a 1.9m wide portion of the awning is proposed as glass. The purpose of this portion of the awning being glass is to highlight and accentuate the residential pedestrian entry. This design feature assists visitors in locating the entry (known as wayfinding). The 1.9m wide portion of glass awning will not cause any undue glare or other impacts to adjoining properties. Further articulation of this portion of the wall is considered to be more appropriately achieved through colour and/or material treatments. The Amending Motion was put and CARRIED UNANIMOUSLY. AMENDING MOTION Moved by: Cr Bianca Sandri Seconded by: Cr Giovanni Italiano To delete Condition 32 and renumber the remaining conditions accordingly. REASON: The condition is not relevant as it is a requirement under the Health Act. The Amending Motion was put and CARRIED UNANIMOUSLY. AMENDING MOTION Moved by: Cr Bianca Sandri Seconded by: Cr Giovanni Italiano To amend Condition 25 to read as follows:

All land indicated as landscaped area on the approved landscaping plans shall be undertaken prior to occupation of the building and be reticulated thereafter, to the satisfaction of the City.

REASON: To be consistent with the other conditions within the report. The Amending Motion was put and CARRIED UNANIMOUSLY. AMENDING MOTION Moved by: Cr Bianca Sandri Seconded by: Nil To delete Condition 21 and renumber the remaining conditions accordingly. REASON: The approved plans clearly demonstrate where the car parking bays are and therefore if anyone was to unusually store things within the car bays that would be a compliance issue and the condition is irrelevant. The Amending Motion lapsed for want of a seconder. AMENDING MOTION Moved by: Cr Bianca Sandri Seconded by: Ms Karen Hyde To amend Condition 15 by inserting a comma after the words “Vehicle parking”.

Residential Design Codes (Visual Privacy) deemed-to-comply provisions is to be provided to the First Floor Lower Walkway, as marked in green on the First Floor plan (A1.02 Rev G refers), to the satisfaction of the City. The amendments are to be shown on the plans submitted as part of the Building Permit application.

8. The submission of an Acoustic Report from a qualified acoustic (noise)

consultant is required to the satisfaction of the City, prior to the issue of a Building Permit. All noise attenuation measures, identified by the report and additionally required by the City of Stirling in accordance with the City’s Local Planning Policy 5.7 – Karrinyup Regional Centre Guidelines, are to be incorporated into the building design and implemented prior to occupancy of the development or as otherwise required by the City of Stirling and the requirements of the report are to be observed at all times.

9. Boundary wall/s shall not exceed the height/s shown on the approved plans.

Prior to occupation, the external finish of the boundary wall/s shall be finished externally to the same standard as the rest of the development, to the satisfaction of the City.

10. All clothes drying devices and clothes drying areas shall be located and

positioned so as not to be visible from the street or a public place.

11. Each multiple dwelling shall be provided with a mechanical dryer prior to the occupancy or use of the development where a concealed drying area is not provided exclusively for the dwelling.

12. The Waste Management Plan submitted with the application dated 23

November 2017 is to be complied with for the duration of the occupation of the development. The refuse areas shall comply with the City of Stirling Waste Management Local Law 2010.

13. Residential car parking bays ‘R1’, ‘R2’ and ‘R3’ as marked in red on the ground

floor plan are to be relocated 200mm towards the residential store structures to ensure an aisle width of 6.1m is achieved between the subject bays and the vehicle access roller door, in accordance with Australian Standards AS/NZS2890.1 section 2.4.2 (d), to the satisfaction of the City.

14. Commercial car parking bays ‘C2’, ‘C3’ and ‘C4’ and Residential car parking

bays ‘R7’, ‘R8’ and ‘R9’, as marked in blue on the ground floor plan, are to be switched in location to ensure access to Residential stores 1, 2 and 3 is not restricted.

15. Vehicular parking, manoeuvring and circulation areas indicated on the

approved plans shall be sealed and drained, the parking spaces marked out and maintained in good repair.

16. All parking areas (including ACROD car parking bays) are to comply with

AS/NZS2890.1:2004, AS2890.2:2002 and AS/NZS2890.6:2009. Particular items to note include headroom (AS/NZS2890.1 section 5.3, and AS/NZS2890.6 section 2.4), and manoeuvring space (AS/NZS2890.1 section 2.4.2 (d)).

17. Crossover/s shall be designed and constructed in accordance with the City’s

Local Planning Policy 6.7 - Parking and Access. Crossovers are to be installed prior to occupancy or use of the development.

18. Prior to the occupation or use of the development, any redundant crossover(s)

shall be removed and the kerbing and road verge reinstated at the owners cost in accordance with City’s Local Planning Policy 6.7 - Parking and Access.

19. The two (2) residential visitor parking bays shall be permanently marked,

maintained and legally accessible at all times for use exclusively by visitors to the property, be clearly visible or suitably sign posted from the street or communal driveway and be located, together with the reversing area, in front of any security gates or barrier for the development unless otherwise approved by the City.

20. Prior to occupancy or use of the development all off-street parking to be

available onsite during business hours for all residents, customers and staff.

21. No goods or materials being stored, either temporarily or permanently, in the parking or landscape areas or within access driveways. All goods and materials are to be stored within the buildings or storage yards, where provided.

22. No walls, letterboxes, fences or other structures above 0.75 metres in height to

be constructed within the 1.5 metres of where: a) vehicular access points adjoin the site, or b) driveway meets a public street, or c) two streets intersect, or d) driveway meets a right of way, unless further approval of Council is obtained.

23. A Site Management Plan to be submitted and approved by the City prior to the issue of a Building Permit. The Site Management Plan to address dust, noise, waste management, storage of materials, traffic and site safety/security. The Site Management Plan is to be complied with for the duration of the construction of the development.

24. Prior to occupancy or use of the development, all privacy screening shall be

visually impermeable and is to comply in all respects with the requirements of Clause 6.4.1 of the Residential Design Codes (Visual Privacy) deemed-to-comply provisions.

25. All land indicated as landscaped area on the approved landscaping plans shall

be undertaken prior to occupation of the building and be reticulated thereafter, to the satisfaction of the City.

26. Prior to occupation of the development, two (2) advanced trees must be planted on site in the areas indicated on the approved landscaping plans and be thereafter maintained. The trees must be provided with a minimum nine (9) square metres of soil space with a minimum dimension of two (2) metres at ground level free of intrusions (refer Advice Note 7).

27. Planting of (1) new street tree at the applicants cost will be scheduled to occur

in the next available planting season after the completion of the development. The applicant shall pay the cost of planting of the new street tree prior to commencement of development as determined by the City in the City’s Local Planning Policy 6.11 - Trees and Development (refer Advice Note 8).

28. Pedestrian entrances shall be finished at pavement level of the adjacent public

road to allow for Universal Access.

29. All signage is to comply with the City’s Local Planning Policy 6.1 – Advertising Signs, unless the further approval from the City of Stirling is obtained.

30. All air conditioning units, plant and roof equipment and other external fixtures

are to be screened from view of a public street.

31. Stormwater from all roofed and paved areas shall be collected and contained on site. Stormwater must not affect or be allowed to flow onto or into any other property or road reserve.

32. All ground floor external walls are to be treated with an anti-graffiti coating to

reduce the likelihood of and improve ease of graffiti removal.

33. A minimum of five (5) bicycle parking bays shall be provided on site. The design and construction of the bicycle bays shall be in accordance with Australian Standards AS 2890.3:2015 Parking Facilities Part 3: Bicycle Parking.

34. The bicycle parking bays shall be made available for use by residents and

visitors, prior to the occupancy or use of the development.

35. External lighting is to be provided to all public spaces including under awnings, parking areas, service areas, footpaths and entry and exit points (refer Advice Note 6).

36. All works proposed within the Francis Avenue and Smith Street road reserves

require separate approval from the City.

Advice Notes 1. Construction noise is not permitted outside of the hours of 7.00am to 7.00pm

Monday to Saturday inclusive. Any construction works are to comply with the Environmental Protection (Noise) Regulations 1997. Noisy construction works to comply with times specified under the Noise Regulations unless a Noise Management Plan for the construction site has been issued.

2. The level of noise emanating from all fixed plant and equipment installed at the

premises not to exceed that prescribed in the Environmental Protection Act 1986 and Environmental Protection (Noise) Regulations 1997.

3. The proposed crossover configuration is subject to the approval of the City’s

Engineering Operations Business Unit. A ‘Crossover Installation Application’ is required to be submitted and approved prior to the commencement of the crossover installation.

4. All street trees adjoining the subject land as shown on the submitted plans are

to be retained and protected. 14. All parking bays, areas and ramps are to comply with Australian Standards

AS/NZS2890.1 and AS2890.2 The number of disabled car parking bays and their design and layout are to comply with Australian Standards AS/NZS2890.6:2009 (Off-street Parking for People with Disabilities) and the Building Code of Australia (Volume 1 section D3.5).

15. A minimum of 46 bicycle parking spaces are to be provided on-site within the

bicycle compound and designed in accordance with Australian Standards AS/NZS 2890.3:2015, prior to the completion of the development.

16. Pedestrian pathways providing wheelchair accessibility connecting all entries to

buildings with the public footpath and car parking areas, to comply with Australian Standards AS/NZS1428.1-2009 (Design for access and mobility – General requirements for access – New building work).

17. A Site Management Plan is to be submitted to the City prior to commencement

of works. The Site Management Plan shall address dust, noise, waste management, storage of materials, traffic, tree protection plan/s and site safety/security. The Site Management Plan is to be complied with for the duration of the construction of the development.

18. A Traffic and Parking Management Plan to the satisfaction of the City is

required to be submitted by the applicant prior to occupation of the development.

19. A “Kiss and Drive” drop off/pick-up drive through facility accessed from St

Brigids Terrace is to be provided and managed on-site, to the satisfaction of the City.

20. Any existing crossovers not included as part of the proposed development on

the approved plan are to be removed. New kerbing to be installed and the verge shall be reinstated to the satisfaction of the City of Stirling.

21. Prior to the completion of the development, a 1.8m wide footpath is to be provided adjacent to the kerb on the north side verge of St Brigids Terrace, between Flamborough Street and Herbert Street, to the satisfaction of the City. This footpath is to include aligned pram ramps on Herbert Street in order to provide safe crossing of Herbert Street.

22. Prior to the completion of the development, the existing footpath on the north

side verge of St Brigids Terrace, west of Herbert Street, is to be extended to connect with the proposed short footpath section to the northeast corner of the intersection of St Brigids Terrace and Grand Promenade at the applicant’s expense, to the satisfaction of the City.

23. Prior to the completion of the development, the existing pedestrian crossing

nearest to the intersection of St Brigids Terrace and Grand Promenade is to be removed at the applicant’s expense, to the satisfaction of the City.

24. Prior to the completion of the development, an additional footpath is to be

provided at the applicant’s expense, on the corner of Grand Promenade and St Brigids Terrace, to the satisfaction of the City.

Advice Notes The following Advice Notes are also recommended: a. All works within the road reserve require separate approval through the City’s

Engineering Design Business Unit. b. With respect to Condition 5, the proposed new crossovers along Flamborough

Street and Grand Promenade will result in the loss of existing on-street parking bays.

The following details will be required to support the application: i. Two copies of scale floor plans showing the position of all fixtures and

equipment (scale 1:50); ii. Two copies of scaled sectional elevation plans showing the position of all

fixtures and equipment; iii. Finishes of every wall, floor and ceiling; iv. Indication of hot and cold water supply and waste water services; v. Location of all sinks including hand washbasin; and vi. Provide details of ventilation and exhaust system servicing the premises.

f. All street trees adjoining the subject land that are not conditioned for removal

are to be retained and protected throughout the duration of the development. Should these trees die, decline, be damaged or are removed, charges will apply as per the City’s Street and Reserve Tree Policy. Part of or all of the Verge Bond may be retained to cover the associated costs and further penalties and/or legal action may occur. It is the responsibility of the applicant to ensure that the site survey plan is correct as any inaccuracy of the plans will not be considered justification for removal of the trees in the event that their positions are incorrectly shown.
