The purpose of this submittal is to amend the 2017 Third Quarter Interim Treatment System report (Report) to (1) provide further details of the Interim Treatment System ( ITS) upset cause, effects, and corrective actions consistent with Attachment G, section V.C.1.a.; (2) to correct some inadvertent data entry errors; and (3) and to provide the signing statement for this amendment and the underlying Report.

(1) As noted in the Report, the ITS experienced an operational upset condition during theweeks of August 30 and September 6, 2017 that interfered with the biological processes andremoval efficiency of the ITS, and affected attainment of relevant selenium-related requirements.Table 1, attached (and previously submitted), provides the weekly composite selenium samplingresults for the ITS. Attachment 1 provides a detailed operational report that provides the cause,effects, and corrective action information necessary to evaluate the circumstance.

(2) Upon review of the Report, Lehigh discovered the following inadvertent errors, Table 1data reported for September was incorrect due to a typographical error, Table 3 data reported forchromium and mercury was incorrect due to typographical errors and Table 4 missed a numberafter a decimal point due to formatting.

Phone (408) 996-4226 November 10, 2017 Ms. Erika Guerra Environmental Director, Cement Operations Lehigh Southwest Cement Company 24001 Stevens Creek Blvd. Cupertino, California 95014 Re: Off-Specification Nutrient, ITS Operation, Lehigh Permanente Plant Dear Ms. Guerra, On August 18th 2017, the Lehigh Permanente plant (Lehigh) unknowingly received a delivery of SeHawk 2501 nutrient that did not meet quality specifications (“off-spec”) due to contamination by debris and other foreign objects that were present in the tanker truck delivered by Frontier Water Systems (FWS) for the Interim Treatment System (ITS). Attachment 1 shows the bill of lading the day the off-spec nutrient was delivered. The ITS nutrient is replenished on average every two months, and upon receipt, the nutrient is transferred into tank 500, which has a capacity of 6,000 gallons. The delivery tanker brings in shipments of 4,500 gallons of nutrient. Lehigh requests FWS to provide new nutrient deliveries to maintain a minimum of 1,000 gallons in tank 500. On August 18, tank 500 had 980 gallons of nutrient, and 4,500 gallons of new nutrient was added. Operational Control The stable operation of the ITS is monitored through Oxidation Reduction Potential (ORP) in the effluent of the bioreactors 2nd stage on a continuous basis for each train. From the period of August 18th to August 23rd, ORP levels demonstrated normal operation. ORP at a normal operating range should be under -350 mV. On August 23, two of the trains presented an “out of range” ORP, while the other three presented an ORP spike, a sixth one was in a normal operational range. Lehigh began an operational response by backwashing the trains to eliminate the possibility of untreated water funneling out of the reactors. After backwashing the trains, ORP levels continued to spike. In response, we topped off carbon levels and allowed the reactors sufficient time to react as part of our normal operational response. ORP levels returned to normal on two of the trains (2100 & 2200), whereas the other ORP values kept fluctuating.

On August 24, routine samples were taken to analyze selenium (Se) concentration, among other parameters. The laboratory presented the results to Lehigh on September 19th. (Attachment 2 laboratory report number 1723939). The reported removal efficiency was 74%. During this entire episode and until August 29, operations personnel kept responding by backwashing the trains and attempting to bring them back to normal ORP levels, but the system kept fluctuating. On August 29, while conducting a nutrient drawdown, we noticed that the graduated cylinders used to measure the amount of nutrient introduced into the bioreactors was not filling up. There are two possible reasons why the drawdown cylinders might not fill up: 1.) if the nutrient tank is empty or 2.) If the main feed line is plugged. We checked the main feed line and there was what looked to be an insect blocking the nutrient line. Once the blockage was removed, we continued to monitor the nutrient delivery from tank 500 to the bioreactors. It seemed that every day, we were having trouble getting nutrient delivered into the bioreactors so we decided to change nutrient distribution lines. We also monitored nutrient drawdown level multiple times a day. On August 30, routine samples were taken to analyze Se concentration among other parameters. The lab presented the results to Lehigh on September 28 (Attachment 2 lab report number 1724416). The reported removal efficiency was 48%. ORP levels kept fluctuating in four of the trains. On August 31, we finished changing nutrient lines and allowed 5 days for the bioreactors to recover, which meant allowing the biology to stabilize. On the fifth day (September 6), the ORP still did not stabilize to normal operational conditions in some of the trains, which led us to believe that the nutrient we received on August 18th was the cause of the instability of the ORP, as well as the plugging observed in the nutrient distribution lines.

On September 6, we collected a sample of the suspected faulty nutrient into a 5 gallon bucket. As noted in the photo below, separation in the nutrient was evident. Upon opening the nutrient storage tank, we saw separation and debris in the solution. That same day, we reported our findings to FWS, and we sent them a sample of nutrient for examination.

On September 7, investigation of the nutrient continued. Debris was slightly visible from the top of tank 500, so a sample was pulled and strained. The photos below show the debris. The photo on the right shows the foreign objects in water. To prevent further plugging, strainers were plumbed into the inlet of the nutrient distribution lines until a new batch of on-spec nutrient could be delivered. Monitoring of nutrient drawdown continued and daily cleaning of the strainer was implemented. After the installation of the strainers, ORP returned to normal operational levels over time.

Phone (408) 996-4226 On September 8, routine samples were taken to analyze Se concentration among other parameters. The lab presented the results to Lehigh on September 28 (Attachment 2 lab report number 1725279). The reported removal efficiency of Se was -14% which was contrary to our expectations, since the ORP already showed sufficient values. Our hypothesis to explain the observed discrepancy is: The ITS bioreactors are a 2-stage system. In the two stages, different biochemical reactions occur characterized by different operational ORP ranges. In the 1st stage oxygen reduction, denitrification and the precipitation of elementary selenium are the main processes following that order, while in the 2nd stage sulfate reduction, heavy metal precipitation, and TSS reduction occurs. Due to the plugged lines and the faulty nutrient, the 1st stage was under-supplied with nutrient and processes were slowed down. It is assumed that the denitrification was incomplete and the precipitation of elementary Selenium partly shifted to the 2nd stages (also recognizable by higher ORP values in the effluent of the bioreactors). As a result, selenium was partly precipitated in the 2nd stage during the time of nutrient under-supply from August 24th and September 7 and began to accumulate. The ORP values in the 2nd stages were still sufficient for that biochemical reaction. It is assumed that when the nutrient supply issue was resolved on September 7th, the operation and the ORP values shifted back to normal, and the amount of precipitated selenium in the 2nd stage was exposed to the (normal) more reducing environment there. The normal ORP values in the 2nd stage is in a range where the natural occurrence of selenium shifts from the elementary solid state to HSe-, which is soluble again. Subsequently, the HSe- moved to the 2nd stage causing high selenium concentrations while the 1st stage was already working as designed (reducing selenium in the 1st stage). This situation was a temporary event, limited to the amount of accidentally precipitated selenium, which is directly linked to the off-spec nutrient. On September 8, Lehigh arranged for FWS to provide on-spec nutrient and scheduled a clean out of tank 500. FWS had difficulties delivering immediately. On September 11, a tote (250 gallons) of on-spec nutrient was delivered and plumbed to feed the ITS. FWS emptied the off -spec nutrient into a tanker truck and hauled it away. Cleaning of the tank 500 commenced and was completed on September 19. The same day (September 11), approximately 4,500 gallons of nutrient was delivered, but rejected due to debris present in the nutrient. Three more attempts were made to deliver nutrient between September 11 and October 3, but Lehigh determined that the nutrient from all 3 deliveries was off-spec, and therefore was rejected. The use of 250-gallon totes containing on spec nutrient continued until October 3.

Phone (408) 996-4226 On September 12, routine samples were taken to analyze Se concentration, among other parameters. The laboratory presented the results to Lehigh on October 16 (Attachment 2 lab report number 1725903). The reported removal efficiency was 91%.

On October 3, FWS was on site to witness and test a delivery of nutrient. The product was strained using a 100 micron bag filter which separated a small amount of debris before the liquid entered the tank and thus, was determined to be acceptable for use by Lehigh. A total of 639 gallons of off-spec nutrient went through the system for a span of 24 days from August 18th to September 11th, 2017. Attachment 3 is the new Standard Operation Procedure developed by Lehigh to perform quality assurance and quality control for each nutrient load before it is approved for off-loading into the system. Lehigh also required FWS to perform quality controls at their facilities to ensure that all nutrient delivered to Lehigh conforms to specifications. Attachment 4 is a letter from FWS to Lehigh confirming that this will be the case for future deliveries. Lehigh has also decided to track ORP levels in a redundant manner enabling the ability to react faster to deviations from stable operation. Sincerely, Antonio Del Rio

Nutrient Acceptance & Unloading

Nutrient is used to supplement bacteria in the bioreactors. Quality assurance of each delivery of nutrient is crucial to the operation and performance of the bioreactors. This SOP is to be used as a guide to ensure all nutrient deliveries are accepted only if nutrient is up to Lehigh’s standards and specifications.

• Responsibility—Environmental engineer. • Applicability— Replenishing nutrient in tank 500. • Affected Area—Environmental Department. • Frequency—Every time a nutrient load is delivered and prior to discharge in Tank 500. • Attachments—None. • Safety—PPE and chemical resistant gloves. • Procedure

1) Before arrival of nutrient delivery truck. i. Remove cover from bag filters attached to tank 500.

ii. Inspect bag filters to make sure they are clean and free of debris. iii. If debris is present replace bag filter with new 100 micron bag filter.

2) Delivery truck arrives at front gate.

i. Review bill of lading to make sure load is correct. ii. Deliver tanker truck will require an escort to tank 500.

iii. Once at tank 500, ensure all safety rules are followed by driver (wheel chock, safety glasses, hard hat, and steel toe boots.)

3) Before introducing nutrient into tank 500. i. Inspect discharge hoses ensuring no debris is preset.

ii. Take sample and test pH (needs to be between 5.5pH-6pH) iii. Using a 100 micron bag filter, place bag inside nutrient tote and pump approximately 10 gallons

through bag. This step is to have the ability to visually inspect the bag filter to determine if debris is present in the nutrient.

iv. If in a 10 gallon sample more than a cup of debris is collected reject the load. If less than a cup of debris is present proceed to step 4.

4) Unloading into tank 500. i. Driver will connect discharge line into inlet of dual 100 micron bag filter housing.

ii. Unload full tanker into tank 500.

• Records 1) Save all records from supplier and hauling company 2) Record all testing results.

cleanoutreceivingtank500.ThenewloadwasalsorejectedbyLehighbecauseitpresentedthesame

debrisandforeignmaterialsasthepreviousdelivery.FWScompletedthetankcleanoutonSeptember

19,

OnSeptember26,anotherloadofnutrientwasdeliveredtothesiteandwasrejectedbyLehighdueto

samereasonsofpresentingforeignmaterialsanddebris.

OnOctober3,anotherloadofnutrientwasdeliveredtothesite.Thematerialwasloadedtoasmall

containerforqualitycontrol.Therewasstillsomedebris,FWSfilteredoutthedebrisbeforeunloading

thenutrientinthetank.

Asagreed,FWShasestablishedthenecessaryqualitycontrolmeasurestoensurethatthetankertrucks

arecertifiedwashedandcleanbeforeloadingnutrient.Weapologizeforanyinconveniencethisissue

hascaused.
