    1 Introduction

    ThepurposeofthispaperistopresentacasestudyontheDanishprocessofrefarmingthe

    900MHzand1800MHzbandsfordocumentingandsharingexperienceonwhathas

    happenedinanactualrefarmingcase.

    Thispaperwillnotcontainanyassessmentsonwhethertheprocesscarriedoutorthe

    outcomeofitisoptimalorwhetherimprovementpotentialcanbeidentified.Furthermore,

    thispaperdoesnotintendtoanditdoesnotexpressanyviewsorpositionsoftheGSMA

    and/orthemobileindustry.

    Itseemsliketheinformationonanddocumentationofthedifferentstagesoftheprocess

    takingplacebetween2007and2010ispublishedbytheregulatorNITA.AndNITAdid

    makesummaryofmeetingsandtheinformationnotesusedinpreparingforthemeetings

    availableontheirwebsite.NITAhavealsopublishedtheconsultationdocumentsandtheconsultationresponses.FinallyNITApublisheditsfinaldecisionsonadjustingand

    amendingtheexistinglicensesandtofreeup2X5MHzof900MHzbandspectrumand

    2X10MHzof1800MHzbandspectrumforthepurposeofauctioningthebandwidthoffto

    newentrantsintothebands.ButsourcesarebasicallyavailableinDanishandunofficial

    translationstoEnglishdonotexist.Thereferencesincludedinfootnotesofthiscasestudy

    thereforerefertodocumentspublishedinDanishandwehavechosentoincludethemeven

    ifthesourceswillnotbeaccessibleifyoudonotreadDanish.Usingthecasestudyto

    understandtheDanish900MHzand1800MHzbandprocessdoesnotdependuponthe

    readerunderstandingDanish.

    ThecasestudyhasbeendevelopedbyKristinDueHaugeoftheGSMAandDanish

    operatorswhoareGSMAmembershavebeeninvolvedinreadingandcommentingonthe

    2 Executive summary

    NITAcarriedouttheDanish900MHzand1800MHzbandrefarminginthesameprocess

    andbyusingtheopenandtransparentapproachofpublicmeetings,publiclyavailable

    informationnotes,publicconsultationandmakingitsfinaldecisiondocumentspublic.

    Between2007and2010the900MHzand1800MHzbandrefarmingwasontheagendafor

    fourmeetingsinFrekvensforumandmeetingagendas,papersandsummarieswere

    publishedbyNITA.The2009consultationwereapublicconsultationanddocuments

    includingresponseswerepublishedbyNITA.NITApublisheditsfinaldecisionsby

    December2009.

    ThelegalframeworkstheNITAdecisionswerebaseduponwereDanishlawandEuropean

    Unionlaw(noreferencesweremadetoCEPTorITUbasedinstruments).Andtheanalysis

    ofeffectsonthecompetitivelevelplayingfieldofliftingtechnologyrestrictionswerethe

    centralbasisforNITAwhendecidingtoredistributeandreshufflebandwidthandmake

    roomfornewentryintobothbands.

    TheDanish900MHzand1800MHzbandrefarmingprocessconsistedofredistributionof

    spectrumtoaccommodatenewentrylicenseesinbothbands,reshufflingofexisting

    licenseesmeaningalloperatorshadtospectrallymovetheircurrentoperations,lifting

    technologyrestrictionsandadjustingtoamoretechnologyneutralapproachtolicense

    designandadjustingexpirydatesofexistinglicenses.

    Inthe

    900

    MHz

    band

    NITA

    basically

    made

    no

    changes

    to

    the

    total

    bandwidth

    of

    the

    operatorsTDCandTelenorwhileTeliasbandwidthwasreducedleavingthethreeexisting

    licenseeswith2X9MHzcontiguousbandwidth,2X9MHzcontiguousbandwidthand

    2X11.8MHzcontiguousbandwidthrespectively.Allexistinglicenseeswerespectrally

    moved.Existinglicenseswereexpiringin2011or2012priortotherefarmingdecisionbut

    NITAdidprolongandsynchronizethedurationsothatallexistinglicensesnowexpireby

    endof2019andNITAmadeitclearthatitwillbenorenewalsandonlynewawardswhen

    prolongedlicensesexpirebyend2019.NITAalsodecidedtoremoveexistingguardbands

    betweenlicensees(butnotguardbandsattheedgesofthe900MHzband)andendedup

    withfreeingup2X5MHzcontiguousbandwidthforanewlicensetobeauctionedoff.

    Inthe1800MHzbandNITAmadenochangetobandwidthofoperatorTelenorwhile

    operatorsTeliaandTDCsbandwidthwasreducedleavingthethreeexistinglicenseeswith

    2X19.4MHzcontiguousbandwidth,2X23.6MHzcontiguousbandwidthand2X21.8MHz

    contiguousbandwidthrespectively.Allexistinglicenseeswerespectrallymoved.Existing

    expirydatewasbasicallynotchanged;licenseswillexpirebyJune2017andNITAmadeit

    clearthatitwillbenorenewalsandonlynewawardswhenlicensesexpireby2017.NITA

    endedupwithfreeingup2X10MHzcontiguousbandwidthforanewlicensetobe

    auctionedoff.

    Existinglicenseesweregivenapproximatelyoneyeartocarryouttheirreplanningand

    accomplishingtheprocessofspectrallymovingtransmitters.TheGSMonlytechnology

    restrictionswereliftedandreplacedwithconditionsondeploymentofGSMand

    technologiesthancancoexistwithGSM,e.g.UMTS/HSPAandLTEcanbedeployed.NITA

    implementedrulesontimingoftheliftingofthetechnologyrestrictionsaimingatcreating

    competitiveplayinglevelfieldforalllicensees,existinglicenseesandthenewentry

    licenseesintothebands,regardingwhennewtechnologiescanbedeployed.

    refarmingchallengesbetweenthemandconsequentlytheyannouncedthatformalnoticesto

    thecompetitionauthoritiesonengagementinsuchdiscussionswerefiled.

    informedFrekvensforumthatithadbeendecidedthatthenew900and1800licenses

    shouldbeawardedbytwo(money)auctions,thatacapshouldbeimplementedsothat

    existinglicensees

    bands

    could

    not

    buy

    spectrum

    in

    the

    two

    auctions,thatnocoverageandrolloutobligationsshouldbeimplementedandthat

    kronerwhilereservationpriceforthe2X10MHz1800MHzbandlicensewastobesetat4

    Existing mobile market structure and competition aspects of distribution of 900

    MHz and 1800 MHz bands frequencies between operators

    BasedontheEuropeanUnionlaw,asamendedbytheamendmentoftheGSMDirective,

    thenewEuropeanUnionCommissionharmonisationinstrumentsonthe900MHzand1800

    MHzbandsandtherevisedsectorspecificEuropeanUnionDirectivesonelectronic

    communicationservicesincludingtheFrameworkDirectiveandtheAuthorisation

    Directive,NITAconcludedthatliberalisationofthe900MHzandthe1800MHzband

    shouldhappenandthatthemainresponsibilityoftheNITAinthisprocesswastoensure

    competitiveplayingfieldintherelevantmobilemarketswhentheuseofthebandswere

    liberalised.

    NITAdidputforwardthefollowingcriteriaforliberalisationofthe900MHzandthe1800

    MHzbandandfortheredistributionofspectrumbetweenmobileoperatorsinthosetwo

    bands:

    Liberalisationofthe900MHzandthe1800MHzbandswillhaveimpacton

    competitionintheDanishmobilemarketandNITAmustfindsolutionsfor

    redistributionofspectrumbetweenplayersusinganapproachwhichis

    proportional,nondiscriminatoryandobjective.

    NITAmustensurelicenseeswillhaverealisticchoicesofimplementingrelevant

    technologiessuchasGSM,UMTS/HSPAandLTEandatthesametimepromote

    efficientuseofthefrequencies.

    NITAmustensureexistingGSMoperationsmaycontinue(shouldexistinglicensees

    choosetocontinuetheirGSMoperations). NITAwereaimingatminimalreductionsofbandwidthforexistinglicenseesand

    NITAstatedthatensuringcontiguousbandwidthforalllicenseeswasconsidered

    essential.

    havingaccesstoany900MHzand1800MHzbandsspectrumNITAconcludedremoving

    GSMonlyrestrictionsfromthecurrent900MHzand1800MHzbandslicenseswouldbein

    breachoftheEuropeanUnionlawbasedobligationongovernment/regulatorsonpromotingcompetitionunless3andotherinterestedpartiesweregivenanopportunitytocompete

    forbeingassigned900MHzand1800MHzbandsspectrum.

    AsofOctober2009usagerightsforthe800MHzandthe2600MHzbandswerenot

    awardedinDenmark,thebandswouldbeawardedusingauctionswhereallexistingmobile

    operatorsandotherinterestedpartieswouldbeallowedtocompeteforusagerightsand

    LTEserviceswerenotprovidedinDenmark.ConsequentlyNITAconcludedassessingthe

    impactofthe900MHzbandorthe1800MHzbandsbeingsuitableforofferingLTEservices

    whenpreparing

    for

    liberalisation

    of

    the

    900

    MHz

    and

    1800

    MHz

    bands

    towards

    end

    of

    2009

    wasnotrelevantforthetimewhenthedecisionsonthe900MHzand1800MHzbands

    situationweremade.

    Coverage requirements and technology restrictions

    NITAputforwardaviewontheEuropeanUnionlawrequiringthemtoensurethatexisting

    GSMoperationsweregiventheopportunitytocontinue.

    Existing900MHzand1800MHzbandslicenseswereawardedusingpaymentinkindstyle

    auctions(beauty

    contests)

    and

    the

    bids

    on

    coverage

    and

    roll

    out

    were

    transformed

    into

    conditionsinthelicensesofwinningbiddersandNITAconcludedthisdidmeantheyhadto

    ensureexistingoperatorshadsufficientspectrumtocomplywiththeexistingcoverage

    obligations.

    NITAdidputforwardaproposalofreducingcoverageobligationsunderoneofTelias

    licensesbecausethebandwidthofthatlicensewereproposedtobesignificantlyreducedfor

    NITAtobeabletofreeupspectrumforanewfourthlicenseinthe900MHzband(proposed

    reductionofbandwidthforTeliainthe900bandwas2X3MHzaltogether).InadditionTelia

    hadtoacceptthat2X1MHzof900MHzbandspectrumwouldcontinuetobeusedby

    BanedanmarkforrailwayrelatedpurposesinageographicalareainandaroundtheDanish

    capitalCopenhagenuntilthislicensewillexpirebyend2012.Nootherreductionsof

    coveragerequirementsinthe900MHzbandwereproposedbyNITA.AndNITAaddedthat

    theirviewisthatcurrentcoveragerequirementsofthe900MHzbandlicenseswere

    extensive.Existingcoveragerequirementsincludebothpopulationcoverageandgeographic

    MHzbandlicensetherefarmingprocessbasicallyendedupwiththefourexistingmobile

    operatorsservingtheDanishmarkethaveaccesstoboth900MHzband,1800MHzband
