site has been checked by the S’Dman and reported that completion of construction work is under processed at site.
3. COMPLAINT
To consider a complaint received through PMDU No: PU 230519-2827221 submitted by
residents of the area of Lane No: 7 near Nullah Peshawar Road Rawalpindi requesting therein for closing of way /
place through construction of two pillars near pulley which was made for pedestrians at subject site. Whereas the
rickshaws / bikes are crossing the pulley which creates in an in-human living condition.
RECOMMENDATION OF THE BAZAR COMMITTEE:
Rejected. However Cantt Engineer be asked to suggest speed breaker at site.
4. FIXATION OF FEE IN RESPECT OF SWIMMING POOL ON PRIVATE LAND
To consider an application dated 22-07-2019 submitted by Malik Mansoor Afsar, Member Ward
No: 7 Cantt Board Rawalpindi mentioned therein for fixation of fee regarding approval of building plan of
Swimming Pool on Private Land.
RECOMMENDATION OF THE BAZAR COMMITTEE:
Building plan charges be recovered as per rates already fixed by the Board for commercial
purpose.

Item No: 6 DIGITAL SURVEY THROUGH SURVEY OF PAKISTAN.
To consider an amount of Rs.30 (M) regarding Digital Survey of RCB through
Survey of Pakistan.
All sites of Digital Survey of RCB through Survey of Pakistan is required.
However, RCB requested Assistant Director, Survey of Pakistan to prepare the cost and schedule
of survey vide RCB letter dated 15-01-2019. Accordingly the authorities of Survey of Pakistan
asked for certain information which was provided vide RCB letter dated 06-03-2019. Necessary
co-ordination has also been made through personal meetings with Survey of Pakistan by the
CEO RCB. Moreover, a team comprising 3 x RCB officials was deputed to visit Survey of
Pakistan on 18-07-2019. During discussion of the above said team with Survey of Pakistan
following points have been decided: -
(i) Complete survey will be carried out in Scale 1:1000.
(ii) FPS unit system be followed.
(iii) Complete detail i.e. all Property Nos. / trees / Sewerage lines / Water
supply lines / transmission lines / Boundary Pillars/ Roads, Streets etc
(iv) Expenditure of Rs.30 (M) approx.

To consider building plan of D Class Bus Stand on Plot bearing Khasra No: 541,
538, measuring 11150 Sft OR 40.95 Marlas situated at Mouza Siham IJP Road, Rawalpindi. The
technical staff of this office checked the building plan and observed certain observations which
was conveyed to the owner Mr. Amjad Khan for rectification but he failed and carrying out
unauthorized construction at subject site. Notices under Section 185/256 of the Cantonments Act,
1924 were issued accordingly but he failed to stop further construction work. However, he has
submitted willingness in-writing for regularization of unauthorized construction already carried
out by him at site on composition fee. The calculation of composition fee is as under: -

Class “C” Land bearing Survey No: 185/9 in lieu of an equal area measuring 238 Sft out of their
Plot No: D, comprising Survey No:185/8 Bank Road Rawalpindi.

Plot No: D, comprising Survey No: 185/8 measuring 145.5 Sq. yards Bank Road,
Rawalpindi is situated outside Bazar area under the management of MEO Rawalpindi and held
on lease in Sch: X (Modified) of the CLA Rules 1937 for commercial purpose in the names of
applicants.
The case was placed before the Board and the Board vide CBR under reference
resolved as under : -
“Considered. The Board discussed long standing issue in detail and resolved to
allow swap over subject to following conditions / options : -
(1) Lessee to be asked to make payment of premium on market rate for 238
Sft of “C” Land already encroached by him.
OR
(2) Instead of surrendering 238 Sft of leased land, he will surrender 514 Sft in
lieu of 176 Sft of encroached C-land and further used for internal parking.
Case to be submitted to the competent authority once written consent of
lessee is received.
The above said decision of Board was conveyed to the MEO Rwp accordingly
vide RCB letter dated 08-04-2016.
Now the applicants / lessees again submitted an application received through
MEO Rwp vide letter dated 04-04-2019 requesting therein for grant of NOC regarding allotment

To consider application dated 01-07-2019 submitted by Mr. Khalid Mehmood on
behalf of M/s. Shahi Beverages (PVT) LTD, Jhangi Syedan, Motorway Chowk, Peshawar Road
Rawalpindi Cantt. As per his application the factory remained closed since 2005 due to
cancellation of franchise license by the Coca Cola International and application to this effect was
furnished by the applicant to SDO WAPDA Islamabad and Dy. Commissioner IR, Regional Tax
Office Rawalpindi. After periodical meeting with the applicant of revenue staff of RCB, the
applicant agreed to pay the property tax upto 31-12-2005 which comes to Rs. Rs.1,11,01,491
out of which he deposited Rs.4 million on account of Property Tax, i.e Rs.2 million deposited on
30-6-2019 which a post dated cheque of Rs.2 million of 20-8-2019. However, the payment made
under protest in anticipation of the decision of court of law as the case is under litigation with
the CDA since long regarding limits. Moreover, the site has been checked by the SD ‘Man of
RCB and found that the property in question has been demolished and the facts also verified by
the Member of Remission Committee i.e Raja Jahandad. (picture endorsed).
It is further mentioned that the applicant requested for remission of property tax
amounting to Rs.2,56,76,106/-. for the period from 2005 to 2019 in support of electricity
disconnection and intimation letter from the Dy Commissioner IR Regional Tax Office
Rawalpindi submitted by the applicant along with application mentioned above. Pictures

Item No: 40 SHOP NO 26, BASEMENT MALL PLAZA, SADDAR, RAWALPINDI

To consider the case of Shop No 26, situated at Basement of Mall Plaza, Saddar,
Rawalpindi for correction of demand in the Demand & Collection Register and for execution of
tenancy agreement.
It is pointed out that the premium of the said shop was auctioned on 25.7.1987 to
one Col. A Khaliq. The tenancy rights of the said shop were lastly transferred to the applicant
vide C.B Office letter NO. R/Property/89/L/12 dated 21.11.1989.
Upon the written application of the lessee, the Board vide CBR No 22 Dated
3-8-2000 resolved to record the actual area of the shop and correct it in the office record and
assess the property on Per SFT basis wef 30.06.2000. Despite several written applications of the
lessee, the actual size of the shop was not recorded until 11/2/2014 when, the Survey Draft Man
of this office reported that the actual area of the said shop is 350 SFT instead of 480SFT. It is
pertinent to mention here that the outstanding amount as per D & C Register, based on old
measurements is 480 SFT, which, rent amounts to Rs. 11,12,790/- upto 30-06-2019. While, if
calculated on the basis of correct measurements (350 SFT) the outstanding amount comes out to
be Rs. 6,64,972/-. Due to this discrepancy and mismatch of rent of shop as per Demand &
Collection register and the one deposited by the lessee, the fresh tenancy agreement was never
executed since 23.8.1994.
Now, the applicant has again requested to correct the demand against his shop as
per CBR dated 3-8-2000 according to correct measurements of his shop, as well as allow him to
execute fresh tenancy agreement.

To considered that Shop No. 16 and Shop No. 38, Ground Floor Mall Plaza,
Saddar Rawalpindi Cantt have been reportedly merged and after 05-09-1994, no tenancy
agreement is on the file or executed between parties. Furthermore, Mr. Nazir Ahmed had already
died on 19-11-2013 and tenancy agreement was signed by the Board with him which is already
expired on 05-09-1995.

The occupation of these shops by the applicant is without lawful authority, hence,
request made by the legal heirs of Muhammad Nazir Ahmed cannot be acceded to therefore,
matter is placed before Board and being sitting occupant they may be offered to execute new
agreement on fresh terms and conditions, if they are not willing to execute the same on fresh
terms, possession of the shops be taken over immediately and thereafter these shops be put to
open public auction for fetching more revenue in the best interest of Cantonment Board
Rawalpindi as per legal opinion of CLA.

publicity through auction notice as appeared in Daily “Jang” , Daily “Jehan Pakistan” and

was unanimously agreed upon :- i. All Shop Facia Signs (size 20’X3’) will be exempted payment of Shop Board Charges (only for Saddar
Bazar area).
ii. One LCD / LED Screens installed inside the Shops at Bank Road will be exempted from the payment of
Shop Board Charges.
iii. 50% Glass Vinyl pasted inside the shops will be exempted as well (only for Saddar Bazar area).
iv. The Contractors shall not indulge themselves in the scuffles with the Shopkeepers rather they will issue
bills to the concerned shopkeepers only.
v. No subletting of the contract shall be made by the contractors. Only contractors are authorized to collect the
Shop Board Charges.
vi. In case of any dispute, the contractors shall bring the matter into the notice of the Grievance Committee for
further decision thereon.
vii. 2 X Representatives from the Trade Unions shall be included in the Grievance Committee.
viii. No rehri / hawker shall be allowed vending on the Bank / Kashmir / Adam Jee Road and all link streets /
roads.

Item No: 59 ISSUE OF RIGHTS OF VERANDAH ADJACENT TO SHOP NO. 17-A &
18-A KAMRAN MARKET KAHSMIR ROAD, SADDAR RAWALPINDI.
To considered that shops No. 16/A, 17/A & 18/A and cover of verandah
(non premium) at Kamran Market, Kashmir Road, Rawalpindi Cantt was transferred in the name
of Mr. Muhammad Jahangir S/o Ch. Muhammad Din vide letter No. R/Property/91/L/975 dated
24-10-1991.
In this regard, it is stated that earlier the permission for glazing the verandah in
front of above mentioned shops was granted to the then tenant (Muhammad Nawaz Khan) vide
letter No. R/shop/16,17,18/Kamran Market/L/3657 dated 08-08-1972 “subject to payment of
Rs. 60/- p.m on the condition that it will be removed on one week notice without
compensation” Later on, the grantee converted veranda into shops.
After the death of Mr. Muhammad Jahangir, the shop No. 16/A was transferred in
the name of Mr. Nabil Rafique Mir vide letter No.RCB/LRB/09/230 dated 20-9-2010 and shop
No. 18/A was also transferred in the name of Mr. Nadeem Rafique Mir vide letter No.
RCB/LRB/RS/shop 18/A CGM/5753 dated 13-6-2017.
When the shop No. 18 was transferred in the name of Mr.Nadeem Rafique Mir an
issue/dispute raised against the rights of verandah between Mr.Nadeem Rafque Mir and Mr.
Waqas S/o Muhammad Jahangir tenants of shop No. 18-A and 17-A respectively. It is added
that shop No. 16 still stand in the name of Muhammad Jahangir (deceased). The total area of
whole verandah is 648 Sft (approx) and monthly rent is Rs.21229/-
It is further reported that an amount of Rs.2,82,122/- is outstanding for the period
upto 30-6-2019 on account of rent against cover of verandah.
Since, both the tenants have claiming over rights of verandah, as such, the case
may please be placed before the Board.

Warden Post (1-B-II), opposite Police Station (Cantt) Saddar, contending that Civil Defence
Organization has always played vital role in public services and helping the needy people since
last many years, however, concerned staff of RCB has recently visited the said post and asked to
produce title documents, besides, informing that the said installation shall be demolished for
want of construction of shops overthere, whereupon, their staff visited the RCB Office in search
of title documents, which could not be availed therefom. It was merely revealed that GLR
Number of said Warden Post and other neighboring shops is 546.

Therefore, he has requested that the said Warden Post either be maintained OR
reconstructed in recognition of 50 years services although title documents are not available.
Besides, the said post be allotted to Civil Defence Warden Post accordingly.

The field staff of this office visited the subject site and reported that construction
of Masjid has already being completed up to 1st floor. However the above said building plan was
placed before the Board and the Board vide CBR No. 3(114) dated 29-04-2019 considered and
regretted as a Jamia Masjid already exists in front of this proposed Masjid.

Item No: 65 MISMEASURED / MISCALCULATED RENT - SHOP NO 26, BASEMENT
MALL PLAZA, SADDAR, RAWALPINDI CANTT
To consider the Application submitted by Mr. Irfan Saeed Mirza, lessee / tenant
of Shop No: 26 (Basement) Mall Plaza, Saddar, Rawalpindi requesting therein that the rent being
paid by him in respect of subject shop is not as per size of the said shop, which he realized on
taking over the possession of shop 30 yars back. He claimed that he has already tried a lot to get
the necessary rectifications in the record of RCB but the same could not be materialized as yet,
as such, necessary rectifications be made accordingly.
All the relevant documents are placed before.

Item No: 66 TENANCY OF SHOP NO. 33, GROUND FLOOR MALL PLAZA,
RAWALPINDI CANTT.
To consider the issue regarding tenancy of Shop No: 33 (GF) Mall Plaza, Saddar,
Rawalpindi Cantt. The subject shop was rented out to Mr. Amir Hussain on 12-05-2006 for a
period of three years through written agreement. The tenancy was extended till 30-06-2015. As
per condition No. iv of the agreement, the tenant was not allowed to sub-let the subject shop
without written sanction of the CEO and the tenant was bound to pay advanced rent for the
whole year in the month of June. Similarly in 3rd proviso of the agreement it is clear agreed by
the tenant that if any condition of agreement is breached the CEO shall be at liberty at any time
thereafter to seal and close the said premises and enter into possession thereof. Vide CBR No.39
dated 21-08-2015 the board approved the extension of tenancy till 30-06-2018 and the tenant was
asked to execute fresh rent agreement vide letter dated 28-10-2015 wherein it was clearly
mentioned that in case of non-compliance, the Board will be constrained to cancel / withdraw the
offer of sanction and possession of the shop would be taken over at his risk and costs. Instead of
signing of fresh agreement by the tenant till 10-07-2017 the Board received seven complaints
that thetenant has received huge amount from them and has sold out tenancy rights to them.
Whereupon, after service of four notices, the shop was sealed as per terms of the
agreement. Mr. Amir Hussain and one Mr. Junaidul Hassan filed Writ Petition No.1061/2015
before Honorable Lahore High Court, Rawalpindi Bench, Rawalpindi which was disposed of on
22-05-2019 by Honorable Lahore High Court, Rawalpindi Bench, Rawalpindi in the following
terms: -
“it is directed that the respondent shall immediately de-seal the premises in-
question. He shall afford an opportunity of hearing to the petitioners as per
mandate of Rule 9(iv) of the Pakistan Cantonment Servant Rules 1957 and
petitioners were directed to appear before CEO Rawalpindi on 27-05-2019
in his office who shall proceed accordingly.
In compliance to the High Court orders dated 22-05-2019, the shop in-question
was immediately de-sealed. Mr. Amir Hussain and Mr. Junaidul Hassan (petitioners of the Writ
petition) appeared on 27-05-2019. Theystated before CEO Rawalpindi that all complainants have
sworn affidavit in their favour and no dispute is left with them.
In order to redress this point, the CEO Rawalpindi opted to issue notices to all
complainants for verification of Affidavits.

Notices were again served to complainants as well as to petitioners,except Mr.
Faisal Safdar and Mr. Waqas Farid remaining persons appeared and got recorded statements,
they have no concern / claim and we opted to withdraw our applications filed against Mr. Amir
Hussain.
However, Mr. Faisal Safdar who is claimant of Rs.60 Lac towards Mr. Amir
Hussain and Mr. Waqas Farid raised claim of Rs. 48,00,000/- both of them have requested in
their statement that the said shop may not be transferred to any third person or Cantonment
Board should intervened for the return of their amount by auctioning the said shop.
Mr. Amir Hussain negated the stance taken by Mr. Faisal Safdar and Mr. Waqas
Farid. Mr. Junaidul Hassan (petitioner No.2) of the Writ Petition stated that his application for
transfer of shop is pending with Cantonment Board and he requested through his statement dated
24-07-2019 that if the shop is transferred to him on fresh terms and conditions he is ready to pay
monthly rent as mutually agreed, he is also ready to execute fresh Rent Agreement with new
terms and conditions.
As per Order dated 22-05-2019 passed by Honorable Lahore High Court,
Rawalpindi Bench, Rawalpindi in Writ Petition No.1061/2019 the CEO Rawalpindi has afforded
an opportunity not only to petitioners of the Writ Petition but to the complainants as well. All
parties were heard at length after through scrutiny of statements it has been decided that if
complainants have made some arrangement with Mr. Amir Hussain or with his relative privately
that has nothing to do with the affairs of Cantonment Board Rawalpindi as they are stranger to
the matter in issue and is not binding on the Cantonment Board Rawalpindi.
As far as pending application of by Mr. Junaidul Hassan for transfer of tenancy
right is concerned, the same is being decided as under: -
If the applicant Mr. Junaidul Hassan is willing to get tenancy rights on fresh terms and
conditions, he will have to pay monthly rent as per market rate, in case of non-acceptance /
unwillingness, the shop in-question be put to open public auction.
The matter is thus placed before the Board for consideration. All connected
papers are also put up.
Resolution: Considered and approved. If the applicant Mr. Junaidul Hassan is willing to get
tenancy rights on fresh terms and conditions, he will have to pay monthly rent as
per market rate, in case of non-acceptance / unwillingness, the shop in-question be

No.RCB/Advertisement/10, dated 05-07-2019 got published the “Notice” for auction of
Collection Rights of Motorcycle Parking Fee at Singapur Plaza, Saddar Rawalpindi Cantt for the
year 2019-2020 i.e 01-08-2019 to 30-06-2020 @ Rs. 10/- per hour.
The Auction Notice was published in the Daily “Jang” Daily “Dawn”
Rawalpindi on 09th July 2019. Accordingly, the Auction was held on 26th July 2019 in the
Board Room of RCB office. In this response, 09 No.s of Persons were participate in auction
proceeding and offer their bids. Out of which, following 02 bidders were somehow on the higher

Item No: 70 EXECUTION OF AGREEMENT WITH PUNJAB FOOD AUTHORITY
ON ANALOGY OF CDA / DC OFFICE, ISLAMABAD.
To consider the execution of contract with the Punjab Food Authority on the
analogy of CDA / DC Office Islamabad, so as to enabling the RCB staff to maintain hygiene at
eatable selling enterprises within the Cantonment area in collaboration with the staff of Punjab Food
Authority.
It is apprised that the measures presently adopted by the Food Branch staff to control
the adulterated food selling are not sufficient as compared with the standardized setups.
Moreover, the expertise / instruments used by the Punjab Food Authority are of high-class / more
efficient to tackle the situations properly while making raids.
Most often, it has also been observed that Punjab Food Authority staff has also faced
resistance while operational duties on the mere plea from the public that they can not take action
within the Cantonment area. So, after approval of subject proposal, this claim shall be devalued
automatically.
In this connection, it is also proposed that a vehicle with RCB logo shall be designed /
labeled for use by the Food Branch staff for fild duty. Besides, the said staff be administered by this
Office, however, technical support shall be provided by the Punjab Food Authority.

Resolution: Considered. The Board after detailed discussion approved the above proposal
subject to completion of all codal formalities.

To consider hiring of vehicles / machinery for disposal of animal excreta, offals
waste / rubbish through Heavy Machinery / Vehicles (for 08 days w.e.f. 09-08-2019 to
16-08-2019) on the eve of Eid-ul-Azha to ensure cleanliness.
Consequently, quotations were called vide publicity through PPRA / News Paper

Item No: 72 PURCHASE OF BIOMETRIC MACHINE.
To consider the purchase of Biometric Machine to rationalize the attendance
mechanism of RCB employees.
The above-said purchase involves an amount of Rs. 36,000/-, however, 17% whereof
shall be paid to M/S Ufone on account of Federal Excise Duty, which comes to Rs. 5,950/-, hence
total expenditure becomes Rs. 41,950/-.
