(iii) Buyback rates of used lamps :

Buy back arrangement is also added i.e. old Mercury containing lamps i.e. florescent tube lights, compact florescent lamps, mercury vapour lamps and sodium vapour lamps shall have to be purchased by the supplier from the purchaser so that safe disposal / recycling of these lamps may be ensured at supplier’s level. The indenting officer may sell the used lamps, to those supplier with whom the work order for same items/ items of similar nature is placed, @ Rs. one per used lamp. 1- SCOPE OF WORK

2- WARRANTY

The items on the rate contract shall be warranted for a specified period, as mentioned above, from the date of receipt by the client against unsatisfactory performance and/or breakdown due to defective design, workmanship of material. The equipments or components, or any part thereof, so found defective during warrantee period shall be forthwith repaired or replaced free of cost, to the satisfaction of the client: The supplier shall ensure to provide the following minimum services to the client/ consignee during the warranty period:

(i) Supplier will appoint authorized dealers preferably at district level or open repair centers and their names shall be communicated to the Indenting/consignee Department within one month time from the date of issue of purchase order. Supplier shall also communicate name of these dealers/ centers to HAREDA.

(ii) If the order is of more than 50 nos (quantity of the single item), then supplier

shall maintain 2% of the order quantities as buffer stock with the indenting department/ office till the warrantee period so that replacement of defective pieces can be attended immediately.

(iii) In case a supplier is not maintaining buffer stock as mentioned under para (ii)

then he is bound to repair/ replace the defective pieces within 24 hours of the receipt of complaints failing which penalty will be charged from him @ of Rs 5/- per day till the period it has been repaired/replaced. This penalty amount shall be deducted from the payment due to the supplier or the consignee shall claim the same from the supplier. The claim so received to the supplier, has to be settled within 15 days. If supplier fails to refund the claim amount, this amount shall be deducted from his performance security deposited with HAREDA.

(iv) The indenting department/ officer / consignee shall maintain separate

complaint register for this purpose and while forwarding the complaint to the supplier, complaint serial number, work order no. , date & qty of the material, date of receipt of material, date of receipt of complaint, nature of defect, reason for defect, date of forwarding the complaint etc. should clearly be mentioned in the letter. Complaint, if any, should preferably be forwarded to the supplier through e-mail.

(v) Supplier shall repair/ replace the defective material at his own expenses to the

satisfaction of the client/ consignee in the store, specified in work order, of the client / consignee during the warranty period.

3- PERFORMANCE SECURITY

(i) M/s Asian Electronics Ltd., New Delhi, Halonix Ltd, Gautambudh Nagar, M/s Surya Roshni

ltd., N. Delhi and M/s HPL Electric & Power Ltd., Sonepat shall furnish the Performance Security of Rs. 25.00 Lacs, in the shape of Bank Guarantee / DD in favour of Director, HAREDA valid for six years within 30 days from the date of issue of the rate contract for the due performance of the contract. M/s Insta Power Ltd. New Delhi shall furnish the Performance Security of Rs. 6.00 Lacs, in the shape of Bank Guarantee / DD in favour of Director, HAREDA valid for six years within 30 days from the date of issue of the rate contract for the due performance of the contract. The EMD of Rs. 2.00 Lacs submitted by M/s Joonix Energy, Faridabad, M/s Servotech Power System, New Delhi & M/s Lord Krishna Electronic Industries, Delhi shall be treated as Performance Security. The suppliers who wish to adjust their EMD in the Performance Security may request for same and deposit the amount over & above Rs. 2.00 lacs for their remaining Performance Security. Those suppliers who have deposited EMD in the shape of DD & wish to replace the Performance Security in bank guarantee may do so.

(ii) If the supplier fails to furnish the required Performance Security then the EMD furnished will be forfeited and the rate contract issued in favour of the supplier (s) may be cancelled and matter shall be forwarded to the industries department and the supplies and disposal department, Haryana for appropriate action.

(iii) The validity of the bank guarantee may be extended by the firm to cover the total period or the firm shall be required to submit the fresh bank guarantee of requisite amount. The performance security deposit shall be refunded/ returned after expiry of 30 days from the actual date of completion of CMC on satisfactory performance report / NOC from the user.

4- PAYMENT TERMS

Subject to any deduction which client may be authorized to make under this contract, the contractor shall be entitled to payment as follows:

(i) 95% payment, to be released by the purchaser, on receipt of duly inspected store. (ii) Balance 5% within one month on satisfactory performance of the supplied goods.

5- TIME SCHEDULE, PENALTY/LIQUIDATED DAMAGES

The items, for which purchase order is placed, are to be supplied within one month’s time from the date of issue of purchase order, if purchase value is up to Rs.5.00 lakhs and if the value is above Rs.5.00 lakhs then the material should have to supply within two months time from the date of issue of purchase order.

The time for and date of delivery or dispatch stipulated in the supply order shall be deemed to be the essence of the contract, and should the contractor fail to deliver or dispatch any consignment within the period prescribed for such delivery or dispatch stipulated in the supply order, the delayed consignment will be subject to 2% penalty per consignment per month recoverable on the value of the stores supplied. In case of non-payment of the contractor, recovery will be made from his bills or amount of Earnest money or security deposited with Director, HAREDA, provide also that: (a) No recovery of penalty will be made if the Director, HAREDA accepts the delayed supplies by

extending the delivery period on receipt of such a request from the supplier by recording in writing that the exceptional circumstances were beyond the control of the supplier and there was no loss to the Government.

(b) On the failure of the suppliers to make supply & installation within the extended period or

otherwise and the receipt of such information in the office of the Director, HAREDA, risk purchase at the cost of the supplier will be made by the Director, HAREDA within 2 months of the expiry of stipulated delivery period by inviting short terms quotations from the Registered and other known suppliers. The difference of excess cost thus, incurred will be recovered from the supplier from his pending bills, earnest money or security whichever is available. This procedure will be adopted after serving a registered notice to the supplier to supply stores within 15 days.

(ii) The Contractor shall not

(a) assign or sublet the contract without written approval of the officer sanctioning the

contract. (b) disclose details of the conditions governing this contract to unauthorized persons

(Indenting against this contract is permissible only for the bonafide use of Governments departments and quasi public and not for private parties or for the private use of the Government officers).

(iii) In the event of the contractor failing duly and properly to fulfill or committing breach of any

of the terms and conditions of the contract or repeatedly supplying goods liable to rejection hereunder or failing, declining, neglecting/ or delaying to comply with any demand or requisition or otherwise not executing the same in accordance with the terms of this contract, or if the contractor or his agents or servants being guilty of fraud in respect of the contract or any other contract entered into by the contractor or any of his partners or representatives thereof with Government directing, giving, promising or offering any bribes, gratuity, gift, loan, perquisite, reward or advantage pecuniary or otherwise to any person in the employment of Government in any way relating to such officers or person of persons, office or employment or if the contractor or any of his partners become insolvent or apply for relief as insolvent debtor or commence any insolvency proceedings or make any composition with his/ their creditors or attempts to do so then without prejudice to Government rights and remedies otherwise, HAREDA/ Government shall be entitled to terminate this contract forthwith and to blacklist the contractor and purchase or procure or arrange from Government’s stocks or otherwise at the contractor’s risk and at the absolute discretion of the Director, HAREDA as regards the manner, place or time of such purchases, such supplies as have not been supplied or have been rejected under this agreement or are required subsequently by Government thereunder and in cases where issues in replacement are made from Government’s stocks or supplies, the cost of value of stocks or supplies together with all incidental charges or expenses, shall be recoverable from the contractor on demand and the contractor shall not be entitled to benefit from any profit which may accrue to Government.

6- INSPECTION OF MATERIAL

The material will be dispatched by the supplier after inspection by the Director, HAREDA or his/her representative and the representative of indenting department. The committee may carry out the

inspection of the material before dispatch at the premises of the supplier for their satisfaction about the quality of the material. The sample of the material may also sent to the approved laboratory at the cost of supplier for any kind of specific test if required by the indenting Department / HAREDA. Supplier shall submit the schedule with date, time & venue of the inspection to the Director, HAREDA and the Indenting Department in written for the inspection of the material. Director, HAREDA or his /her representative or indenting department is authorized to get the material tested from the approved laboratory at the supplier cost for any kind of specific test if required. In case the material offered for inspection fails to meet the specifications stipulated in NIT /Order /Contract and the samples are rejected by the Inspecting Committee, the Indenting Department will have the right to levy a penalty at 0.1% of the order value. In case the material offered for inspection fails during the 2

nd inspection also, the Indenting Department will have the right to

increase the penalty to 0.25% of the order value. In case, the material offered fails during the 3rd

and final inspection also, the firm will be liable for penal action including forfeiture of EMD, risk purchase, debarring/blacklisting in future, and no further opportunity for inspection will be provided to the supplier firm. The firm will emboss or engrave the words ‘PROMOTED BY HAREDA’’ on the body of the Fitting/ Fixture so as to minimize any possible malpractices.

7- OTHER TERMS AND CONDITIONS (i) The approved rates include F.O.R. anywhere in the State inclusive of all taxes, octroi,

VAT etc. (ii) Material shall be strictly as per DNIT specifications/applicable latest BIS/ International

Standards. (iii) The supplier shall laminate the logo of HAREDA inside or outside the body of the

lamp/fixture. (iv) The make and serial number of lamp/ fixture must be recorded by the manufacturer in a

permanent manner on the body of the lamp/ fixture along with the serial number and year of manufacture of that item. This will enable verification with sale/ supply records.

(v) The manufacturer should issue excise gate pass for the products sold so that sale of product can be independently verified.

(vi) Any left out specification(s) (if any) shall be as per the applicable IS/ International Standard.

(vii) All disputes relating to this work shall be subject to the jurisdiction of Chandigarh and Director, HAREDA shall be the sole arbitrator.

(viii) Indenting Departments / Organizations / Officers shall forward a copy of the work order(s) placed by them with the supplier to the Director, HAREDA. Subsequently, indenting department/ officer shall also forward copy of the material receipt & complaint (if any) to the Director, HAREDA.

(ix) Procurement under the rate contract shall be governed by the policy decision/ guidelines on procurement of stores issued by Department of Industries & Commerce, haryana vide GO No. 2/2/2010-4 I BII dated 28 May 2010. These guidelines are available on the State Govt. website i.e. www.haryana.gov.in

(x) The supplier shall be bound to furnish the information on the purchase order received, detail of supply made and pending orders etc against the rate contract on monthly basis to the Director HAREDA by 7

th of the consecutive month in the following format :

(i) Care shall be taken in the design of outdoor lighting that there is no water stagnation anywhere. The entire housing of outdoor systems except High Pressure Sodium Vapor (HPSV) & Metal Halide, must be dust and water proof having IP 65 protection as per IEC 60529. The High Pressure Sodium Vapor (HPSV) & Metal Halide housing must confirm to IP66 protection.

(ii) The supplied equipments/ items should confirm to the latest applicable BIS/ International

Energy Efficient Florescent Tube light fitting with suitable T5 Lamps (indoor applications) (i) Energy Efficient Tube Light Fittings (item No. 5): Energy Efficient Fluorescent Tube light (EEFTL) fitting, shall be complete with electronic ballast and lamp holders duly wired, ready to use, suitable for specified nos. of T-5 Energy Efficient Tubular Fluorescent Lamps of pre-heated cathode type to be operated on 230V,50 Hz single phase AC supply. The fitting shall conform to IS: 10322 (Pt.1 & Pt.2)/1982(Reaffirmed 2005), IS: 10322 (Pt.3& Pt.4)/1984(Reaffirmed 2005) and IS: 10322 (Part 5 Section1)/1985 (Reaffirmed 2005). The electronic ballasts shall conform to the specifications included in para (iii) below. The fitting shall be made of plastic extruded housing with inbuilt electronic control gear with decorative end caps. The reflecting surface shall be in white colour. The wiring shall be of Class I and Enclosure IP-20. The lamp holders shall conform to IS: 3323/1980 with amdt No.1 (Reaffirmed 2002). (ii) Energy Efficient Decorative mirror optics Type Fittings (item no. 6 &7): Energy Efficient Fluorescent Tube light (EEFTL) Fitting decorative with mirror optics type , shall be complete with electronic ballast ( separate ballasts for each lamp to be used ) and lamp holders duly wired, ready to use, suitable for specified nos. of T-5 Energy Efficient Tubular Fluorescent lamps of pre-heated cathode type to be operated on 230V, 50Hz,single phase AC supply. The fitting shall conform to IS: 10322 (Pt.1 & Pt.2):1982(Reaffirmed 2005), IS: 10322(Pt.3 & Pt.4):1984(Reaffirmed 2005) and IS: 10322 (Pt.5 Section 1 & 2)/ 1985(Reaffirmed 2005).The electronic ballasts shall conform to the specifications as per para(iii) below. The fitting shall be made from 0.50 mm thick cold rolled close annealed (CRCA) Steel sheet duly powder coated. The fitting shall be painted in white colour both on exterior as well as on lamp compartment. The mirror system shall be made from pre-anodized aluminium sheet of 0.3mm MIN. nominal thickness. The cross louvers shall however be anodized in mat finish. The wiring shall be of Class I and enclosure IP-20. The lamp holders shall conform to IS: 3323 /1980 with amdt No.1 (Reaffirmed 2002) and the photometric efficiency of the fitting shall be not less than 75% as per IS: 13383: Pt.1:1992(Reaffirmed 2005). (iii) Electronic Ballast for Energy Efficient fitting suitable for T5 Lamp Energy Efficient Electronic Ballasts shall be suitable for Energy Efficient Tubular Fluorescent Lamp of pre-heated cathode type for use on 230V, 50 Hz, single phase AC supply and shall conform to IS: 13021(Part-

1 & Part-2)/1991(Reaffirmed in 2000) with power consumption as stated and current consumption as declared by the manufacturer. The Ballast shall satisfy all requirements at rated Voltage. T5 lamps for which ballasts are to be used will conform to data sheet no. 60081-IEC-6520-4 for 14-watt lamp & data sheet no.60081-IEC-6640-4 for 28-watt lamp respectively in IEC no. 60081/2005. The Ballasts when used along with the lamp shall satisfy the requirements of type tests. A circuit diagram, components list, shall accompany the TTC and a coloured photograph of the ballast including PCB clearly showing all the components, duly authenticated by the laboratory. (iv) Tubular Florescent, Double Capped (T-5) Lamps for General Lighting services Tubular Fluorescent, double capped, (T-5) lamp with G-5 caps with pre-heating cathode current for general lighting services to be used with HF starter less electronic ballast for 230 V, 50Hz single phase AC supply conforming to IEC 60081/2005. 1. The lamps shall be as per data sheet no.60081-IEC-6520-4 for 14-watt and data sheet no.60081-IEC-6640-4 for 28-watt lamps respectively. 2. Rated life of the lamps shall be 15000 Hrs. 3. The initial lumen reading shall be checked after 100Hrs ageing after 5 Minutes thermal stabilization at 35 degree Centigrade. 4. The method of test and sampling criteria shall be as per IS: 2418 (Part- I)/1977(Reaffirmed 2005). The dimension, reference ballast particulars, electrical characteristics shall however comply with IEC 60081/2005. The initial lumens shall be measured after 5 minutes thermal stabilization at 35 +/- 1 deg. C after 100 Hrs ageing.
