Black State Legislators, which has called on Lee to stop the state’s release of the in-formation to police agencies.

Democratic state Rep. G.A. Hardaway, the chairman of the caucus, says the group fears police will use the information for other purposes and that it might cause people to hesitate to get tested for the vi-rus.Local health officials have acknowl-edged that the effort to broaden testing has been challenged by those who refuse to be tested because of conspiracy theo-ries on social media as well as concerns the health department’s information could be used to target immigrants for federal prosecution.Hardaway said Lee has pledged to work with the caucus to find other solutions to the dilemma.

“Let me just make it clear. We have to protect our first responders,” Rallings said.

“When you think about it, at the peak we had 31 police employees who tested positive and 269 have returned from be-ing on quarantine. The one question I have for our listeners in the media is who responds to 911 calls when we run out of first responders?”

Hedy Weinberg, the executive director of the Tennessee chapter of the Ameri-can Civil Liberties Union, disputed that the information is for the safety of first

responders. “First responders should always be

taking precautions when entering any home and the state should ensure that they have the necessary protective gear to do so,” Weinberg said in an email state-ment. “Disclosing the personal informa-tion of individuals who will never have contact with law enforcement raises fun-damental concerns about privacy with-out yielding a significant public health benefit.”

Shelby County Mayor Lee Harris said he sees problems with the disclosures to police and that county government is not participating in an agreement with the state for the information.

Memphis Fire Director Gina Sweat says her department, which includes emergency medical services responders, also uses the information and likened it to information dispatchers send fire and ambulance units about buildings or properties where hazardous substances are stored.“

This is not unusual,” Sweat said at the Monday briefing.

Police dispatchers routinely have in-formation about addresses at or near loca-tions where police have had problems in past calls, including citizens with mental issues. But those locations are marked based on past police calls and not health or medical records.

Lululemon Athletica w il l open a store in a 111-year-old Midtown building, the athletic apparel company’s second loca-tion in the Memphis area and first inside the Interstate 240 loop.The Vancouver-based chain of about 500, company-operated stores worldwide will operate at 2129 Central, at Cooper, said Jon-athan Aur of Boyle Investment Co. He represented building owner Charlie Ryan in brokering an initial, short-term lease.

Lululemon will take posses-sion of the building on Friday, May 15, with plans to open in six to eight weeks, Aur said.The Andrews Building in the Cooper-Young district last housed Toad

Hall Antiques.Lululemon’s his-tory in the Memphis area has been to locate in commercial dis-tricts with some of Shelby Coun-ty’s highest incomes.Lululemon now has a store in Germantown’s Shops of Saddle Creek, 2031 West. It had moved there from the Re-galia shopping center at Poplar and Ridgeway in East Memphis. Founded in Vancouver in 1998, Lululemon initially specialized in yoga-inspired clothing but has expanded its line of apparel to running, cycling, general train-ing and other “sweaty pursuits,” its website states. The store will occupy both floors of the historic Cooper-Young building, totaling 5,500 square feet, Aur said.

Lululemon signed a one-year lease, which is typical for the way

the retailer enters new areas, he indicated.

Asked what drew Lulule-mon to the site, Aur responded, “The visibility” as well as the other businesses along Cooper and Central. “The strong demo-graphics with the neighborhood and surrounding neighborhoods,

the access to obviously all parts of Midtown and Downtown, the west portion of East Memphis, really all of East Memphis,” Aur said. In its March 26 financial report summarizing its 2019 fis-cal year, Lululemon reported net revenues of $1.4 billion for the year. The company opened 51

new stores during the year.Company-operated stores ac-

counted for 59.5% of Lululemon’s revenue, and commerce generat-ed 33.2%, the report states.

By the end of fiscal 2019, Lu-lulemon had 491 company-oper-ated stores compared to 440 at the end of fiscal 2018.

relief, or a textured look.The other two walls are formed

from wood reused from the plant’s wood molds.

The massive bar in the middle of the room measures 25 feet long by four feet deep.

The taproom offers two views.Guests can look to the north

through the wall’s large windows to see beer being made.

Or they can look to the south – through the three glass, roll-top doors and two glass shopfront windows – to see a vast Bermuda and fescue lawn and Downtown skyline beyond.

But the taproom won’t open until sometime this summer be-cause of a power pole.

Memphis Light Gas and Water Division must move a pole that stands in the middle of the future entrance along Waterworks from North Second. Seely had hoped the pole would be moved six months ago, but he didn’t complain.

“When you go through con-struction you get used to the speed bumps,” he said.

Once the pole is moved, the city will complete the extension of Waterworks across a new cul-vert bridge and to the brewery’s parking lot.

The brewery’s original date for a hearing to get its wholesale beer

license was delayed because of the pandemic. The virus contagion was in full force by the time Grind City got its license.

COVID-19 also has limited the initial distribution of Grind City kegs to area bars that remain closed because of the contagious

virus, the 24-year-old Seely said.“COVID-19 has caused some

delays,” he said in a matter of fact way.

“We’ve had some issues just like everybody else.”The pandem-ic also caused Grind City Brew-ing to cancel its “grind opening”

celebration.The brewery eventually will

host one, but is using the budget allocated for the original celebra-tion to start a relief fund through the Community Foundation of Greater Memphis.

The fund will “help support

local restaurants and bars that have been impacted by COV-ID-19,” said Bill Seely, Hopper’s father and Grind City’s chairman and developer. “We’re giving back to the community to help get the eco-system back.”“And for every keg sold we will donate $5 to that fund as well,” he said.

Grind City Brewing has an El-vis-inspired motto: “Taking care of beerness.”Ask Hopper Seely what the beer will be like, and he responds the brew will have “drinkability.”“It’s lower in alcohol for the most part,” he said. “You can drink a few and you can still function.”

Trained at England’s Brewlab, Seely said the beer also is easy on the stomach. It is not too filling, he said, adding, “so you can have a nice meal and can have more than one.”“But the most important part of ‘drinkability’ is making sure the beer is delicious,” he said.

The qualities that thread through all the beers Grind City makes is a smoothness and light-ness, he said.

“We want it to be approach-able to people,” said Tyler Nel-son, Grind City Brewing’s general manager.

“Our focus in creating these is to make them delicious, first, and also appeal to people of every dif-ferent level” when it comes to their knowledge of beer.

A group of Memphis voters and a voter advocacy organization are suing the state, seeking a court order allowing any voter worried about the COVID-19 pandemic to vote absentee.

The complaint was filed May 8 in Da-vidson County Chancery Court against Gov. Bil l Lee, Secretary of State Tre Hargett, State Coordinator of Elections Mark Goins and Attorney General Herbert Slatery. It calls for absentee ballots for all voters, regardless of whether they have an excuse set out by state law.

The challenge claims that, as ap-plied to the unique circumstances of the coronavirus pandemic, Tennessee’s strict absentee ballot requirements vio-late the right to vote under Tennessee’s Constitution.

The lawsuit seeks a declaration that an existing exception allowing absentee

voting with a doctor’s note should be inter-preted broadly to allow a doctor to certify that all voters in a county are “medically unable” to vote in person in 2020 due to pandemic-related health risks.

State law allows absentee voting for those over 60, people who are out of town and those who are physically unable to go to polls for medical or other reasons during early voting and on Election Day.

“People shouldn’t have to choose be-tween their health and the health of their loved ones and their fundamental right to vote,” the Rev. Earle Fisher, one of the plaintiffs, said in a statement.

“Voters should be able to choose to send their ballot by mail, or drop it off at secure, safe locations, as is done in other states,” added Fisher, pastor at Abyssin-ian Baptist Church and founder of Up-TheVote901, which advocates for voter rights and turnout in “marginalized” communities.

Joining UpTheVote901 as plaintiffs are a mix of Republican and Democrat Mem-phis voters, Hunter Demster, Julia Hilton-smith, Jeff and Ginger Bullard and Allison Donald, according to attorney Jake Brown, with the Apperson Crump law firm.

None of the plaintiffs are eligible now to vote absentee ballots, though some have health problems making them vulnerable to COVID-19 or live with people who have underlying health problems, according to a release. They’re worried going to the polls could force them to come into con-tact with someone carrying the virus, causing them to pass it to others.

“The state should be making it as safe and convenient as possible to vote during this global pandemic health crisis,” Dem-ster said. “This year, that means allowing mail ballots. Anything less will suppress voter turnout.”

Most states allow absentee voting without an excuse and voters can obtain a mail ballot by request or what is called pure “vote by mail,” where voters auto-matically receive a ballot, according to the release.

The group contends Tennessee is one of only six states still requiring people to vote in person during the COVID-19 pan-demic. Ten of the 17 states where voters must have an excuse to vote absentee have suspended those rules for the remainder of the emergency, and a state court ordered Texas to suspend its absentee voter ex-cuses, according to its release.

the COVID crisis,” Brown said.If the state’s situation with COVID

cases is vastly improved by August and November election dates,

“I don’t think anybody’s lost anything,” Brown said. But if the virus continues to spread or surges, the state needs to have widespread absentee voting in place or voter turnout could be depressed, he said_

“This is not in any way a partisan issue. Tennesseans have an express personal right to vote, whether for Joseph Biden, Donald Trump or the Peabody ducks,” Brown said.

This lawsuit is the second filed in the span of a week challenging Tennessee’s absentee voting law.

The A. Phillip Randolph Institute of Memphis, The Equity Alliance, Free Hearts, Memphis and West Tennessee AFL-CIO, the Tennessee State Conference of the NAACP, Sekou Franklin of Davidson County and Kendra Lee of Shelby County filed a complaint May 1 against Tennessee claiming the state’s absentee ballot rules don’t take into account the COVID-19 cri-sis and potential penalties against organi-zations that try to improve ballot access.

Secretary of State Hargett’s office did not respond immediately to a request for comment Monday.

Goins said previously the office is working on a plan for elections dealing with the COVID pandemic but has not provided information. He has not com-mented on requests by lawmakers for universal absentee ballot voting or the initial lawsuit

IMPORTANT PUBLIC NOTICE The United States District Court for the Western District of Tennessee has implemented the following measures in response to the COVID-19 Pandemic: 1- All in-person civil judicial proceedings currently scheduled are CONTINUED until after May 30, 2020. Counsel and/or litigants will be notified of new settings and rescheduled dates.

2- All currently scheduled in-person criminal judicial proceedings other than the initial appearances, arraignments, bond and detention hearings and other in-person proceedings presided over by Magistrate Judges are CONTINUED until after May 30, 2020. Initial appearances, arraignments, bond and detention hearings will continue on a schedule determined by the Magistrate Judge assigned to criminal duty and will be handled by videoconferencing or as otherwise directed by the presiding judge. Counsel and/or litigants will be notified of new settings and rescheduled dates.

3- All jury selections and trials scheduled to commence now or through May 30, 2020 are CONTINUED until further notice, and all grand juries already selected will not meet until after May 30, 2020, unless an emergency proceeding is deemed necessary prior to May 30, 2020. 4- Prior to May 30, 2020, the Court will reevaluate then existing circumstances and updated guidance from reliable medical sources to determine whether to extend the May 30, 2020 date or whether judicial proceedings can resume.

5- The Clerk of Court’s offices in Memphis and Jackson are closed to the public. Staff will be available by telephone, mail will be received, but no counter operations will remain open. Attorneys and parties with access to CM/ECF are encouraged to use it for the submission of all filings. Any unrepresented litigants with access to email are encouraged to submit their filings at this email address: [email protected]. Any unrepresented litigants who do not have access to email are advised to submit their filings via U.S. Mail to one of the divisional offices:

Coverage Area – Public Records Real Estate TransactionsWarranty Deeds, Trust Deeds, and other special deeds are compiled daily from the records of the Shelby County Register’s office.Warranty Deeds usually convey title to real estate from the seller to the buyer.Trust Deeds, in effect, convey a lien on the real estate from a borrower, guarantor, person or firm putting up the real estate as collateral or security for some purpose, to a lender, person or firm receiving collateral or security for some purpose. A lender is usually designated by its trustee. In many instances, the borrower is at the same time a buyer of the real estate, and is executing a purchase money mortgage. When that occurs, the Warranty Deed and Trust Deed will usually have consecutive, or nearly consecutive, instrument numbers.Other special deeds also transfer an interest in the real estate from the grantor to the grantee.
