    NOTICE INVITING TENDER

    1. Sealed tenders are invited from firms or organizations having experienceof providing sanitation services in hospitals or organizations for morethan three consecutive years and having yearly turnover at least of Rs.40 lacs for last two years. The tenderer must have the experience ofrunning the sanitation services engaging more than 60 workers in oneorganization. He should also submit the certificate of satisfactory workperformed duly issued by Head of organization under whom serviceswere rendered.

    2. Tender schedule will be as under:-

    TERMS AND CONDITIONS OF THE TENDER

    The following terms and conditions should be complied with whilesubmitting tender:-

    1. GENERAL

    1.1 Tender document must be sealed in two separate envelope A

    (technical bid) and B (Price Bid). Put both A and B envelopetogether in big envelope C and sealed this envelope also.Write TENDER FOR HOSPITAL SANITATION SERVICES on top ofenvelop C and addressed to Director, RIMS&R, Saifai, Etawah-206130, and deposit it on or before the last date of deposit ofthe tender.

    1.2 All the tender documents and supporting documents must be fixedfirmly and secured properly in sealed envelope, using sealingwax only.

    1.3 Tender should be submitted in the prescribed forms only and noalteration in the format is permitted. Figures and words shouldbe typed only.

    1.4 Only proprietor will sign the tender document in case of aProprietary Firm. In case of a Partnership firm authorizedpartner of the firm shall sign the tender documents and attestedcopy of authorization of such partner shall be enclosed withtender. In case of a Company the tender documents shall beaffixed with the seal of the company and signed by such person /persons as may be authorized by the articles of associations of

    the company and/ or a resolution of the board of directorsthereof to sign for and on behalf of the company and dulyattested copy of the resolution shall be enclosed with tender.The cancellation of any document such as power of attorney,partnership deed, etc. shall immediately be communicated by theTenderer(s) to the Institute in writing, failing which theInstitute shall have no responsibility or liability of anyaction, taken on the strength of the said documents.

    1.5 All the pages of the tender documents and supporting documentsshould be serially numbered, stamped and signed by the tenderer.

    1.6 Tenderer must ensure that the serial numbers of all thedocuments including tender documents must be mentioned in thetender at proper place.

    1.7 Subletting of contract is strictly prohibited. All documents ofthe tender must be signed by the proprietor of the proprietaryconcern/partners of the firm/Director of the company, and nopower of Attorney will be allowed.

    1.8 That the institute shall make calculations of reasonable ratesat its sole discretion and on the basis of the same the award ofthe contract shall take place. Mere quoting lowest rates shallnot make the firms entitled to get the contract.

    1.9 Right to accept any Bid and to reject any or all Bids:-TheUPRIMS&R is not bound to accept the lowest or any other bid andmay reject any or all the bids without assigning any reason.

    1.11 Tender shall be liable for rejection if:

    (a) Authenticity of the supporting found to be fabricated.(b) Firms trying to influence any official of the Institute in

    any manner.(c) Firms fail to deposit security money.(d) Firms fail to submit the required information/document along

    with the tender.(e) Firms fail to put serial number, signature and seal on each

    pages of technical and financial bids.(f) CORRECTION, ALTERATION AND OVERWRITING is found in the

    Financial Bid.

    1.12 That the successful tenderer shall follow the rules anddirections issued by the Institute from time to time. Non-Compliance for same may result in strict action includingtermination of the contract.

    1.13 That the Institute reserves the right to makeaddition/ deletion or alterations in the contract, withoutaffecting the basic nature of the contact.

    1.14That by giving three months notice from the Institute side thecontract can be terminated.

    1.15 Force Majeure shall mean and be limited to the following:-

    (a)Any War/hostilities.(b)Any riot or civil commotion.(c)Any earthquake, flood tempest, lighting or other natural

    physical disaster.(d)Any strike, or lockout (only those exceeding ten

    continuous days in a duration).

    1.16 The bidder is expected to examine all instructions, Forms, Termsand Conditions in the Tender document. Failure to furnish allinformation required in the tender document. Non submission ofrequired documents may result in rejection of his bid.

    1.17 Conditional bids/offers will be summarily rejected.

    2. ELIGIBILITY:

    2.1 Only those firms/organizations having experience of providingsanitation services in hospitals or organizations for more thanthree consecutive years and having yearly turnover at least ofRs. 40 lacs for the last two years are eligible to participatein the tender process. The tenderer must have the experience ofrunning the sanitation services engaging minimum 60 workers or

    more in one organization. He should also submit the certificateof satisfactory work performed duly issued by Head oforganization under whom services were rendered.

    2.2 Tenderer must have minimum solvency limit of Rs 50 Lacwith a Nationalized bank (Able to pay debts or meetliabilities; and financially sound).

    2.3 The Tenderer must have E.P.F. Registration number duly allottedby Commissioner of E.P.F.

    2.4The employees of U.P. Rural Institute of Medical Sciences &Research (Institute) or their Family members shall not beeligible to participate in the tender process. For the purposesof this clause family members includes only Parents, Spouse,Sons, Daughters and dependent brothers and Sisters.

    3. LEGAL:

    3.1 That the contractor shall strictly abide by (a) ProhibitionEmployment of Children Act. (b) Workman compensation Act. (c)Employment of labors/Contract Labours Act (d) IndustrialEmployment Act. (e) Contract labour abolition & regulation Act1976 (f) Minimum wages Act (g) any other legislation or rulesapplicable in respect of labour and other relevant laws fromtime to time.

    3.2 The Successful Tenderer shall comply with all the statuespertaining to Labour Laws which is in force at present or whichmay come into force in future.

    3.3 The Successful Tenderer shall agree to maintain employmentrecords in respect of its personnel as required under variousLabour Statues, such as attendance register, wage register,

    bonus register and leave register etc.

    3.4 It will be the sole responsibility of the Successful Tenderer toabide by the provisions of all Labour Laws as to the workersengaged by him for performance of the contract.

    3.5 In the event of any dispute or difference arising between theparties relating or concerning to interpretation of the contractor any alleged breach there of or any matter relating to thiscontract, the same shall be settled by the parties as far aspossible by mutual discussions and consultation betweenthemselves, whether the same has arisen during the subsistenceof this contract or thereafter.

    3.6 In the event of any dispute or difference arising in connectionwith this tender whether during the subsistence of the contractor there after not being settled in aforesaid manner, the mattershall be referred to the Director, Rural Institute of MedicalScience & Research, Saifai, Etawah for appointing an arbitratorwhose decision shall be final and binding on both the parties.The proceedings before the arbitrator would be governed by theprovision of the CONCILATION AND ARBITRATION ACT, 1996.

    3.7 That the institute reserves the right to terminate the contractwithout assigning any reasons. This decision will not bechallengeable in any court of law.

    3.8 The Institute shall not pay any compensation in respect of anyinjury or death caused to the workers of the tenderer. It willbe the sole responsibility of the tenderer.

    3.9 The Institute shall not be responsible for any loss, breakage ortheft of tenderer's material.

    3.10 That during the proceedings of any in house investigation orinquiry it shall not be open to either of the parties to berepresented through a lawyer.

    3.11 The Court of Etawah shall have exclusive jurisdiction in allmatters arising out of this contract.

    3.12 Stamp duty leviable on Agreement shall be borne by theSuccessful tenderer.

    4. FINANCIAL AND PAYMENT:

    4.1 Must enclose Earnest Money of Rupees 1,50,000.00 (Rupees One LacFifty Thousand) in the form of TDR/FDR issued from nationalizedbank and drawn in favour of Finance Controller RIMS&R, Saifaiand shall be valid for 01 year from the date of issue.

    4.2 That on award of the contract, the contractor shall deposit a

    FDR/TDR of Rs. 5.00 Lacs (Rupees Five lacs) as security money infavour of Finance controller U.P. RIMS&R, Saifai valid for fouryears from the date of award of contract. The Institute shall beentitled to claim/adjust any amount and dues from the saidsecurity deposit.

    4.3 That the contractor shall pay license fee rupees 5,000/- permonth and it shall be deducted from monthly bill of contactor.

    4.4 (a)Service tax will be reimbursed on production of proof ofdeposit the tax in the proper Govt head.(b)Other Taxes will be deducted as per the Government rules.(c) Any other tax imposed in future will be govern according tothe provision of that act/rules made for thereto.

    4.5 That subject to satisfactory performance and fulfilling allterms and conditions, the contract shall initially be awardedfor a period of one year and may and may not be extended foranother two years on yearly renewal basis, subject tosatisfactory services verified by Institute. The Terms andconditions of the contract may be reviewed after 1 year by theInstitute. The total period of contract would not exceed 03years.

    4.6 That no change in the rates would be considered for the periodof contract i.e. one year. In case of extension (that can bemaximum upto two years) a request for enhancement of rates maybe considered on mutually agreed terms and conditions by theInstitute. The decision of the institute in this regard shall befinal.

    4.7 All the consumables and disposables required for cleaning andhousekeeping will be provided by the institute, hence no paymentin this regard shall be made to the contractor.

    4.8 Tenderer should have own the automatic advanced cleaningequipments such as Floor Sweepers, Vacuums, Pressure CleaningMachines, Carpet Cleaners, Extractors, Scrubbers and Burnishersetc. If not, then the above equipments must be purchased beforestart of the work if the contract will be awarded. Themaintenance of these equipments will be done by tenderer. Incase of award of tender, the tenderer has to show theseequipments physically before starting the work.

    4.9 If cleanliness is not observed upto the satisfaction of theUPRIMS&R, a penalty of a minor fine of Rs.1,000/- per day orRs.500/- per day per square metre, whichever is higher, will beimposed on the contractor depending on the objective criteria asabove.

    4.10 That in the event of failure on the part of the contractor

    to carry out the jobs enumerated in the contract on anyparticular day, it shall be open for the institute to get thejob done from alternative source on behalf on the contractor andall expenses/cost incurred thereof shall be recovered by theInstitute from the contractor.

    4.11 The Tenderer must have E.P.F. Registration number duly allottedby Commissioner of E.P.F. In compliance with the provisions ofEmployee Provident Fund (EPF), the contractor shall provide EPFcover to each of his employee subsequent to award of thecontract but the firms which have at least 100 sanitary workers,Supervisor registered under ESI & EPF will be given preference.

    4.12 That the Institute will make payment to the contactor againstthe number of workers deployed as per applicable minimum wagesdeclared by the government and the same shall be transferred tothe bank account of the concerned workers by the tenderer.

    4.13 The wages will be payable by the tenderer to the worker upto 7thday of every month without waiting for the payment of bill tothe tenderer by the institute. The payment of wages will be donethrough direct bank account transfer to the concerned worker'sbank accounts with EPF deduction of individual worker. Proof ofwage disbursement must be submitted for claiming the paymentalong with deployment chart. The hospital work however should inany way be not disturbed on account of wage disbursement. Payslip be issued to each worker by the tenderer with all relevantdetails including his/her EPF deduction etc.

    4.14 Contractor will submit monthly bill in triplicate for payment onor before the 7th of each months. The Institute will deduct Taxesand Fee as applicable from each bill as per rule.

    5. SPECIAL:

    5.1 The cleaning and housekeeping works are to be carried out insuch manners that all premises always look neat and clean.

    5.2 That it shall be obligatory on the part of the contractor tomaintain highest standards of hygiene and cleanliness in the

    institute including fitting and fixtures. Requisite man powerfor this purpose shall be responsibility of the contractor.

    5.3 That the services of the contractor for this purpose shall beopen as per the requirement of the Institute for all 365/366days of the year, including Sunday and holidays.

    5.4 Day to day sanitation services for the entire UPRIMS&R campuses

    including all institutional & residential buildings, hospital,hostels etc., roads, paths, parking, lawns etc. are required.

    5.5 No sanitary worker will be deployed by the tenderer withouthaving screened by the committee formed by the Institute forthis purpose. The Institute/committee can examine for medical

    category, age, physical fitness proof of experience such asdischarge book/qualification/Salary statement or any otherdocument any time even after. The tenderer will be responsiblefor any false statement/forged document produced by any sanitaryworker if caught any time during the deployment. The Institutewill have full authority to inquire into thedocumentation/credentials of the sanitary worker from anysources at any point of the time during or even after thecontract period.

    5.6 Police verification before employment of all the workers isprerequisite and a must. The tender shall not employ casualunverified sanitary worker for short periods on duty in theinstitute .As for as possible continuity should be maintainedand the sanitary worker should be engaged for the entireduration of the contract. Tenderer shall have the right tochange /rotate for the disciplinary /administrative and othervalid reason by informing the ward committee, preferably inadvance fully ensuring that sanitary worker so provided arestrictly in conformity with the requirement as elaborated inthis tender.

    5.7 Under any circumstances no personnel will be allowed to work formore than one shift (8 hourly) per day. The tenderer should haveadequate strength of manpower for relieving duty.

    5.8 The successful tenderer will also provide list of requirednumber of men with relievers supervisors and officer in-chargeon the format given below along with relevant copies beforesigning the agreement. If the successful tenderer fails to do sowithin the stipulated time, the Institute shall have full rightto forfeit his EMD/Security deposit and the award of thecontract will be treated as cancelled.

    5.9 The manpower engaged should be trained in management of garbage(bio-degradable & non-degradable and recyclable waste) also sothat waste disposal is carried out properly without affectingthe environment as per pollution control directions.

    5.10 Some of the sanitation workers should be trained for sewermansjob because the scope of work includes the unclogging ofsoil/waste pipes, floor traps, gully traps, building manholes

    etc.

    5.11 Only female workers shall be deployed in the girls hostels.5.12 That the Institute shall be at liberty to use the services of

    the sanitation workers as and where required by it.

    5.13 The sanitation workers may be required for shifting offurniture, equipments and machines. No extra charge will bepayable to the contractor in this regard.

    5.14It will be the sole responsibility of the contractor that themen/women engaged are trained and UPRIMS&R will not be liablefor any mishap, directly or indirectly.

    5.15 The cleanliness will be periodically checked by the institutebased on certain objective criteria which are decided to measurelevel of cleanliness and the contractor has to abide by thosecriteria. These are as follows:(i) Shine level, presence of dust, pan and gutkha stains,

    spillage of water or other liquids, bird droppings etc. onfloors, tiled walls, doors, windows or stairs, etc.;

    (ii) Dust or cobwebs etc. on roof, window grills etc.;(iii)Finger or palm marks, dust and gutkha stain on glass panes

    of windows or doors and mirrors;(iv) Dirt marks, dust, dryness and odour in Wash-basin, WC

    Seats, floors etc. in toilets/bathrooms.

    5.16 The personnel engaged by the tenderer shall not be the employeesof the Institute in any manner.

    5.17 The Contractor shall be at liberty to choose his work force fromtime to time subject to ensuring desired quality of services.

    5.18 That for the conduct of his workers and staff, the contractorshall personally be responsible, and in the event of anymisconduct reported to him, he shall take prompt action inconsultation with Institutes authority.

    5.19 That it shall be obligatory on the part of the contractor toissue identity cards and two set of uniforms to his personnel athis own expense. The Uniform will include Cap, Pant, shirt etc.The contractor will take approval of color, design and qualityof cloth from Institute authorities.

    5.20 That the contractor shall ensure that his personnel are wearingneat and clean uniform. They are properly dressed up and their

    appearance is good. They are medically fit and they are notsuffering from any communicable disease.

    5.21 That the contractor, or his representative or staff shall submitdaily report to the institute and shall also take day to dayinstruction relating to the work under the contract and willfollow the instruction given to him by the institute.

    5.22 That the contractor shall produce medical fitness certificate ofeach of his employees at the time of commencement of work andevery six months thereafter, subject to such medical fitness the

    employees of the contractor shall be allowed to work in theHospital Sanitation. However, the medical examination shall bedone at institute itself, and all expenses to this account shallbe borne by the contractor.

    5.23 That the contractor shall maintain a suggestion/Complaint booksin various locations, which shall periodically be producedbefore the institute for perusal and necessary action.

    5.24 The tenderer will physically present himself at least once in aweek and will contact the nodal officer during his visit.

    6. SCOPE OF WORK

    6.1 VISIT TO AREA OF UPRIMS&R FOR WHICH SANITATION SERVICES AREREQUIRED:-UPRIMS&R is a growing medical institute. At present ithas a hospital of 750 beds. The entire campus spread overapprox. 92.39 acres of land. Besides hospital and medicalcollege, there are hostels, residential complexes, centrallibrary, administrative wing, auditorium, animal house, guesthouses, gymnasium, patients relative accommodation, communitycentre etc. in the campus of the institute. It will be expandedin near future. There are several entry/exit points in the

    campus and the campus is well covered by boundary walls. Thebidders are therefore advised to visit the campus and acquaintthemselves with the area, scope of work and operational systemthoroughly. The costs of visit shall be borne by the bidder. Itshall be deemed that the contractor has undertaken a visit toUPRIMS&R and is fully aware of the scope of work and operationalconditions prior to the submission of the tender documents.

    6.2 The scope for sanitation services extends to complete campuscomprising of all institutional & residential buildings,hospital, hostels (excluding rooms), guest houses, library,gymnasium, animal house, administrative block, roads, paths,parking etc. The following activities shall be performed onregular basis:

    6.3 The scope of work for sanitation services includes collectionof garbage from various places and disposal of the same in thedustbins/dumping yard as per the direction of the officer-in-charge, UPRIMS&R or his authorized representative and shouldbe eco- friendly.

    6.4 At present nearly 163 un-skilled and 11 semi-skilled workersare required. This requirement may vary in future.

    7. CANCELLATION/TERMINATION OF CONTRACT:

    7.1 After giving opportunity of being heard to the Contractor,Institute may terminate/cancel the agreement on the followinggrounds:-

    I. Breach of anyone or all terms and conditions of agreement.

    II. Non-performance or unsatisfactory performance of work.

    In such circumstances Security Deposit may be forfeited by theInstitute and the Contractor shall have no claim whatsoeveragainst the Institute.

    7.2 Notwithstanding, any other provisions made in the Contract,the Institute reserves the absolute right to terminate thecontract after giving three months notice in writing withoutassigning any reason. No compensation or claim in the event ofsuch cancellation shall be admissible to the Tenderer.However, if the Institute so desires the Tenderer shallcontinue the Hospital Sanitation Services even after expiry orthe notice period of three months till the Institute makes analternative arrangement.

    8. ENCLOSURES:

    (i)Permanent Account Number. (Copy of PAN card).(j)Income Tax Return of last three preceding years.(k)Balance Sheet of Last two financial years.(l)Solvency Certificate.(m)List of Advanced Automatic Cleaning Equipments along

    with proof of ownership (if equipments alreadyhaving).

    9. Other documents, viz, tender documents, technical report andfinancial chart etc. will form the part of this agreement.
