    Short title

    1. This notice may be cited as the Taking of Land Notice (No. 5) 2019 .

    Land taken

    2. The land described in Schedule 1 is taken by the Coordinator-General pursuant to the State Development and Public WorksOrganisation Act 1971 for the establishment of the new mental health facility for the Ipswich Hospital Redevelopment Project,and vests as an estate in fee simple in the West Moreton Hospital and Health Service on and from 8 November 2019.

    At 8:05pm on 8 November 2019, the Minister for Fire andEmergency Services approved the declaration of a DisasterSituation under section 64 of the Disaster Management Act2003 for the area within the Sunshine Coast Disaster Districtencompassing the Noosa Local Government Area.

    Fire and Emergency Services Act 1990

    DECLARATION OF STATE OF FIRE EMERGENCYFOR QUEENSLAND

    Title

    1. This notification shall be known as the Notification ofDeclaration of State of Fire Emergency for Queensland.

    Authorising Law

    2. The law under which this notification is approved is section 87and section 88 of the Fire and Emergency Services Act 1990.

    Period of state or fire emergency OR Commencement of stateor fire emergency

    3. This declaration will commence from 1700 hours on thedate of 9 November 2019 and will remain in force untilsuch time as it is cancelled, amended or revoked.

    Area to which the state or fire emergency applies

    4. This declaration of a state of fire emergency applies to theState of Queensland. (As indicated on the attached map)

    Effect of declaration

    5. This declaration ceases the effect of all previous authoritiesgiven under Fire and Emergency Services Act 1990 or anyother Act to light a fire, whether given before or during thisstate of emergency while this state of emergency remains inforce. This cessation of authority includes:(a) The lighting of any fire in accordance with a Permit to

    Light Fire issued pursuant to section 65 of the Fire andEmergency Services Act 1990.

    (b) The lighting of any fire in accordance with theNotification issued on 30 July 2010 issued pursuantto section 63 of the Fire and Emergency Services Act1990 being:i. any fire in which neither the height, width nor the

    length of the material to be consumed exceeds2 metres;

    ii. any fire lit for the purpose of burning the carcassof a beast;

    iii. any fire lit at a sawmill for the purpose of burningsawdust or other residue resulting from theoperations of a sawmill;

    iv. any fire lit out-doors for the purpose of cooking,if enclosed in a fireplace so constructed as toprevent the escape of fire or any burning materialthere from.

    6. This declaration orders that any person finding a fire burningin the open air take all possible steps to extinguish it and, assoon as is practicable, report the existence and locality of thefire to Queensland Fire and Emergency Services via triple zero.

    7. The use of the follow appliances, materials or substancesis prohibited:(a) Fireworks and pyrotechnic devices of any kind,(b) Use of devices which incorporate a naked flame, and

    any other similar activities that can be a source ofignition when flammable material is present, or canbecome a fire hazard regardless of the presence offlammable material.

    (c) The operation of steam trains or similar apparatus.

    8. The following activities or operations are suspended forperiod of this declaration.(a) Welding, grinding, the use of oxy acetylene cutting or

    heating, use of naked flames and other similar operationsthat can be a source of ignition when flammable materialis present or can become a fire hazard regardless of thepresence of flammable material.

    Failure to comply with this declaration

    9. Any person who fails to comply with a declaration of a state offire emergency or with any requisition made pursuant tosection 91(2) commits an offence against this Act having apenalty of up to 25 penalty units or 2 years imprisonment.

    NOTICE OF AMENDMENT TO THE DEVELOPMENT ASSESSMENT RULES UNDER THE PLANNING ACT 2016 , SECTIONS 69 and 11

    I, the Honourable Cameron Dick MP, Minister for State Development, Manufacturing,Infrastructure and Planning, do hereby notify that, pursuant to sections 69 and 11 of thePlanning Act 2016 , I made minor amendments to the Development Assessment Rules on11 November 2019.

    In accordance with section 69(2) of the Planning Act 2016 , the Development AssessmentRules as amended, do not have effect until:

    (a) the chief executive of the Department of State Development, Manufacturing,Infrastructure and Planning publishes both the amendment, and the rules asamended, on the department’s website; and

    (b) the rules as amended are prescribed by regulation.

    The amended Development Assessment Rules document is available from theDepartment of State Development, Manufacturing, Infrastructure and Planning’s websiteat https://planning.dsdmip.qld.gov.au/.

    Fire and Emergency Services Act 1990

    DECLARATION OF STATE OF FIRE EMERGENCY FOR QUEENSLAND

    Title

    1. This notification of an amendment to the Declaration ofState of Fire Emergency gazetted on 9 November 2019shall be known as the Notification of Declaration of State ofFire Emergency for Queensland (Amendment 1) .

    Authorising Law

    2. The law under which this amendment to the declarationtakes effect is section 87(2)(h) and section 88 of the Fireand Emergency Services Act 1990 .

    Commencement of amendment to the Declaration of State orFire Emergency

    3. The amendment to the declaration takes effect from thedate of gazettal or notification under section 88(2) of theFire and Emergency Services Act 1990 .

    4. The declaration, as amended herein, will remain in forceuntil such time as it is amended or revoked.

    Amendment to the content and application of the Declarationof State of Fire Emergency

    5. The declaration is amended to apply to the parts of theState of Queensland as indicated in the attached amendedmap and table.

    6. The declaration is further amended by replacingparagraphs 5, 6, 7, 8 and 9 of the Declaration of State ofFire Emergency gazetted on 9 November 2019, with thebelow paragraphs 7, 8, 9, 10, 11 and 12.

    Effect of declaration – Activities that are prohibited

    7. This declaration ceases the effect of all previousauthorities given under the Fire and Emergency ServicesAct 1990 or any other Act to light a fire, whether givenbefore or during this state of emergency while this state ofemergency remains in force, subject to the remainingprovisions of this declaration. This cessation of authorityincludes:(a) The lighting of any fire in accordance with a Permit to

    Light Fire issued pursuant to section 65 of the Fire andEmergency Services Act 1990

    (b) The lighting of any fire in accordance with theNotification issued on 30 July 2010 pursuant tosection 63 of the Fire and Emergency Services Act1990 being:

    i. any fire in which neither the height, width nor thelength of the material to be consumed exceeds2 metres;

    ii. any fire lit for the purpose of burning the carcassof a beast;

The following activities or operations are suspended inareas where flammable vegetation is present within 10meters or can become a fire hazard regardless of thepresence of flammable vegetation, until such time as it isamended or revoked;(a) welding(b) grinding(c) the use of oxy acetylene cutting or heating(d) use of naked flames(e) other similar operations that can be a source of

    ignition.

    Effect of declaration – Activities that are not prohibited

    10. In accordance with section 90(2) of the Fire and EmergencyServices Act 1990 , this declaration does not cease theeffect of the following authorities:(a) A fire lit in accordance with the Notification for

    Burning of Sugar Cane as published in the gazette on31 May 2019; save that if a fire permit is required itmust be issued by the Regional Manager, Rural FireService, Queensland Fire and Emergency Services, forthe relevant region;

    (b) A fire lit in accordance with the Notification issued on30 July 2010 pursuant to section 63 of the Fire andEmergency Services Act 1990 , under clause b, item iv-any fire lit out-doors for the purpose of cooking, ifenclosed in a fireplace so constructed as to preventthe escape of fire or any burning material there from;and

    (c) Any powers exercisable pursuant to section 53, 55 or83 of the Fire and Emergency Services Act 1990 .

    11. This declaration orders that any person finding a fireburning in the open air take all possible steps toextinguish it and, as soon as is practicable, report theexistence and locality of the fire to Queensland Fire andEmergency Services via triple zero.

    Failure to comply with this declaration

    12. Any person who fails to comply with a declaration of astate of fire emergency or with any requisition madepursuant to section 91(2) commits an offence against thisAct having a penalty of up to 250 penalty units or 2 yearsimprisonment.
