1. ISSUE OF TENDER FORM: - The tender form can be obtained from SDE (Plg). O/o the TDM, BSNL, Hajipur on payment of Rs-574/- (Rupees five hundred seventy eight only) in cash to AO (cash)TDM,BSNL, Hajipur. O/o the TDM BSNL, Hajipur up to 16.01.2016 between 10:00 to 16:00 hours on all working days.

2. The SSI bidders desirous of getting tender documents free of cost may apply to AGM (Plg) O/o the TDM BSNL, Hajipur. The SSI bidders downloading the tender document from website should submit documents proving their eligibility, valid registration certificate from NSIC for tendered items, monetary limit of financial competence to perform the contract under the tender, copy of T.A.C along with TECHNICAL BID.

3. The bidders (small scale units) who are registered with National Small Scale Industries Corporation UNDER SINGLE POINT REGISTRATION SCHEME are exempted from payment of bid security to the extent of their monetary limit. In case of bidders having monetary limit exceeding Rs. 50 Lakhs, the exemption will be limited to Rs-50 lakhs (Rupees Fifty lakhs) only. If the amount of the bid security specified above is more than monetary limit of any bidder, then such bidder needs to furnish Bid Security for the differential amount (i.e. Bid security amount mentioned above minus their monetary limit subject to the maximum of Rs. 50 lacs). A proof regarding current registration with NSIC for the tendered item(s) will have to be attached along with the Bid Documents. The NSIC certificates having monetary limit as ‘NO LIMIT’, ‘Without Limit’ will not be treated as valid certificate

SUBMISSION & OPENING OF TENDERS: - The tender shall be submitted to AGM (Plg), O/o the TDM, BSNL, Hajipur before 14:00 hours of dated-18/01/2016 and will be opened on the same day at 15:00 hours in the presence of the tenderers or their authorized representative who wish to be present at their own cost.The Telecom District Manger (Hajipur) Bihar reserves the right to cancel all or any tenders without

assigning any reason.Note: Tender validity period is 150 days from the date of opening of tender. Tender document down loaded from website may also be used for bidding purpose. SECTION IIGeneral Terms and Conditions

1. The (Wax/PVC) sealed tenders are invited by TDM BSNL Hajipur for the work “Tender for DATA Entry & associated works, O/o TDM, BSNL, Hajipur SSA” in the offices of Hajipur from

registered, reputed and well established firms, who have executed DATA Entry & Report Generation Jobs in BSNL/MTNL/Any other PSU of Central Govt. or State Govt/Central

Govt/State Govt. Departments.

2. The Tender form can be obtained from SDE (Plg), O/o the TDM, BSNL, Hajipur on payment of Rs-574/- (Rupees five hundred seventy four only) in cash to AO (cash), O/o The TDM BSNL, Hajipur, as per NIT.

3. The tender in sealed cover addressed to AGM (Plg), O/o the TDM, BSNL, Hajipur shall be accepted in person by hand or by post up to sharp 14.00 hrs of dated-18/01/2016 in the chamber of AGM(Plg) O/o the TDM BSNL Hajipur. The tender shall not be accepted after due date and time.

4. The tender will be opened at 15.00 hours dated-18/01/2016 in the presence of tenderers who may choose to be present at the time of opening of the tender at their own cost.

5. If any of the last dates mentioned in this tender document becomes a holidays due to any Unforeseen reason, the said last date shall in such a case would become on the next working Day.

6. THE TENDER NOT ACCOMPANYING THE FOLLOWING DOCUMENT IS LIABLE TO BE REJECTED The bidders would furnish the following documents as part of this bid documents establishing the bidder’s eligibility for executing the works.

6.1. (A) Bid security (EMD) in accordance of NIT-Section I.(B) Tender form cost in accordance of NIT- Section I

6.2. Tender document(s), in original, duly filled in and signed by tenderer of his authorized representative along with seal on each page, all correction and overwriting must be initiated with date by the tenderer or this authorized representative.

6.3. Registration of the Firm (i) Attested copy of the registration of the firm, authenticated copy of the partnership deed in

case of partnership firm or in case of sole proprietor firm, declaration is to be attached.

(iii) Memorandum of Association and Article in case of Pvt. Ltd Co. with registration Certificate issued by registrar of companies.

6.4. Original power of Attorney should be executed on non judicial stamp paper of appropriate value as prevailing in the respective state and same be attested by a Public Notary or registered before Sub-Registrar of State of BIHAR.

6.5. Photo copy of PAN Card issued by Income Tax Department duly attested

6.6. Copy of Service Tax Registration Certificate.

6.7 Copy of EPF Registration.

6.8 Copy of ESI Registration.

6.9. Certificate of No near Relative is working in BSNL.The Bidder should give a certificate that none of his/her near relative is working in the units where he is going to apply for the tender. In case of proprietorship firm certificate will be given by the proprietor. For partnership firm certificate will be given by all the partners and in case of limited company by all the Directors of the company excluding Government of India/Financial Institution nominees and independent non-official part time Directors appointed by Govt. of India or the Governor of the State.

6.10. TurnoverThe average annual financial turnover during the immediate last three financial years (2012-13, 2013-14 & 2014-15) should be at least 30% of estimated cost of tender. This should be duly signed by a Chartered Accountant.

6.11. Experience

The bidder should have an experience of 2 years for doing such similar works by engaging at least 10 data entry operators in Govt/PSU organizations.

The experience Certificate in this regard must be issued by an officer not below the rank of STS/ JAG

level or equivalent officer attested by Gazetted officer/Notary. Similar work means work of manning of Counters, DATA Entry & Report Generation and Job work on Computer etc.

6.12 The bidder should not have been black listed or debarred for participating in tender notice for non compliance by any unit of BSNL/DOT/MTNL. An affidavit on Indian nonjudicial stamp paper shall be furnished by bidder with the bid inconfirmation of the same, clearly stating that has firm or Company is not blacklisted.

7 The bid security shall be forfeited:

i. If a bidder withdraws his bid during the period of bid validity specified in the bid document, or

ii. If the bidder makes any modifications in the terms and conditions of the tender before acceptance of the tender, which are not acceptable to the department or any information given by him is found false.

iii. In case of a successful bidder, if the bidder fails to sign the agreement or furnish the required performance security as required by the competent authority.

iv. If any information furnished by the tenderer is found incorrect at any point.v. If any documents submitted by the tenderer found false, bid security shall be

forfeited and tenderer will be blacklisted.8 (a) The successful bidder shall be required to furnish a security deposit 10% of the total tender

cost within 15 days after receipt of letter of intent in the form of cash/DD/Bank Guarantee from any scheduled bank valid for 24 months.

(b) The bid security will be refunded to the successful bidder on receipt of the security deposit as required vide clause 8(a) above.

9. Tender document downloaded from website may also be used for bidding purpose. A Demand Draft for an amount equal to the cost of tender form drawn in favour of AO(Cash),TDM BSNL Hajipur, O/o the TDM BSNL, Hajipur payable at Hajipur should be enclosed along with the bid documents without which the bid document will not be valid.

10. The tenderer will have to quote the rate in financial bid of the prescribed format only issued by BSNL. The rate shall be quoted in figures as well as in words inclusive of all taxes, except service tax which shall be paid as applicable.

11. If there is difference in the rates quoted in figures and words then the rates quoted in words will be final.

12. The contractor shall quote the rates inclusive of all taxes, the BSNL shall pay only the rates quoted and agreed through this tender.

13. The tenderers are advised not to mutilate or erase the figures, correction if any in the tender form should be signed in full otherwise the tender shall be rejected.

15. CONDITIONAL AND INCOMPLETE TENDERS SHALL BE REJECTED.

16. The submission of more than one tender in the same name is strictly prohibited and in such a case all such tenders shall be rejected.

17. If any of the information furnished by the tenderer is found to be incorrect or false at any point of time, his contract is liable to be terminated without giving any notice and his earnest money and the other deposits shall be forfeited. If contractor submitted false document at the time of tender he will be blacklisted.

18. The court case if any shall be entertained in Hajipur jurisdiction only.

19. No sub-contracting is permissible by BSNL. The near relatives of all BSNL employees {Non executive employees working in BSNL & executive employees (also called Group ’A’ & Group ’B’ officers) working in BSNL either directly recruited or on deputation are prohibited from participation in this tender. The near relatives for this purpose are defined as:(a) Member of Hindu Undivided Family,(b) They are husband and wife.(c) The one is related to the other in the manner as father, mother, son(s), son’s wife

(daughter-in-law), Daughter(s) & daughter’s husband (son-in-law), brother(s) & brother’s wife, sister(s) & sister’s husband (brother-in-law).

20. The tenderers signing the tender in case of firms should specify whether they are signing as Sole proprietor or Partner authorized under power of attorney or as Director, Manager or secretary etc authorized through resolution of BOD of company, as the case may be supported copies of the documents authorizing the signing authority to sign the tender shall be attached with the tender form.

21. The accepted rates shall be operative for a period of one year from the date of agreement. The Telecom District Manager, Hajipur reserves the right to extend the period of contract on same cost with same terms & condition with same value of work if necessary.

22. The contractor shall not engage any BSNL employee regular/casual for getting the job executed.

23. TDM BSNL, Hajipur reserves the right to reject, accept, prefer any tender or tenders without assigning any reason and may or may not accept the lowest or any tender.

24. BSNL will not take any responsibility of providing any facility to any individual who is carrying out the Job work.

25. BSNL will provide computer stationery to the contractor for execution of DATA entry and report generation jobs in the premises of BSNL of telecom under the jurisdiction of the TDM BSNL, Hajipur. The contractor shall not be allowed to take computers and any documents out side the premises of the TDM BSNL, Hajipur.

26. (a)The contractor shall be responsible to complete timely DATA feeding and report generation jobs efficiently & shall take care that no damage is caused to the costly computers and others accessories belonging to BSNL Telecom District Hajipur. Any negligence in this regard shall be viewed seriously & recovery on this account shall be made from the contractor as decided by the TDM BSNL, Hajipur.(b) Any fraud or misappropriation while operating any of the counters by him or his

agent will be the sole responsibility of the contractor. He will be liable for making good the loss so incurred.

(c) Contractor will be solely responsible for arising out any dispute regarding labour act/ court case of any legal matter, BSNL will not be responsible in any case.

27. The BSNL reserves the right to carryout the DATA entry and report generation jobs in part or full through BSNL or through any other contractor/Agency or contractors. The BSNL also reserves the right to appoint one or more contractors for the job.

28. The contractor will employ experienced person for caring out the counters and commercial outlet.

29. The approximate quantum of work is mentioned in annexure”A” of the tender document. However,the TDM BSNL, Hajipur reserves the full right to increase or decrease the quantum of work in the interest of BSNL for any or all items of work.

30. No additional payment will be made for working beyond any fixed working hours or on Sundays or holidays.

31. The contractor shall not charge any extra amount for travelling and will not be entitled to get any compensation for any damage or losses in the course of execution of the job.

32. The contractor is expected to start the work of a work order within a maximum of 7 days of the receipt of work order failing which it shall be assumed that contractor is not in a position to carry out work penalty and action as per clause -37 will be taken.

33. The BSNL reserves the right to reject any tender without assigning any reason. The BSNL reserves the right to suspend any scheduled item/items temporarily or permanently.

Note- The bidders are requested to divide the tender form into two parts as technical bid in one envelope (duly sealed & marked as technical Bid) consisting the documents establishing the eligibility along with bid security cost and cost of tender document in the form of dd or ACG-67 & another envelope containing financial bid (duly sealed & marked as Financial Bid). Both the aforementioned sealed envelopes should be kept in an outer cover, (duly sealed & marked as “Tender for DATA Entry & associated works ,TDM BSNL Hajipur SSA”), addressed to AGM(Plg), O/o the TDM BSNL, Hajipur or delivered in person or by post on or before the time of due date mentioned with NIT. Both envelops will be opened separately.

34. JOB WORK ON COMPUTER

1. The contractor shall be responsible for the Job Work on Computer jobs assigned to him by concerned officers of the BSNL on day to day basis subject to maximum output depend under clause 27(a) above so as to complete the work assigned in a day, on the same day itself.

2. Contractor should deploy well-educated & experienced person who is having good working knowledge, computer typing in Hindi and English as per requirement in the office and has good speaking skills in both languages for direct interations with officers/ officials.

35. BID OPENING AND EVALUATION1. Opening of bids by BSNL

A. BSNL shall open the bids in the presence of bidders or their authorized representatives who choose to attend, at 14:00 Hrs. on due date. The bidder’s representatives, who are present, shall sign an attendance register. The bidder shall submit authority letter to this effect before they are allowed to participate in the bid opening.

B. Maximum of two (2) representatives for any bidder shall be authorised and permitted to attend the bid opening.

C. The Bids shall be opened in the following manner:

D. The bid opening committee shall count the number of bids and assign serial numbers to the bids. For example, if 10 tenders have been received the bids shall be numbered as 1 of 10, 2 of 10 etc. All the members shall initial on the outer envelopes of all the bids with date.

E. The envelopes containing the tender offer not properly sealed shall not be opened and shall be rejected outright. Closing the cover by gum, will not be treated as sealed cover. The reasons for not opening such tender offers shall be recorded on the face of the envelope and all the members of bid opening committee shall initial with date.

F. First the outer envelope containing the two envelopes be opened. The bid opening committee shall initial on all envelopes with date.

G. Among these two envelopes, the envelope marked “TECHNICAL BID” shall be opened first and examined.

H. The bidders who have submitted proper bid security as per tender document, their “TECHNICAL BID”, shall be opened and papers/documents submitted by the bidder shall be examined and recorded by the TOC. After opening the technical bid, all the documents contained therein shall be serially numbered and signed by the bid opening committee members.

I. After recording of the “TECHNICAL BID” the TOC will place all the financial bids submitted by the bidder in an envelope and will seal it with a wax for keeping in safe custody.

J. The financial Bid shall be opened in the following manner:K. The envelope marked “Financial Bid”, will be opened only for qualified bidders in

“TECHNICAL BID”L. The date and time of opening of “Financial bid” shall be conveyed to all the bidders

who have qualified in qualifying bid and their representatives shall be allowed to attend the financial bid opening.

M. After opening the “Financial Bid” the bidder’s name, bid prices, modifications, bid withdrawals and such other details as BSNL, at its discretion, may consider appropriate, will be announced at the opening.

N. In case there is discrepancy in figures and words in the quote, the same shall be announced in the bid opening, but the quote in words shall prevail.

O. LATE BIDS:Tenders will not be received after the specified time of closing of the tender and the same shall be rejected and returned unopened to the bidder. It is the sole responsibility of the tenderer that he should ensure timely submission of tender.

36. PENALTY FOR DELAY: -

1. In case the approved contractor is not able to complete the work of a work order the BSNL shall impose a penalty @ Rs.0.5%/- per day per office. Subject to a maximum of Rs.3000/- per office per month apart from prorate payment.

2. In case the contractor does not complete the work even after imposing maximum penalty in a month then:

A. The BSNL shall have the liberty to get the work done through any other agency even at higher rates and the extra cost shall be adjusted from the running bills/security of the contractor.

B. The BSNL shall have the liberty to initiate the case for terminating the contract by giving one-month notice to the contractor.

IN CASE THE CONTRACTOR DOES NOT RESPOND FAVOURABLY AND TO THE FULL SATISFACTION OF THE BSNL, THEN THIS CONTRACT SHALL BE TERMINATED BY THE BSNL AFTER THE LAPSE OF ONE MONTH FROM THE DATE OF ISSUE OF SUCH A NOTICE

37. The contractor’s person doing work on computer should confine himself to the assigned job only. Any unlawful loitering or engagement in unauthorized work shall result in invoking clause 27(b) & 27(c) apart from taking legal action against the contractor as deemed fit to competent authority.

38. However, in a particular case, if the TDM BSNL, Hajipur is satisfied based on facts and Circumstances of the case, and also based upon any written representation that the Contractor may make in this regard, that the delay in the progress of work was due to Reasons beyond the control of the contractor, the TDM, BSNL, Hajipur reserves the right to waive off the penalty.

39. If at any point of time the TDM BSNL, Hajipur feels that the security amount is to be increased Depending upon the nature of work done by contractor. The Contractor should be able to deposit the additional security in form of Government Security/ FD/Bank Guarunty.

40. The earnest money will be refunded to the unsuccessful tenderers in due course in Accordance with the rules of the BSNL and for which stamped pre-receipt may be submitted after finalization of tender.

41. The successful bidder shall have to deposit security money amounting 10% of the total value of the tender before entering into agreement or may be deducted from the running bill after prior approval of the competent authority.

42. The security money will be refunded to the contractor only on successful completion of the complete work and after expiry the period of the tender. The security deposit money will be refunded on receipt of necessary certificates from the field officers about satisfactory performance of all works related to the contract and about return of all stores by the contractor to the field officers.

43. BSNL will not be liable to pay any interest on the earnest money/security deposit that is in its custody.

44. BSNL also reserves the right to forfeit the earnest money & the security deposit if theContractor fails to comply with the agreed terms & conditions of the contract.

45. LABOUR WELFARE MEASURES AND WORKMAN COMPENSATION45.1. Obtaining licence before commencement of work.

The contractor shall obtain a valid labour licence under the Contract Labour (H&A) Act, 1970 and the contract labour (regulation and abolition) Central rules 1971, before commencement of the work, and continue to have a valid license until the completion of work. The contractor shall also abide by the provisions of the Child Labour (Prohibition and regulation) Act 1986. Any failure to fulfill the requirement shall attract the penal provisions of the contract arising out of the resultant non- execution of work.

45.2. Working Hours I. Normally working hours of an employee should not exceed 8 hours a day. The working day

shall be so arranged that inclusive of interval for rest, if any, it shall not spread over more than 12 hours on any day.

II. When a worker is made to work for more than 8 hours on any day or for more than

48 hours in any week he shall be paid over time for the extra hours put in by him.III. Every worker shall be given a weekly holiday normally on a Sunday, in accordance with the

provisions of minimum wages (central) Rules 1960, as amended from time to time, irrespective of whether such worker is governed by the minimum wages Act or not.

IV. Where the minimum wages prescribed by the government, under the minimum wages Act, are not inclusive of the wages for the weekly day of rest, the worker shall be entitled to rest day wages, at the rate applicable to the next preceding day, provided he has worked under the same contractor for a continuous period of not less than 6 days.

V. Where a contractor is permitted by the Engineer-in-charge to allow a worker to work on a normal weekly holiday, he shall grant a substituted holiday to him for the whole day, on one of the Six days, immediately before or after the normal weekly holiday, and pay wages to such worker for the work performed on the normal weekly holiday at the overtime rate.

45.3. Display of Notice Regarding Wages Etc.The contractor shall, before he commences his work on contract, display and correctly maintain and continue to display and correctly maintain, in a clear and legible condition in conspicuous places on the work, notices in English and in local Indian languages spoken by the majority of the workers, giving the minimum rates of the wages fixed under minimum wages Act, the actual wages being paid, the hour of work for which such wage are earned, wages and other relevant information.

45.4. Payment of Wages. I. The contractor shall fix wage periods in respect of which wages shall be payable.II. No wage period shall exceed one month.III. The wages of every person employed as contract labour in an establishment or by a

contractor, where less than one thousand such persons are employed, shall be paid before the expiry of seventh day and in other cases before the expiry of tenth day after the last day of the wage period in respect of which the wages are payable.

IV. Where the employment of any worker is terminated by or on behalf of the contractor, the wages earned by him shall be paid before the expiry of the second working day from the date on which his employment is terminated.

V. All payment of wages shall be made on a working day at the work premises and during the working time and on a date notified in advance and in case the work is completed before the expiry of the wage period, final payment shall be made within 48 hours of the last working day.

VI. Wages due to every worker shall be paid to him direct or to other person authorised by him in this behalf.

VII. All wages shall be paid by account payee cheque or in their bank account by transfer only.VIII. Wages shall be paid without any deductions of any kind except those specified by the central

government by general or special order in this behalf or permissible under the payment of wages Act 1956.

IX. A notice showing the wage period and the place and time of disbursement of wages shall be displayed at the place of work and a copy sent by the contractor to the Engineer-in-charge under acknowledgement.

X. It shall be the duty of the contractor to ensure the disbursement of wages in presence of the site Engineer-in-charge i.e. SDE/SDO Phones/JTO who will be required to be present at the place and time of the disbursement of wages by the contractor to workmen.

XI. The contractor shall obtain from the site Engineer or any other authorised representative of the Engineer-in-charge, as the case may be, a certificate under his signature at the end of the

45.5. Fines and deductions which may be made from wages 45.5.1 The wages of a worker shall be paid to him without any deduction of any kind except the

following:-(a) Fines(b) Deductions for absence from duty i.e. from the place or the places where by the

terms of his employment he is required to work. The amount of deduction shall be in proportion to the period for which he was absent

(c) Deductions for damage to or loss of goods expressly entrusted to the employed person for custody, or for loss of money or any other deductions which he is required to account, where such damages or loss is directly attributable to his neglect or default.

(d) Deduction for recovery of advances or for adjustment of overpayment of wages, advances granted shall be entered in a register.

(e) Any other deduction, which the central government may from time to time allow.

45.5.2 No fines should be imposed on any worker save in respect of such acts and omissions on his

part as have been approved of by the labour commissioner.45.5.3 No fine shall be imposed on a worker and no deduction for damage or loss shall be made

from his wages until the worker has been given an opportunity of showing cause against such fines or deductions.

45.5.4 Every fine shall be deemed to have been imposed on the day of the act or omission in respect of which it was imposed.

45.6. Labour records 45.6.1 The contractor shall maintain a Register of persons employed on work on contract in form

XIII of the contract Labour (R & A) central Rules 1971.45.6.2. The contractor shall maintain a Muster Roll register in respect of all workmen employed by

him on the work under contract in form XVI of the CL (R&A) Rules 1971.45.6.3 The contractor shall maintain a Wage Register in respect of all workmen employed by him

45.6.5 The contractor shall maintain a Register of Fines in the form XII of the CL (R & A) Rules 1971 the contractor shall display in a good condition and in a conspicuous place of work the approved list of acts and omission for which fines can be imposed.

45.6.6 The contractor shall maintain a Register of Deductions for damage or loss in form XX of the CL (R & A) Rules 1971.

45.6.7 The contractor shall maintain a Register of advances in form XXIII of the CL(R & A) Rules 1971.

45.6.7 The contractor shall maintain a Register of overtime in form XXIII of the CL (R & A) Rules 1971.

45.7 Attendance card-cum wage slip45.7.1 The contractor shall issue an Attendance card cum wage slip to each workman employed by

him.45.7.2 The card shall be valid for each wage period.

45.7.3 The contractor shall mark the attendance of each workman on the card twice each day, once at the commencement of the day and again after the rest interval, before he actually starts work.

45.7.4 The card shall remain in possession of the worker during the wage period under reference.45.7.5 The contractor shall complete the wage slip portion on the reverse of the card at least a day

prior to the disbursement of wages in respect of the wage period under reference. The contractor shall obtain the signature or thumb impression of the worker on the wage slip at the time of disbursement of wages and retain the card with him.

EPF Contribution Records:-

45.7.6 The contractor shall prepare a contribution card in Form-3A for EPF in respect of every employee in his employment at the commencement of the contract or who is taken into employment after that date and who is required or entitled to become or is a member of the fund including those who produce an account Number and in respect of whom no fresh Declaration Form is prepard Provided that in the case of any such employee who has become a member of the family pension fund under the Employees’s Family pension Scheme, 1971, the aforesaid Forms shall also contain such particulars as are necessary to comply with the requirements of that scheme.

45.7.7 The Contractor shall maintain such accounts in relation to the amounts contributed to the EPF by him and by his employees as the EPF authority, from time to time, direct, and it shall be the duty of the contractor to assist in making payments from the EPF Department to his employees.

45.7.8 The Contractor shall, within seven days of the close of every month, submit to the BSNL a statement showing the recoveries of contributions in respect of employees employed by him and shall furnish to BSNL such information as is required to furnish under the provisions of the EPF Act.

45.7.9 The Contractor shall permit to its employee, on request, the inspection of his contribution cards to him or any person duly authorized by him with in 72 hours of making such request provided that such request is made once in every two months.

45.7.9 The Contractor shall provide a pass book to every employee and maintain the same as per rules framed under EPF Act.

45.7.10The Contractor shall provide ESI Cards to its employees as expeditiously as possible as but not later than 15 days from start of the contract.

45.7.11The Contractor shall furnish copies of returns filed from time to time in compliance of provisions of Contract Labour (Abolition & Regulation) Act, EPF Act, ESI Act, etc.

45.7.12As per new procedure introduced by the EPF and ESI DEPARTMENTS regarding payment of EPF and ESI Contributions electronically the contracters have to submit monthly ECR in respect of the payment of EPF Contributions with full details and monthly contribution history in respect of ESI Contributions of his workers containing the names of the workers employed for the work.

45.8. Employment CardThe contractor shall issue an Employment Card in the form XIV of CL (R&A) central Rules

1971 to each worker within three days of the employment of the worker.45.8.1 Service certificate

On termination of employment for any reason whatsoever the contractor shall issue to the workman whose services have been terminated, a service certificate in the form XV of the CL (R&A) central Rules 1971.

45.8.2 Power of labour officer to make investigations or enquiryThe labour officer or any person authorised by the central government on their behalf shall have power to make enquiries with a view to ascertaining and enforcing due and proper observance of fair wage clauses and provisions of these Regulations. He shall investigate into any complaint regarding the default made by the contractor in regard to such provision.

45.8.3 Report of investigating officer and action thereonThe labour officer or other persons authorised as aforesaid shall submit a report of result of his investigation or enquiry to the Engineer-in-charge indicating the extent, if any to which the default has been committed with a note that necessary deductions from the contractor’s bill be made and the wages and other dues be paid to the labourers concerned. The Engineer-in-charge shall arrange payment to the labour concerned within 45 days from the receipt of the report from the labour officer or the authorised officer as the case may be.

45.9 Inspection of Books and Slips.The contractor shall allow inspection of all the prescribed labour records to any of his workers or to his agent at a convenient time and place after due notice is received or to the Labour Officer or any other person, authorised by the Central Government on his behalf.

45.10 Submission of ReturnsThe contractor shall submit periodical returns as may be specified from time to time.

45.11 Amendments.The Central Government may from time to time add to or amend the regulations and on any question as to the application / interpretation or effect of those regulations.

45.12 INSURANCE:Without limiting any of his other obligations or liabilities, the contractor shall, at his own expense, take and keep comprehensive insurance including third party risk for the plant, machinery, men, material etc. brought to the site and for all the work. The contractor shall also take out workmen’s compensations insurance as required by law and under take to indemnify and keep indemnified the Government from and against all manner of claims and

demands and losses and damages and cost (including between attorney and client) charges and expenses that may arise in regard the same or that the BSNL may suffer or incur with respect to and / or incidental to the same. The contractor shall have to furnish originals and /or attested copies as required by the BSNL of the policies of insurance taken within 15 days of being called upon to do so together with all premium receipts and other papers related thereto which the BSNL may require.

45.13 COMPLIANCE WITH LAWS AND REGULATIONSDuring the performance of the works the contractor shall at his own cost and initiative fully comply with all applicable laws of the land and with any and all applicable by laws, rules, regulations and orders and any other provisions having the force of law made or promulgated by the Government , Governmental agency or department, municipal board, Government of other regulatory or authorised body or persons and shall provide all certificates or compliance therewith as may be required by such applicable law. By laws, rules, regulations, orders and/ or provisions. The contractor shall assume full responsibility for the payment of all contributions and pay roll taxes, as to its employees, servants or agents engaged in the performance of the work specified in the contractor documents. If the contractor shall require any assignee or sub contractor to sham any portion of the work to be performed hereunder may be assigned, sub- leased or sub contracted to comply with the provisions of the clause and in this connection the contractor agrees as to undertake to save and hold the Government harmless and indemnified from and against any/all penalties, actions, suits, losses and damages, claims and demands and costs( inclusive between attorney and client) charges and expenses whatsoever arising out or occasional, indirectly or directly, by failure of the contractor or any assignee or subcontractor to make full and proper compliance with the said by laws, rules, regulations, laws and order and provisions as aforesaid.

46. QUERIES ON BID DOCUMENTS:A prospective bidder, requiring any clarification of the Bid Documents shall notify the Department in writing or by fax, not later than 7 days prior to the date for the opening of the bids. Copies of the query (Without identifying the source) and the clarifications by the department shall be uploaded on our website www.ntproj.bsnl.co.in and all such clarifications issued by the Department will form part of the bid document.

47. PAYMENT OF BILLS: -(i) The contractor will submit the bills on monthly basis after making payment of person

employed for the work upto 10th day of next month against actual work completed and duly verified by concerned officer in charge of BSNL in the planning office to process for final payment. The bill shall be paid through cheque on availability of fund. Proof of Payment of EPF, ESI and Service Tax of previous month shall be enclosed compulsory with the bill alongwith the names of employees. In respect of EPF payments contractor shall provide the copies of contribution cards maintained in respect of each employee after every two months alongwith bills. Now the EPF and ESI contributios are being paid electronically hence contractor shall have to submit following with the monthly bills: -

a. The contractor shall have to submit ECR (Electronic Challan cum Return) every month with the bills, except first month bill, along with relevant details of employees. This will be essential so as to verify and check the remitted amount status along with the names of employees for whom the contractor establishment has remitted the amount.

b. ESI Contributions of the employees shall be remitted to ESIC authorities every month and paid copy of the ESIC Challan alng with ESIC Contribution History taken from ESIC website

shall have to be submitted every month with the bills, except first month bill, along with names of employees for whom the contractor establishment has remitted the amount.

c. ESI Cards of all the employees shall be submitted with the first month bill without which bills will not be paid.

d. Above documents may be verified through the concerned department if found false action will be taken as penal clauses of the bid documents.

(ii) Service Tax should be indicated in bill separately on each bill. The contractor is not supposed to execute work beyond the agreement amount without

written permission of the TDM BSNL, Hajipur as conveyed by designated officer.48. RISK & COST: - In the event of the contractor failing to execute the work to the satisfaction of the BSNL. The

BSNL reserves the following rights:-(a) To reject any part of the work executed and with hold payment of such inferior

Quality of the work, till such time the defects are rectified to the satisfaction of the BSNL.

(b) In case the contractor does not perform to the full satisfaction of the BSNL after giving one-month notice his contract shall be terminated after the lapse of one month. The decision of the BSNL shall be final and binding on the contractor.

Note:- If any one of the above document, required to be submitted alongwith the technical bid, is found wanting, the offer is liable to be rejected at that stage. However, the BSNL at its discretion may ask for the submission of any clarification within stipulated time period. In such case(s), the bidder shall have to comply the BSNL requirement within the specified time. In case of non-compliance to such queries, the bid will be out rightly rejected without entertaining further correspondence in this regard.

49. The grievances of the bidders who have participated in bidding process will only be entertained.

50. The estimated cost of work is as mentioned in the Notice Inviting Tenders, which has been worked out based on standard schedule rates mentioned in this tender document. The actual value of work may vary based on the actual requirement but generally being limited to + /- 50% of the indicated value.

51. The TDM BSNL, Hajipur reserves the right to extend the tender with same cost, same terms and conditions beyond one year.

52. ARBITRATIONIn respect of any dispute arising out in connection with the misinterpretation of any clause

in the terms & conditions of the contract as well as agreement, the matter shall be refereed to Chief General Manager, Bihar Circle to decide the case by appointing an arbitrator. The appointment of such an arbitrator shall not be questioned by the contractor on the ground that the arbitrator belongs to the Bharat Sanchar Nigam Limited.

The provision of the arbitration & Conciliation Act-1996 or any statuary modification or reenactment thereof and the rules made there under and for the time being in force shall apply to the arbitration proceedings under this clause.

SECTION VIII

PERFORMANCE SECURITY GUARANTEE BOND

1. In consideration of the TDM BSNL Hajipur (hereinafter called BSNL) having agreed to exempt ___________________ (hereinafter called ‘the said contractor(s)’) from the demand under the terms and conditions of an agreement/Advance Purchase Order No ________________ dated ____________ made between _____________________ and __________________ for the supply of _______________________ (hereinafter called “the said agreement ”), of security deposit for the due fulfillment by the said contractor (s) of the terms and conditions contained in the said Agreement, on production of the bank guarantee for _____________________________________we, (name of the bank) _________________________ ( hereinafter refer to as “the bank”) at the request of ___________________________________ (contractor(s) do hereby undertake to pay to the BSNL an amount not exceeding ___________________ against any loss or damage caused to or suffered or would be caused to or suffered by BSNL by reason of any breach by the said Contractor(s) of any of the terms or conditions contained in the said Agreement.

We under take to pay to the BSNL any money so demanded notwithstanding any dispute or disputes aised by the contractor(s)/supplier(s) in any suit or proceeding pending before any court or tribunal relating thereto our liability under this present being absolute and unequivocal. liability for payment there under and the contractor(s)/supplier(s) shall have no claim against us for making such payment.

4. We (name of the bank)_________________________ further agree that the guarantee herein contained shall remain in full force and effect during the period that would be taken for the performance of the saidagreement and that it shall continue to be enforceable till all the dues of the BSNL under or by virtue of the said Agreement have been fully paid and its claims satisfied or discharged or till ________________________(office/Department) BSNL certifies that the terms and conditions of the said Agreement have been fully or properly carried out by the said contractor(s) and accordingly discharges this guarantee. Unless a demand or claim under this guarantee is made on us in writing on or before the expiry of TWO/TWO AND HALF/THREE YEARS (as specified in P.O) from the date hereof, we shall be discharged from all liabilities under this guarantee thereafter.

5. We (name of the bank)_________________________ further agree with the BSNL that the shall have the fullest liberty without our consent and without affecting in any manner our obligations hereunder to vary any of the terms and conditions of the said Agreement or to extend time of performance by the said contractor(s) from time to time or to postpone for any time or from time to time any of the powers exercisable by the BSNL against the said Contractor(s) and to forbear or enforce any of the terms and conditions relating to the said agreement and we shall not be relieved from our liability by reason of any such variation, or extension being granted to the said Contractor(s) or for any forbearance, act or omission on the part of the BSNL or any indulgence by the BSNL to the said Contractor(s) or by any such matter or thing whatsoever which under the law relating to sureties would, but for this provision, have effect of so relieving us.

6. This guarantee will not be discharged due to the change in the constitution of the Bank or the contractor(s)/supplier(s).
