Subject: Approve “Development Variance Permit 2014-066”
Staff Recommendation THAT Council approve “Development Variance Permit PL2014-066”, a permit to reduce the required front yard building setback from 6.0m to 4.5m for Lots 5 and 6, District Lot 2710, Similkameen Division Yale District, Plan KAP84202, located at 2983 and 2985 Partridge Drive, to accommodate a single detached dwelling on each lot. AND THAT staff are directed to issue “Development Variance Permit PL2014-066” Background Both subject properties are part of the Partridge Drive subdivision created in 2009 (Attachment A). The Partridge Drive subdivision is a hillside subdivision and features lots with steep grades. The two lots in question both taper down sharply from the street level, which allows for houses with walk out basements. In the case of 2983 Partridge Drive, the back 1/2 of the lot is covered by a no-build, environmental protection area, which currently features a strand of trees (Attachment ‘B’). In the case of 2983 Partridge, the lot is pie shaped, making it difficult to build a traditional single detached dwelling within the required setbacks. In both cases, a reduction in the front yard setback would create a better building footprint for a traditional house in the style seen in the area. Council has supported similar variances to other lots in this subdivision. Most recently, Council supported a front yard variance to 2987 Partridge Drive, to accommodate a house that is currently under construction. That property in directly adjacent to the two subject properties and was granted the same variance being requested through this application. The applicant has not provided actual plans for the lots at this time, as the applicant is marketing the lots for sale and is not yet building on them. The properties however should be expected to be built in the style of the already under construction and completed housing of the area. A standard set of plans have been provided for reference (Attachment C).

Proposal The applicants are requesting a development variance permit to vary Section 10.1.2.5 of Zoning Bylaw 2011-23, reducing the minimum required front yard from 6.0m to 4.5m to accommodate the construction of a single family house on each lot. Financial implication N/A Analysis Approve When considering a variance to a City bylaw, staff encourages Council to consider whether there is a significant site constraint that exists on the property that makes following the bylaw difficult or impossible; whether approval of the variance would cause a negative impact on neighbouring properties; or, if the variance request is a reasonable one. In this case, the applicant is siting a few hardships that make meeting the bylaw difficult. On the first lot, there is an abundance of fill on the lot and an environmental protection area in the back 1/2 of the lot. These two factors, requires pushing the building closer to the street if a traditional sized house is to be constructed on the lot. On the second lot, the shape of the lot makes it difficult to build a proper sized house. In regard to the impact on the neighbouring properties, staff feel there will be little impact. Sometimes when a front yard setback is reduced it can have the effect of the house ‘sticking-out’ from the rest of the street. In this case though, the two lots are on an arc in the street and the minor reduction in the setback will hardly be noticeable. Also, the neighbouring property 2987 Partridge Drive made a similar application for a reduction in front yard setback from 6.0m to 4.5m for similar reasons. That house is now under construction. Given the above, staff feel that the variance requests are reasonable and that Council should support the application and direct staff to issue the permits. Deny or Refer Council may not feel that the variances are not warranted and that approval of the variances will change the nature of the neighbourhood. Council may also not wish to approve the variance without plans attached. If either of those two scenarios are the case, Council should deny the variance application. Alternatively, Council may support the variance for one lot but not the other lot. Alternate recommendations THAT Council support “DVP PL2014-066” with conditions that Council feels appropriate.
