URBAN SETTING DESIGNATION FORTHE FORMER KOCH MATERIALS, LLC FACILITY

AKRON, OHIO

Public notice is hereby given that the Ohio Environmental Protection Agency (Ohio EPA)has received, on August 24, 2007, a request to approve an Urban Setting Designation(USD) for approximately 0.98 acres of land, located at 990 Hazel Street, Akron, Ohio. Thisrequest was submitted by Mr. Randy Bishop and Shaw Environmental, Inc., on behalf ofThe Former Koch Materials, LLC.

Pursuant to Ohio Administrative Code 3745-300-10(D), Ohio’s Voluntary Action Program(VAP) allows for the voluntary cleanup of contaminated property in Ohio without the riskof state civil liability. Under the VAP, ground water cleanup is required where contaminatedground water poses risks to the community or environment.

A USD may be requested for properties participating in the VAP when there is no currentor anticipated future use of ground water by local residents for drinking, showering,bathing, or cooking. In these areas, an approved USD would lower the cost of cleanup andpromote economic redevelopment while still protecting public health and safety.

Ohio EPA’s director may approve the request for a USD based on a demonstration by thecertified professional that the USD requirements are met and that an evaluation of existingor future uses of ground water in the area have been assessed.

PUBLIC NOTICENOTICE OF RECEIPT OF A 401 APPLICATION

Public notice is hereby given that the Ohio Environmental Protection Agency (Ohio EPA)Division of Surface Water (DSW) has received an application for, and has begun toconsider whether to issue or deny, a Clean Water Act Section 401 certification for a projectto construct a 20.6 acre mixed office/retail/hotel development. The application wassubmitted by NP Limited Partnership, 8800 Lyra Drive, Suite 550, Columbus, Ohio 43240.The project is located at the northeast corner of the Worthington Road and PolarisParkway Intersection, City of Westerville, Delaware County, Ohio. The Huntington DistrictCorps of Engineers Public Notice Number for this project is LRH-2006-115-SCR. The OhioEPA ID Number for this project is 083335.

As required by the Anti-Degradation Rule, three alternatives have been submitted for theproject. The applicant’s proposed preferred alternative, if approved, would impact 1,548linear feet of intermittent stream and 0.316-acre of Category 1 wetlands. The applicant’sproposed minimal degradation alternative, if approved, would impact 1,548 linear feet ofintermittent stream. The applicant’s proposed non-degradation alternative, if approved,would have no direct impacts on waters of the state.

The discharges from the activity, if approved, would result in degradation to, or loweringof, the water quality of unnamed tributaries and adjacent wetlands of Alum Creek. Thereview of the application will be conducted, and a decision whether to grant or deny theapplication will be made, in accordance with Chapters 3745-1 and 3745-32 of the OhioAdministrative Code (OAC). In accordance with OAC 3745-1-05, an anti-degradationreview of the application will be conducted before deciding whether to allow a lowering ofthe water quality. Other alternatives resulting in lesser or no degradation of lowering ofwater quality will also be considered by Ohio EPA during the review process.

No exclusions or waivers, as outlined by 3745-1-05 of the Anti-Degradation Rule, apply ormay be granted by the Director of Ohio EPA.

OHIO EPA RECEIVES NEW HAZARDOUS WASTE CLOSURE PLAN

On March 25, 2008, Ohio EPA received a new hazardous waste closure plan from PortagePlating concerning container storage, tank storage, and land application units located at9596 State Route 43, Streetsboro, Ohio 44240. The EPA Identification Number for thisfacility is OHD981001217.

Why is Portage Plating submitting this Closure Plan?At the request of Ohio EPA, Portage Plating submitted the closure plan. This closure planis intended to replace revision number one prepared in March 2006 which addresses: 1)Plating Building, 2) Drum Storage area; 3) Waste Storage Tank and associated secondarycontainment; and, 4) Swale Area. This closure plan also incorporates the Sampling andAnalysis Plan previously approved, and fulfills the requirements found in Ohio EPA’sConsent Order and Final Judgment filed in July 2006. Additionally, the plan provides abrief discussion of air emissions, decontamination efforts, closure cost estimates, and theclosure plan’s schedule and certification procedures.
