4.a Status update and consideration of the Class "B" Beer and "Class B" Liquor License for G5 Brewing Company, LLC, located at 1895 Gateway Blvd, Beloit, WI, Lee Gunderson, Agent. Mr. Gunderson was present and asked to step forward. G5 Brewing Company, LLC was granted a Class “B” Beer and “Class B” Liquor License located at 1895 Gateway Blvd, Beloit for the license period August 21, 2017 to June 30, 2018. The license has not been issued due to construction not being complete. City Ordinance 31.04(3) states that Where the City Council has granted a license, but the license has not been issued because construction, renovation or code compliance is not completed in 6 months, the City Council may rescind the license at a regular Council meeting after notice to the licensee and opportunity for the licensee to be heard. Since Construction has not been completed, Mr. Gunderson will need an extension and is seeking recommendation for a 6 month extension from the ABLCC. Moved by Mary Campbell – Seconded by Ron Tilley to recommend a six-month extension as presented to the City Council. Motion carried 6 – 0. compliance check. Agent Gravitt was present and came forward with the store owner Raj Patel.

Lt. Sayles explained that in partnership with Youth to Youth, on February 26, 26 businesses were checked for compliance and Clark Gas Station was one of four to be cited for “licensee selling to underage person.” He asked agent Gravitt if he was aware of the violation when it occurred. Lt. Sayles asked what Clark Gas Station would be doing in the future to make sure they don’t incur more violations. Mr. Gravitt explained that the registers are capable (and were capable at the time of the violation) of scanning the ID’s to ensure they are of age and now all employees are being trained that ID’s must be scanned before selling alcohol. This is a company-wide policy that employees are to scan ID’s before selling. Owner Raj Patel indicated that this employee didn’t ask for ID and that is why the policy failed. He also indicated that the employee cited was quite new. Lt Sayles informed the committee that this is their second violation in three years. Assistant City Attorney Bruce informed Mr. Gravitt that a second violation within a 12-month period would result in the sanction against the license held by Clark Gas Station. Assistant City Attorney Bruce further indicated that Mr. Gravitt should understand that the City Council takes violation of the underage alcohol laws very seriously and that a second violation within a 12-month period could result in lengthy suspension of between 10-60 days. Assistant City Attorney Bruce encouraged Mr. Gravitt to be diligent with staff training and instill in the staff the severity of the repercussions that can result from additional violations.

4.c Consideration of an incident February 26, 2018, at Badger Spirits, 2621 Prairie

Avenue, Alice Blue, Agent for a sale to an underage person during an alcohol compliance check. Ms. Blue was present and asked to come forward.

Lt. Sayles asked agent Blue if she was aware of the violation when it occurred. The person who didn’t check the ID has worked for the company for six years and has held an Operator’s License since 1973. This is her first violation and she has been counseled and retrained. Lt. Sayles asked what Badger Spirits would be doing in the future to make sure they don’t incur more violations. Ms. Blue explained that the registers are capable (and were capable at the time of the violation) of scanning the ID’s to ensure they are of age and now all employees are being trained that ID’s must be scanned before selling alcohol. Lt Sayles informed the committee that this is their second violation in three years.

Assistant City Attorney Bruce informed Ms. Blue that a second violation within a 12-month period would result in the sanction against the license held by Badger Spirits. 4.d Consideration of an incident February 26, 2018, at Beloit Mobil, 1902 Shopiere

Road, Harjinder Samra, Agent for a sale to an underage person during an alcohol compliance check. Agent Samra was present as well as store manager Melissa Mc Adory, 2306 Boulder Lane, Beloit.

Lt. Sayles agent Samra if he was aware of the violation when it occurred. He indicated he was and deferred to Ms. Mc Adory to answer the specific questions. Lt. Sayles asked what Beloit Mobil would be doing in the future to make sure they don’t incur more violations. Ms. Mc Adory explained that the registers are capable (and were capable at the time of the violation) of scanning the ID’s to ensure they are of age and now all employees are being trained that ID’s must be scanned before selling alcohol. This is a company-wide policy that employees are to scan all ID’s before selling. She indicated that this employee didn’t ask for ID and that is why the policy failed. She also overrode the register. Lt Sayles informed the committee that this is their first violation. Ms. Mc Adory stated this employee was suspended and retrained prior to her returning to work. She also stated the entire staff was refreshed in their training as a result of this violation.

Assistant City Attorney Bruce informed Mr. Samra that a second violation within a 12-month period would result in the sanction against the license held by Beloit Mobil. Assistant City Attorney Bruce further indicated that Mr. Samra should understand that the City Council takes violation of the underage alcohol laws very seriously and that a second violation within a 12-month period could result in lengthy suspension of between 10-60 days. Assistant City Attorney Bruce encouraged Mr. Samra to be diligent with staff training and instill in the staff the severity of the repercussions that can result from additional violations

4.e Consideration of an incident February 26, 2018, at Tobacco Shack, 1212

Cranston Road, Jignesh Desai, Agent for a sale to an underage person during an alcohol compliance check. Store manager Tom Lindaas, 4323 Oldwyck Dr, Janesville, appeared on behalf of agent and store owner Jignesh Desai, who was out of the country.

Lt. Sayles asked agent Lindaas if he was aware of the violation when it occurred. Lt. Sayles asked what Tobacco Shack would be doing in the future to make sure they don’t incur more violations. The employee was suspended for 30 days and was retrained. The key personnel are undergoing recertification as a result of this incident. Signage has been increased. Mr. Lindaas explained that the registers are capable of entering the Date of Birth to ensure they are of age and now all employees are being trained that ID’s must be checked for anyone under 40 years old. The company does not have register scanners at this time. Lt Sayles informed the committee that this is their second violation in two years.

Assistant City Attorney Bruce informed Mr. Lindaas that a second violation within a 12-month period would result in the sanction against the license held by Tobacco Shack. Assistant City Attorney Bruce further indicated that Mr. Lindaas should understand that the City Council takes violation of the underage alcohol laws very seriously and that a second violation within a 12-month period could result in lengthy suspension of between 10-60 days. 5) CHANGE OF AGENT

5.a Consideration of a Change of Agent on the Class "B" Beer and "Class B" Intoxicating Liquor License for Beloit Snappers, Beloit Professional Baseball Association, Inc., located at 2301 Skyline Drive from Seth Egan Flolid to Steven Tyler Unser for period ending June 30, 2018. Beloit Snappers, Beloit Professional Baseball Association, Inc., located at 2301 Skyline Drive, Beloit has requested to change their agent from Seth Egan Flolid to Steven Tyler Unser for license period ending June 30, 2018. A complete application with fees has been submitted to the Clerk’s office. Lt. Sayles indicated that he has check municipal and state criminal records. To the best of his knowledge, with the available information, the character, record and reputation are satisfactory and he has not objection to the agent appointed. Assistant City Attorney Bruce asked Mr. Unser to reaffirm his understanding that he can be personally held responsible for any violations that occur on the property, even when he is not physically present on the premises. Mr. Unser stated that yes, he understands his responsibility. Moved by Ron Tilley – Seconded by Jerome Jennings Recommend COA as presented. CITY OF BELOITREPORTS AND PRESENTATIONS TO ABLCC

Topic: Annual Applications for Beer/Liquor Licenses 2018-2019

Overview/Background Information

The laws defining and regulating the sale, procurement, dispensing and transfer of alcoholic beverages is regulated byWis. State Stats Chapter 125 and Chapter 31 of the General Code of Ordinances for the City of Beloit. Annually, andpremise engaging in the sale, procurement, dispensing and transfer of alcoholic beverages must make application to theCity of Beloit for annual renewal of their appropriate liquor license(s).

ALL licenses shall expire on June 30 of each year and a renewal process is necessary to maintain operations. Therenewal process in the Clerk’s office begins March 15 when letters are mailed to current license holders with a renewalapplication (AT-115), Auxilliary Questionaire (AT-103), instructions for filing with clerk and a list of applicable fees.They are asked to return the paperwork and pay the publication fee by April 15, 2018. The list is assembled and broughtto Council for referral to the ABLCC upon which a recommendation to the City Council is made at the 1st meeting inJune.

City Ordinance 31.04 – Approval by City Council states:

No new retail alcohol beverage license, other than a temporary Class "B" or "Class B" license, shall be granted except bya majority vote of the members present at a meeting of the City Council. In determining the suitability of an applicant,consideration shall be given to the responsibility of the applicant, the appropriateness of the location, the premisesproposed and generally, the applicant's fitness for the trust to be reposed in him/her. In addition, the applicant shallpossess the qualifications required by §125.04(5), Wis. Stats.

Key Issues

1. The Municipal Clerk is responsible for receiving all applications for timely referral to ABLCC

2. The Municipal Clerk must publish all applications (this list will publish May 3, 4 & 7, 2018)

3. The ABLCC will act on this list at the May 8, 2018 regular meeting. Upon committee recommendation, this list will

return to the Council for approval at the June 4, 2018 regular meeting.

4. The Municipal Clerk will issue check sheets and inspection forms to pertinent parties, collect all fees and upon

successful completion of the application checklist, will issue a new annual license to be effective July 1, 2018 – June30, 2019.

5. By July 15, 2018, the Municipal Clerk is responsible for submitting a list containing the name, address, trade name,type of license and name of agent to the Department of Revenue.

CLASS “A” BEER

Class “A” licenses are for the sale of fermented malt beverages from premises within the municipality and authorizes retail sales of fermented malt

beverages for consumption off the premises where sold and in original packages, containers and bottles. See State Statute 125.25 for more.

125.51(2)(e) allows the granting and issuing of a “Class A” Cider license to applicants whose retails sales of intoxicating liquor is limited to cider and

already hold a Class “A” license for the same premise. There is no additional cost for the Cider license. “Cider” means any alcohol beverage that is

obtained from the fermentation of the juice of apples or pears that contains not less than 0.5 percent alcohol by volume and not more than 7.0 percent

alcohol by volume. “Cider” includes flavored, sparkling, and carbonated cider.

Overview/Background Information

Walmart Supercenter #2532, located at 2785 Milwaukee Road, Jeffrey Scheuerell, agent, has submitted a completeapplication for renewal of their Class “A” Beer and “Class A” Intoxicating Liquor License with the existing premisedescription. Upon receipt of that renewal, they submitted a request to amend their premise description to include theirnew grocery pick up service area.

Key Issues

1. Walmart Supercenter #2532, located at 2785 Milwaukee Road, Jeffrey Scheuerell, agent, has submitted acomplete application for renewal of their Class “A” Beer and “Class A” Intoxicating Liquor License

2. The applicant is seeking to amend their premise description from 1 room, 1 story, approximately 200,084 sq. ft.to 1 room, 1 story, approximately 200,084 sq. ft. including stalls and/or canopy locations in parking lotspecifically designated for online grocery pickup

3. It was confirmed with Planning Director Drew Pennington that a Conditional Use Permit would not be needed toamend the premise description

4. This is a trending function among Walmart and Woodman’s Grocery in WI and I’ve included an article writtenfrom the League of Wisconsin Municipalities offering assistance with lawfully addressing this request

5. Walmart has included their procedure guide and drawings with their request to amend application6. Walmart would like to rollout their program on or around June 21st, before the existing license expires June

30th; therefore, action will be necessary to accommodate the current license and the renewal.7. This matter is coming before the ABLCC on May 8th for recommendation and will proceed to the City Council on

May 21st for action
