PROCEEDINGS OF THE BELOIT CITY COUNCIL 100 State Street, Beloit WI 53511 City Hall Forum – 4:00pm Tuesday, October 9, 2018 1) ROLL CALL

Chairperson Metter called the meeting to order at 4:00 p.m. and welcomed Mr. Jeff Klett to the committee as appointed by the School District of Beloit as the School Board representative. Present: Malissa Cronin, Jeff Klett, John Metter, Ron Tilley, Tara Tinder Absent: Jerome Jennings Vacant: 1 seat Staff: Assistant City Attorney Patrick Bruce, Lt. Sayles and Lt. Elrod

2) APPROVAL OF THE MINUTES 2.a Moved by Ron Tilley – Seconded by Malissa Cronin to approve the Minutes of

the regular meeting of August 14, 2018 as presented. Motion carried 6-0. Attachment

3) PUBLIC COMMENT

Alice Blue, 2621 Prairie Ave, Beloit spoke as the owner of Badger Spirits where she holds a Class “A” Beer and “Class A” Liquor license. She is opposed to the license being considered today at 2648 Prairie Avenue stating this area currently has a high density of locations available for the purchase of alcohol. She shared some facts and figures (via handout provided to committee members) that in her opinion support her opposition and asked the ABLCC to deny the application.

Fran Fuzen, 1726 Garfiled Ave, Beloit stated he is also opposed to the license being considered today at 2648 Prairie Avenue. He believes that there are enough outlets in this area and additional outlets this close to Aldrich Middle School could cause problems in the community.

Debbie Fischer, 416 College St, Beloit spoke as the representative of Youth2Youth 4 Change and stated she is also opposed to the license being considered today at 2648 Prairie Avenue. The mission of her organization is to reduce substance abuse among youth and promote healthy lifestyles through education and advocacy. She stated there are plenty of liquor outlets in the community.

4) LICENSES

4.a Consider Application for a new Class "A" Beer and "Class A" Intoxicating Liquor License for Nicholas Freddy Lerma, d/b/a Nico's Convenience and Liquor store, located at 2648 Prairie Avenue. 1. Nicholas Freddy Lerma d/b/a Nico’s Convenience & Liquor Store is opening a

business at 2648 Prairie Avenue, (formerly Fiesta Cancun restaurant), in the City of Beloit and is requesting a Class “A” Beer and “Class A” Intoxicating Liquor License for the license period ending June 30, 2019.

2. A complete application with fees has been submitted to the Clerk’s office and

is being referred to the ABLCC for their October 8th agenda by the City Council on October 1st via the consent agenda.

3. The City Council adopted a Resolution approving a Conditional Use Permit to allow a drive-in use in a C-2, Neighborhood Commercial District at their October 1, 2018 meeting. However, the motion to approve struck condition #3 from the Resolution stating “alcohol is prohibited from being sold through the drive-through window.”

4. The customer/applicant has specifically excluded the sale of alcohol through the drive-up window on his alcohol license application.

5. This application will return to the City Council for final action at the October 15, 2018 regular meeting.

Lt. Sayles indicated that he has checked municipal and state criminal records. To the best of his knowledge, with the available information, the character, record and reputation are satisfactory and he has not objection to the agent appointed or the license being granted. Assistant City Attorney Bruce asked Mr. Lerma about his residency here in Wisconsin per Chapter 125 requiring the applicant to live in Wisconsin at least 90 days prior to application. Mr. Lerma stated he signed a lease with a friend in the beginning of March but still owns a home in Illinois and is in the process of selling that home as a result of divorce. Mr. Lerma was asked about employment and he stated he has done construction and remodeling for almost 20 years. Attorney Bruce asked why he waited to apply for a Wisconsin license for seven months. He stated that he has had a lot of items to get done. Attorney Bruce stated that state law requires you to notify change of address within 60 days. Assistant City Attorney Bruce asked Mr. Lerma to reaffirm his understanding that he can be personally held responsible for any violations that occur on the property, even when he is not physically present on the premises. Mr. Lerma stated that he understands his responsibility. Moved by Tara Tinder – seconded by Ron Tilley to deny the application. Ms. Tinder asked to qualify her motion and included concerns regarding the density of alcohol establishments within the proximity of the applicant’s property as well as in the City overall. She was opposed to the Walgreens in that neighborhood years ago. Motion carried 4-1 with Jeff Klett voting opposed. 5) CHANGE OF AGENT

5.a Consideration of Change of Agent on the Class "B" Beer and "Class B" Intoxicating Liquor License for Board of Trustees of Beloit College d/b/a Beloit College - Pearsons Hall, located at 700 College Street from John Winkelmann III to Ken Hnilo for period ending June 30, 2019 Lt. Sayles indicated that he has checked municipal and state criminal records. To the best of his knowledge, with the available information, the character, record and reputation are satisfactory and he has not objection to the agent appointed. Assistant City Attorney Bruce asked Mr. Hnilo to reaffirm his understanding that he can be personally held responsible for any violations that occur on the property, even when he is not physically present on the premises. Mr. Hnilo stated that yes, he understands his responsibility. Moved by Malissa Cronin – Seconded by Ron Tilley to recommend approval of the change of agent as presented. Motion Carried 5-0.

Assistant City Attorney Bruce asked Ms. Klimowicz to reaffirm her understanding that she can be personally held responsible for any violations that occur on the property, even when she is not physically present on the premises. 6) COMMITTEE COMMENTS Chairperson Metter attended the joint workshop with the ABLCC and City Council on

September 10 that reviewed the parameters and changes to Chapter 31 of the Code of General Ordinances in the City of Beloit. This was a good meeting in his opinion and he found it informative for moving forward.

Overview/Background Information

G5 Brewing Company, LLC was granted a Class “B” Beer and “Class B” Liquor License located at 1895 Gateway Blvd,Beloit for the license period August 21, 2017 to June 30, 2018. The license was issued an extension of six months onApril 16, 2018 due to construction not being complete.City Ordinance 31.04(3) states that Where the City Council has granted a license, but the license has not been issuedbecause construction, renovation or code compliance is not completed in 6 months, the City Council may rescind thelicense at a regular Council meeting after notice to the licensee and opportunity for the licensee to be heard.Since construction has still not been completed, Mr. Gunderson will need another extension for compliance and toavoid having his license revoked/non-renewed.

Key Issues

1. G5 Brewing Company, LLC was granted a Class “B” Beer and “Class B” Liquor License located at 1895 GatewayBlvd, Beloit for the license period August 21, 2017 to June 30, 2018.

2. Ordinance 31.04(3) states: Where the City Council has granted a license, but the license has not been issuedbecause construction, renovation or code compliance is not completed in 6 months, the City Council mayrescind the license at a regular Council meeting after notice to the licensee and opportunity for the licensee tobe heard.

3. It has been past precedent that if the 6 month window expired, the applicant would appear before the ABLCC topresent a status update and seek an extension if necessary. The ABLCC would hear the update and make arecommendation to the Council on whether or not an extension was warranted. Mr. Gunderson will need anextension and is seeking recommendation for a 6 month extension from the ABLCC.

4. The ABLCC reviewed this license in April 2018 and recommended approval for a six-month extension thatCouncil granted on April 16, 2018. That extension has now expired and Mr. Gunderson has indicated that he willneed another extension as the business construction is not complete.

5. Staff recommends granting an extension to accommodate completion of this business.

CITY OF BELOITREPORTS AND PRESENTATIONS TO ABLCC

Topic: 2018 Year End Liquor License Report to the ABLCC

Overview/Background Information

2018 was a year of learning as a result of bringing our processes in line with State Statute Chapter 125 and an effort toupdate Chapter 31 of the Code of General Ordinances. We’ve had discussion about the parameters and qualificationsneeded to obtain Operator (Bartender) licenses as well as a lot of discussion about the total number of liquor licensesand types in the City of Beloit.

Key Issues

1. At the November 5, 2018 City Council Meeting, Councilor Jacobsen asked for a workshop to learn more aboutour licensing process and the laws surrounding.

2. The first document is being provided to you today. Attached is a list of the liquor licenses by type currentlyissued in the City of Beloit as well as a color coded map showing their location. On each type, you’ll notice thestate law as to what that license is limited to and whether or not there is a quota attached.

3. In a future workshop the council will discuss the current Ordinance and quota limits on each license type byexploring other municipalities and reviewing research and feedback from professionals in the field.

4. Also at the workshop, Councilor Jacobsen is seeking a 5-year history of businesses who have been ticketedduring our alcohol compliance checks.

5. We are looking at January 14th for that workshop – mark your calendars and plan on attending if you’d like tolearn more about alcohol licensing.

CLASS “A” BEER (16)

Class “A” licenses are for the sale of fermented malt beverages from premises within the municipality and authorizes retail sales of fermented malt

beverages for consumption off the premises where sold and in original packages, containers and bottles. See State Statute 125.25 for more.

125.51(2)(e) allows the granting and issuing of a “Class A” Cider license to applicants whose retails sales of intoxicating liquor is limited to cider and

Class “B" Beer licenses are for the sale of fermented malt beverages from premises within the municipality and may authorize an official or body of the

A “Class C" license authorizes the retail sale of wine by the glass or in an opened original container for consumption on the premises where sold. A “Class

C" license may be issued to a person qualified under s. 125.04 (5) for a restaurant in which the sale of alcohol beverages accounts for less than 50

percent of gross receipts and which does not have a barroom or for a restaurant in which the sale of alcohol beverages accounts for less than 50 percent

of gross receipts and which has a barroom in which wine is the only intoxicating liquor sold. A “Class C" license may not be issued to a foreign

corporation, a foreign limited liability company or a person acting as agent for or in the employ of another.
