    1. What is an application for provisional release to the court? Suchapplicationisforprovisionalreleasewithoutbail,orwith

    bail,orwithbailandsecuritysubmittedtothecourttoconsiderfor areleaseofanaccusedoradefendantforaspecifiedperiodoftime.

    2. Is filing of an application for provisional release complicated? Notatall,apublicrelationsofficeroftheCourtofJusticemay

    provideinformationonstepsofapplicationforprovisionalreleaseand

    helptheapplicantsinfillingoutapplicationform.1Theapplicants2may

    seekanyadviceandmakeanapplicationforprovisionalreleaseforthe

    accusedordefendantbythemselvesatallstepsandthepublicrelations

    6.6 Whentheprofessionalpractitionersuchasmedicaldoctor,

    pharmacist,nurse,engineer,architect,auditor,teacher,massmediaand

    communicationpractitionerisanaccusedordefendantforthecharge

    resultingfromtheperformanceofsuchdutyorpractice,he/shemayuse

    personalpledgeforbailbondnotmorethan15timesofcurrentsalaryor

    averagemonthlyincome.

    7. How to surrender the security for bail? 7.1 Incaseofusinglandtitledeed,NorSor3orNorSor3Kor,

    itisnecessarytoobtainthepriceappraisalletterbeingissuedwithinthe

    periodnotmorethan6monthsfromprovinciallandofficeorfromthe

    districtofficewherethelandislocated.Thepriceappraisalletterissued

    byprovinciallandofficemustbecertifiedbytheprovinciallandofficer

    oractingprovinciallandofficeroranyauthorizedofficer.Ifissuedby

    districtoffice,suchlettermustbecertifiedbythedistrictchiefofficer ordistrictclerkactingfordistrictchiefofficerordistrictlandmanaging

    officer.

    7.2 Incaseofusingthebankaccountbook,itisnecessaryto enclosethebanklettercertifyingthecurrentbalanceintheaccount fromthebranchwheretheaccountisopened,withthestatementto theeffectthatbankwillnotallowanywithdrawalfromsuchaccount unlessinstructedotherwisebythecourt.

    7.3 Incaseofusingpersonalpledgeasspecifiedin6.5as security,itisnecessarytoobtaincertificationletterfromtheirorganization

    indicatingcurrentpositionholding,levelofsalaryscaleandthisshould

    beclearlyspecifyingforwhomthebailisposing.Incasewherethereis

    anypledgeinotherbailapplicationortheuseofpersonalpledgeforother

    person,thelettershallindicatesuchpledge.

    7.4 Incaseofusingthecarregistrationormotorcycleregistration documentassecurity,thecarormotorcyclehastobeinspectedand appraisedbycourtofficer.

    7.5 Incaseofusingaresidentialhouse,theapplicantshould

    presentapictureofsuchhouseandaletterofappraisalissuedbythe

    subdistrictheadmanorvillageheadman.

    7.6Incaseofusingthesecurityundermortgageoranycharge, theapplicantmustshowthatthepriceofthesecurityexceedingtheamount ofthemortgageoranychargeissufficienttocoverthebail.

    7.7 Wheretheparentsposebailfortheirchildren,thecourtmay

    grantbailwithoutsecurities.Theparentsmustprovidesufficientproof

    oftheirrelationship.

    Remark Incasesecuritysubmittedisinsufficienttocovertheamount ofbailspecifiedbythecourt,thecourtmayallowtheapplicanttobring additionalsecuritywithinthetimespecified.

    8. Means to authorize someone to submit the application for provisional releaseTheownerofthesecurity,whowishestoauthorizesomeone

    tosubmittheapplicationforprovisionalrelease,mustexecutethepower

    ofattorneyatthedistrictofficewheretheownerlivesorthesecurity

    islocated.Suchpowerofattorneymustbecertifiedandattestedwith thesignatureofthedistrictchiefofficeroractingofficertogetherwith

    authorizedpositionsealaffixed.Thepowerofattorneymayalsobemade

    beforethecourtofficer.Indoingso,thepersonalidentificationcardor

    governmentofficeridentificationcardandcopyofhouseholdregistration

    oftheappointorandappointeemustbepresented.However,somecourts

    maynotallowtheownerofthesecuritytoappointanyonetosubmit thefirstapplicationforprovisionalreleaseonhis/herbehalf.Somecourts

    maygrantprovisionalreleaseonlyincasewheretheownerofthesecurity

    isarelativeofthepersonforwhomthebailisposed,inordertoprevent

    thefraudulentactionbyexploitingotherpersonspropertyinbail.

    9. How to use a certification letter from an insurance company as security? Theuseofcertificationletterissuedbyaninsurancecompanyas

    securityforbailorbailpolicycantake2forms:

    Form 1 : freedom insurance before offence is committed Itistheinsuranceforanypersonwhowishestomakeanadvance securityforbailbecauseofhavingriskorpotentiallycommittingany

    criminaloffencebynegligence,e.g.driver,physician,construction contractor.Suchpersonmayusethecertificationlettertoapplyinthe

    courtforhis/herownapplicationforprovisionalrelease.

    Form 2 : freedom insurance after offence is committed Whenapersonischargedtobeanaccusedoradefendantand

    wishestohaveanysecurityforbail,suchperson,friendorrelatives

    maycontacttheinsurancecompanytobuyfreedominsuranceandthe companywillissueapolicyandcertificationletterfortherequired amount.Suchcertificationlettercanbeusedassecurityforbailinthecourt. Ingeneral,theapplicantcanusefreedominsuranceforalloffences excepttheoffencerelatedtothedistributionofdrugsandnarcotics. Afterobtainingtheinsurancecertificate,theapplicantshouldcheck againstthename,familyname,offence,amountforbail,etc.for thecorrectness.Whentheprovisionalreleasehasbeengranted,thecourt mustnotifytheinsurancecompanyfortheamountofbailwithout delay.

    Thereisalsoanothertypeofinsurancesocalledthebailinsurance forvehicledriverwhichtheinsurancecompanyprovidesadditional protectioninadditiontothevoluntarycarinsurance.Thecertificateof thistypeofinsurancecanbeusedassecurityforbailofthedriveras

    well.

    Remarks Insurancecompanymayrefundtheinsurancepremiumtothe

    applicantasfollows:

    (1) freedominsurancebeforetheoffenceiscommitted:itisonly

    refundablewhentheinsureepassesawayandthereisnoclaimduring theprotectionoftheinsurance.

    Iftheinsureeonceusestheinsurancecertificatebutnotupto

    thefullinsuringamountasstatedintheinsurancetable,theinsureemay

    requestanewinsurancecertificatefortheremaininginsuringamount bynotificationinwritingtotheinsurancecompany;

    (2) freedominsuranceaftertheoffenceiscommittedis refundableon5groundsasfollows:

    a. ifthecourtdeniesprovisionalrelease,theinsurance companyshallrefundtheinsureeforthepremiumwithdeductionfor managementchargeof500baht.

    Remark Incaseofbeingnotcertainwhetherthecourtwillgrant

    provisionalreleaseornot,theapplicantshouldsubmitanapplicationfor

    provisionalreleasebeforebuyinginsurance.Whentheprovisionalrelease

    isgranted,theapplicantthenbuysthefreedominsurance;

    b. ifthecourtgrantsprovisionalreleasebutatthelatertime

    duringtheinsurancecoveragethecourtwithdrawsorrevokesprovisional

    releaseortheapplicantdoesnotwishtobail,theinsurancecompanyshall

    refundattherateof20%ofthepremium;

    c.iftheinsureediesduringtheprotectionoftheinsurance withoutbreachofbailcondition,theinsurancecompanyshallrefundat

    halfofthepremiumtotheheiroftheinsuree;

    d. iftheinsureedoesnotbreachanybailconditionuntil theexpirationoftheinsurabletime,theinsurancecompanyshallrefund

    at20%ofthepremium;

    e.iftheinsureealreadyusedtheinsurancecertificatebut

    notuptotheamountassetundertheinsurancetable,theinsurance companyshallrefundremainingpremiumbycalculatingtheportionwhich ismorethanliabilityundergrantedprovisionalrelease.

    10. Can the securities from previous provisional release in other stages be used? 10.1 Incaseofcashorothersecuritysurrenderedasbail security

    Theaccusedordefendant,whohasalreadybeengranted

    provisionalreleaseattheinquiryofficialorpublicprosecutorandstill

    notrequestsuchsecurityretrieval,ifwished,maycontinuetoapplyfor

    provisionalreleaseandsubmittheapplicationtothecourttotakesuch

    cashorsecurityassecurityforbail.

    10.2 Incaseofpersonalpledgeasbailsecurity

    Suchpersonmayrequestthecourttotakesuchpersonas

    16. On what grounds shall the court deny the application for provisional release? Thecourtshallexercisehis/herdiscretiontodenyprovisional

    releaseonlyuponanysubstantialgroundforbelievingasfollows:4

    (1) theaccusedordefendantislikelytoabscond;

    (2)theaccusedordefendantwouldinterferewiththewitness orevidence;

    (3)theaccusedordefendantwouldcommitfurtheroffenceand otherdanger;

    (4)theapplicantorsecurityisnotcredible;

    (5)ifprovisionalreleaseisgranted,thiswillcauseanobstruction ordamagetotheinvestigationoftheofficerortheproceeding atthecourt.

    17. How many types of order for provisional release?Thereare3typesasfollows:

    17.1releasewithoutbailwhichisareleaseonbailwithoutbail

    bondandsecurity.Inthiscase,theaccusedorthedefendantshallbe requiredtomake,beforebeingreleased,anoathoraffirmationundertaking

    thathe/sheshallappearasappointedoraccordingtothesummons;

    17.2releasewithbail:whenprovisionalreleasehasbeengranted

    withbail,theapplicantshallberequired,beforereleasetakingplace,to

    signthebailbondundertheconditionsthattheaccusedorthedefendant

    shallfollowthecourtinstructionandappearfortrialorwritofsummons, iftheaccusedorthedefendantfailstocomplysuchconditionsthe applicantwillbefinedfortheamountsetunderbailbondandthecourt

    mayorderfurtherconditions;

    18. Is there a case where the provisional release has been granted without bailor or an applicant? Ifthereisnobailororapplicant,thecourtshall,normally,not

    orderprovisionalreleaseoftheaccusedordefendant.However,ifthe

    accusedordefendantisajuvenile,thejuvenileandfamilycourtsshall

    haveapowertograntprovisionalreleasewherethereisnobailoror applicantasthecourtdeemsexpedientunderthegroundsasfollows:

    (1) thejuvenileisincustodyatthejuvenileobservationand protectioncenteroranyotherplacesentrustedtokeepthe juvenileincustody;

    (2) thecourtmay,ifitdeemsexpedient,releasethejuvenile withoutbail,withbail,withbailandsecurityorentrustthe juveniletothecareofparents,guardian,thepersonwith whomthejuvenileisresidingortothepersonorinstitution thecourtdeemsexpedient;

    (3) beforethecourthasanordertoentrustthejuvenileto thecareofsuchpersonorinstitutionasmentionedabove, thecourtshallaskthedirectorofthejuvenileobservation andprotectioncenterortheguardianinchargeoftheplace entrustedtokeepthejuvenileincustody,asthecasemaybe, forhis/heropinion.

    Duringtheinvestigationorthetrialofthecourtoffirst

    instance,ifthecourtoffirstinstanceissuestheordernotgranting provisionalreleasewhichisfiledbytheaccused,defendantorany interestedperson,theapplicant5hastherighttofileappealmotionagainst

    suchorderorfilethenewapplicationforprovisionalrelease.Anew applicationshould,however,havereasonablegroundforthecourtto

    amendthepreviousorder.

    19.2 Timelimitforfilinganappeal

    Incasetheprovisionalreleasehasnotbeengranted,it

    canbeappealedbytheaccusedordefendantatanytimeevenafterone

    monthfromthedatethatthecourtorderhasbeengiven(accordingto theSupremeCourtorderno.617/2528).

    19.3Wheretolodgeanappeal

    Theappealshallbelodgedwiththecourtoffirst instance.

    19.4 WheretopronouncetheorderoftheCourtofAppealor aregionalcourtofappeal

    WhentheCourtofAppealoraregionalcourtofappeal issuesanorder,suchordershallbeforwardedtothecourtoffirst instanceforpronouncementtotheaccusedordefendantandthe appellantwithoutdelay.

    19.5 Whentheprovisionalreleasehasnotbeengrantedbythe

    CourtofAppealoraregionalcourtofappeal

    IftheCourtofAppealoraregionalcourtofappealissues

    theorderconfirmingtheorderofnotgrantingprovisionalreleaseofthe

    courtoffirstinstance,suchorderoftheCourtofAppealortheregional

    courtofappealshallbefinal.But,itshallnotdebartherighttoapplya

    newapplicationforprovisionalrelease.

    20. How to apply for provisional release during the proceedings of the Court of Appeal or a regional court of appeal? Afterthecourtoffirstinstancehaspronouncedthejudgment,

    nomatterthesentenceisdeathpenalty,imprisonment,confinement,or

    detentionfortraininginthetraininginstitution,ordismissthechargebut

    detaindefendantduringtheproceedingsinappeallevelorconfinement inlieuoffine,thesekindsofdetentionsrendertherighttofilean applicationforprovisionalrelease.

    appeal? 20.2.1Incasewherethecourtoffirstinstancehas pronouncedthejudgment,nomatteranappealhasnotbeenlodgedor anappealhasalreadybeenlodgedbutthecasefilehasnotbeensent totheCourtofAppealoraregionalcourtofappeal,theapplication forprovisionalreleaseshallbelodgedatthecourtoffirstinstance wherejudgmentisgiven.Inthiscase,ifthecourtoffirstinstancedeemsexpedienttograntaprovisionalreleaseduringanappeal,thecourtof firstinstanceshallhaveapowertograntaprovisionalrelease.Incontrast, ifthecourtoffirstinstancedeemsitisnotappropriatetogrant aprovisionalrelease,thecourtshall,withoutdelay,sendtheapplicationwiththecasefiletotheCourtofAppealoraregionalcourtofappeal forconsideration.Thecourtoffirstinstancecannotdenyaprovisionalreleaseduringanappealbyitself.

    IncasewheretheCourtofAppealoraregionalcourtof

    21. How to apply for provisional release during the proceedings of the Supreme Court? Theapplicationforprovisionalreleaseduringtheproceedings

    oftheSupremeCourtcanbefiledincasewheretheCourtofAppealor aregionalcourtofappealsentencesfordeathpenalty,imprisonment,

    confinement,ordetentionfortraininginthetraininginstitution,dismisses

    thechargebutdetainsduringtheproceedingsoftheSupremeCourtor thedefendantisunderconfinementinlieuoffine.

    21.1 Theeligiblepersonstoapplyforprovisionalreleaseduring

    theproceedingsoftheSupremeCourtare:

    21.1.1thedefendant;

    21.1.2anyinterestedperson(e.g.parents,descendant,

    notbeenlodgedoranappealhasalreadybeenlodgedbutthecasefile hasnotbeensenttotheSupremeCourt,theapplicationforprovisional

    releaseshallbelodgedatthecourtoffirstinstancewherejudgmentis

    given.Inthiscase,ifthecourtoffirstinstancedeemsexpedientto

    grantaprovisionalreleaseduringtheproceedingsoftheSupremeCourt, thecourtoffirstinstanceshallhaveapowertograntaprovisionalrelease.

    Incontrast,ifthecourtoffirstinstancedeemsitisnotappropriatetogrant

    aprovisionalrelease,thecourtshall,withoutdelay,sendtheapplication

    withthecasefiletotheSupremeCourtforconsideration.Thecourtof

    firstinstancecannotdenyaprovisionalreleasebyitself.

    21.2.2Ifthecourtoffirstinstancehasalreadysent thecasefiletotheSupremeCourt,theapplicationmaybelodgedatsuch courtoffirstinstanceordirectlytotheSupremeCourt.Ifitislodgedat thecourtoffirstinstance,thecourtshallsendtheapplicationto theSupremeCourtforfurtherconsideration. 21.3Whentolodgeandhowmanytimescantheapplicationbelodged? AslongastheSupremeCourthasnotpronounced thejudgment,theapplicationcanbelodgedatanytime.Inaddition,if theSupremeCourtdoesnotgrantprovisionalrelease,theapplication maybereappliedwithoutlimit.Itshould,however,containreasonable groundstoamendthepreviousSupremeCourtorder.

    21.4 ThepronouncementoftheSupremeCourtorder

    WhentheSupremeCourtissuesanorder,suchorder

    shallbeforwardedtothecourtoffirstinstanceforpronouncementto theappellant.Inthiscase,thecourtoffirstinstanceshallnotify theaccusedorthedefendantandtheapplicantwithoutdelay.

    22. What are the duties of the bailor? Thebailormustbringtheaccusedorthedefendanttoappear

    beforethecourtonthescheduleddate.Thebailormaydelegateanyone tobringsuchpersontoappearbeforethecourtaswell.Inthiscase, thebailormustusetheproxyformobtainingfromthepublicrelations officer.Iftheaccusedorthedefendantappearsbeforethecourt withoutthebailor,itisnotdeemedasbreachofprovisionalreleasebut itisdeemedthatthebailoracknowledgesthecourtorderandthenextdate ofanappearance.

    Ifthebailisgrantedwithconditions,e.g.theaccusedor thedefendantmustreporthimself/herselftotheinquiryofficialor thecourtofficial,theaccusedorthedefendantandthebailormustcomply

    23. If the accused or the defendant absconds or is likely to abscond, what should the bailor do? Thepersonenforcedbythebailconditions6mayseektheassistance fromthenearestadministrativeofficerorpolicetoarresttheaccused

    orthedefendant.Incasewherethereisnosuchassistance,suchperson

    shallhaveapowertoarresttheaccusedorthedefendant.Afterarresting, suchpersonshallsendtheaccusedorthedefendanttothenearest administrativeofficerorpolice.

    24. What is the consequence if the bailor fails to bring the accused or the defendant to appear before the court? Thefailuretobringtheaccusedorthedefendanttoappearbefore thecourtwithoutreasonablegroundsisabreachofbailconditions. Thecourt,then,shallorderthebailor,enforcedbythebailconditions,for

    finepaymentandseizethesecuritiestoauctionifthefineisnotpaid.

    Remark Ifbailor,enforcedbythebailconditions,canbringtheaccused

    orthedefendanttoappearbeforethecourtwithoutdelay,thecourtshall

    adjustthefinepaymentattheamountasitdeemsappropriate.

    25. How can bailor appeal the fine payment order? Incasewherethereisanybreachofbailconditionandthecourt

    offirstinstancehasanordertoenforcethebailconditions,theperson

    whoisenforcedorthepublicprosecutorcanappealsuchcourtorderto

    theCourtofAppealoraregionalcourtofappealwithinonemonthfrom

    thedateonwhichhe/sheacknowledgessuchcourtorder.Thisappeal

    isfreeofchargeandthereisnorestrictiononappeal.Thejudgment oftheCourtofAppealoraregionalcourtofappealisfinalandunable tobeappealedtotheSupremeCourt.
