PROSPECTUS FOR FIVE YEARS INTEGRATED B.A. LL.B. (HONS) COURSE (CHOICE BASED CREDIT SYSTEM)

1. INTRODUCTION

History of Legal Education in the State of Odisha started in the year 1869 when the diploma in law course for

Pleadership licence was introduced in the Ravenshaw Collegiate School, Cuttack. Subsequently the course

continued in the Ravenshaw College, In the year 1881, Bachelor of Law Course was introduced in the same College

under the Calcutta University. Subsequently Bihar and Odisha was separated and Ravenshaw College remained

under the territorial jurisdiction of Patna University. After formation of Odisha as a separate Province in 1936, the

Govt. Of Odisha established Utkal University which started functioning from 27th

November, 1943.This University

took over the Bachelor of Law classes continuing in the Ravenshaw College as its first teaching Department having

converted the same into a full-fledged College with its present nomenclature naming it as “Madhusudan Law College”

to perpetuate the memory of late Utkal Gourab Madhusudan Das. From 20th

July, 1949 it is functioning in its own

campus which is very near to the Cuttack Railway Station.

M.S. Law College in course of time became the premier taw teaching institute not only of the State but of the

country as well. This institution had tremendous contribution in the field of legal education in the State of Odisha by

producing eminent Jurists, Lawyers and Law Teachers who have brought name and fame to the institution and also

for the nation.

This College was functioning in two shifts i.e. morning and evening. Due to pressing demand, a third-shift was

started in the institution during the academic session, 1971-1972. As there was no law college at Bhubaneswar, the University shifted the evening shift of M.S. Law College to the Utkal University campus and named it as “Vanivihar

Law College” from 1974. In the course of time the nomenclature was changed and at present it is functioning in the

name of “University Law College” at Vanivihar, BBSR. Both the colleges enjoy the status of constituent Colleges and

are directly managed by the University and functioning as full time institutions. M.S. Law College, Cuttack is offering

3 years LL.B. (H) under Choice Based Credit System ( CBCS), 5 year Integrated B.A. LL.B.(Hons.) and LL.M.

course, where as University Law College, Vani Vihar, Bhubaneswar is offering only 3 years LL.B (H) under Choice

Based Credit System (CBCS), 5 year Integrated B.A. LL.B. (Hons.) course and LL.M. in Human Rights. Both the

Institutions are having their reputation at national and international levels.

The idea to introduce specialized five years Integrated Law Course originated at the All India Law Minister‟s

and Secretary‟s Conference held on 24th September, 1995 at Bhubaneswar. In response to the resolution of the said Conference, the Utkal University started five year Integrated B.A.LL.B. (Hons.) Course in both the Constituent

colleges from the academic session,1997-98. Since the 2014-15 Academic Session the Choice Based Credit System

has been introduced in the 5 year Integrated B.A. LL.B. (Hons.) Course.

To monitor this specialized course, a High Power Committee has been constituted with a sitting Judge of the Hon‟ble High Court of Orissa as its Chairman alongwith the Vice-Chancellor of Utkal University, Chairman of State

Bar Council, Representative of Bar Council of India, Teachers and other Officers of the Utkal University as its

members. The curriculum is designed as per the guidelines prescribed by the Bar Council of India and the University

Grants‟ Commission, New Delhi. 2. PROGRAMME OFFERED

Utkal University is imparting the Five year Integrated B.A.LL.B.(Hons.) Course at its two constituent Colleges

i.e. Madhusudan Law College, Cuttack and the University Law College, VaniVihar, Bhubaneswar. The course has

been designed in the same line taking into account the standards prescribed by the UGC

and Bar Council of India, New Delhi. This course is at par with the syllabus prescribed by leading Universities/Law Schools in India offering Five Year Integrated B.A., LL.B. (Hons.) Programme in law. 03. STUDENT STRENGTH

The students strengths is as follows:

M.S. Law College, Cuttack 60 seats

University Law College, Vani Vihar, BBSR 60 seats

4. ELIGIBILITY REQUIREMENTS

A candidate shall be eligible for admission into 5-yr B.A.LL.B (Hons.) Course, If he/she has passed +2 Examination (at least 10+2 pattern) securing a minimum of 45% marks in aggregate for General category and 40% marks for SC/ST category.

5. APPLICATION PROCEDURE

5.1 : Candidates seeking admission into 5 year B.A. LL.B (Hons.) Degree Course shall apply in the prescribed

form obtainable from the office of The Principal, Madhusudan Law College, Cuttack - 753 003 or The

Principal, University Law College, VaniVihar, Bhubaneswar- 751004 on payment of Rs.500/- (Rupees Five Hundred) only in cash or by post by sending a Bank Draft of Rs.600/· (Rupees Six Hundred) only

drawn in favour of the respective Principals. Candidates shall write their full name on the back of the Bank Draft. Application forms can be downloaded from the college website- www.mslawcollege.org

and www.universitylawcollegebbsr.org.

5.2 : The application form duly filled in by the candidate shall reach the office of the Principal at respective Colleges on or before the last date mentioned in the advertisement/notification. The forms can be

submitted either by person or by post. The institution shall not be held liable for any postal delay.

The following documents are to be attached along with the Application Form:

i) Attested copy of HSC/SSC or equivalent Certificate and Marksheet.

ii) Attested copy of CHSE/SSE Certificate & Marksheet.

iii) Attested copy of Conduct Certificate from the Institution last attended.

iv) Attested copy of Caste Certificate in case of SC/ST category.

v) Four Passport size (2.5cm x 3.5 cm) photographs signed be candidate.

vi) Two self-addressed Envelope size 12" X 5".

vii) Original Money Receipt of the Application Form. 6. ADMISSION PROCEDURE

Selection of the students shall be made strictly on the basis of career -cum-entrance test with the following break-up of marks:-

1. H.S.C./Equivalent 20 Marks

2. +2 Arts/Science/Commerce/Equivalent 30 Marks

3. Entrance Test (General English & G.K) 50 Marks

7. SELECTION FOR ADMISSION

Selection for admission will be made on the basis of a career-cum-entrance test. Out of the total 100 points, career evaluation would carry 50 points and entrance test would carry 50 points.

7.1: Career Evaluation: ·For career evaluation, the performance of a candidate both in the H.S.C. as well as

that in the +2 or equivalent examination shall be taken into consideration. Out of the 50 points, 20 points

are earmarked for H.S.C. Examination and 30 points for +2 examination.

7.2 : Entrance Test: The Entrance Test which carries 50 points includes 100 questions on General

Knowledge, General English and Reasoning. The time period for the test is for one hour only.

7. 3: Intimation: Intimation for admission will be sent to the selected candidates in order of merit from the merit

list by Speed Post/Regd. Post. The selected list will also be notified in the Notice Board and website of

both the colleges. 8. RESERVATION

Reservation of seats will be as follows:

1. 16.25% of the seats for the SC and 22.50% for ST (interchangeable). In case of non-availability of candidates in one of these categories, seats will be filled up from the candidates of the other category.

2. 3% of the total number of seats will be reserved for physically handicapped students at the time of

admission. In case of non-availability, the seats will be filled-up from the merit list.

3. 1% of the seats for son / daughter of Ex - Servicemen.

4However the reservation is subject to rules framed by the Govt. of Odisha from time to time. 9. COURSE FEE

Each candidate is required to pay a Sum of Rs. 35000/· (Rupees Thirty five thousand) only per annum towards course fee at the time of admission in shape of Bank Draft drawn in favour of the Principal of respective colleges

where he is admitted. However, the course fee is subject to change in accordance of the decision of the High Power

Committee/ University which will be intimated to the candidates sufficiently ahead of their re-admission. 10. COURSE STRUCTURE

B.A. LL.B (Hons.) Degree shall be awarded to candidates on successful completion of ten semesters. In ten

semesters, there shall be 60 papers with 6 papers in each semester carrying 100 marks. The course structure of the programme will have 360 credits in ten semesters as explained below:·

N.B. : Besides core and elective credit courses, there shall be summer Internship (4-6 weeks) for the students of 3rd

Year and 4th Year as Audit Courses. The Audit Courses shall not be taken into account for calculation of credit

or ranks etc. The Teacher‟s Council of respective colleges shall work out the details. · 11. DURATION OF SEMESTER

Each Semester shall not be less than 15 ·weeks duration with not less than 30 class hours per week including tutorials, moot room exercise and seminars provided there shall be at least 24 lecture hours per week. 12. ATTENDANCE

a. As per the Common Minium Standard (CMS) Guidelines 2013-2014 issued by the Government of Odisha communicated Vide No. 21474 (H.E dtd. 21.08.2013) the duration of one period of general class shall be at least for 45 minutes.

b. A candidate in order to qualify him /her self to appear the Semester Examination shall have to secure at least 75% of classroom attendance in each paper of that Semester.

c. A candidate who represents the Institution in any lnternational/National/State level Academic Sports

Competition with prior permission of the Principal shall be awarded with 15% class room attendance

during that Semester.

d. A candidate, who has secured 60% to 74% of classroom attendance due to illness, may submit a Medical Certificate from a Regd. Medical Practitioner for adjustment of deficit attendance. ·

e. The Principal shall enjoy the prerogative to award 10% of classroom attendance to a candidate. ·

13. SYSTEM OF EXAMINATION

Each course paper shall be of 100 marks. For evaluation, the overall structure of the distribution of marks in a theory based course shall be such that 20 Marks shall be allotted to Internal Assessments during the semester, while 80 Marks shall be allotted for the End Semester Examinations. For Theory and Activity Based Courses, the

examination system shall be different as per details given below: 1. Theory Course

The scheme of examination for theory course shall include:

A.InternalAssessment

i. The Internal Assessments in theory courses will comprise of written test and Viva-Voce, Such assignment shall carry 20 Marks, of which 10 Marks will be For Written Test and 10 Marks for Viva-

Voce. There will be no internal assessment in paper -VI of both IXth and Xth Semester Examination.

ii. The Written and Viva-Voce of the Internal Assessment shall be conducted by the teacher concerned, on a date fixed by the Principal. The concerned teacher shall submit the result of Internal Assessment to the Principal who shall forward the same to the Controller of Examinations, Utkal University.

iii. Where a candidate fails to take examination in any one or more subject or having taken the examination

has failed to secure the minimum pass marks in any one or more subjects or in the aggregate, his

Internal Assessment marks shall be carried forward to the subsequent examination. The absentee or failed candidate shall have to clear all examinations within next two consecutive years. Besides a

candidate securing less than 35 mark in a paper including Internal Assessment or less than 50% of the marks in aggregate in the end semester examination may reappear the said examination within the next

two consecutive chances.

B. End Semester Examination and evaluation for 80 Marks

At the end of the each semester, there shall be a University Examination for 80 Marks. 1st, 3rd, 5th, 7th and 9th Semesters will be held in the Month of December and 2nd, 4th, 6th, 8th and 10th Semesters will be

held before the Month of June. The Controller of Examinations, Utkal University shall notify the examination schedule on completion of courses.

3. The Credit System

The credits specified for 5 year B.A. LLB (Hons.) programme describe the weightages of various courses of the

Programme. The number of credits along with grade points that the student has satisfactorily completed measures

the performance of the student. Satisfactory progress of a student is subject to his/her maintaining a minimum

Cumulative Grade Point Average (CGPA), as well as minimum grades in different courses of the programme. A certain number of credits must be earned by the student to qualify for the degree. Description of credit distribution for

Core Courses, Activity Based Courses and Elective Courses has already been shown. · (A) Assignment of Credits:

Credits of a course shall be assigned in the following manner:

(a) For all theory (lecture) courses, one credit shall be assigned for one- hour lecture per week in a semester.

(b) Credits shall be in whole numbers.

(i) Except when otherwise directed by the Regulation or by the examiner in the examination paper, every candidates shall answer questions in English Language in the examination in all the courses.

(ii) Each individual paper shall be of 3 (three) hours duration.

5. Evaluation Pattern:

Non-appearance in I examination (Incomplete)

Explanation: Letter grades 0, E, A, B & C in a course mean that candidate has passed that course.

If a candidate secures minimum of 35 marks in individual paper(s) (Theory+lnternal) but obtains 50% or above marks in aggregate in the end semester examination, such candidate will be awarded Grade according to the percentage. The candidates must secure at least 28 marks out of 80 marks in theory paper.

The F grade denotes poor performance, i.e., failing in the course. A student has to appear at subsequent examination(s}, (next two consecutive chances only) as provided in the regulation in all courses in which he /she obtains “F” grade, until a passing Grade is obtained.

The I Grade is awarded, when a student does not appear in the examination of course/ courses. This shall be treated as “F” Grade.

6. Grace Rule: Grace mark shall be awarded as per the following Guidelines :

1. 1% of the total marks in aggregate can be awarded to a candidate for enabling him/her to pass in a semester examination provided he/she secures minimum 35 marks in individual paper(s).

2. The candidate(s) securing I Grade will not be eligible for grace mark.

3. Grace Mark will not be awarded for making up shortfall in minimum pass mark in individual paper or to

obtain division or in CGPA.

14. DEGREE REQUIREMENTS

A candidate will be eligible for award of B.A. LL.B (Hons.) degree if he/she satisfied the following:

1. Has Secured CGPA 6.0 or more.

2. Has cleared the credit requirements with pass grade or more in each subject.

3. Has at least a satisfactory conduct.

4. Has cleared all the theory, activity based and elective courses of all semesters.

5. Credit requirements for the Degree shall be 360.

6. The passed candidates may be awarded with the division according to the following criteria:

1) First Division with Distinction CGPA 8.5 and above

2) First Division CGPA6.5 and above, but below 8.5

3) Second Division CGPA 6a.0 and above, but below 6.5

Note: The SGPAand CGPA shallbe computed upto 2 places of decimals (truncated at the second place).

The Conversion formula for converting CGPA to the corresponding Percentage of Marks will be as follows:

X= 10 Y- 0.5 Where, X = Percentage of Marks

Y = CGPA

15. RANKING TO THE CANDIDATE

1. Ranking shall be given to only those candidates who pass all the courses of the programme in one attempt.

2. The marks obtained by him/her at the examination shall be considered as the basis for the University

Ranking, Scholarships and other distinctions.

3. In order to get the benefit of this provision the student should claim that he I she is eligible for this

benefit and get a decision in writing after proving his/her eligibility there for. 16. GRADE SHEET

At the end of each even semester, grade sheet shall be made available to each student free of cost. However, if a student requires a duplicate grade sheet heI she should apply to the Controller of Examinations, Utkal University,

VaniVihar, Bhubaneswar in the prescribed format along with the requisite fee.
