Nos encontramos hoy en día que mucha gente alquila pisos, adosados o viviendas a turistas y no saben si lo que hacen es legal o no, si hacer un contrato de arrendamiento o de alojamiento, si darse de alta o no…Estamos ante una nueva realidad económica que paradójicamente el Govern Balear la proscribe. Efectivamente el Govern no sólo da la espalda a la nueva realidad comercial (internet), sino que pretende prohibirla con el juego de la Ley de Arrendamiento Urbano y la Ley de Turismo de les Illes Balears.No obstante ello es poner puertas al campo y no tener una visión del siglo XXI, que finalmente via legislativa o judicial, acabará imponiéndose (de hecho ya hay comunidades autónomas que las han regulado, como por ejemplo Canarias, y otras que han anunciado su regulación como Catalunya).Ahora bien, en tanto en cuanto no esté regula-do, los juristas prácticos y los comercializadores, no nos quedará más remedio que jugar con las herramientas de las cuales disponemos hoy en día, en particular el llamado contrato de arren-damiento de temporada de la LAU y el contrato de alojamiento turístico de la Ley de Turismo de les Illes Balears, aun cuando como se verá de-jan mucho que desear. Sin embargo es lo que tenemosEfectivamente se trata de un tema en donde rei-na la confusión (una confusión deliberadamente propiciada por el legislador), muy discutida tan-to doctrinal como jurisprudencialmente y sobre la que aún no existen pronunciamientos judicia-les definitivos.

¿CÓMO PUEDO ALQUILAR “LEGALMENTE” UN PISO O UN ADOSADO CON FINALIDAD VACACIONAL? PARA BALEARS

Wir sehen uns in mit einer neuen Realität kon-frontiert, die ihren Ursprung sicherlich nicht zuletzt in der Finanzkrise der letzten Jahre hat: Viele Eigenheimbesitzer beabsichtigen heutzu-tage ihre Immobilie, sei es eine Wohnung, ein Reigenhaus oder ein freistehendes Haus an Tou-risten zu vermieten, um sich so den ein oder anderen Euro dazu zu verdienen. Paradoxer Weise verschliesst die Regierung der Balearen die Augen vor dieser neuen Situation und versucht mit dem Gesetz zur Vermietung von urbanem Wohnraum (LAU) und dem Touris-musgesetz der Balearen dieser touristischen Ver-mietung einen Riegel vorzuschieben. Nichts desto trotz ist der Vermietung von Wo-hnraum zu touristischen Zwecken nicht mehr Einhalt zu bieten und über kurz oder lang wer-den sicherlich auch die Gesetzgebung und Re-chtssprechung dieser Tatsache Rechnung tragen müssen, folglich sind einige andere Autonome Regionen Spaniens wie z.B. die Kanaren den Ba-learen bereits um einiges voraus und haben die Ferienvermietung bereits rechtlich geregelt statt zu versuchen, diese vollständig zu unterbinden. Andere Autonome Regionen wie Katalonien ha-ben bereits angekündigt, dem gleichzutun. Bis die Ferienvermietung auf den Balearen eben-falls rechtlich geregelt ist, bleibt den an der Ba-sis praktizierenden Juristen und Betreibern von Ferienvermietungen lediglich, mit den uns zur Verfügung stehenden Mitteln zu jonglieren: auf der einen Seite die Kurzzeitvermietung wie sie geregelt ist in dem Gesetz zur Vermietung von urbanem Wohnraum (LAU) und der touristischen Unterbringung wie vorgesehen im Tourismusge-setz der Balearen. Beide Möglichkeiten aber, und das werden Sie im Folgenden sehen, lassen einiges zu wünschen übrig. Daher wird die Thematik auch unter den Rechtsgelehrten sehr kontrovers eingeschätzt.

Nowadays, we find ourselves faced with a new reality that certainly has its origins not at least in the financial crisis of recent years: many ho-meowners want to rent out flats or houses to tourists in order to earn some extra money. Paradoxically, the Government of the Balearic Is-land closes its eyes to this new reality and tries to put an end to this situation by means of two different laws: the Urban Rental Act and the Ba-learic Tourism Law ignoring completely the new commercial application of the Internet. Nevertheless, we consider that the rental of re-sidential properties for tourism purposes can no longer be stopped and sooner or later the le-gislation and jurisdiction will be forced to take account of this development. In fact, other Autonomous Regions of Spain such as the Canary Islands have already done an im-portant step ahead and have legally regulated the issue rather than trying to prevent the ren-tals of residential properties for holiday purpo-ses. Other territories have already announced to do so in the very near future. Until the holiday rental will also be regulated by law on the Balearic Island, Until the holiday rental on the Balearic Islands will also be regulated by law, lawyers and opera-tors of holiday rentals only have the chance to juggle with the means at our disposal: on the one hand the short-term rental as they are re-gulated by the Urban Rental Act (LAU) and on the other hand the tourist accommodation regu-lated by the Tourism Law of the Balearic Islands.As you will see below, both options however lea-ve something to be desired. Therefore, this is a matter where confusion is widespread much discussed theoretically, as well as in court and about which there are no firm judicial decisions.

1. ¿Cuál es el punto clave?El punto clave es la naturaleza diferente entre el contrato de alojamiento y el contrato de arren-damiento de temporada. En ambos casos hay una cesión de uso del inmueble (piso, aparta-mento, vivienda, adosado…), pero en el contra-to de alojamiento, también hay prestaciones de servicios (limpieza, reposición de sábanas, man-tenimiento de servicios, servicio de atención al público…).

2. Por lo tanto, ¿se puede alquilar un piso o un adosado con finalidad vacacional?Sí, si consiste en la simple cesión del uso de la vivienda sin que se presten servicios turísticos. Efectivamente se puede alquilar un piso, aparta-mento o adosado mediante un contrato de alqui-ler de temporada contemplado en la LAU.Es aconsejable hacer un contrato de temporada por “escrito” en el que conste que no se prestan servicios turísticos (por lo que conviene excluir el derecho de adquisición preferente del arren-datario y prohibir el subarrendamiento o cesión del contrato).

3. ¿Y si quiero arrendar y prestar servicios turísticos?En este caso estaríamos ante un contrato de alo-jamiento turístico permitido, pero sujeto a im-portantes limitaciones y obligaciones: .- Solo es posible con viviendas unifamiliares y apareados (dos viviendas en un solar), de un máximo de seis dormitorios, doce plazas y que tengan como mínimo un baño por cada tres pla-zas..- Han de ofrecer estos servicios turísticos: lim-pieza periódica, sábanas, ropa y menaje del ho-gar así como la reposición de estos, manteni-miento de las instalaciones, servicio de atención al usuario o turista en horario comercial y de asistencia telefónica 24 horas..- Deberán tener un seguro de responsabilidad civil por daños corporales y materiales..- Se ha de presentar la declaración responsable de inicio de actividad turística.

Wo genau liegt das Problem?Die Problematik liegt in den verschiedenen möglichen Vertragsformen: Es gibt auf der einen Seite die Kurzzeitmietverträge geregelt durch das spanische Gesetz über die Vermietung von urbanem Wohnraum (LAU) und auf der anderen Seite die Unterbringungs- Verträge. Beide Ver-tragsformen haben gemein, dass eine Immobilie (Wohnung, Apartment, frei stehendes Haus oder Reihenhaus etc.) zur Nutzung überlassen wird. Allerdings gehen die Unterbringungs- Verträge ausserdem mit einer Dienstleistung einher wie Reinigung, Handtuch- und Bettwäschewechsel etc.

Kann man also eine Wohnung oder ein Reihenhaus für touristische Zwecke vermietenDie Antwort ist „JA“, wenn es sich um die einfa-che Überlassung der Immobilie zu Wohnzwecken handelt und zwar ohne dass eine weitere andere Dienstleistung angeboten wird. Diese Art der zeitlich beschränkten Mietverträge ist prinzi-piell immer möglich und durch das Gesetz über die Vermietung von urbanem Wohnraum gere-gelt. Es ist absolut ratsam, diese Kurzzeitmietverträge in schriftlicher Form zu schliessen und auss-drücklich darauf hinzuweisen, dass touristische Dienstleitungen definitiv nicht Gegenstand des Vertrages sind. In der Konsequenz sollte auch in dem Vertrag explizit darauf verwiesen werden, dass die Untervermietung, das Vorkaufsrecht des Mieters und die Übertragung des Mietvertrages and Dritte ausgeschlossen sind, andernfalls ste-hen diese Rechte dem Mieter auch bei noch so kurzer Mietdauer zu.

3. Und wenn ich vermieten und gleichzeitig touristische Dienstleistungen anbieten will?In diesem Fall handelt es sich um einen Unter-bringungsvertrag. Diese ist rechtlich anders ge-regelt und gebunden an bedeutende Auflagen und Beschränkungen:Grundsätzlich ist ein derartiger Unterbringungs-vertrag ausschliesslich möglich bei Einfamilien-häusern oder Doppelhäusern (max. 2 Wohnein

In both cases there is a surrender of property (flat, house etc.), but in the accommodation contract the-re are also services provided (i.e. cleaning, bed linen, service maintenance, customer services etc.)

2. Therefore, is it possible to rent a flat or a detached house for holiday purposes?Yes, if it only consists in surrendering the pro-perty without providing additional services. In-deed, it is possible to rent a flat, apartment or a detached house through a holiday rental con-tract in conformity with LAU (Tenancies Act).It is advisable to have a signed season rental contract, where it is noted that no touristic services are being provided (for which is conve-nient to exclude the preferential entitlement of the tenant and prohibit the sublease or transfer of the contract).

3. And what if I want to rent and offer tou-ristic services?In this case, we would be talking about an allowed touristic accommodation contract, which is subject to important limitations and obligations:.- It is only possible with single-family homes and semi-detached (two properties in one plot), with a maximum of six bedrooms, twelve beds (12 people) and they must have minimum one bathroom for every three beds (3 people)..- These touristic services must include: regular cleaning, bed linen, clothing and houseware, as well as their replacement, maintenance of the facilities, customer or tourist service in working hours and a 24 hour helpline..- They must have a liability insurance for perso-nal injury and damage..- They must submit an affidavit for the start of the touristic activity.

4. ¿Se puede comercializar en páginas webs turísticas el arrendamiento de pisos y adosa-dos con finalidad vacacional?Comercializarlo en canales de oferta turística creemos que es muy discutible dada la redac-ción del artículo 5.3 de la LAU, pero publicar en otros medios que no sean canales de oferta tu-rística (periódicos…) consideramos que sí pero ha de constar que se trata de un contrato de arrendamiento de temporada y que no incluye servicios turísticos, ni de atención al usuario.

5. ¿Pueden iniciarme un expediente sancio-nador por el hecho de hacer un contrato de arrendamiento de temporada de carácter va-cacional?Nuestro parecer es que un contrato de arrenda-miento de temporada escrito sin prestación de servicios y sin comercialización en canales de oferta turística, no es sancionable.Ahora bien, esto no quita que la administración pueda iniciar un expediente sancionador en cualquier momento. De hecho la Ley Turística de las Illes Balears es muy expansiva por lo que res-pecta a la tipificación de infracciones. Se ha de tener en cuenta que aunque se pueda impugnar ante los tribunales la sanción, esto no suspende la aplicación de la sanción.

6. ¿Y si los arrendatarios del piso molestan a los vecinos, puede hacer algo la comunidad de propietarios?Sí. La comunidad de propietarios no puede impe-dir que el piso se alquile por temporadas, pero si se acredita que los sucesivos ocupantes del piso causan sistemáticamente continuas y graves mo-lestias al resto de vecinos, se puede demandar judicialmente el cese del uso del piso por un tiempo no superior a tres años en función de la gravedad de la infracción.

Kann ich die Kurzzeitvermietung meiner Immobilie auf einschlägigen Tourismus- Internetseiten anbieten?Wir schätzen das Inserat derartiger Angebote zur Kurzzeit- Ferienvermietung auf Tourismus-Internetseiten vor dem Hintergrund des Geset-zes zur Vermietung von urbanem Wohnraum (Art. 5 E) als problematisch ein. Ein Inserat in anderen Medien (Zeitungen etc.) sollte aber grundsätzlich möglich sein, allerdings dann im-mer mit dem Hinweis, dass es sich um eine Kur-zzeit- Vermietung ohne touristische Dienstleis-tungen oder Kundenservice handelt. Ausserdem ist zu beachten, dass das Tourismusgesetz der Balearen in diesem Zusammenhang die Verwen-dung von Ausdrücken wie „touristisch“, „zu Ur-laubszwecken“ o.ä. verbietet.Das neue kgl. Dekret 20/2015 vom 17. April über die Umsetzung des Tourismusgesetzes sie-ht aber in jedem Fall vor, dass die zuständige Tourismusbehörde der Balearen auf ihrer Inter-netseite eine Liste all derjenigen Kanäle publi-zieren muss, die als Medium der Kommerziali-sierung des Tourismus gelten. Bis zum heutigen Datum ist die entsprechende Liste noch nicht veröffentlicht worden.

4. Is it possible to commercialize the rent of flats and semi-detached houses for holiday purposes on touristic web pages ?We believe that it is very questionable whether to commercialize it in touristic commercial chan-nels, given the wording in Article 5.e of the LAU (Tenancies Act), but we consider that it is pos-sible to advertise in other media, which are not a touristic commercial channel (newspapers…) but it has to be mentioned that the contract is a season rental contract and that it does not in-clude touristic services or any customer services. The law of Tourism of the Balearic Islands does not allow to use the terms of tourism, holiday or similar advertising.The Decree 20/2015 of 17 April of implementa-tion of the Act of Tourism of the Balearic Islands, states that the Balearic Administration have to publish on its website an updated list Channels which are considered as touristic ones, that will be not exclusive. Today is pending publication.

5. Can they initiate an infringement proce-dure for making a season rental contract for holiday purposes? According to our understanding a season rental contract, which does not provide any services or is not commercialized in touristic commercial channels, is not punishable.Nevertheless, the administration can initiate an infringement procedure at any moment. Ac-tually, the Tourist Law of the Balearic Islands is very expansive, relating the classification of infringements. It must be borne in mind that even though the penalty can be appealed in court, this does not suspend the application of the penalty.

6. And if the tenants of the flat bother the neighbours, can the housing association do something? Yes. The housing association cannot prevent the flat from being rented short-term, but if they prove that the successive occupants of the flat cause systematically on-going serious distress to

7. ¿Cómo tributan estos tipos de arrendamientos?En el caso de realizar un contrato de temporada, el ingreso tendrá naturaleza de rendimiento de ca-pital inmobiliario y tributará en la declaración de renta anual del IRPF y la operación no llevará IVA.En el caso de realizar un contrato de alojamien-to turístico, los ingresos tendrán la naturaleza de rendimientos de actividad económica en el IRPF y además deberá cobrarse IVA, por lo que deberán presentar declaraciones trimestrales de pagos a cuenta del IRPF y de IVA.

8. ¿Deben estar de alta como autónomos? En el caso de realizar un contrato de temporada, como quiera que no se considera una actividad empresarial, no será necesario.En el caso de realizar un contrato de alojamien-to turístico, será necesario estar de alta como autónomo siempre que se cumplan los demás requisitos legales de la seguridad social. Los no residentes en España, no pueden darse de alta en el régimen del RETA (autónomos).

5. Kann gegen mich ein Sanktionsverfahren eröffnet werden, wenn ich meine Immobilie zu touristischen Zwecken vermiete?Unserer Auffassung nach kann ein Kurzzeit- Mietvertrag ohne touristische Dienstleistungen und ohne dass diese Vermietung in Tourismus-Internetseiten angeboten wird, nicht sanktio-niert werden. Nichts desto trotz besteht prinzipiell immer die Möglichkeit, dass die Behörde ein solches Sanktionsverfahren eröffnet. Gerade das Touris-musgesetz der Balearen lässt viel Spielraum für mögliche Sanktionen.Sanktionen können in jedem Fall gerichtlich an-gefochten werden, dieses Prozedere jedoch setzt die Zahlung nicht automatisch aus.

In the case of a season contract, as it is not considered a business activity, it will not be ne-cessary.In the case of a touristic accommodation con-tract, it will be necessary to register as self-employed, whenever the rest of the legal, social security requirements are fulfilled. The non-residents in Spain cannot be registered as self-employed (Regime RETA).

6. Was passiert, wenn sich meine Nachbarn gestört fühlen? Kann die Eigentümergemeins-chaft gegen die Vernietung vorgehen?Ja! Die Eigentümergemeinschaft kann zwar die Kurzzeitvermietung der Immobilie nicht verbie-ten, dennoch haben die Nachbarn prinzipiell die Möglichkeit, zeitweise (maximal für drei Jahre) die Kurzzeitvermietung gerichtlich aussetzen zu lassen, sofern die verschiedenen Kurzzeitmieter systematisch und andauernd schwere Beeinträ-chtigungen und Störungen verursachen.

7. Wie sind die Einnahmen zu versteuern?Die Mieten aus Kurzzeitvermietungen gelten als Einkünfte aus Immobilienvermögen und sind als solche in der jährlichen Einkommensteue-rerklärung (IRPF) zu versteuern. Bei dieser Art von Mietverhältnissen fällt keine Mehrwertsteuer an.Bei touristischen Unterbringungsverträgen werden die Mieteinnahmen als Einnahmen aus wirtschaftlicher Tätigkeit gewertet und sind demzufolge ebenfalls in der jährlichen Einkom-mensteuer zu versteuern. Ausserdem muss von den Gästen Mehrwertsteuer erhoben werden. Demzufolge sind pro Quartal Vorauszahlungen zu leisten für Mehrwertsteuer und Einkommensteuer.

8. Muss ich als Selbständiger gemeldet sein?Bei Kurzzeitmietverträgen ist es nicht erforder-lich, dass der Vermieter als Selbständiger gemel-det ist, da e sich bei derartigen Vermietungen nicht um eine unternehmerische Tätigkeit han-delt.
