DEVELOPMENT REVIEW COMMITTEE (DRC) SITE PLAN APPLICATION
PRE-APPLICATION MEETING REQUEST: Prior to formal submittal of a Development Review Committee site plan
application, applicants are encouraged to schedule an appointment with Urban Design & Planning Division
staff to obtain feedback regarding subject proposals, rezoning and right-of-way vacation requests, as well as
any other considerable development projects. This meeting provides the applicant with an opportunity to
obtain feedback and general direction, prior to expending significant effort on design and preparation of
submittal documents.
DEADLINE: Submittals must be received by 12:00 PM each business day. Pursuant to Section 47-24.1(1), the
Department will review all applications to determine completeness within five (5) business days. Applicants will
be notified via email, if plans do not meet the submittal requirements and if changes are required.
FEES: All applications for development permits are established by the City Commission, as set forth by resolution
and amended from time to time. In addition to the application fee, any additional costs incurred by the City
including review by a consultant on behalf of the City, or special advertising costs shall be paid by the
applicant. Any additional costs, which are unknown at the time of application, but are later incurred by the
City, shall be paid by the applicant prior to the issuance of a development permit.

Dear Development Review Committee:
EnviroCare, Inc. represents Co-Applicants: Richard Bolz, the owner of real property located at 1180 N. Federal Hwy #609, Boat Slip #4, Scott Rappoport, the owner of real property located at 1180 N. Federal Hwy #408, Boat Slip #17 and Peter Zupcofska, Title Manager of RIVA 1106 LLC, the owner of real property located at 1180 N. Federal Hwy #1106, Boat Slip #19 for properties in Fort Lauderdale FL, 33304. The Co-Applicants respectfully submit this narrative, ("Narrative"), and request Site Plan Level II to add a boat lift to the boat slips #4, #17 & #19,permitted under Florida Department of Environmental Protection (FDEP) Submerged Land; the "Project".
I. Project Specifics
The Property is located east of US -1 and north of East Sunrise Boulevard. The property is zoned B-1, with an underlying land use designation Multi-Family Residential. A condominium known as RIVA Condominiums (RIVA). RIVA has approximately 412 linear feet of shoreline along the Middle River.
In October 2016, RIVA was granted a Sovereignty Submerged Land Lease (SSLL) from the FDEP to install (1) 2 foot wide concrete seawall cap, (2) a 360 foot X 4 foot wood marginal dock, (3) Eleven (11) 10 feet X 4 feet finger piers and twenty-two (22) permittable boat slips purchased by 22 condominium owners.
The Co-Applicant boat slips #4 and #17 are 16 feet wide and 40.5 feet long and boat slip #19 is 16 feet wide and 35 feet long. The Co-Applicants are looking to install a 4 post 16,000-pound boat lift in their boat slips. The boat lift dimensions are 14 feet X 12.6 feet and extend ±11” above the existing wooden piles on site. Four wood piles will be installed to hold the lift.
Under city code a Site Plan Level II is required before additional boat lifts can be installed at RIVA. Four (4) existing and (1) approved boat lift have been assigned to slips number 2, 9, 10, 11 and 14. Of the five (5) boat lifts, four (4) lifts; boat slips 2,10,11 and 14 were granted dock waiver of distance limitations by the Marine Advisory Board and approved by the City Commission to install piles 5 feet beyond the 25-foot city limitation.
The install of the co-applicant’s boat lifts will provide a positive environmental impact by reducing the amount of boat hull copper bottom paint being releasing into the river.

II. Unified Land Development Regulations Analysis In terms of the development review, the Property and the proposed development project are subject to the following sections of the Unified Land Development Regulations ("ULDR"):

An analysis of the pertinent land use and zoning regulations is below. Boat slips, docks, boat davits, hoists and similar mooring structures Section 47-19.3(b) - (b) Boat davits, hoists and similar mooring devices may be erected on a seawall or dock subject to the following limitations on the number and location The Co-applicants are requesting to add a mooring structure. Four (4) mooring structures exist, and one (1) has a permit pending with City of Fort Lauderdale Building Department, therefore the structure limitation for the property’s 412 feet of shoreline has been reached. The proposed boat lifts will not impede the view from adjacent properties as the slips will continue to moor boats of various sizes. The requested additional mooring device is approved on the waterway and there is not a conflict with a neighboring property owner's usage of the waterway due to the additional mooring device. Section 47-19.3(d) and (e) (d) Mooring or dolphin piles, shall not be permitted to extend more than thirty (30) percent of the width of the waterway, or twenty-five (25) feet beyond the property line, whichever is less. (e) approval by the city commission.
The co-applicants are requesting to add two dolphin piles beyond the twenty-five (25) foot property line limitation. The piles are within the boat slip permitted under the FDEP SSLL. The co-applicants submitted an approval request for a waiver of distance limitation from the City Marine Advisory Board on August 6, 2020.
III. Conclusion
Boat slips on the Property are approved and permitted by the appreciate governmental agencies. Adding boat lifts to the existing boat slips will not create adverse or negative impacts. The addition of additional boat lifts is consistent with the applicable environmental regulations.
Accordingly, the Co-applicants respectfully request a DRC determination that the proposed
boat lifts meet the zoning limitation criteria for a Site Plan Level II approval. If we can provide any additional information, or if you have any questions, please do not

Construction shall be in accordance with the submitted Application, the approved plans and theattached General Conditions. This approval does not authorize impacts to natural resources(mangroves, sea grasses, etc). Failure to comply with the license conditions may result insuspension or revocation of the license and/or enforcement actions.
Issuance of this license does not relieve the licensee from obtaining any other required federal, stateor local permits or authorizations required for this project prior to commencement.

The terms, conditions, requirements, limitations and restrictions set forth herein are accepted bythe licensee and enforceable by the Environmental Protection and Growth ManagementDepartment (EPGMD) pursuant to Chapter 27 of the Broward County Code of Ordinances.EPGMD will review this license periodically and may revoke the license, initiate administrativeand/or judicial action for any violation of the conditions by the licensee, its agents, employees,servants or representatives or principals.
The licensee agrees to comply with Chapter 27 of the Broward County Code of Ordinances, asamended.
Enforcement of the terms and provisions of this license shall be at the reasonable discretion ofEPGMD, and any forbearance on behalf of EPGMD to exercise its rights hereunder in the event ofany breach by the licensee shall not be deemed or construed to be a waiver of EPGMD's rightshereunder.

The disposal of any putrescible or deleterious debris in any water body isprohibited.
This license does not eliminate the necessity to obtain any required federal, state, local or specialdistrict permit/license/approval prior to the start of any activity authorized by this license.

Description: New 16,000lbs (4) post boat lift in the owners slip #19.
The above project has been reviewed and was verified to meet the criteria outlined in Chapter27-336(a) of the Broward County Natural Resource Protection Code for the issuance of thisEnvironmental Resource General License (GL). This approval is specific for the plans anddescription described on this verification. Any changes to project footprint, design or size must bereviewed by the Department and may require additional licensing.
Construction shall be in accordance with the submitted Application, the approved plans and theattached General Conditions. This approval does not authorize impacts to natural resources(mangroves, sea grasses, etc). Failure to comply with the license conditions may result insuspension or revocation of the license and/or enforcement actions.
Issuance of this license does not relieve the licensee from obtaining any other required federal, stateor local permits or authorizations required for this project prior to commencement.
Per Section 27-58(b)(9), "The licensee, by acceptance of this license, specifically agrees to allowaccess and shall allow access to the licensed source, activity, or facility at times to the COUNTYpersonnel for the purposes of inspection and testing to determine compliance with this license andthis chapter."
Broward County General Conditions GL-FTL2007-039(Required for all licenses)
The terms, conditions, requirements, limitations and restrictions set forth herein are accepted bythe licensee and enforceable by the Environmental Protection and Growth ManagementDepartment (EPGMD) pursuant to Chapter 27 of the Broward County Code of Ordinances.EPGMD will review this license periodically and may revoke the license, initiate administrativeand/or judicial action for any violation of the conditions by the licensee, its agents, employees,servants or representatives or principals.
The licensee agrees to comply with Chapter 27 of the Broward County Code of Ordinances, asamended.
Enforcement of the terms and provisions of this license shall be at the reasonable discretion ofEPGMD, and any forbearance on behalf of EPGMD to exercise its rights hereunder in the event ofany breach by the licensee shall not be deemed or construed to be a waiver of EPGMD's rightshereunder.
In addition to the general conditions set forth above, each license issued by EPGMD shall containspecific conditions determined by site conditions and requirements pursuant to the regulations asdetermined by the director of EPGMD. The licensee agrees that specific conditions are enforceableby EPGMD for any violation thereof.
If the licensee wishes to renew a license or extend its term, the licensee shall make applicationsixty (60) days prior to its expiration. Expired licenses are not renewable.
This license does not constitute a waiver or approval of any other license that may be required forother aspects of the total project.
The licensee, by acceptance of this license, specifically agrees to allow access to the licensedsource at reasonable times by EPGMD personnel for the purposes of inspection and testing todetermine compliance with this license and Chapter 27 of the Broward County Code of Ordinances.
This license must be available for inspection on the licensee's premises during the entire life of thelicense.
The issuance of this license does not convey any vested rights or exclusive privileges, nor does itauthorize any injury to public or private property or any invasion of personal rights, or any violationsof federal, state or local laws or regulations.
In the event the licensee is temporarily unable to comply with any of the conditions of the license,the licensee shall notify EPGMD within twelve (12) hours. Within five (5) working days of the event,the licensee shall submit a written report to EPGMD that describes the incident, its cause, themeasures being taken to correct the problem and prevent its reoccurrence, the owner's intentiontoward repair, replacement, and reconstruction of destroyed facilities, and a schedule of actionleading toward operation within the license conditions.
This license is valid only for the specific uses set forth in the license application, and any deviationfrom the approved uses may constitute grounds for revocation and enforcement action by EPGMD.
By accepting this license, the licensee understands and agrees that all records, notes, monitoringdata and other information relating to the construction or operation of this permitted source, thatare submitted to EPGMD, may be used by EPGMD as evidence in any enforcement proceedingarising under Chapter 27 of the Broward County Code of Ordinances, except where such use isprohibited by Section 403.111, F.S.
Any new owner of a licensed facility shall apply by letter for a transfer of license within thirty (30)days after sale or legal transfer. The transferor shall remain liable for performance in accordancewith the license until the transferee applies for, and is granted the transfer of license. Thetransferee shall also be liable for performance in accordance with the license.

Notify the Department in writing a minimum of forty-eight (48) hours prior to project commencementand a maximum of forty-eight (48) hours after project completion.
Any project caused environmental problem(s) shall be reported immediately to the Department'sEnvironmental Response Line at 954-519-1499.
All project generated solid waste and/or spoil material must be disposed of in a suitable approvedmanner in accordance with current regulations at an upland location (not including surface watersand wetlands).
Turbidity screens or equivalent shall be properly deployed and maintained as necessary duringconstruction activities so that turbidity levels do not exceed twenty-nine (29) NephelometricTurbidity Units (NTU's) above natural background fifty (50) feet downstream of project.

Only clean fill and clean demolition materials shall be placed in the water bodies being filled. Cleandemolition materials include things such as brick, stone, ceramic and concrete rubble which areuncontaminated by other materials. Any fill material used shall be free of garbage, rubbish, refuse,asphalt, hazardous materials, organic matter such (as) wood, lumber, tree or tree trimmings, orother contaminants. The disposal of any putrescible or deleterious debris in any water body isprohibited.
This license does not eliminate the necessity to obtain any required federal, state, local or specialdistrict permit/license/approval prior to the start of any activity authorized by this license.

Construction shall be in accordance with the attached plans and drawings. Any deviation mayrequire a new license and may cause enforcement actions to be initiated.
