time of the signing of the contract, a Performance and Payment Bond of approved form throughan approved bonding company duly authorized to do business in the State of Texas, andcurrently listed in the Department of Treasury Federal Register, which is acceptable suretywithin their Uni underwriting limitations on bonds, in favor of the Frisco ISD as specified in theInstructions To Proposers contained in the project manual.
I. The undersigned further agrees that the Certified Check, Cashier's Check, or Proposal (Bid)Bond in the amount of five (5%) percent of his Proposal, payable to the Frisco ISD,accompanying this Proposal, is left in escrow with the Architect, that it's amount is the measureof liquidated damages the Owner will sustain by the failure of the undersigned to execute anddeliver the above-named agreement, or in furnishing the 100% Payment and PerformanceBonds within ten (10) days of written notification of the award of the contract to him, then theCertified Check, Cashier's Check, or Proposal Bond shall become the property of the Owner;but if this Proposal is not accepted within forty-five (45) days of the time set for the submissionof proposals, or if the undersigned executes and delivers said contract and bonds, the checkshall be returned to him on receipt thereof.
J. For each day that the completion of the project extends beyond the stipulated completion dates,the Contractor agrees to pay to the Owner the sum of One Thousand Five Hundred and no/100Dollars ($1,500.00) per day, and that this is the amount of liquidated damages the Owner willsustain for each day the time of completion of the project extends beyond the stipulated dates.
K. If he is notified of the acceptance of this Proposal within forty-five (45) days of the time set forthe opening of proposals, he agrees to execute a contract for the above work for theabove-stated compensation in the form of the Standard Agreement of the American Institute ofArchitects.
L. The undersigned agrees that the following unit prices may apply on any additions to, ordeductions from the work, which prices shall include overhead, profit, taxes, and all otherrelated costs. The unit prices shall be installed, in-place prices for materials/systems asspecified. The quoted unit prices will be valid, and the quoted unit prices will be in force on anywork. A singular cost shall be provided below to be used for both additions and deductions. Ifdifferent prices are provided for additions and deductions the average of the absolute values willbe used. The materials and work shall be in compliance with the specifications. The Contractorshall not be compensated for work that is not authorized by the Architect or Owners Laboratory(e.g. over drilling of piers and additional concrete and reinforcement for over drilled piers)
