LEGALLY: Health and safety offences in the UK are concerned with failures to manage risks and do not require proof that the offence caused any actual harm. The offence is in creating a risk of harm. Corporate fines can range up to £10,000,000 and individual sentencing can incur unlimited fines and up to 2 years imprisonment.
FINANCIALLY: It is a misconception that most accident and incident costs are recoverable through insurance. The HSE estimates that uninsured losses are ten times the cost of insurance premiums paid. Accident and ill-health costs can be likened to an iceberg: costs that are recoverable are visible but those that are unrecoverable are hidden below the waterline and are many times greater.
BEST PRACTICE: Safety performance is an integral aspect of modern business activity and is measured on most management boards by Key Performance Indicators. Effective health and safety performance comes from the top; members of the board have both collective and individual responsibilities. MORALLY: Health and safety is about ensuring workforce wellbeing and business continuity.
