Current Developments in Professional Responsibility James J. Grogan – Deputy Administrator & Chief Counsel, ARDC

James J. Grogan is both the Deputy Administrator and the Chief Counsel (DACC) of the Attorney Registration and Disciplinary Commission of the Supreme Court of Illinois (ARDC). For over 37 years, he has investigated and prosecuted hundreds of charges of lawyer misconduct and has argued dozens of disciplinary cases in the Supreme Court of Illinois. He is a Past President of the National Organization of Bar Counsel (NOBC), the bar association of lawyer regulators. For over 30 years, Mr. Grogan has taught legal ethics, first at the DePaul University College of Law and then at the Loyola University of Chicago School of Law, where he is an Adjunct Professor. He has presented hundreds of speeches, lectures and workshops to law firms, bar associations, corporations and judicial and governmental groups and agencies on various professional responsibility and lawyer regulation topics.

This program is a summary of recent developments in lawyer ethics and discipline. Mr. Grogan will discuss such specific topics as electronic and social media concerns for lawyers, attorney multi-

 

jurisdictional practice and recent professional responsibility trends in Illinois and throughout the country.

Proposal Seeks to Create New Supreme Court Rule 781 to Address Lawyer Succession Planning

Why?Purpose of the rule is to ensure that a lawyer’s clients are not prejudiced in the event of a lawyer’s unanticipated death, disability, or other event that makes a lawyer’s continued representation of a client reasonable unlikely or impossible.

Proposal Seeks to Amend IRPC 7.3

Why?Existing Rule 7.3 allows liberal use ofdirect mail solicitation letters. The LAFbelieves, however, that such letters berestricted in ORDER OF PROTECTION caseswhere a Respondent has yet to have beenserved. LAF argues that the current rulecreates a situation with a high risk ofharm to petitioners.

More, More, More…

• Lawyer charged by ARDC with engaging in conductinvolving dishonesty, fraud, deceit ormisrepresentation;

• ARDC Hearing Board concludes Lawyer “wanted toharass, hurt and make fun of” Doe;

• Board found Lawyer did not have sudden burst ofanger/short-term lapse of sound judgment due to anadverse incident;

• Conduct lasted over lengthy period of time and, athearing, Lawyer acknowledged that Doe had donenothing to justify his “retaliatory harassing behavior.”

Bottom Line• Board troubled by fact that, although

Lawyer believed that stress arisingfrom handling family law cases was afactor in causing misconduct, he stillcontinued to handle such cases;

• Board recommends suspension of 6months UFO. Supreme Court agrees.
