Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education

(NCTE) was convened on 29th

-30th

June, 2016 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar,

Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the

217th

ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the

provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of

Chairperson, Shri Mukesh Kumar (Convener) presented the Agenda before the Committee for its due

consideration and appropriate decision.

Confirmed with changing the decision of the following two applications:

(i) Al-Ameen Teachers training college (ERCAPP3167) (D.El.Ed)

(ii) Al Ameen College of Education (ERCAPP3101) (B.Ed)

The ERC in its 216th meeting decided to issued Letter of Intent u/s 7(13) to the

above institutions.

Now, as per available records it is observed that the above institution applied

two applications in the same plots with different name which comes under the

category of stand-alone institution. As per NCTE Regulation 2014 stand-alone

institution is not permissible to grant any teacher education progrmme.

However, the committee decided as under:

Show cause notice be issued to the (i) Al-Ameen Teachers training college

(ERCAPP3167) (D.El.Ed) & (ii) Al Ameen College of Education

(ERCAPP3101) (B.Ed) on the ground of stand-alone institution.

ATTENTION!

1. The committee unanimously decided that the institution may reply in

response to the decision of the committee uploaded on the ERC website

without waiting formal letters from the office of ERC. The replies so

received will also be considered by the committee.

2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per

programme. (See ERC website: www.ercncte.org for detail).

3. The institution need to submit list of 10 schools for internship and school based

activities duly approved by District Education Officer.

4. Institutions must give the affidavit for consent / willingness for number of units

either one or two if it was not submitted earlier.

5. The institution shall comply with the additional facilities required (additional

6. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any

course or training in Teacher Education without obtaining recognition or

permission under this Act, the qualification in teacher education obtained

pursuant to such course or training or after undertaking a course or training in

such institution, shall not be treated as a valid qualification for purposes of

employment under the Central Government, any State Government or

University, or in any school, college or other educational body aided by the

Central Government or any State Government.

7. The Committee suggested to prepare Data Bank for the teachers.

8. The institution needs to install Fire Safety equipment and submit

the Fire Safety Certificate if not submitted earlier.

ER-217.2 Court Case

1. 217.2.1

Mahatma Buddha Teachers Training College, Stamarhi, Plot No.1775, Vill-Dhrub

Nagar Panchmile, PO-Kamaldah,Tehsil-Bathnaha, Town/City-Sitamarthi, Dist-

Sitamarhi, Bihar-843322 (D.El.Ed.-Addl. Course) (PRIVATE) (Bihar School

Examination Board) (ERCAPP2486) (Court Case file No.ERC/05-1262/2016)

The ERC in its 213th meeting held on 29th – 30th April 2016 & 1st – 2nd May 2016 has decided to

issue formal permission order for applied D.El.Ed programme with an intake of 50 (one basic unit).

Accordingly, formal permission order under clause 7(16) was issued vide order dated 02.05.2016 with

an intake 50 (one basic unit) from the academic session 2016-2017.

The institution has filed writ petition No W.P. ( C ) 5094 & CM No 21222—21223/2016

before the Hon’ble High Court of Delhi challenging the ERC NCTE order dated 02.05.2016. The

Hon’ble High Court has disposed of the writ petition on 30.05.2016 and directed as mentioned below:

“ Learned counsel for the petitioners contends that respondent No. 2 has neither rejected nor allowed

the application of the petitioner for second unit. He states that the rejection, if any, has to be preceded

by show cause notice which has not been issued so far. He further states that no deficiency has been

pointed out by respondent No.2 with regard to the second unit is arbitrary and unjustified.

Keeping in view the aforesaid, the present writ petition is directed to be treated as

representation by respondent No.2 and to be decided by way of a reasoned order within two months in

accordance with law”.

In view of the above the committee observed as under:

On verification of marks sheet and certificates of faculties submitted by the institution, the following

deficiencies are pointed out as mentioned below:

(i) The M.Ed mark sheet of one faculty namely Sashi Ranjan is a down loaded copy without

signature of the issuing authority wherein, it is clearly written ―this cannot be treated as

original mark sheet‖. Hence the Committee could not ascertain the % of marks and the

authenticity of M.Ed Degree.

(ii) The M.Ed mark sheet of one faculty namely Mukesh Kumar is not legible. Hence the

Committee could not ascertain the % of marks and the authenticity of M.Ed Degree.

(iii) The mark sheet of M.A in Education of one faculty namely Madhu Kumari is a provisional

Mark sheet without seal and signature of the issuing authority.

(iv) Copies of educational certificates/marksheet of Dharmendra Kumar (Fine Art Teacher),

Kumari Bharati (Music Teacher) and Reeta Gupta ( Physical Education Teacher not submitted.

In view of the above the committee decided as under:

The committee is of the opinion that it is not permissible to grant additional unit as per the Norms &

Standards as envisaged in Appendix-2 of the NCTE Regulation, 2014 as the institution has valid

faculty strength of 10 which is less than 16 for conducting two basic units of 50 students each. As per

the Norms & Standards in Appendix-2 clause 5.1 (Note-1) of NCTE Regulation, 2014 envisages if the

students’ strength for two years is one hundred only, the number of faculty shall be reduced to 8

(eight). The Committee taken up the faculty position of the Institution for granting final permission in

its 213th Meeting held on 29th-30th April 2016 & 1st-2nd May 2016. Keeping in view, the cut of date

i.e. 2nd May, 2016 for granting recognition/permission for the session 2016-2017, the committee

decided not to issue show cause notice amounting to complete loosing of enrolment of students for the

session 2016-2017. However, the committee granted one basic unit of 50 students from the academic

session 2016-2017 in the greater interest of the Institution.

The above decision had been taken fairly to the best of its fitness in terms of the stipulation in the

NCTE Regulation 2014 and any allegation to the contrary is unfounded and imaginary. The prayer of

the petitioner to accord revised recognition for the required additional unit is not at all possible at

present as the cut of date for grant of recognition/permission is over and in no circumstances, the same

can be taken for consideration. As such the application of the petitioner for grant of recognition stands

disposed of and it is open for the applicant to make afresh application as per NCTE Regulation, 2014

for the next academic session.

2. 217.2.2

Midnapore Institute of Education, Plot NO- 223/3511, 225, 1(P), 2(P), 4(P),

Vill- Rangamati, PO- Vidyasagar University, Tehsil/Taluka- Rangamati, Town/City-

Midnapore, Dis- Midnapore, West Bengal- 721102 (D.El.Ed.-Addl. Course)

(PRIVATE)(West Bengal Board of Primary Education) (ERCAPP3081)

(Court Case file No.ERC/1260/2016)

That the institution has filed writ petition No W.P. (C) 5460 before the Hon’ble High Court of Delhi

challenging the orders dated 03.12.2015 and 18.04.2015 passed by the ERC NCTE and the Appellate

Authority respectively. The Hon’ble High Court has disposed of the writ petition on 02.06.2016 and

directed as mentioned below:

“Should the petitioner approach the authorities for re-examination of their claim for recognition of

the particular course referred to above, the authorities concerned shall pass a reasoned order

after taking into account that it would not have been in the interest of the petitioner to

send/dispatch the hard copy later than the scheduled time and that there were no deliberate

latches.

Needless to say that in case the claim of the petitioner is decided favorably by the respondent

authorities, the recognition of the additional units of the aforesaid course shall be only for the

academic year 2017-18 as much time has by now passed and it would not be fair to ask the

authorities to accord recognition for the academic year 2016-17 as the Hon’ble Supreme Court

has fixed a time schedule for running the courses in such Technical Institute and such time limit

cannot be deviated from”

The Committee discussed the matter in detail and observed as under:

The institution’s application for the applied course D.El.Ed (Addl course) was summarily rejected

under clause 7(1)(a)(b) of NCTE Regulation, 2014 and the file is closed. The Committee Honour the

order dated 02.06.2016 of the Hon’ble High Court of Delhi and decided as under.

The institution namely Midnapore Institute of Education, Plot No-223/3511, 225, Vill: Rangamati, P.o-

Vidyasagar University, Tehsil-Rangamati, Town/City- Midnapore, Dist: Midnapore, West Bengal-

721102 be advised to apply afresh for consideration of its application for the next academic session.

(Babasaheb Bhimrao Ambedkar Bihar University) (ERCAPP2483)

(Court Case file No.ERCAPP1262(i)2016)

The ERC in its 213th meeting held on 29th – 30th April 2016 & 1st – 2nd May 2016 has decided to

issue formal permission order for applied B.Ed programme with an intake of 50 (one basic unit).

Accordingly, formal permission order under clause 7(16) was issued vide order dated 02.05.2016 with

an intake 50 (one basic unit) from the academic session 2016-2017.

The institution has filed writ petition No W.P. (C) 5017 & CM APPL. No 20958—20959/2016 before

the Hon’ble High Court of Delhi challenging the ERC NCTE order dated 02.05.2016. The Hon’ble

High Court has disposed of the writ petition on 30.05.2016 and directed as mentioned below:

“ Learned counsel for the petitioners contends that respondent No. 2 has neither rejected nor allowed

the application of the petitioner for second unit. He states that the rejection, if any, has to be

the name of the University is not found in the copy of mark sheet. Hence the

Committee could not ascertain the % of marks and the authenticity of his Degree.

Standards as envisaged in Appendix-4 of the NCTE Regulation, 2014 as the institution has valid

faculty strength of 14 which is less than 16 for conducting two basic units of 50 students each. As per

the Norms & Standards in Appendix-4 clause 5.1 (Note-1) of NCTE Regulation, 2014 envisages if the

students’ strength of one unit of 50 students for two years is one hundred only, the number of faculty

shall be reduced to 8 (eight). The Committee taken up the faculty position of the Institution for granting

final recognition in its 213th Meeting held on 29th-30th April 2016 & 1st-2nd May 2016. Keeping in

(ERCAPP4191) (Court Case file No.ERCAPP1263/2016)

The ERC in its 213th meeting held on 29th – 30th April 2016 & 1st – 2nd May 2016 has decided to

issue formal permission order for applied D.El.Ed programme with an intake of 50 (one basic unit).

ER-217.2(i) Complaint recevied against institution

5. 217.2(i).1 S.M. Zaheer Alam Teacher’s Training College, Bahera, Dist-Darbhanga, Bihar-

847201

A complaint dated 31.03.2016 against the institution was received from Shri S.M.Nayer Imam, Founder

Secreary-cum-Director of the institution. A copy of the same complaint was forwarded by the NCTE Hqrs.

vide letter no.24081 dated 15.03.2016. A copy of the complaint has been forwarded to the Vice-Chancellor,

LN Mithila University, Darbhanga, Bihar and the Secretary, Bihar School Examination Board, Patna, Bihar

vide letter No.47485 dated 25.06.2016 with a request to enquire the matter and submit the report within 30

days to ERC, NCTE, Bhubaneswar for taking appropriate action against the institution.

In view of the above the Committee decided as under: Wait till the reply from concerned authority received.

Letter No.9/2/2015/Gen-WB(NCTE) dt.08.03/2016 and subsequent reminer dated

02.06.2016 received from A Bhatacharya, research Officer, National Commission

for Schedule of Castes (NCS), Governemtn of India)Ground Floor, Mayukh

08/03/2016 from the Smt. Mousumi Mondal, desbondhu Pally, Seven lane, Khardah,

The committee considered the letter No.9/2/2015/Gen-WB(NCTE) dt.08.03/2016 and subsequent reminer

dated 02.06.2016 received from A Bhatacharya, Research Officer, National Commission for Schedule of

Castes (NCSC) (Governemtn of India) Ground Floor, Mayukh Bhawan, Salt Lake City, Kolkata-700091,

together with a copy of leter dated 08/03/2016 from the Smt. Mousumi Mondal, desbondhu Pally, Seven

lane, Khardah, PO & PS-Khardah, Dist-North 24 Pgs, Pin Code -700117 and decided as under:

The matter of relaxation for appointment of Professor and Associate Professor is come under the perview of

the State Govt/University, so the State Govt will decide the appointment of Professor and Associate

Professor etc as per their norms of relaxation.

ER.217.4 Appeal Case

7. 217.4.1

The appellate authority vide Order No. . 89-271/2015Appeal/2nd

Meeting/2016/24656 dated 23.03.2016 remanded

the case back to ERC with a direction to process the application further as per NCTE Regulations.

After considering and examining the application along with the documents submitted by the institution, the

agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines

received from the NCTE Hqrs. from time to time, VTR and reply to LOI, the Committee discussed the

matter in detail and observed as under:

(i) Seal and signature of Controller of Examination is not mentioned in the M.Sc. marksheet of

Dinesh Pratap Singh.

(ii) Principal is not qualified as he does not possess required 08 years teaching experience from any

teacher training institution.

(iii) Seal and signature of issuing authority of B.Ed. marksheet of Dipika Das not mentioned.

(iv) As per faculty list name of the faculty is Sumana Ghosh whereas all marksheet / certificates are

in the name of Sumana Sanyal.

(v) M.Ed. marksheet of Mritunjay Mazumdar is a tampered marksheet which is not acceptable.

(vi) M.Ed. marksheet of Saraboni Sarkar is a computer generated which is not acceptable.

In view the above, the committee decided as under: Show Cause Notice be issued to the institution as to why the recognition to the institution be not refused on

the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE

Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the

Committee takes final decision.
