The 197

th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher

Education (NCTE) was convened on 30th

– 31st October, 2015 at Conference Hall, ERC, NCTE, 15,

Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were

present at the time of the 197th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them

about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the

permission of Chairperson, Shri Mukesh Kumar (Convener) presented the Agenda before the Committee for

its due consideration and appropriate decision.

ATTENTION!

1. The committee unanimously decided that the institution may reply in response

to the decision of the committee uploaded on the ERC website without waiting

formal letters from the office of ERC. The replies so received will also be

considered by the committee.

2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per

programme. (See ERC website for detail).

3. The institution need to submit list of 10 schools for internship and school based

activities duly approved by District Education Officer.

4. Institutions must give the affidavit for consent / willingness for number of units

either one or two if it was not submitted earlier.

5. The institution shall comply with the additional facilities required (additional

built-up area, additional staff, additional funds etc) for the SECOND UNIT as

prescribed in NCTE (Recognition Norms and Procedure) Regulations 2014

before 31.10.2015.

6. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any

course or training in Teacher Education without obtaining recognition or

permission under this Act, the qualification in teacher education obtained

pursuant to such course or training or after undertaking a course or training in

such institution, shall not be treated as a valid qualification for purposes of

employment under the Central Government, any State Government or

University, or in any school, college or other educational body aided by the

Central Government or any State Government.

7. The Committee suggested to prepare Data Bank for the teachers.

8. The institution needs to install Fire Safety equipment and submit

the Fire Safety Certificate if not submitted earlier.

the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines

received from the NCTE Hqrs from time to time, VTR and letter of intent u/s 7(13) issued on 20.05.2015, the

Committee discussed the matter in detail and observed as under:

(1) Letter of Intent u/c 7(13) issued on 20.05.2015. No reply received till date.

(2) Show Cause Notice u/s 14(3)(b) issued on 07.08.2015. No reply received till date.

In view the above, the committee decided as under:

Show Cause Notice be issued to the institution as to why the recognition to the institution be not refused on

the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE Act

1993 to the institution to submit its reply within 21 days from the issue of the letter before the Committee

takes final decision.

(i) VT conducted on 28.02.2015.

(ii) Clarification letter was issued on 09.04.2015 stating therein that the land is only 2429.0539 sqmt.

which is less than 2500 sqmt.

(iii) Reply dated 6.04.2015 received from the institution was considered in 185th ERC meeting and

decided Letter of Intent u/s 7(13) be issued to the institution after submission of rectified land deed,

accordingly a letter dated 22.04.2015 was issued to the institution for compliance the same.

(iv) No reply received from the institution till date.

in response to show cause notice issued after LOI u/c 7(13), the Committee discussed the matter in detail and

observed as under:

(i) The Appellate Authority vide its order No. 89-636/2013-Appeal/3rd Meeting-2014/ A86193 dated

24.03.2014 remanded back the case to ERC with a direction to allow 30 days time to the

University for selection & appointment of required faculty members by revalidating the LOI to

that extent. Till date the institution has not submitted the faculty list.

(ii) As per 189th

ERC meeting decision, a show cause notice was issued on 19.06.2015 to the

university with a direction to submit the list of required faculty members by revalidating the LOI

to that extent as per NCTE Regulation 2014.

(iii) In response to the show cause notice the university vide letter dated 10.07.2015 submitted that the

minimum qualifications for appointment of faculty members prescribed by the UGC are different

from the NCTE Regulation 2014.

Taking in view the above references the committee observed as under:

The committee considered the reply dated 10.07.2015 received from the university in its 197th

meeting and

directed to the university to appoint the required faculty as per NCTE Regulation 2014 and submit the faculty

list duly approved by the Registrar of the university.

of VT, the Committee discussed the matter in detail and observed as under:

Two show cause notices were issued on 26.12.2013 and 19.06.2015 respectively on the following

grounds.

(i) Inspection letter was issued to the institution as well as VT experts on

29.10.2013. VT was not conducted.

(ii) The institution vide letter dated 28.10.2013 submitted that the building is at the

construction stage and it will take 3 months time. The institution requested to

postpone the VT for 3 months.

(iii) The committee has not accepted the request of the institution and show cause

notice was issued on 26.12.2013 and 19.06.2015.

(iv) The institution has not submitted any reply in response to letter of willingness

dated 27.12.2014 to adhere to NCTE Regulations 2014.

No reply has been received from the institution in response to show cause notice till date.


Recognition to the institution is refused.

(ii) The institution has submitted photocopy of the registered land document (sale deed). However,

the institution is required to submit the certified copy of registered land document.

(iii) Blue print of the building plan duly approved by the Govt. Engineer not below the rank of J.E.

mentioning the plot No., khesra No, total area & built up area etc. for the proposed teacher

education institution not submitted.

(v) Non-encumbrance certificate in the name of institution/trust issued from the Land Registering

Authority - Not submitted.

(vi) Notarized copy of (conversion of land utilization from agriculture to non-agricultural Purpose

i.e. Educational purpose) CLU issued the competent Govt. authority i.e. S.D.O. – Not

submitted.

(vii) Enclosure regarding column 5 of the affidavit regarding land is exclusively meant for running

the educational institution, issued by the competent Govt. authority not submitted.

2. No reply has been received from the institution in response to ERC letters dated 01.05.2015 and

14.08.2015, till date.

constituted after the institution submits an affidavit and willingness for required units of the

The institution vide its letter dated 04.07.2015 requested to withdraw its application for B.Ed. Course as decided

Taking the above Clauses of the Regulation 2014 into consideration, the Eastern Regional Committee

observed as follows:

(i) A copy of the Land document not submitted along with hard copy of printout of the online

application.

(ii) Processing fee, as prescribed under Rule 9 of the NCTE Rules 1997.

In view of the above the Committee decided as under:

issue form for admission in D. El. Ed course for the session 2014-2016. The Institution was inspected on

26.12.2014 by the NCTE (HQ). The NCTE (HQ) analyzed the VT report and submitted VT Report along

with analyzed copy of inspection report before the Hon’ble High Court at Calcutta.

The Hon’ble High Court has disposed of the case on 17.07.2015 which was received from the petitioner

advocate by this office on 21.08.2015. The Hon’ble High Court has directed as mentioned below:

“Since it has been directed earlier by this court that a final decision is to be taken by the

NCTE based on the inspection report as well as the responses thereto offered by the two

groups, I dispose of this writ petition with a direction upon the Regional Director,

Eastern Regional Committee of the NCTE to take into consideration the responses

received from the two groups, to find out whether the deficiencies pointed out in the letter

dated 24.04.2015/06.05.2015 issued by Pradeep Kumar Yadav, Under Secretary

(Inspection) have been cured/removed or not and to take a final decision within twelve

weeks from date of receipt of a copy of this order. In the event the deficiencies are cured

and the Regional Director considers it proper to allow the institute to admit students,

permission in that behalf may be granted.

However, while considering the issue in terms of this order, the Regional Director

shall also decide as to which of the two groups have the authority to manage and

administer the affairs of the training institute upon extending reasonable opportunity of

hearing to the two groups.

I hope and trust that having regard to the sensitivity involved, the Regional Director

shall make all endeavour to complete the process of consideration and decision within the

time fixed above without seeking any further extension”.

Accordingly, the matter was placed before the ERC in its 197th Meeting held on 30

th-31

st October, 2015.

The Committee decided as under:

“Regarding the first direction of the Hon’ble High Court at Calcutta that the deficiencies

pointed in letter dated 24.04.2015/06.05.2015 issued by the NCTE Hqrs. has not been

removed/cured by the institution till date. This facts has been substantiated by the

communication made by both the parties dated 29.05.2015 and 19.10.2015.

The following deficiencies still exists:

1. You are directed to explain as to why it has not properly set up the Computer Lab and

Library. The Institution be directed to enhance the seating capacity in the library and arrange

more computers and digital Learning Resources in the ICT Lab.

2. The institution does not fulfil the NCTE Norms regarding infrastructure as it has small sized

multipurpose hall, Library, science Lab, computer Lab, Art room etc and the building has

asbestos roofing also. The institution is therefore, directed to give comments on the status of

infrastructural facilities provided by it.

3. You are directed to explain as to why students and teachers were not available for

interaction with VT members on the day of inspection. Further, you may also explain as to

why the salary to staff is paid in cash and why only consolidated salary is paid. The salary

statement submitted relates to the month of October, 2012. The institution is required to

submit salary statements upto the month of December, 2014.

4. The institution is required to submit the list of students enrolled for the session 2012-2013

and list of schools allotted for the practice teaching in the year of 2013-14.


Show Cause Notice be issued to the institution as to why the recognition to the institution be not

withdrawn on the above points. The Committee therefore, provides last opportunity under section 14(3)(b)

of the NCTE Act 1993 to the institution to submit its reply within 15 days from the publication of minutes

in the ERC NCTE website before the Committee takes final decision.

dated 13.07.2015, the Joint Secretary, School and Mass Education Department, Govt. of Odisha

forwarded the comments vide letter as stated bellow:

“The Joint Secretary to Government, School & Mass Education Department,

Government of Odisha vide its letter No. XII-SME (TRG)-23/2014-20353 dated

30.09.2015 has informed that “O.E. (Amendment) Act, 1989 prohibits establishment of

Teacher Training Institutions in Private Sector w.e.f. 14.08.1989.

Further it is stated that grant of recognition/permission for opening of any Teacher

Training Courses i.e. D.El.Ed., B.Ed., M.Ed., B.H.Ed., B.P.Ed., M.P.Ed. etc. in private

sector including Centurion University, KIIT University and Sri Sri University is not,

hereby, recommended.

The Commissioner-cum-Secretary to Govt., School & Mass Education Department,

Government of Odisha vide office Order No. XIISME-Trg.07/15-9832/SME dated

18.05.2015 has also conveyed the decision of State Govt. that due to ban imposed on

private Teacher Training Institutions in Odisha, the State managed Universities, Govt.

managed Autonomous Colleges and Govt. Colleges shall be permitted to start such

courses and the Director, TE & SCERT, Odisha is authorized to issue NOC in favour of

the applicant institutions i.e. Govt. Degree Colleges, Govt. Managed Autonomous

Colleges and State Managed Universities in the State for opening of B.Ed. / M.Ed. &

Integrated B.Ed./M.Ed. course.”
