The Complainant has made a complajnt that lndjan AirlinesPilots Cooperative House Building Society Ltd. (IAPCHBSL )purchased 47.5acres of land in Village Sukhrali, M.G. Road Gurgaon way back in 1983-85.The land was purchased with the funds collected from the members forproviding housing plots. The payment of stamp duty was exempted under theHCS Act, 1984 The society entered into a collaboration agreement with M/sAltmash Townshjps Pvt. Ltd. a company which was registered.lust one monthbefore entering )nto the collaboration agreement and then another newlytormed company M/s Essel Housing Prolects pvt. Ltd. fo construction of flatsfor the members on the land of ithe Society. The builder was to provide 245flats to the members of the Society and the remaining were to be sold by himto the public The builder has been setiing flats to the- public and getting themregistered in the buyers names without payment of stamp duty through apower of attorney obtained surreptitiously from ex-president of the SoaietyCapt. Town Planner (E) Gurugram has lnformedvide is memo No. 1310 dated 10 -12 - 2016 that inview of above, it is submitted that the comptainanthad eartier submitted their aforesaid comptaint in theoffice of undersigned on O4-09-2016 and after carryingout due site inspection, the relevant constructionactivity was got stopped by this office and thecolonizer was directed to submit the relevant approveddrawings. However, during the meeting with therepresentative of the buitder as wetl as thecomplainant hetd in the office of the undersigned, thedirections were issued to the colonizer for getting a

survey conducted in the presence of the complainantregarding the atteged levets of construction vis-ir-visthe reference [eve[ of abutting road i.e. GurgaonSohna Road. The comptainant again apprised on28.09.?016 that the construction work has againcommenced and accordingty, a show cause noticeunder Section 10 (2) of Haryana Devetopment andRegutations of Urban Areas Act, 1975 was issued to thedevetoping agency vide this office memo no. 1560-61dated 28.09.2016. ln response to this show causenotice the developing agency has submitted a reportfrom the surveying agency informing therein that therequisite survey as desired vide this office on09.09.2016 atready stands conducted on 10.09.2016 byNikon Survey and Engineering Works, New Dethi in thepresence of the comptainant and other RWA Membersand it was estabtished that the construction work atsite is being carried out as per approved levets andhence as per sanctioned buitding ptans.
