Pencaitland offers a range of local facilities and amenities including a local pub, filling station, post office and shops and a very well regarded Primary School. In addition to the local facilities

there are larger supermarkets in nearby centres of Haddington and Tranent with the Fort Kinnaird Retail complex only 15 minutes away via car.

Due to its idyllic rural setting, Pencaitland is popular with locals and tourists alike, for its ease of access to the attractive countryside, Championship Golf Courses and outdoor pursuits, including route 196 of the National Cycle Network which runs adjacent to the site. Description The site is located on the southern edge of Pencaitland, to the south of established housing on Bruce Grove and Lamberton Court, and bounded to the east by Lempockwells Road and to the west by the Pencaitland Railway path. Naturally enclosed within the landscape, the site measures in the region of 6.7 ha (16.55

acres) or thereby, comprising mainly of open agricultural fields and is broadly rectangular in shape. The site has an attractive edge of settlement location and is situated within close proximity to all the village amenities.

The Planning Permission in Principle approved at Appeal, includes an indicative masterplan for a residential development of up to 120 units including 25% affordable housing. The indicative masterplan uses the natural topography of the site and successfully integrates the existing settlement with the new development. Vehicular access is proposed to be taken from Lempockwells Road on the eastern boundary of the site.

The masterplan has been designed with the location and likely demographic in mind and provides for medium to low density housing incorporating open space, landscape and play provision. The masterplan also provides an indicative layout of the development along with the proposed location of the footpaths, roads and sustainable urban drainage system.

A Section 75 Legal agreement has been signed in relation to the Planning Permission in Principle on this site. This agreement sets out a number of planning gain requirements and developer contributions including affordable housing, recreation provision, education and footpath works. Full details of the section 75 agreement will be available to any interested parties.

GeneralVAT: The site has been elected for VAT purposes. VAT will be payable in addition to the purchase price. The purchaser will be responsible for LBTT and registration dues.

Legal Costs: Each party will be responsible for their own legal costs incurred in the transaction.

Method of Sale: The heritable interest in the site is offered for sale as a whole with vacant possession.

It is likely a closing date will be set with the sale process inviting Stage 1 bids, followed by Stage 2 Bids and Interview to shortlisted parties.

TitleThe area shown outlined in blue on the sale plan was previously owned by Scott Brothers (Stirling) Limited. That company was dissolved in 1998, with the land owned by the company being transferred to Mr Robert Scott and Mrs Diane Scott (the parents of the Sellers). The intention of the Company had been to divest itself of its whole interest in the land at Lempockwells prior to dissolution. However, due to a poorly drawn plan being annexed to the Disposition in favour of Mr and Mrs Scott, the area shown outlined in blue on the sale plan was unintentionally excluded and, as a result, following the dissolution of the Company, fell into the ownership of the Crown. The Queen’s and Lord Treasurer’s Remembrancer, being the Crown’s representative, has accepted that this has been a case of genuine error and has confirmed that it will disclaim any interest which the Crown may have in and to this area.
