TERMS AND WARRANTIES

POLICIES

Classic Optical Laboratories, Inc. (Classic) takes great pride in setting industry standard by producing only high quality ophthalmic lenses.

Classic extends the warranties of its manufacturers and guarantees all of our products to be free of manufacturing defects in material

and workmanship.

Except as described above, Classic HEREBY DISCLAIMS ALL OTHER EXPRESS, STATUTORY AND IMPLIED WARRANTIES APPLICABLE TO

THE PRODUCTS AND OTHER ITEMS INCLUDING, WITHOUT LIMITATION, ALL IMPLIED WARRANTIES OF MERCHANTABILTY OR FITNESS

FOR ANY PARTICULAR PURPOSE.

LENS WARRANTIES

Anti‐Reflective CoatingCrizal® coated lenses are guaranteed for two years, two time replacement (one time per year). In the event a patient is dissatisfied for

any reason with the performance of his or her Crizal® lenses, the Lab will replace them with scratch resistant lenses, without AR, in the

same prescription and original frame at no charge.

In the absence of an extended manufacturer warranty, anti‐reflective coated lenses are warranted for one year, strip and recoat or one

time replacement at Lab’s discretion.

To qualify, please return the original lenses with a copy of the original invoice.

Scratch Resistant CoatingTD2® is warranted against scratching on both sides of the lens for two years. During that time, if a lens becomes scratched through

normal use, Classic will replace it with an exact duplicate of the original prescription (same Rx, same material).

In the absence of an extended manufacturer warranty, scratch resistant coated lenses are guaranteed against scratching on the front

side for one year from date of order. During that time, if a lens becomes scratched through normal use, Classic will replace it with an

exact duplicate of the original prescription (same Rx, same material). A maximum of one replacement per Rx order is allowed.

To qualify, Provider must return the original lenses with a copy of original invoice. Front surface scratches through normal use will be

covered; however, misuse of the lens will not be covered.

Safety lenses are warranted only for 60 days due to the environment associated with this type of lens.

Drilled Rimless WarrantyOn Drilled Rimless, Classic warranties Polycarbonate, Trivex, 1.67 Index and 1.74 Index against splitting and cracking for one year, one

time.

Uncut LensesProvider may specify lens size on any order at Provider’s risk. If no lens specified on order, the size will be determined by several factors

including eye size, decentration, segment height, lens type, effective diameter and edging allowance.

Edging, Tinting and AR Coating of Customer’s Lenses

Edging, Tinting and AR coating of enclosed lenses will be processed at the customer’s own risk.

ORDER CHANGES AND REMAKES

Cancellations of Orders in Process

Prior to lens fabrication, changes to or cancellations of orders still in process can be made at NO ADDITIONAL CHARGE if the lens(es) can

be returned to stock. Once fabrication has started, however, changes or cancellations are not possible; the order will be billed in full. A

corrected order can be processed and the lesser expensive order will be billed to Provider with a 50% discount.

Professional Courtesy (Doctor’s Error and Patient Satisfaction)

Classic extends a Professional Courtesy policy for Doctor redo/Patient Satisfaction requests for Power, PD or Segment Height changes

within 90 days of original invoice. The remake will be billed to the Provider at full price and upon return of the original lenses and

invoice, a 50% discount will be applied to the less expensive order. Frame and lens material changes are EXCLUDED from this policy (this

policy does not apply to the cost of replacement lenses supplied due to a change in frame or lens material).

Progressive and Digital Single Vision Lenses – Non‐Adapt/Patient SatisfactionIn the absence of an extended manufacturer warranty, within 90 days of delivery, if the patient is not satisfied or cannot adapt to the

original progressive or digital single vision lenses, Classic will remake the original progressive Rx into conventional lenses (same Rx, same

material, same frame) in the original frame at no additional cost. Classic will not refund any fees or costs associated with the original

order.

Lab ErrorClassic warrants that all lenses are manufactured in compliance with the most current ANSI standards and FDA regulations for

ophthalmic products. For a period of sixty (60) days from shipping, Classic warrants all lenses to be free from any manufacturing defects.

All remakes due to Lab error will be processed at no charge with reason(s), original lenses and invoice copy returned. Otherwise order

will be billed in full to Provider’s account and credit issued when original lenses are returned.

Classic will not replace or accept for credit, lenses that have been further processed, edged, tinted, or coated after delivery to Provider,

unless the Provider can clearly demonstrate that the unprocessed lens was defective.

FRAMES

Returning Frames Purchased From ClassicClassic may accept returns of frames purchased from Classic. Frames will be considered for return only where the frames were

purchased within the last 365 days, are returned in resalable condition (free of personal markings or price tags, accompanied by original

backing cards, packaging, and demo lenses), and the frame is currently manufactured. Frames that have been discontinued by the

manufacturer are not returnable. Invoice copies must accompany all returns.

Acceptance of a returned frame is subject to Classic’s sole discretion. All returned frames are subject to a restocking fee of 10%.

Defective FramesAll frames purchased from Classic are guaranteed against defects in material and workmanship for one year. Classic will replace

defective frames that have been discontinued with a new one of equal or lesser value.

Defective frames are defined as:

1. Separation of metal/zyl attachments

2. Separation along solder points

3. Visual cosmetic defects upon initial inspection before dispensing

4. Visual defects in workmanship upon initial inspection before dispensing

Non‐Defective frames are defined as:

1. Error during adjustments causing separation

2. Bubbles or rolled eyewear due to excessive heat generated by salt pan

3. Undue stress on frame material during insertion of lenses

4. Excessive twisting of pad arm in nose pad adjustments

5. Frame misuse by customer

6. Any problem that has occurred after obvious prolonged wear by a consumer.

Patient’s Own FrameClassic will fabricate lenses to fit patient’s own frames whenever possible. Patient’s own frames are inspected by Classic when received.

If frame cannot be used for the order requested (e.g., non‐ophthalmic frames, frames received damaged or in poor condition), Classic

will contact Provider accordingly.

Classic assumes no risk/liability when processing an order with a patient’s own frame. Classic is not responsible for patient’s own frames

that arrive at the Classic damaged, broken, or break through normal processing.

When sending anything to Classic, send via traceable means. Classic is not responsible for items that do not arrive at Classic.

Patient’s Own Lenses and CasesIf the Provider wishes patient’s own lenses (including demo lenses) and cases be returned, Classic prefers the Provider not send to

Classic.

MISCELLANEOUS

Special Orders

Special orders cannot be returned for credit.

ShippingAll orders are shipped at $1.50 per invoice by best method. And special shipping requests will be charged accordingly. Shipping will be

charged on all stock invoices including frames, cases and stock lenses.

Payment Terms

Classic’s standard payment terms are net thirty (30) days, unless otherwise specified in writing.

In addition to its rights or rights with respect to defaults hereunder, Classic shall have the right to interest on all balances not paid within

the stated term at rate of interest of 18% per annum. All quoted prices are FOB Youngstown, Ohio.

Prices are subject to change without notice.

Default

If Provider is in default of any of its payment obligations with the Classic, Classic reserves the right, within Classic’s sole discretion, to

suspend or terminate any discounts, warranties or other promotional incentives Provider may otherwise be eligible to receive.

Where Provider is in default of any of its payment obligations with Classic and Classic is processing an order that Classic will bill a third

party directly (e.g., health plan, managed care plan or state Medicaid agency, etc.), Classic will advise Provider of default of any payment

obligation with the Classic. If the Provider does no issue immediate payment, Classic will cancel the order or, with Provider permission,

remove any non‐covered lens(es) and/or frame upgrades from the order and process only the covered lens(es) and/or frame.

Invoice Copies

Requests for invoice copies may be subject to $1.00 charge per copy.
