AMENDMENTS
As amended in the Conduct of Election Amendment)Rules, 2013, after rule 49Athe proviso is added that a printer with a drop box of such design as approved by the ECI, may be attached to a voting machine for printing a paper trail of the vote, in such constituency or Constituencies or part thereof as the ECI may direct. This instrument is known as the Voters Verifiable Paper Audit Trail (VVPAT)

After the panel containing the name and particulars of the last candidate on the ballot paper for Postal Ballot, EVM Ballot as well as Tender and Braille ballot, there shall be a panel below the last panel with the words ‘None of the Above’ written therein, for the benefit of those electors who may wish to exercise the option of not voting for any of the candidates in the fray. Those words shall be written in the same language or languages as used in case of names of candidates. The size of the panel shall be the same as in the case of the candidates.

Article 324 (1) - The superintendence, direction and control of the preparation of the electoral rolls for, and the conduct of, all elections to Parliament and to the Legislature of every State and of elections to the offices of President and Vice-President held under this Constitution shall be vested in the Election Commission.
Article 324 (2) – The Election Commission shall consist of the Chief Election Commissioner and such number of other Election Commissioners, if any, as the President may from time to time fix and the appointment of the Chief Election Commissioner and other Election Commissioners shall, subject to the provisions of any law made in that behalf by Parliament, be made by the President.
Article 324 (3) – When any other Election Commissioner is so appointed the Chief Election Commissioner shall act as the Chairman of the Election Commission.

• 26. Appointment of presiding officers for polling stations.—(1) The district election officer shall appoint a presiding officer for each polling station and such polling officer or officers as he thinks necessary, but he shall not appoint any person who has been employed by or on behalf of, or has been otherwise working for, a candidate in or about the election

ABSENCE OF A PRESIDING OFFICER
• 26(3) If the presiding officer, owing to illness or other unavoidable cause, is obliged to absent himself from the polling station, his functions shall be performed by such polling officer as has been previously authorized by the [district election officer] to perform such functions during any such absence

27. General duty of the presiding officer.
• It shall be the general duty of the presiding officer at a polling station to keep order thereat and to see that the poll is fairly taken.

28. Duties of a Polling Officer
• It shall be the duty of the Polling Officers at a polling station to assist the Presiding Officer for such station in the performance of his function.

28A. Returning officer, presiding officer, etc., deemed to be on deputation to Election Commission
• . —The returning officer, assistant returning officer, presiding officer, polling officer, and any other officer appointed under this Part, and any police officer designated for the time being by the State Government, for the conduct of any election shall be deemed to be on deputation to the Election Commission for the period commencing on and from the date of the notification calling for such election and ending with the date of declaration of the results of such election and accordingly, such officers shall, during that period, be subject to the control, superintendence and discipline of the Election Commission.

134. Breaches of official duty in connection with election
• 1) If any person to whom this section applies is without reasonable cause guilty of any act or omission in breach of his official duty, he shall be punishable with fine which may extend to five hundred rupees.

48. 128. Maintenance of Secrecy of voting.—(1) Every officer, clerk, agent or other person who performs any duty in connection with the recording or counting of votes at an election shall maintain, and aid in maintaining, the secrecy of the voting and shall not (except for some purpose authorised by or under any law) communicate to any person any information calculated to violate such secrecy: [Provided that the provisions of this sub-section shall not apply to such officer, clerk, agent or other person who performs any such duty at an election to fill a seat or seats in the Council of States.].(2) Any person who contravenes the provisions of sub-section (1) shall be punishable with imprisonment for a term which may extend to three months or with fine or with both.a.

Q.12 Who is a ‘ proxy ’ ?Ans. A service voter may appoint (by applying to Returning Officer in Form 13 F ofConduct of ElectionsRules, 1961–Form available at the website of ElectionCommission) any person as his / her proxy to give vote on his / her behalf and in his /her name at the polling station. The proxy shall have to be ordinary resident of thatconstituency. He neednot be a registered voter but he / she must not be disqualified tobe registered as a voter

. 13 What is the procedure of appointment of a ‘proxy’ ?Ans. A ‘proxy’ can be appointed in the following two ways :-a.If a service voter is at the place of hisposting, he hasto put his signatureinForm 13F before the Commanding Officer of the Unit and thentosend theForm to his proxy for affixing his / her signature beforeaNotary / First ClassMagistrate. Thereafter, the proxy can submit the Form to theReturningOfficer concerned.b.If a service voter isathis native place, bothheandhis proxy can signForm13 FbeforeaNotary / First Class Magistrateand then send to theReturning Officer concerned.
