The purpose of this Preliminary Order is to clarify water district administration and assessments of

King Hill Irrigation District’s (“KHID”) water rights 37-4112 and 37-21595. The clarification is necessary

because KHID’s water rights are within Water District 130 but KHID’s water rights are regulated primarily by

the Water District 02 watermaster because of KHID’s multiple points of re-diversion on the Snake River. This

order provides that KHID’s water rights shall continue to be administered by Water District 02 and shall be

assessed by Water District 02.

KHID owns five separate pump stations on the Snake River between Milner Dam and Murphy Gage.

The pump stations are authorized points of re-diversion for KHID’s water rights from the Malad River, a

tributary to the Snake River near Hagerman Idaho. The authorized point of diversion for KHID’s Malad River

water rights is the Lower Malad Diversion Dam, which diverts water to a flume that is shared with the Idaho

Power Company (“IPC”). Water diverted to the KHID-IPC shared flume is conveyed through IPC’s Lower

Malad Gorge power plant for hydropower generation and discharged to the Snake River. The point of

discharge to the Snake River from the IPC Lower Malad Gorge power plant is described as the point of

injection on KHID’s Malad River water rights. KHID constructed the pump stations on the Snake River after a

1978 landslide damaged an inverted siphon extending from the KHID-IPC diversion flume across the Snake

River to KHID’s main canal.

The lower Malad River or Malad River Gorge is included in Water District 130 (“WD130”). KHID’s

pumping stations on the Snake River are located within Water District 02 (“WD02”).

FINDINGS OF FACT

1. On November 14, 2006, the Idaho Department of Water Resources (“Department” or

“IDWR”) issued Preliminary Order Revising the Boundaries of Water District No. 130 to include

administration of surface water rights in that portion of IDWR Administrative Basin 37 overlying the Eastern

Snake Plain Aquifer. The revised boundaries include surface water rights in Basin 37 from spring sources in

the Thousand Springs area near Hagerman, Idaho, including the Malad River.

2. On May 1, 2012, the Department issued a preliminary order creating WD02 to administer

water rights and diversions from the Snake River between Milner Dam and the Murphy Gage below Swan

Falls Dam. See Preliminary Order in the Matter of the Creation of Water District No. 2, Snake River from

Milner Dam to the Murphy Gage Below Swan Falls Dam (“WD02 Preliminary Order”). The Director of

IDWR signed the Final Order Creating Water District No. 2 (“WD02 Final Order”) on July 10, 2012. The

WD02 Final Order adopted the WD02 Preliminary Order in its entirety.

3. On September 17, 2013, the Department modified several water districts in IDWR’s

Administrative Basin 37. See Preliminary Order in the Matter of the Proposed Combination of Water District

Nos. 37, 37A, 37C and 37M and the Inclusion of Both Surface Water and Ground Water Rights in the

Combined District; and in the Matter of Abolishing the Upper Wood Rivers Water Measurement District.

This order clarified that Water District No. 37 excluded the lower portion of the Malad River and tributaries

downstream and west of the approximate point where Interstate 84 crosses the Malad River. The portion of

the river excluded from Water District No. 37 is commonly known as the lower Malad River or the Malad

River Gorge.

4. KHID holds two water rights that are summarized as follows:

5. Information in KHID’s water right files includes the following narrative summarizing KHID’s

diversion system1:

“Irreparable damage to the inverted siphon extending from the diversion flume, across the Snake

River, to the main canal of the District, necessitated construction of four pumping stations to pump

water from the Snake River. The original point of diversion is retained, and by agreement with Idaho

Power Company the water is diverted at the original point of diversion and used to generate electrical

power at the Lower Malad power plant of the Idaho Power Company. After passing through the

generating facilities of Idaho Power Company, the water is discharged into the Snake River and thence

carried in the natural channel of [the] Snake River to the pumping stations located at the points

described in the original claim and Transfer No. 2315. By reason of the provisions in Idaho Code §

42-105, King Hill regards this procedure as turning its water into the channel of another stream,

mingling the water, and then reclaiming the water at the pump stations, so long as the water is diverted

through the Lower Malad power plant of Idaho Power Company.”

6. The point of diversion described for KHID’s water rights listed in Finding of Fact No. 4 is the

Lower Malad Diversion Dam on the Malad River. This diversion dam is also used as the point of diversion

for IPC’s water rights at the Lower Malad Gorge power plant.

7. The authorized water right rate of diversion for IPC’s hydropower water rights used at the

Lower Malad Gorge power plant is 1,500 cfs. See Final Order Regarding Instructions to Water District 02

Watermaster and Water District 130 Watermaster, IDWR, June 28, 2014. WD130 water delivery records for

the period 2007 through 2014 show that average monthly diversions to the IPC Lower Malad Gorge power

plant range from 0 cfs to about 1,300 cfs. Mean monthly diversions typically range from about 500 cfs to

1,300 cfs. The sum of the discharge records for the Lower Malad Gorge power plant and the IPC Malad River

gage station located near the mouth of the Malad River indicate that the total flow of the Malad River always

exceeds the total combined diversion rate under KHID’s water rights, which is 370 cfs.

8. KHID’s five water right points of re-diversion or pump stations are located on the Snake River

between 5.5 and 43 miles downstream of the Lower Malad Gorge power plant. Numerous water right

diversions on the Snake River between KHID’s pump stations are measured and administered by WD02.

9. Since 2007, the WD130 watermaster has reported the diversions from the lower Malad River

for the IPC Upper Malad Gorge and Lower Malad Gorge power plants. The WD130 watermaster has assessed

IPC for its Malad Gorge power plant diversions since 2007.

10. The WD130 watermaster has never measured or reported any water diverted by KHID at its

Snake River pump stations, nor has the WD130 watermaster ever assessed KHID for any WD130 annual

expenses.

11. KHID benefitted from a funding grant secured by the Idaho Water Resources Board (“IWRB”)

on behalf of WD02 to assist with acquisition and installation of water diversion measuring devices and

telemetry equipment. The IWRB obtained the grant to help fund installation of measuring and monitoring

equipment for numerous diversion facilities on the Snake River in WD02, including KHID’s Snake River

pumping plants. In 2014, KHID committed to participate in the grant with a cost share arrangement (KHID

Letter of Commitment – Bureau of Reclamation WaterSMART Water and Energy Efficiency Grant, Idaho

Water Resource Board Application for Water District 02 Water Diversion Measurement and Telemetry,

January 10, 2014).

CONCLUSIONS OF LAW

1. Idaho law declares all surface water, when in natural channels or springs or lakes, and all

ground water within the State of Idaho to be the property of the state, whose duty it is to supervise the

appropriation and allotment of the water to those diverting the same for beneficial use. See Idaho Code §§ 42-

101, 42-103, and 42-226.

2. The Director, acting on behalf of the State of Idaho, has the statutory authority to control the

appropriation and use of all surface and ground waters within the state in accordance with, but not limited to,

Idaho Code §§ 42-101, 42-103, 42-202(1), 42-220, 42-226, 42-237a.g., 42-351, and 42-602 et seq.

3. The Director has responsibility for direction and control over the distribution of water in

accordance with the prior appropriation doctrine as established by Idaho law within water districts to be

accomplished through watermasters supervised by the Director, and subject to removal by the Director, as

provided in chapter 6, title 42, Idaho Code.

4. Idaho Code § 42-604 authorizes the Director to form water districts as necessary to properly

administer uses of water from public streams, or other independent sources of water supply, for which a court

having jurisdiction thereof has adjudicated the priorities of appropriation.

5. Idaho Code § 42-105(1) authorizes the holder of a valid water right to commingle the water

from the source of the right with water in another natural water way and reclaim the commingled water as long

as the amount of water to which prior appropriators may be entitled is not diminished. Further, Idaho Code§

42-105(1) states that “the use of natural waterways to commingle and reclaim water shall be subject at all

times to the supervision and control of the director of the department of water resources and shall be subject to

regulation of the watermaster within an established water district.”

6. Idaho Code § 42-701 requires holders of water rights to install and maintain, when required by

the Director of IDWR, measuring devices on each diversion for the purpose of assisting the watermaster or

Department in determining the amount of water that may be diverted from the public source of water.

7. Measurement of diversions from the Snake River within WD02, including KHID’s water right

points of re-diversion, is necessary for the proper distribution of water within the water district in accordance

with the prior appropriation doctrine. Measurement of diversions also allows for the equitable, defensible and

legal means for determining water user assessments since Idaho law requires the expenses of the water district

be based on water delivery.

8. Idaho Code § 42-612 outlines lawful procedures for the assessment of water rights in water

districts for compensation of the watermaster and other expenses of delivering water to water users in the

district. Pursuant to Idaho Code § 42-612, water users are assessed based on water delivered to the diversions

during the past season or seasons, not exceeding five (5) seasons.

9. Based upon the above statutory authorities and the Finding of Facts herein, the Director of the

Department should order the WD02 watermaster to administer KHID’s water right nos. 37-4112 and 37-

21595. Specifically, the WD02 watermaster should be responsible for measuring and reporting water diverted

at KHID’s Snake River points of re-diversion. The WD02 watermaster should also be responsible for any

necessary regulation of KHID’s points of re-diversion on the Snake River. WD02 should assess KHID’s

water rights and Snake River re-diversions consistent with other water rights and diversions in the water

district and in accordance with Idaho Code § 42-612. The WD130 watermaster should monitor the KHID-IPC

shared diversion from the Malad River and coordinate with the WD02 watermaster as to the total available

supply of water from the Malad River to fill KHID’s water rights that are diverted from the Snake River.

ORDER

IT IS HEREBY ORDERED that:

1. The watermaster of WD02 shall administer KHID's diversions from the Snake River authorized by water right nos. 37-4112 and 37-21595. The watermaster of WD02 shall measure and report the delivery of water at KHID's diversions from the Snake River authorized by water right nos. 37-4112 and 37-21595.

2. KHID must install and maintain measuring devices at its Snake River diversions in accordance with the Department's Final Order in the Matter of Requiring Measuring Devices for Diversions in Water District No. 2, Snake River From Milner Dam to the Murphy Gage Below Swan Falls Dam.

3. The watermaster of WD02 shall, starting in 2016, assess KHID's water right nos. 37-4112 and 37-21595 in accordance with the provisions ofldaho Code§ 42-612.

4. The watermaster of WD130 shall continue to measure, report and assess the diversions and water rights that are diverted from the Malad River to the IPC Lower Malad Gorge power plant for hydropower purposes. The WD130 watermaster shall coordinate with the WD02 watermaster regarding the total available supply of water from the Malad River to fill KHID's water rights that are diverted from the Snake River.

5. This Preliminary Order does not prohibit KHID from using the Lower Malad Diversion Dam and conveyance flume in the future to directly irrigate all or a portion of the lands within its service boundary. The Director of IDWR may issue further orders or instructions clarifying administration of KHID water rights contingent on changes that KHID may make to its diversions or re-diversions from the Malad and Snake Rivers.

EXPLANATORY INFORMATION TO ACCOMPANY A PRELIMINARY ORDER

(To be used in connection with actions when a hearing was not held)

(Required by Rule of Procedure 730.02)

The accompanying order or approved document is a "Preliminary Order" issued by the department pursuant to section 67-5243, Idaho Code. It can and will become a final order without further action of the Department of Water Resources (“department”) unless a party petitions for reconsideration, files an exception and brief, or requests a hearing as further described below:

PETITION FOR RECONSIDERATION

Any party may file a petition for reconsideration of a preliminary order with the department within fourteen (14) days of the service date of this order. Note: the petition must be received by the department within this fourteen (14) day period. The department will act on a petition for reconsideration within twenty-one (21) days of its receipt, or the petition will be considered denied by operation of law. See Section 67-5243(3) Idaho Code.

EXCEPTIONS AND BRIEFS

Within fourteen (14) days after: (a) the service date of a preliminary order, (b) the service date of a denial of a petition for reconsideration from this preliminary order, or (c) the failure within twenty-one (21) days to grant or deny a petition for reconsideration from this preliminary order, any party may in writing support or take exceptions to any part of a preliminary order and may file briefs in support of the party's position on any issue in the proceeding with the Director. Otherwise, this preliminary order will become a final order of the agency.

REQUEST FOR HEARING

Unless a right to a hearing before the Department or the Water Resource Board is otherwise

provided by statute, any person aggrieved by any final decision, determination, order or action of the Director of the Department and who has not previously been afforded an opportunity for a hearing on the matter may request a hearing pursuant to section 42-1701A(3), Idaho Code. A written petition contesting the action of the Director and requesting a hearing shall be filed within fifteen (15) days after receipt of the denial or conditional approval.

ORAL ARGUMENT

If the Director grants a petition to review the preliminary order, the Director shall allow all parties an opportunity to file briefs in support of or taking exceptions to the preliminary order and may schedule oral argument in the matter before issuing a final order. If oral arguments are to be heard, the Director will within a reasonable time period notify each party of the place, date and hour for the argument of the case. Unless the Director orders otherwise, all oral arguments will be heard in Boise, Idaho.

CERTIFICATE OF SERVICE

All exceptions, briefs, requests for oral argument and any other matters filed with the Director in connection with the preliminary order shall be served on all other parties to the proceedings in accordance with IDAPA Rules 37.01.01302 and 37.01.01303 (Rules of Procedure 302 and 303).

FINAL ORDER

The Director will issue a final order within fifty-six (56) days of receipt of the written briefs, oral argument or response to briefs, whichever is later, unless waived by the parties or for good cause shown. The Director may remand the matter for further evidentiary hearings if further factual development of the record is necessary before issuing a final order. The department will serve a copy of the final order on all parties of record.

Section 67-5246(5), Idaho Code, provides as follows:

Unless a different date is stated in a final order, the order is effective fourteen (14) days after its service date if a party has not filed a petition for reconsideration. If a party has filed a petition for reconsideration with the agency head, the final order becomes effective when:

(a) The petition for reconsideration is disposed of; or (b) The petition is deemed denied because the agency head did

not dispose of the petition within twenty-one (21) days.

APPEAL OF FINAL ORDER TO DISTRICT COURT Pursuant to sections 67-5270 and 67-5272, Idaho Code, if this preliminary order becomes

final, any party aggrieved by the final order or orders previously issued in this case may appeal the final order and all previously issued orders in this case to district court by filing a petition in the district court of the county in which:

i. A hearing was held, ii. The final agency action was taken, iii. The party seeking review of the order resides, or iv. The real property or personal property that was the subject of the agency action is

located. The appeal must be filed within twenty-eight (28) days of this preliminary order becoming final. See section 67-5273, Idaho Code. The filing of an appeal to district court does not itself stay the effectiveness or enforcement of the order under appeal.
