QCan I use my own tenancy agreement?

Peter Hermon-Taylor, lettings manager of John D Wood & Co Wandsworth, replies . . .

AYes, is the simple answer. It is possible to pick up a basic tenancy agreement from your

local stationery shop. In fact, there is no legal obligation to have a written tenancy agreement at all.

A landlord could simply shake hands with their tenant and move them into their property. The three main elements required to create a legally binding contract are an offer, the acceptance of the offer and a consideration. However, as I am sure you can imagine, there are a number of good reasons why this is not the prudent course of action for any responsible landlord.

Why? Your property is likely to be the largest single asset you will ever own and it is essential that it is properly protected. If your intention were to sell a property, you would expect to instruct a solicitor to handle the conveyancing, so why wouldn’t you instruct a professional when you rent your property?

In any business dealings, written contracts provide protection for all parties involved and are the key to avoiding conflict over relevant issues. An off-the-shelf tenancy agreement is unlikely to contain important clauses that a landlord would want to be included for their protection.

For example, if the landlord lived abroad they would need to be advised they may need to include Ground 1 of Part 1 of Schedule 2 of the Housing Act 1988, known as the Owner Occupier clause, in the tenancy agreement. Likewise if they have a mortgage on the property, they may need to include Ground 2 of Part 1 of Schedule 2 of the Housing Act 1988.

Similarly, it is imperative a tenancy agreement is kept up-to-date with the frequent changes in lettings legislation. These must be included in the agreement or the landlord can incur a penalty. As an ARLA-registered agent, we would always recommend that your tenancy agreement is drawn up either by a solicitor or your

chosen ARLA agent, although the latter is likely to be more cost effective.

to determine why your house isn’t selling, suggests Cheryl MarkoskyCan’t sell, won’t sell? Not selling your house rapidly could be down to something small that’s eminently fixable, such as fixing the roof or replacing the boiler. But if your home’s sticking because of more serious reasons, tackle the problem now.

George Franks, sales director at Douglas & Gordon, goes for the endgame, suggesting that if you’re struggling to sell your house, the long and short of it is that the price is not right. He says: “There are all sorts of things you can do to make your home more enticing to potential buyers, but the price is the main reason a property will sit on the market for a prolonged period.”

Before reducing the price, however, there are many things you can do to improve a property, such as replacing carpets and curtains, clearing up the garden, de-cluttering and ensuring that the temperature is correct when viewings are taking place, he advises.

“It’s also very important to have a good relationship with your agent,” Franks adds. “It must be a very honest relationship, because the agent cannot give you the best advice unless they’re aware of all the facts. And if they think you’re not being honest, their motivation can decline.”

Buying a property is an emotional thing, points out Laura Wilcox-Chandley from Marsh & Parsons Balham. “Not all buyers are able to imagine a home decorated to their own personal taste. Messy tenants, unpleasant smells or cluttered spaces won’t help you’re your home.”

It’s important for sellers to present their homes to the highest standard and make sure they’re neutral and tidy. “Put some flowers around the place, light some candles, clean the bathroom and you’d be amazed what a difference it makes to have windows and carpets professionally cleaned,” she says.

You don’t have to spend huge amounts of money - small touches go a long way, according to Wilcox-Chandley. For instance, if the property’s vacant, dress it with some furniture. “We were marketing a property for months without any offers. I recommended to the seller that he ‘dress’ the property, and within two weeks we had multiple offers.”

thewordSpecial report by Philip Agius of Jacksons Estate Agents, Wandsworth CommonWhat a year it’s proving to be here in Blighty: royal celebrations that

are the envy of the world and mounting excitement for the feast of sport that the London 2012 Olympics has in store for us.

It seems the spring in the step of the whole country has allowed many to forget some of the gloom that has been seeping in, with one financial worry after another. Whether this feelgood factor has a knock-on effect in the housing market is trickier to call, but what we can report is that prices in South-West London have continued to forge ahead, despite the new seven per cent stamp duty rate introduced in the Budget in March.

Values in prime residential areas around Battersea, Balham, Wandsworth Common and Between the Commons appear to be holding up strongly and in many cases accelerating. Indeed inquiries for larger family homes worth more than £2m, the level at which the higher stamp duty rate kicks in, were significantly higher in April and May than before the Budget.

As concerns for the euro have continued, demand has been boosted by a surge of inquiries from European buyers who want a safe haven for their funds in the event of a meltdown in the eurozone. While we have all heard about Russians and Middle Eastern buyers snapping up prime central London locations, it seems that Europeans and the French in particular see South-West London as a more affordable hedge against the turmoil back home.

That said, it is not just foreign buyers –

it is anyone looking for a secure place to put their money. There is a renewed flight to quality as residential property in prime locations again proves to be the asset class of choice for savvy homebuyers and investors.

It is pleasing to report that there seems to be brisk business to be done for those selling homes in the coming weeks and months. Add to this the huge numbers of overseas visitors converging on London for the Olympics, and it’s not unreasonable to expect a much busier summer than usual.

Famously the ‘Barcelona effect’ has meant all Olympic cities benefit from a surge in property demand in the run-up to hosting their Games, as well as during and immediately afterwards. Property tends to follow the rules of economics more diligently than many asset classes, and the basic rule of lower supply and increased demand will surely mean that sale prices will creep even higher this summer.

The smart move is to market your home now in order to exploit this to the full. We have already had conversations with a number of homeowners who had originally planned to market their homes after the summer, but have now changed tack and given us the green light to secure a buyer during July and August. I suspect they will not be alone in doing so.

He’s dealt with numerous celebrities, including selling three homes for Sean Connery and several Prime Ministers’ residences. When he and his wife Hilary, pictured, were first married, he considered buying a one-bedroom flat in Battersea. “My suburban mother was so horrified at the thought of this, she didn’t sleep for three nights. We ended up buying in central London instead,” said Colin.

Kennington’s annual Cleaver Square Fete, sponsored by Winkworth, raised thousands of pounds for local charities and will help to fund a new community garden.

The event on May 27 featured jazz, opera and belly dancing. Restaurants Toulouse Lautrec, the Lobster Pot and KT Kennington Tandoori organised the food and the music.

Report by John Ennis, director of Foxtons New Homes & Investments The new homes market in London and the South East is booming and the first few months of 2012 began with a bang.

According to recent research by Molior London, construction volumes are about as high as they have been in the last 20 years. The great news, though, is that the sales rate is keeping pace with the construction rate. A study by London Residential Research shows that more than 5000 new homes were sold in the London boroughs last year – the highest number since 2007.

At Foxtons we have seen a 27 per cent increase in activity levels on our new homes sales this year, which mirrors this activity seen across London.

There has been an increase in the availability of dedicated mortgage products for new-build houses and flats, as well as a significant increase in the number of buy-to-let mortgages. According to mortgage broker Alexander Hall, who specialise in the London market, there are over 500 buy-to-let mortgage products available right now. In March 2010 there were just 215.

Recent reports in the press suggest the UK property market is worth around £3.8tn with less than £1tn worth of debt against this. Disillusioned with pensions and with global economic uncertainty, we are seeing the Bank of Mum and Dad continue to liquidate the equity sat in their homes and reinvest the proceeds in property as their new pensions, for their children and as long-term stable assets.

Savvy parents with around £75,000 to £100,000 to invest, and limited time on their hands, have been turning to the safe haven of new-build bricks and mortar – seeing the London buy-to-let market as a conduit for capital growth, rental yield and investment. Many have seen their assets grow by over 10 per cent in the last year alone, whilst enjoying rapid rentals, small void periods and inflation-beating returns on their money.

This year we are seeing housewives able to receive buy-to-let mortgages without any income requirements, numerous cash purchasers (a third of all our deals, with many often choosing to remortgage at a later date), plus the seasoned property professionals all playing their part in driving the property market forward.

However, new-build houses and flats are not just for the rental investors. So far this year, 62 per cent of our sales have been to owner-occupiers, who are benefitting from 10-year warranties, turnkey properties and some great incentives offered by many keen-to-trade house builders.

However, every silver lining has a cloud. There are real supply issues for London, and the morass of legislation continues to slow the planning process. With ever-increasing equity-driven demand in London and the South East, stock levels may run thin.

There are some great properties for sale out there, and with some developments now showcasing incredible design, superb finishing, beautiful and interesting materials and high specifications – now is the key time to buy a new-build home.

Time travellingA bespoke home with all mod cons hides behind a carefully restored period façade, says Cheryl MarkoskyYou’d be hard-pushed to know that a contemporary dwelling absent of the draughts, leaks and perishing cold rooms often found in older property lies behind the historic frontage of a striking house in Fife Road, East Sheen.

However, once you’re past the front door of the smart honey-and-crimson-coloured brick outlook, you know you’ve gravitated painlessly from the 19th to the 21st century.

This time-shifting trick is subtle and in keeping with the heritage of the house, explains Simon Wedgewood, managing director of Palladian Construction, who’s brought this architectural gem back to life with his faithful team of workers.

His specialist company that focuses on renovating and developing in west London bought the tired-looking property two-and-a-half years ago in one of the best positions (adjacent to Richmond Park) on one of the most popular roads in the area. And now, after a serious revamp more than doubling the square footage through the addition of side, rear and basement extensions from 2300 to 5100, it’s available for a buyer who will appreciate the care and attention that’s gone into the project.

“Nothing had been done to the house for years, and because it was in a townscape merit (similar to listed building status) and conservation zones, it meant that the neighbours and planners were keen for the exterior to retain its historical appeal,” explains Wedgewood.

The interiors were another matter, of course. With no notable period features to retain, Wedgewood and his colleagues pretty much had free reign when it came to the design. Aided by an architectural firm, the Charlton Brown Partnership, the once gloomy house was opened up into a three-storey modern wonder with a galleried reception hall, five bedrooms, separate dining room and subterranean basement containing cinema and games rooms, extra study/bedroom, gym and wine cellar.

“We effectively rebuilt the whole house, completely rewiring it, installing underfloor heating and putting in the best sanitary ware available,” says Wedgewood. “The

Originally, Wedgewood thought he would live in the house himself, but due to the cost and time spent updating the property, he’s selling it. With bespoke ‘his and hers’ wardrobes and a custom-made Roundhouse kitchen (at the buyer’s specifications and agreed budget), it looks like Wedgewood’s loss will be some lucky buyer’s gain.

Lenders grow more miserly

Borrowers pay the price of euro crisis, reports Duncan FarmerAs the crisis in Europe continues to hit economic confidence and fallout has wiped billions off the value

of stock market investments and therefore pensions, now it is mortgage borrowers who are beginning to pay the price.

With even Mervyn King, governor of the Bank of England, warning of a “risk of a storm heading our way from the Continent”, and that mortgage costs were likely to rise as banks sought to shore up their profits, the outlook is not great for British borrowers. Even the Council of Mortgage Lenders, the trade body for banks and building societies, has joined in with doom and gloom.

“Eurozone developments are highly uncertain and have the potential to undermine UK economic prospects and conditions in our housing and mortgage markets,” says the CML’s chief economist Bob Pannell. “The underlying picture is likely to be one of easing momentum in the housing market, but with potential for a sharper downwards correction on bad eurozone news.”

The problem is that while the Bank of England base rate remains at 0.5 per cent, banks are having to pay far more than that to secure funds in the wholesale market.

Those so-called swap rates are rising and are forecast to carry on climbing.

If you compare the best-buy tables today, compared with rates in the first three months of the year, the cost of fixed-rate and tracker deals has risen. For example, today’s best-buy two-year tracker is 0.3 percentage points dearer than in March.

There is a second problem facing would-be borrowers: availability. In the immediate post-credit-crunch years, getting hold of a loan was extremely difficult as banks and building societies tightened the criteria for applicants, but in the past couple of years the situation has improved slightly.

However, as the European crisis deepens, many lenders are pulling in their horns, notably HSBC and the Spanish-based banking giant Santander, which has a huge presence in the UK.

Mark Harris, chief executive of broker SPF Private Clients, says: “Santander has pulled back significantly in terms of lending volumes this year. It is demonstrating much less of an appetite to lend, which is having a knock-on effect on other lenders and their service levels, because in recent years Santander has done significant volumes of lending.”

The good news is that in spite of these factors, Knight Frank’s latest survey of the UK housing market suggests that prices in London will continue to rise.

LENDERS RAISE COST OFOFFSET MORTGAGESIn common with rates on fixed and tracker loans, the cost of offset mortgages, in which savings are used to defer the cost of borrowing and which are particularly popular with wealthy homebuyers, is also rising.

A number of banks and building societies that offer these loans have recently raised rates. Chelsea Building Society, which began offering offset alternatives to its entire mortgage range last October, has put up the price of some offset mortgages to 0.2 percentage points above its standard loans.

Borrowers could become ‘mortgage prisoners’New rules introduced by lenders could turn hundreds of thousands of borrowers into “mortgage prisoners”, leaving them unable to keep their low-cost loan should they wish to move house.

While Halifax has raised the rate on its standard variable rate deal by 0.49 percentage points, Nationwide’s rules do not allow such an increase. Instead, the building society has put restrictions on borrowers who want to ‘port’ their existing loan to a new house purchase.

However, mortgage brokers said these new terms are a way of moving people off cheaper deals and on to more expensive loans and, crucially, one where the lender has the flexibility to raise the interest rate.

“If borrowers have a good rate, they will want to hang on to it,” says David Hollingworth, a broker at London & Country. “I think lenders have been asking themselves, why are we making it so easy for borrowers to keep hold of these rates, which are costing us so much money?”

LENDING FALLSBY 20 PER CENTFigures released by the Council of Mortgage Lenders show that mortgage lending fell by almost 20 per cent in April. This may be largely due to the fact that the army of first-time buyers who wanted to beat the end of the stamp duty holiday completed their deals in March, and although April’s figure was low it remains slightly higher than the level of lending in April 2011. The CML does not however believe that lending figures will rise in the coming months.

No rate rise for a yearInterest rates are unlikely to rise for at least another year if not far longer, according to Mervyn King, the governor of the Bank of England, and other analysts.

In his quarterly report on inflation, King cut his forecast for economic growth and said that the country should “brace for higher-than-expected inflation”. A spokesman for IHS Global Insight said it expected that interest rates would not rise from their historic low of 0.5 per cent “until at least late-2013, and very possibly not until 2014”.

Fraser Allen, lettings manager for Featherstone Leigh Battersea, reports Our lettings office on Lavender Hill, Battersea, has been particularly busy over the past months. We have definitely seen an increase in the numbers of applicants looking for a rental

property in both Battersea and Clapham. With Clapham Junction’s direct rail links to Stratford

in East London, the 2012 Olympics have encouraged an upsurge in enquires from corporate relocation agents, who see the area as an attractive place to live, offering exceptional transport links for commuters.

Equally, the area will always be popular with private individuals looking to move into London. The high demand for properties in the area has resulted in excellent rents being achieved.

As well as increasing numbers of transactions from new tenants, more existing tenants are electing to remain in their current properties and this has further reduced supply. This shortage of stock and high demand give landlords greater choice when selecting new tenants and the length of tenancy agreement.

With fast access to central London, this is an

extremely popular residential area. We are seeing our database of potential tenants grow month on month, with viewing numbers increasing on a weekly basis. Currently we are confident we can fill any property that we market.

The area has a universal appeal and is popular with young professionals attracted to the area because of the fashionable shops, bars and restaurants of Northcote Road and Clapham High Street, as well as families looking for large family homes and good schools. Those who initially rent in the area often choose to buy here.

We have experienced a continued growth in the buy-to-let market over the past few months, with investor buyers encouraged by the number of lettings enquires from prospective tenants. I anticipate this will continue in the second half of the year.

The Lumière Apartments, a development by Henley Homes in Clapham, has seen a healthy take-up of properties that were bought to let. These one and two-bedroom luxury apartments are built on the former site of Clapham Grand Cinema, and epitomise modern urban living, offering open plan spaces combined with superb specifications.

Tell us how you joined the property industry and briefly describe your career to date.I slightly fell into property ten years ago, when I

began working for Savills as a secretary. Two years later I became a sales negotiator and in 2011 director and head of the sales department for Savills Wandsworth.

What do you enjoy most about working in this market and what have been your highlights so far?I love working in the Wandsworth market. I was brought up here, so I know the area very well. Highlights have included selling property in new areas such as the Tonsleys, as we have broadened our market share to include smaller properties as well as the mansions lining the Commons.

Describe the biggest challenges you face on a day-to-day basis.Property chains are probably the most difficult thing to manage. Getting everyone to meet their completion dates and meeting clients’ expectations is not always easy.

What advice would you give anyone considering a career in estate agency?You need to be very determined. Every day is different and you are looking after people at possibly one of the most stressful times in their lives, but it is incredibly rewarding when it all works.

How difficult is the market for sellers and what advice would you give them?It is a difficult market at the moment and making your property look good is very important, as well as being flexible when it comes to viewings. Sellers need to be realistic about pricing and that means taking best advice from a respected agent.

In your view, how does the South London market differ from other areas of London?Wandsworth is much more family orientated, so as well as being an estate agent you often need to be a nanny at the same time. Know your applicants and their children’s needs!

What are your predictions for the property market in South London?We believe that the stamp duty increases are likely to be a catalyst for a period of relatively static prices, in line with the Savills research published forecasts. Longer-term growth prospects for South London are still strong as growth is forecast to resume later in 2013, driven by strong global city fundamentals and an improving domestic economy.

If you were Prime Minister for the day, what would you change or what new measures would you introduce?I’d introduce compulsory licensing for sales agents, so standards were regulated across the board and every agent would have a code of conduct to adhere to, ensuring they provided the best possible service.

Where, in your view, is the best place to live south of the river and why?Wandsworth because of the lovely Commons, the Northcote Road with its great cafes and shops, and the excellent schools in the area.

If you were not an estate agent, what career would you choose and why?You might not expect it but I would have been a nurse. I am fascinated by medicine and I love interacting with people, I have great respect for nurses as I think it is an incredibly challenging job.
